Abstract

The palm oil development provides many advantages for Indonesia. One of which is that the development of Indonesian palm oil came fast and contributed a lot to the country's economic sectors. There are also other organic oil-based, such as jatropha, camelina, soybean and rapeseed. However, compared the palm oil to the other base of the organic oil materials, palm oil price outperforms the others oil-based because of the stability of the palm oil price. Palm oil benefits the Indonesian economy and the triple bottom line of John Elkington: people, planet, and profit. However, there is a critical issue with palm oil production. Its production is believed not to apply sustainability principles. Thus, it can damage and ruin the natural environment in Indonesia; for example, it damaged the area where the Sumatran tiger, Sumatran Orang Utan, and Borneo Orang Utan lived. Through the ministry of agriculture, the government established Indonesian Sustainable Palm Oil (ISPO) to answer this critical issue and recover the sustainability aspect of Indonesian palm oil. Abstrak: Indonesia beruntung karena dapat menikmati berbagai manfaat dari pembangunan kelapa sawit yang merupakan salah satu ciri dan keuntungan tersendiri yang Indonesia miliki, pembangunan kelapa sawit Indonesia sangat cepat dan pesat serta memberikan kontribusi yang tinggi terhadap negara melalui sektor ekonomi, jika dibandingkan dengan minyak nabati lainnya seperti : jathropa, camelina, soy bean dan rapeseed, kelapa sawit lebih unggul dari segi ekonomi yang mana dari segi harga lebih stabil jika dibandingkan minyak nabati dengan bahan baku lainnya. Minyak kelapa sawit memberikan berbagai manfaat bagi Indonesia selain daripada ekonomi juga terhadap triple bottom line sebagaimana dikemukakan oleh John Elkongton yakni people, planet dan profit sehingga dalam pemanfaatannya memberikan dampak yang baik meski begitu tetap saja dihadapkan dengan berbagai critical issue mengenai kelapa sawit. Dalam kegiatan produksi kelapa sawit diyakini bahwa belum mengedepankan aspek keberlanjutan yang kemudian berdampak terhadap kerusakan lingkungan di Indonesia. Abstract

Pemerintah telah secara resmi mengesahkan Undang-Undang Nomor 10 Tahun 2020 tentang Bea Meterai. Dengan pengesahan tersebut, maka ketentuan lama yang mengatur mengenai bea meterai, yaitu Undang-Undang Nomor 13 Tahun 1985 tentang Bea Meterai resmi dicabut. Perubahan ini disebabkan karena pertimbangan untuk menyesuaikan dengan perkembangan teknologi serta kelaziman internasional dalam kegiatan perekonomian, dimana perdagangan elektronik makin marak dan meluas jangkauannya. Maka dari itu, perlu dikaji terkait konsep pengaturan kedepan terhadap pengaturan bea meterai dalam kegiatan perdagangan elektronik di Indonesia. Tujuan penelitian yang hendak dicapai dari penulisan ini adalah agar lebih dipahami konsep pengaturan kedepan terhadap pengaturan bea meterai dalam kegiatan perdagangan elektronik di indonesia dilihat dari segi teori tujuan hukum. Metode yang digunakan dalam penelitian ini adalah metode pendekatan perundang-undangan dan pendekatan konseptual.Hasil penelitian yang dicapai adalah Konsep pengaturan kedepannya terhadap pengaturan bea meterai dalam kegiatan perdagangan elektronik di Indonesia yaitu model bea meterai bersifat elektronik yang diatur dalam Undang - UndangNomor 10 Tahun 2020 tentang Bea Meterai adalah alternatif dalam hal pelaksanaan pembubuhan bea meterai terhadap perjanjian perdagangan secara elektronik yang terjadi di Indoneisa. Model ini merupakan model bisnis berbasis layanan elektronik dengan tujuan secara hukum untuk memberikan kepastian hukum kepada masyarakat terhadap pelaksanaan nantinya terkait pengenaan bea meterai dalam kegiatan perdagangan elektronik.

Abstract

Abstract: The presence of cybercrime in Indonesia is challenging to handle, especially for cybercrime actors who come from across countries. This study aims to examine the problem of taking global cybercriminals and examine solutions to applying the Aut Dedere Aut Judicare principle through the ratification of the Budapest Convention. The research method used in this study is normative legal research with a regulatory approach, cases, and comparative analysis. The study results indicate that Indonesia does not yet have a special regulation regulating cybercrimes; however, two rules cover cybercrimes offences, namely, the Criminal Code and the ITE Law. However, these two regulations can still not deal with transnational cybercriminals specifically for fun issues. Therefore, applying the Aut Dedere Aut Judicare principle through the Budapest Convention ratification becomes urgent for implementation. The Aut Dedere Aut Judicare principle states that every country will understand with other countries to arrest, prosecute and prosecute perpetrators of international crimes. So it is necessary to ratify the Budapest Convention as a legal basis to apply the Aut Dedere Aut Judicare principle.Keywords: Aut Dedere Aut Judicare; Budapest Convention; Cybercrime Perpetrators; Cross Country. Abstrak: Kehadiran cybercrime di Indonesia sangat sulit ditangani terkhusus bagi pelaku cybercrime yang berasal dari lintas negara. Tujuan penelitian ini adalah untuk mengkaji problematika penanganan bagi pelaku cybercrime lintas negara, serta mengkaji solusi penerapan prinsip Aut Dedere Aut Judicare melalui upaya ratifikasi Budapest Convention. Metode penelitian yang digunakan adalah dalam penelitian ini, penelitian hukum normatif, dengan pendekatan peraturan perundang-undangan, kasus, serta analisis komparatif. Hasil penelitian menunjukkan bahwa Indonesia hingga saat ini belum memiliki pengaturan khusus yang mengatur cybercrime, namun demikian terdapat dua peraturan yang mencakup delik cybercrime yakni, KUHP dan UU ITE. Namun demikian, dua peraturan tersebut masih belum bisa menangani para pelaku cybercrime lintas negara terkhusus permasalahan yurisdiksi. Oleh karena itu, penerapan prinsip Aut Dedere Aut Judicare melalui ratifikasi Budapest Convention menjadi urgensi yang harus dilakukan. Prinsip Aut Dedere Aut Judicare menyatakan setiap negara akan bekerjasama bersama negara lain untuk menangkap, menuntut, dan mengadili para pelaku kejahatan internasional. Sehingga perlu upaya ratifikasi Budapest Convention sebagai dasar hukum untuk menerapkan prinsip Aut Dedere Aut Judicare. Abstract

Sustainable agriculture is one of the future-oriented legal policies. In this case, agriculture is oriented to be preserved, especially for future generations. Problems occur when various laws and regulations governing sustainable agricultural law policies are disharmonies even though they are substantially interrelated. This study aims to initiate legal politics of harmonization of sustainable agricultural policies. This research is normative legal research that focuses on analyzing legal issues. Analysis of legal issues is essential in legal research oriented to prescriptions or legal solutions to the problems being discussed. The approach in this study uses a statutory approach and a conceptual approach. The results of the study confirm that the implications of disharmony of sustainable agricultural law policies in various laws and regulations in Indonesia need to make legal harmonization in planning, formulating, and evaluating legislation. Future improvements to the legal politics of sustainable agriculture in Indonesia can be carried out by harmonization of legal policies related to sustainable agriculture by revising the PP PBP to include sustainable agriculture as one of its regulatory substances.

Abstract

Agriculture is an important aspect of the life of the Indonesian people. Apart from being a commodity, agriculture is also a part of Indonesian people’s lives. In this case, the state needs to enact legal policies related to sustainable agriculture. This study seeks to discuss legal issues in the form of legal disharmony related to sustainable agricultural legal policies. This research is normative legal research. The study results confirm that the disharmony of legal policies related to Sustainable Agriculture has only become a “paper tiger,” which means that the rules exist but cannot be implemented because they do not have to implement regulations, so they are difficult to implement. That happens because the respective laws, particularly those related to sustainable agricultural cultivation systems and job creation, which substantially regulate sustainable agriculture, do not refer to each other. That impacts the lack of coordination and horizontal harmonization between fellow laws that substantially regulate sustainable agriculture. Harmonization is also not carried out vertically between Laws and Government Regulations. That occurs when Government Regulations relating to the administration of the agricultural sector do not refer to and harmonize vertically with the Law relating to sustainable agricultural cultivation systems. The results of this study also suggest that in the future, the government, in this case, needs to revise the Government Regulations relating to the implementation of the agricultural sector by incorporating the substance of the Sustainable Agriculture policy as well as being more thorough in harmonizing both vertically and horizontally in drafting legislation.

Abstract

Kemajuan revolusi 4.0 mendasari terciptanya cryptocurrency, secara universal awalnya cryptocurrency memanglah dimaknai hanya sebagai mata uang belaka, namun dikala ini telah mengalami perluasan sudut pandang maupun fungsinya. Perihal itu dibuktikan dengan telah digunakannya cryptocurrency sebagai suatu jaminan; berlandaskan perihal itu maka dapat dikonsipsikan bahwasanya cryptocurrency dapat dipergunakan sebagai objek jaminan fidusia. Selaras perihal itu, maka diperlukannya kajian mendalam terkait penggunaan cryptocurrency sebagai objek jaminan fidusia; pokok permasalahannya yaitu keistimewaan serta kepastian hukum penggunaan cryptocurrency sebagai objek jaminan fidusia. Tujuan dari penelitian ini ialah memperoleh korelasi antara cryptocurrency dengan jaminan fidusia. Teknik peradilan normatif, undang-undang, dan konseptual digunakan dalam metodologi penelitian ini. Hasil penelitian ini yakni crytocurrency yang dipergunakan sebagai jaminan fidusia tidak melanggar norma hukum yang sudah ada dan berlaku, alhasil dapat dikatakan sah karena selaras dengan teori dari Roscoe Pound yang menyatakan bahwasanya di mana hukum selaku alat pembaharuan masyarakat. Cryptocurrency mempunyai keisitimewaan sebagai komoditi yang mempunyai hak atau kepentingan, berbentuk digital aset dan dapat dimiliki oleh perseorangan maupun badan hukum; serta dapat diklasifikasikan kedalam hukum kebendaan yang bersifat memberikan jaminan sepanjang dapat dibuktikannya hak kepemilikannya, sehingga dapat digunakan sebagai terobosan atau perkembangan dalam hukum jaminan, khususnya sebagai objek jaminan fidusia. Cryptocurrency yang digunakan sebagai jaminan fidusia akan berlaku asas droit de suit (Pasal 1 angka 1 UU.4/1999); penjaminan atas cryptocurrency berlaku asas publisitas (Pasal 11 UU.4/1999 jo. PP.21/2015). Senyampang perihal itu, cryptocurrency hanya dapat dipergunakan sebagai jaminan tambahan bukan sebagai jaminan pokok, karena sifat cryptocurrency memliki harga yang sangat flutuatif.

Abstract

Financial transactions cause the emergence of legal relationships between two or more parties. In order to expedite the flow of financial transactions, it is required to produce evidence in the civil sector, therefore the participation of Notaries is required as a public official who has the task of making authentic deeds. The deed in question is an authentic deed made by or before a notary according to the form and procedures stipulated in the Law. In making authentic deeds, it is not uncommon for Notaries to meet with parties who are perpetrators of money laundering crimes with the aim of obtaining protection under the confidentiality provisions of the Notary profession. Isn't the Notary only responsible and authorized to make authentic deeds and other powers, all related to documents, then where are the suspicious transactions carried out by his clients? This problem must be studied in more depth to see how the Notary applies the principle of prudence in getting to know the presenters and the legal consequences of authentic deeds that do not apply the principle of prudence in getting to know the presenters.

Abstract

This paper analyzes the corruption of PT Timah Tbk using Indonesian corporate law perspective based on Law Number 19 of 2003 concerning BUMN and Law Number 40 of 2007 concerning Limited Liability Companies. This research method is normative with a normative juridical approach, namely the study of PT Timah Tbk's corruption using laws and regulations in the form of Law Number 19 of 2003 concerning BUMN and Law Number 40 of 2007 concerning Limited Liability Companies and various other literature. This paper aims to examine whether or not the rules of Indonesian corporate law in accordance with Law Number 19 of 2003 concerning BUMN and Law Number 40 of 2007 concerning Limited Liability Companies are implemented in the governance of PT Timah Tbk. The results of this study show that Law No. 19 of 2003 and Law No. 40 of 2007 are not optimally implemented, resulting in corruption that causes state losses.

Abstract

The resolution of bankruptcy disputes in Indonesia presents significant challenges due to the ease with which bankruptcy can be filed against debtors, even if they are capable of continuing their business operations and repaying their debts to creditors. This issue arises from the provisions of Article 2, paragraph (1) of Law 37/2004, which stipulate only two requirements for declaring bankruptcy: the existence of a past due debt and the presence of at least two creditors. This paper aims to examine the problems associated with bankruptcy dispute resolution in Indonesia and to propose the implementation of an insolvency test mechanism as a prerequisite before a Commercial Court judge can issue a bankruptcy ruling. Additionally, the study offers a comparative analysis of the insolvency test mechanisms employed in several countries, including the Netherlands, Germany, the United States, and the United Kingdom. Utilizing a doctrinal approach, this legal research analyzes primary and secondary literature by reviewing laws and regulations pertinent to the issues at hand. The findings of this study suggest that adopting an insolvency test is a crucial policy for the bankruptcy law framework in Indonesia. The implementation of such a test could prevent the bankruptcy of debtors who are still capable of fulfilling their financial obligations. Consequently, there is a need to revise Law 37/2004 to incorporate a legal instrument for the insolvency test.

Harmonization was not carried out vertically, between laws and government regulations. This occurs when government regulations related to the administration of the agricultural sector do not refer to, and vertically disharmony with the Law relating to sustainable agricultural cultivation systems. The results of this study suggest that in the future, in this case, the government requires to revise the Government Regulations on the implementation of the agricultural sector by incorporating the substance of the sustainable agriculture policy as well as being more thorough in harmonizing both vertically and horizontally in drafting legislation.
