Abstract

This study examines the Nyadokaken pengantin tradition in the marriage of the Osing tribe in Kemiren Village, Banyuwangi, emphasizing its origins, execution, and legal standing under Islamic law. This research utilizes a qualitative methodology, encompassing participant observation, in-depth interviews, and recording while adopting a normative framework that integrates Pierre Bourdieu's habitus theory as an analytical instrument. Research suggests that Nyadokaken began as a method for conflict settlement aimed at preserving familial unity. It possesses considerable societal significance, as families that renounce it encounter stigma and less social acknowledgment. From a fiqh standpoint, the tradition is classified as ‘urf shahih, as it conforms to Al-‘Adah Muhakkamah, meeting the standards of recognized customary practice in Islamic jurisprudence. This study enhances Islamic family law by examining how ‘urf shahih might incorporate local traditions into modern Islamic legal frameworks. Abstract

Ideally, conflicts are resolved through legal channels that uphold justice. However, in reality, the Madurese community often resorts to the tradition of carok, particularly in cases involving honor, which frequently result in fatalities. This raises legal issues, especially regarding criminal accountability for carok perpetrators under both state law and Islamic law. This study aims to analyze the carok tradition, which leads to death, from the perspective of Islamic criminal law, including criminal accountability, the application of Islamic law to carok, and specific conditions where carok is committed out of necessity or self-defense. This article is a library-based study with a juridical-normative approach. The methodology employed is descriptive-analytical. The findings reveal that carok perpetrators are criminally responsible for their actions that cause death. In Islamic law, carok is categorized as an act of murder with specific sanctions, except when it is carried out in self-defense or in defense of one's family.

Abstract

Marriage in Islamic law has been clearly stated regarding its pillars, conditions, and the permissible and prohibited provisions. This study aims to analyze the Javanese customary marriage practices of the people in Langkat Regency, North Sumatra Province, considering that the community still strongly adheres to various wedding processes as inherited from their ancestors, from the perspective of Islamic law. This research is empirical and uses a social approach. The data analysis employed is the Miles and Huberman model, with the steps of data reduction, data display, and conclusion drawing and verification. In practice, Javanese customary marriages among the people of Langkat Regency still feature a series of traditional Javanese wedding ceremonies, even though they live outside Java Island. The analysis of Islamic law's perspective on Javanese customary marriage shows a dynamic interaction between cultural traditions and religious principles. Determining auspicious wedding days based on 'primbon' can be accepted in Islam as long as it does not involve beliefs in supernatural elements contrary to Islamic law. Furthermore, the practices of 'kembar mayang' and 'pecah telur' in Javanese customary marriage are considered 'urf fasidah (customs contrary to Islamic law) because they involve beliefs in things not based on Islamic teachings. The accommodation process of Islamic law in Javanese marriage customs demonstrates a harmonious integration effort between religion and culture. From an Islamic viewpoint, cultural traditions can be accepted and integrated as long as they do not conflict with the fundamental principles of the religion.

Abstract

The purpose of this study is to describe the evaluation of learning from the perspective of the Qur'an. This research is qualitative with a library research approach. Data collection techniques are done with documentation. Then, analyze the data with data reduction, presentation, conclusion drawing, and verification. Based on the description and research results above in Islamic education, several basic terms are always connoted with the term evaluation, such as al-Qadha, al-Bala', al-Hisab, al-Imtihan, and al-Fitnah. Although these terms have different orientations of meaning, all five have similar functions in education. The primary evaluation process measures the achievement of learning or educational programs in schools and outside schools. Learning evaluation serves to identify the achievement of learning objectives and provide information on what should be done to overcome the weaknesses obtained in the activities that have been carried out.

Abstract

Penelitian ini bertujuan untuk mengetahui hukum positif dan hukum pidana islam terhadap tindakan pidana dalam membelanjakan uang palsu, serta dampak dalam membelanjakan uang palsu. Penelitian ini menggunakan penelitian yuridis normatif, dengan menggunakan alat pengumpulan data yaitu: studi kepustakaan, atau studi dokumen (documentary study) untukmengumpulkan data sekunder yang terkait dengan permasalahan yang diajukan. Penelitian ini menghasilkan Setiap orang yang mengedarkan dan/atau membelanjakan Rupiah yang diketahuinya merupakan Rupiah Palsu sebagaimana dimaksud dalam Pasal 26 ayat (3) dipidana dengan pidana penjara paling lama 15 (lima belas) tahun dan pidana denda paling banyak Rp50.000.000.000,00 (lima puluh miliar rupiah).” Dalam Hukum Islam membelanjakan uang palsu ini termasuk dalam hukum Jarimah ta’zir, hukuman ta’zir ini banyak macamnya, yang hukuman ta’zirnya dimulai paling ringan sampai hukuman yang paling berat.

Abstract

Radicalism is a term used among academics to refer to an ideology that contradicts the Indonesian national ideology, Pancasila. There are many factors behind the emergence of radicalism in Indonesia, and almost all of them stem from the inability of certain groups to accept differences within their surrounding environment. In terms of religion, radical groups can be identified by their perspective in interpreting religious teachings. This article aims to describe the prevention of radicalism in non-formal education through the role of *Rijalul Ansor*, a sub-organization of Nahdlatul Ulama (NU). The method employed is descriptive qualitative, with data collected through observation, interviews, and documentation. The research findings indicate that the function of non-formal education in countering radicalism includes: 1) Instilling Pancasila values through selapanan (monthly study sessions). 2) Promoting nationalism through tawasul (prayers of intercession) to national heroes. 3) Providing an understanding of peaceful and tolerant religion through the study of Risalah Aswaja by KH Hasyim Asy’ari. 4) Constructing Qur’anic perspectives on religious moderation. The implementation of these efforts is carried out through the study of Risalah Aswaja and Mujahadah Dzikrul Ghafilin held every Senin Pon (a Javanese calendar day).

Abstract

Coastal abrasion at Mampie Beach, West Sulawesi, poses a serious threat to community livelihoods and biodiversity. This community-based program aimed to implement Blue Economy principles by integrating eco-technology and mangrove adoption to mitigate abrasion while empowering the local community at Rumah Sahabat Penyu. The methods included the installation of 60 geobags, planting 300 Rhizophora mangrove seedlings, and training in mangrove-based soap making as a sustainable livelihood initiative. Evaluation results showed that 100% of the geobags remained intact and the mangrove survival rate reached 80% (though 20% were damaged by plastic debris, large wood, and human activities). Furthermore, 23 participants successfully learned the mangrove-based soap-making process, enhancing environmental awareness and economic resilience. This program confirms the effectiveness of combining eco-technology and community participation in coastal protection and sustainable livelihood development. Further monitoring is recommended to evaluate the long-term performance of geobags and mangrove survival during peak abrasion seasons.
