Abstract

The aim of this research is to determine law enforcement against operators of damaged roads which result in traffic accidents and to find out what are the obstacles in implementing law enforcement against operators of damaged roads which result in traffic accidents. This research uses an empirical legal research method where the researcher uses a statutory approach and a case approach and data collection is carried out using literature studies and interviews. The results of the research show: firstly, the police in the Bone Bolango Police area carry out law enforcement against drivers who maintain damaged roads that cause accidents. traffic in a preventive and repressive manner. Bone Bolango Regency Police have been carrying out repressive actions such as education and legal action; However, due to a number of obstacles experienced by the Bone Bolango Police, no legal action can be taken until the trial, which only requires making a case report. Both the internal and external operational environment of the traffic police are some of the challenges faced by the Bone Bolango Police. The Bone Bolango Police Traffic Accident Unit lacks personnel and expertise, and the officers' attitude towards drivers is less firm. One of the internal problems faced by the traffic police is this problem. Public ignorance of laws and regulations related to damaged roads and lack of community involvement in reporting damaged roads are two examples of external variables handled by the Traffic Police. Apart from that, there is ambiguity in Law Number 22 of 2009 concerning Road Transport and Traffic. The meaning of "road managers" and the difficulty of law enforcement in enforcing these regulations, especially Article 273, which emphasizes the importance of considering the potential legal consequences for "road managers" who fail to repair damaged roads immediately, which can result in traffic accidents.

Abstract

The existence of criminal cases arises because there are criminal acts handled by law enforcement. Criminal cases always arise whenever there is a criminal process. Criminal acts or crimes are an inseparable part of life in society. The public measures justice not by the word for word formulation of the law, but by what is felt and seen by the decisions issued based on the legal reality witnessed. The aim of this research is to examine the role of prosecutors in resolving cases using a restorative justice approach. To find out the factors that hinder prosecutors in resolving cases using the concept of restorative justice. In this research, researchers used Empirical Law research. And the data feeding technique is carried out using the interview technique. The data obtained by researchers in this study used quantitative and qualitative methods. The results of the research show that the resolution of acts of abuse by the Bone Bolango District Prosecutor's Office through a restorative justice approach has been adopted. The inhibiting factors experienced by the Bone Bolango prosecutor's office were legal factors, human resources, clashes between victims and perpetrators and community culture.

Abstract

Abstract

Jurnal ini bertujuan untuk mengetahui dan menganalisis faktor penyebab sehingga terjadinya perkelahian antar warga dan untuk mengetahui dan menganalisis upaya-upaya yang dilakukan oleh aparat kepolisian untuk menghindari terjadinya perkelahian. Faktor penyebab terjadinya perkelahian antar warga dikalangan adalah ketersinggungan anggota kelompok, kesalahpahaman, dendam, miras/shopy’, rasa solidaritas, kesenjangan sosial/faktor ekonomi, penguasaan lahan dan hal-hal yang dapat membuat perpecahan, misalnya Pilkada dan upaya-upaya yang dilakukan aparat kepolisian dalam menanggulangi perkelahian antar warga adalah dengan berbagai metode, salah satunya Pre-emptif merupakan usaha atau upaya-upaya pencegahan kejahatan sejak awal atau sejak dini, yang dilakukan oleh kepolisian yang mana tindakan itu lebih bersifat psikis atau moril untuk mengajak atau menghimbau kepada masyarakat agar dapat mentaati setiap norma-norma yang berlaku. Metode preventif merupakan upaya yang dilakukan dengan tujuan untuk mencegah timbulnya kejahatan dengan tindakan pengendalian dan pengawasan, atau menciptakan suasana yang kondusif guna mengurangi dan selanjutnya menekan agar kejahatan itu tidak berkembang ditengah masyarakat.

Abstract

This article aims to find out how the position of the standard clause in an agreement in this case refers to consumer protection regulated in Law Number 8 of 1999 concerning Consumer Protection where the inclusion of standard clauses in an agreement both retail banking transactions and others as is still very much happening in everyday life, where when this clause is agreed upon by both parties then the agreement is considered binding and applies like a law for both of them However, on the other hand, there are opinions that oppose the inclusion of standard clauses in agreements, especially based on the principles of balance and fairness in contracting. By using descriptive analytical research methods and a normative juridical approach, the author wants to answer the extent of the validity and unenforceability of standard clauses in agreements and also how standard clauses in an agreement based on Law Number 8 of 1999 concerning Consumer Protection. The result of this research is that the prohibited standard clause is a clause in a standard agreement that contains a transfer of responsibility of the business actor. the transfer of responsibility has been regulated by the prohibition of its inclusion through Article 18 Paragraph (1) of the GCPL Law.

Abstract

Nowadays, the development of science and technology such as the Internet (interconnected computer network) can practically support any profession and its work, thus allowing you to achieve your life goals in a short time. The internet can also be detrimental to the interests of others. As internet and mobile phone technology advances, so does social media. As the number of internet users increases, more and more people are using these social networks for various purposes, some for positive purposes, some for cybercrime. The ease of access to pornographic content is believed to be one of the main causes of the increase in sexual crimes against children in Indonesia. The research used is normative legal research that examines literature studies based on normative systems. The results of this research are in the form of an analysis of the legal regulations related to the responsibility of PJI in filtering pornographic content via the internet in Indonesia.

Abstract

This article aims to determine the problems of implementing article 44 paragraph (3) of the law on the elimination of domestic violence in criminal acts of domestic violence which result in the victim's death. This research uses normative legal research methods. If you look at the severity of criminal cases, what often happens are cases of domestic violence in which the victim dies. The crime of domestic violence actually has a special law that regulates criminal acts within the household locus, namely Law number 23 of 2004 concerning the elimination of domestic violence. However, sometimes there are still similar cases which are decided by applying Article 338 of the Criminal Code (KUHP).

Abstract

The purpose of this research is twofold: first, to provide a conceptualization of restorative justice principles in Indonesia's criminal justice system; and second, to examine the problematic application of these concepts in that system. Normative legal research, specifically the statutory technique and the conceptual approach, are utilized in this study piece. On top of that, the processed legal materials were analyzed using a qualitative analytical method that relies on interpretation. According to this study's findings, the judicial subsystem in Indonesia, which includes the police, the prosecutor's office, and the Supreme Court, has started to implement the notion of restorative justice. Due to the lack of a legislation governing the implementation of restorative justice in Indonesia, institutional or partial rules and guidelines continue to be used when discussing its application. This brings up the issue of sub-system authority imbalance in the criminal justice system, as well as the lack of consistent guidelines for each sub-system to apply restorative justice. As a result, the various proportional institutions within each sub-system face legal uncertainty. Thus, in order to establish legal clarity on the implementation of restorative justice, Indonesia has to enact legislation that specifically addresses this concept, known as RKUHAP.

Abstract

This research aims to find out what the judge's forgiveness policy (rechterlijk pardon) is in the New Criminal Code, to find out how the rechterlijk pardon formulation in the Dutch Criminal Code compares and to find out what the challenges of rechterlijk pardon (judge's forgiveness) will be in the future. The research method used is juridical-normative with a statutory approach and a case approach. The research results show that Rechterlijk Pardon puts a different concept in giving space to judges in handing down guilty decisions without criminal penalties. Before being ratified, the principle of judge forgiveness was already used in several countries, for example the Netherlands. Even judges in Indonesia have made several decisions that contain the value of the judge's forgiveness. In connection with the analysis of Rechterlijk Pardon's challenges, it is viewed from the perspective of law enforcement and legal culture in society.

Abstract

The Constitutional Court's presence yields positive impacts on constitutional law, yet isn't devoid of controversies, including Judge misconduct, transgression of 'nemo judex idoneus in propria causa' principle, and potential super body transformation. This paper aims to comprehend and analyze constitutional interpretation dominance in assessing laws against the 1945 Constitution through a constitutional dialogue approach. This normative writing employs legal, historical, and conceptual methods. Findings underscore: 1) Demonstrating respect for state institutions, notably the People's Consultative Assembly of Indonesia. 2) Establishing a more democratic system to test the 1945 Constitution's compatibility in the Constitutional Court. 3) Breaking the monopoly of Constitutional Court-centric constitutional interpretation. 4) Reviving 'nemo judex idoneus in propria causa' principle is pivotal due to extensive testing of Constitutional Court Law, addressing concerns about verdict impartiality.
