Abstract

Pergeseran teknologi ke era digital berimbas semakin bervariasinya upaya pencucian uang yang memunculkan bahaya reputasi, likuiditas bagi sektor jasa keuangan. Oleh sebab itu perlu adanya tindakan untuk mencegah dan memberantas maraknya transaksi lalu lintas keuangan yang teridentifikasi sebagai kejahatan pencucian uang. Dalam kegiatan operasionalnya Bank Sumut sudah melaksanakan Customer Due Diligence, Enchanced Due Diligence (EDD), dan memantau transaksi keuangan nasabah. Hal ini berpedoman pada Peraturan DireksiaBank Sumut Nomor : 002/Dir/UKK APU-PPT/PBS/2017 Tentang Pedoman Pelaksanaan Penerapan Program APUadanaPPT di Lingkungan BankaSumut.

Abstract

Demand is growing rapidly, but the economy is still weak, employment is limited, unemployment continues to increase. Effective regulation is needed in the recovery of various sectors of the economy. The government formed the Omnibus Law to face the challenges of the times, reduce unemployment and attract new entrepreneurs. The research method is empirical law. The research characteristic is descriptive analysis with qualitative research. The research shows that the omnibus law was formed because the government felt there was a lack of implementation of policies by Law Number 13 of 2003, especially the provision of severance pay so that there were still widespread differences in interests between workers and employers. As a result, many people do not dare to start a business. The difference in remuneration arrangements in Omnibus Law is arrangements for workers' severance pay and compensation for contract workers. The time limit for contract workers is a maximum of 3 (three) years of work being changed to 5 (five) years and extended to a maximum of 5 (five) years. The advantages of Omnibus Law are mobilization of the investment climate and employment opportunities, providing compensation for workers, increasing overtime wages. Lack of public participation in the formation of laws, and weak legal transparency make rejection of workers who feel disadvantaged by the lack of severance pay, the elimination of district/city minimum wages, and wages during leave. Hope that government will form regulations openly and pay attention to workers' rights without prejudice to common interests.

Abstract

In general, everyone has the right to health, so this means that the government must create conditions that allow each individual to live a healthy life, with efforts to provide adequate health care facilities and affordable health services for the community and the state is responsible for providing health care facilities. and proper public service facilities. In a pandemic condition like today, doctors as health care providers must still provide health care services to patients with the aim of improving patient health. The risk of transmitting the corona virus to each other between doctors and patients in health care facilities and the incessant calls for social and physical restrictions have made telemedicine a popular choice for both doctors and patients. Telemedicine is the provision of health services remotely by health professionals using information and communication technology, including the exchange of information on diagnosis, treatment, disease and injury prevention, research and evaluation, and continuing education of health care providers for the benefit of improving individual and community health. This study was conducted with the aim of knowing the mechanisms carried out by doctors or health workers for COVID-19 patients and the rights of doctors to protect in telemedicine services for Covid- 19 patients. The research method used in this study is library research, which is a method used by studying literature books, legislation. The analytical method used is qualitative analysis with descriptive analysis method, namely the selection of theories, principles, norms, doctrines, and articles in the most important legislation relevant to the problem. Then make a systematic from these data so that it will produce a certain classification. This study shows that Telemedicine carried out by doctors or other health workers on Covid-19 patients has been regulated in Article 17 paragraphs (1) and (2) and Article 18 paragraphs (1) and (2) of the Minister of Health 20/2019, but there is no synchronization of regulations regarding theprotection of doctors' rights in telemedicine services for Covid-19 patients in Indonesia, in this case receiving a service fee.

Abstract

Discotheque workers exposure to excessive loud music which classify as the noise at workplace. Noise causes health problems, namely hearing loss. Discotheque workers need to get legal protection against the impact of noise in the workplace.

Abstract

Covid-19 is transmitted through close contact and droplets. People who are most at risk of infection are in close contact with Covid-19 patients or who care for Covid-19 patients and mortuary staff. For this reason, regulating criminal acts, mechanisms, and legal sanctions to the perpetrators of curing and burying the bodies of suspected, probable, and confirmed cases of Covid-19 that are not following the procedures will be discussed in this thesis research.

Abstract

Setiap orang dilarang mengumpulkan limbah B3 khususnya oli tanpa ada izin dari Menteri, gubernur, atau bupati/walikota sesuai dengan kewenangannya. Hal ini di atur dalam Pasal 59 ayat (4) dan sanksi pidana terdapat dalam Pasal 102 UUPPLH Dan di dalam PP Pasal 1 ayat 2 Peraturan Pemerintah No. 18 tahun 1999 tentang Pengelolaan Limbah Bahan Berbahaya dan Beracun. Limbah B3 khusunya oli dapat merusak lingkungan. Penelitian ini menggunakan penelitian yuridis normatif dengan metodologi mengacu pada sumber data sekunder sebagai bahan hukum utamaDianalisis dan disusun secara sistematis kemudian menarik suatu kesimpulan bersifat deskriptif. Secara spesifik limbah B3 merupakan sisa bisnis dan/atau aktivitas yang mengandung bahan berbahaya dan / atau beracun karena sifat dan / atau konsentrasi dan / atau jumlahnya, baik secara langsung maupun tidak langsung, dapat mencemari dan / atau merusak lingkungan, dan / atau dapat membahayakan lingkungan, kesehatan, kelangsungan hidup manusia dan makhluk hidup lainnya. Oli sebagai pelumas / minyak kotor, yang dengan sengaja dikumpulkan untuk dijual kembali kepada mereka yang membutuhkannya dapat merusak lingkungan karena sida dari sedimen dibuang ke media tanah dapat menyebabkan kerusakan tanah. Minyak yang tersisa harus diolah atau diberikan kepada perusahaan yang dapat memproses limbah sehingga tidak berbahaya. Pelaku dapat bertanggung jawab apabila terdapat kesalahan didalam diri sipelaku, tidak terdapat unsur pemaaf dan pembenar didalam diri pelaku dan memenuhi unsur subyektif dan obyektif dari pasal 102 jo. 59 ayat (4) Undang-Undang Nomor 32 Tahun 2009 Tentang Perlindungan Pengelolahan Lingkungan Hidup.

Abstract

Abstract Forests are the lungs of the earth that produce huge amounts of oxygen that humans need to live. But at this time there are many criminal acts of forest encroachment that are carried out irresponsibly, so that it harms many parties such as third parties as owners of heavy equipment used to commit acts of forest encroachment. Article 78 paragraph (15) of Law Number 41 of 1999 concerning Forestry which stipulates that all forest products and proceeds of crime, violations or transportation equipment used to commit crimes or violations will be confiscated for the State. From this article, injustice arises for third parties who have heavy equipment when renting to others because their heavy equipment is seized by the State. Because the third party only rents the heavy equipment to other people without knowing that the person who hired uses it for a crime. This study uses a normative juridical method with library research data collection techniques, qualitative data analysis using inductive deductive methods. The legal action that can be taken by a third party is to object to the seizure placed on the object or object belonging to a third party as long as the case against it has not yet had a decision that has permanent legal force. By taking legal action against third parties to recover their property that was confiscated based on a decision concerning evidence of a crime which was considered relevant enough to provide justice to a third party.

Abstract

The development of technology and information systems in the financial sector has changed people's habits inefficient financial transactions. The method used the normative legal method, the aim of analyzing the legal arrangements for money laundering criminals in the Fintech Industry. The results of the research is regulation of money laundering is the provisions of Law No. 8 of 2010 articles 3, 4 and 5, Law No. 11 of 2008 as amended into Law No. 19 of 2016 articles 29 and 32, Then, the Draft Criminal Code is contained in articles 607, 608 and 609, if more than one money laundering regulation, the more specific regulation is used, namely in the Fintech Industry, as with the application of the principle of lex specialis derogat legi generalis, prevention of money laundering through repressive and preventive measures. There is prevention of money laundering in the Fintech Industry by the Financial Services Authority (OJK) by issuing circular letter no. 6/ SE OJK. 05/2021. Every perpetrator of money laundering in the Fintech Industry, can be accountable for the actions if there is an element of error consisting of intentional and negligence.

Abstract

The purpose of this study was to analyze: rules and regulations related to internal regulations in RSUD Dr. R.M. Djoelham Binjai, rules and regulations related to the implementation of good clinical service governance in Dr. RSUD. R.M. Djoelham Binjai, implementation of internal regulations of RSUD Dr. R.M. Djoelham Binjai in carrying out good clinical service governance. This type of research is a empirical juridical research using primary data and secondary data and data analysis carried out by qualitative methods. The results obtained: Regulations related to internal regulations at RSUD Dr. R.M. Djoelham Binjai is regulated in Binjai Mayor Regulation Number: 45 of 2018 concerning Hospital Internal Regulations (Hospital Bylaws) RSUD Dr. R.M. Djoelham City of Binjai which refers to the Decree of the Minister of Health Number: 772/MENKES/SK/VI/2002. The Decree of the Minister of Health of the Republic of Indonesia No.772/2002 was made based on the Law of the Republic of Indonesia Number: 23 of 1992 concerning Health; Law of the Republic of Indonesia Number: 22 of 1999 concerning Regional Government, Government Regulation Number: 32 of 1966 concerning Health Workers and Regulation of the Minister of Health of the Republic of Indonesia Number 159.b/1988 concerning Hospitals. RI Law Number: 23 of 1992 concerning Health has changed to RI Law Number: 36 of 2009 concerning Health while RI Law Number: 22 of 1999 concerning Regional Government has changed to RI Law Number: 23 of 2014 Regarding Regional Government while the Regulation of the Minister of Health of the Republic of Indonesia Number: 159.b/1988 concerning Hospitals has changed to Regulation of the Minister of Health of the Republic of Indonesia Number: 3 of 2020 concerning Hospital Classification and Licensing; Regulations related to the implementation of good clinical service governance in RSUD Dr. R.M. Djoelham Binjai refers to the Regulation of the Mayor of Binjai Number: 45 of 2018 concerning Hospital Internal Regulations (Hospital Bylaws) RSUD Dr. R.M. Djoelham City of Binjai as the highest person in charge for establishing hospital operational policies covering the fields of medical and nursing services, general and financial services, as well as human resources; Barriers to the implementation of internal regulations of RSUD Dr. R.M. Djoelham Binjai in carrying out good clinical service governance is a human resource because each individual has a different character when carrying out his duties and responsibilities.

Abstract

Each country strives to achieve what is the goal of the Nation and State which for Indonesia is stated in the 4th paragraph of the 1945 Constitution, namely to achieve public welfare, one way is to improve transportation facilities, this is very important to support the activities of the daily community. . This research is socio-juridical, looking at how an existing legal regulation is applied in society. Data collection was carried out by means of observation, interviews and questionnaires consisting of online motorcycle taxi drivers and office staff of online motorcycle taxi institutions and consumers.From the results of the research that the legal relationship between online motorcycle taxi drivers is only a partnership relationship and also as a liaison between partners and consumers, however the partnership relationship is made with a separate role and it is written that the partner frees PT Paket Global Semesta in criminal and civil lawsuits, because each agreement it must comply with Article 1320. Based on the provisions of the law that online motorcycle taxi drivers are not appropriate as partners because this is only an individual and in the standard agreement entered into by PT. Paket Global Semesta which regulates the rights and obligations of both parties, in fact it provides more benefits than the producer and as if the entrepreneur is transferring the risk to the partner, this is still a dilemma about the legal consequences that will occur in the implementation of all activities offered by producers to consumers, there are still many discrepancies.
