Abstract

An electronic signature is an authentic marker to show a person's responsibility. Electronic signatures also ensure confidentiality, integrity, authorization, access control, and non-repudiation of information in electronic medical records. Therefore, this research was conducted to determine the legal aspects of electronic signatures in administering electronic medical records. This research used a qualitative method with a normative juridical approach. The research sources were based on laws, government regulations, journals, and other tertiary sources related to electronic signatures and electronic medical records in health facilities. Research findings illustrated that Minister of Health Regulation Number 24 of 2022 concerning medical records only defined electronic signatures as an authentication and verification of the security and privacy of medical record information. Electronic signatures are specifically regulated by Constitution Number 11 of 2008 concerning Information and Electronic Transactions and Government Regulation Number 71 of 2019 concerning Electronic Systems and Transaction Operators. Both certified and uncertified electronic signatures have legal legitimacy in their application in electronic medical records. However, how they are supported by evidence is what makes them different. Certified electronic signatures are more trustworthy than uncertified electronic signatures.

Abstract

In juvenile criminal justice system, there is the diversion policy as the transfer of juvenile cases from judicial process to outside of judicial process. The requirement regulation for diversion implementation are regulated in SPPA Law. However, about the implementation of diversion at Court, there is PERMA Number 4 of 2014 which regulates the requirement for implementing diversion as contrary with SPPA Law. This research aims to do analysis about disharmonization of norms related to regulation of requirement for implementing diversion between SPPA Law and PERMA Number 4 of 2014, and analysis about implementation of PERMA Number 4 of 2014 against SPPA Law. This research used normative legal research methods with legislative regulations approach and conceptual approach. The legal materials used is primary, secondary and tertiary legal materials obtained through document study techniques, and analyzed using deductive methods. The results of this research show that disharmonization of norms between SPPA Law and PERMA Number 4 of 2014, is because PERMA position is below the Legislative Regulations based on hierarchy of Legislative Regulations, but in case examination process at the District Court, PERMA Number 4 of 2014 still enforced and ignoring the SPPA Law with referring to the Supreme Court Law.

Abstract

The research purposes is to explain the comparison of the legal division of powers in the constitution in the 1945 Constitution of the Republic of Indonesia and in the Constitution of the Republic Democratic Timor Leste. The division of powers within a country, both in Indonesia and in Timor Leste, are stipulates in a constitution, in this case a state that protects and guarantees the implementation of human rights and other civil rights and limits its powers in a balanced manner between the interests of state administrators and their citizens. The research method used in this study was normative legal research. In addition, this research also applied comparative legal research method is a research methodology carried out by comparing one legal system to another, an activity in which experts compare the positive legal system of a nation to that of other nations. In this case, legal comparison of Indonesia and Timor Leste. The novelty of this research is to examine and analyze comparative law on the distribution of power in the constitutions of Indonesia and Timor Leste, it can be explained that there is a difference in the division of power. In Indonesia there is constitutive power, executive power, legislative power, judicial power, examining/inspective power, and monetary power, while in Timor Leste it is based on the constitution of the Democratic Republic of Timor Leste division of power consisting of the power of the president, the power of the national parliament, the power of the government and the power of the court.

Abstract

One of the main elements in corruption is the loss of state finances. It results in confusion impacting law enforcement officials' performance in eradicating corruption. In Indonesia, the Supreme Audit Agency (BPK) is an institution authorized to assess state financial losses. In practice, the Financial and Development Supervisory Agency (BPKP) is another institution with similar power. This study analyzed which institutions have the more appropriate power in determining state financial losses in corruption. Using legal research with statutory and conceptual approaches, this study showed that the BPK is an institution granted the constitutional power to examine state finances' management and responsibility, asserting its more legitimate institution to handle the power to assess the financial losses. Consequently, the BPK is the only state institution that can determine state financial losses. At the same time, the BPKP is only authorized to assess or audit the calculation of state financial losses as an indication of irregularities detrimental to state finances. This study concluded that only the BPK can assess and determine state financial losses used in examining the alleged corruption before the court. Abstract

The quality of regulatory and legislative measures, both within and outside the hierarchy in Indonesia, can be assessed using certain indicators. These indicators demonstrate a stagnation and a slight shift towards other legal issues. To improve the quality of regulatory and legislative measures, it is necessary to amend preventive and evaluative mechanisms. This condition provides a foundation for further analysis of all problems, with a focus on creating a positive system that prioritizes urgency and required improvements. This paper aims to analyze the preventive and evaluative mechanisms of legislation in Indonesia objectively. This article uses the doctrinal legal method, utilizing legal concepts, statutory laws, legal facts, and legal case approaches. It suggests amending the current mechanism and recommends reforms towards both preventive and evaluative mechanisms to improve regulatory and legislative quality in Indonesia. This study was concerned with formulating grounded principles and concepts, and providing proof of concept for preventive and evaluative mechanisms towards statutory laws, which would ensure the sustainability of Indonesia's legislative and regulatory reform.

Abstract

The exploration of Restorative Justice (RJ) in Indonesia's border areas, particularly within the context of North Central Timor High School, reveals intriguing insights into its implementation and reception among students. This study, employing an empirical legal research approach focused on statutory analysis, factual examination, and thoughtful analysis, sheds light on the evolving landscape of Indonesia's criminal justice system. Notably, the research highlights that while PERMENDIKBUD 46/23 initially adopts a distributive punishment framework, there exists a growing inclination towards adopting RJ principles. A significant proportion of students, constituting 55.50%, express strong support for the incorporation of RJ within the school environment. Moreover, a majority (51%) acknowledge the presence of RJ initiatives within their schools, emphasizing the gradual acceptance of this alternative approach. Furthermore, the findings underscore the importance of transparency in RJ practices, with 40% of students recognizing its significance. Additionally, a notable percentage (35.5%) of students endorse the application of RJ in addressing issues of sexual violence, signaling a potential avenue for addressing such sensitive matters within the school community. Crucially, a substantial proportion (43.33%) of students advocate for the active involvement of schools in facilitating the resolution of sexual violence cases through RJ processes. This underscores the pivotal role educational institutions can play in fostering a culture of accountability and restoration. Overall, the student perspectives elucidated in this research offer valuable insights into the feasibility and efficacy of RJ in addressing not only disciplinary matters but also complex issues like sexual violence within educational settings. As Indonesia continues to explore innovative approaches to justice, the embrace of RJ principles signifies a promising step towards fostering a more inclusive and restorative justice system.

Abstract

Hak dan kewajiban dokter masih menjadi masalah hukum yang harus dikaji terutama perlindungan hukum dokter dalam melakukan tindakan operasi. Artikel ini bertujuan untuk menganalisis perlindungan hukum terhadap dokter dalam konteks tindakan operasi berdasarkan sumber hukum yang berlaku di Indonesia. Kajian ini melibatkan pemahaman terhadap norma-norma hukum, etika medis, serta kewajiban dan hak dokter dalam memberikan pelayanan kesehatan kepada pasien. Analisis mendalam dilakukan terhadap prinsip-prinsip kewajiban profesional dokter, persyaratan informed consent, jenis tindakan operasi yang dilindungi hukum, tanggung jawab profesional, perlindungan hukum dokter, dan kewajiban pelaporan. Hasil telaah diperoleh perlindungan hukum terhadap dokter dalam melaksanakan tindakan operasi di Indonesia merupakan rangkaian ketentuan dan regulasi yang bertujuan untuk menciptakan lingkungan praktik medis yang aman, etis, dan profesional. Seperti Undang-Undang Kesehatan sebagai fondasi hukum, kode etik kedokteran sebagai pedoman etika, informed consent sebagai aspek penting, asuransi malpraktik untuk perlindungan tambahan, sertifikasi dan registrasi sebagai pengakuan kompetensi, peran otoritas kesehatan dan sistem pelaporan. Dengan adanya kerangka kerja hukum dan regulasi yang komprehensif ini, dokter dapat menjalankan tugas mereka dengan keyakinan dan memberikan pelayanan medis yang berkualitas, sambil menjaga hak-hak pasien dan menjauhi risiko hukum.

Abstract

Justice, non-discrimination, equality before the law are important values of the constitution. This study seeks to examine the constitutional rights of the younger generation that were cut by the framers of the law through the age requirement in the electoral law for presidential and vice presidential candidates. The research method used is a normative legal research method with qualitative methods. The age requirement no longer needs to be regulated in the Election Law because it is not in line and is not expressly regulated by the 1945 Constitution. If it is still regulated, the age requirement used must be 18 years, in accordance with the adult size applicable in Indonesia, as a consequence providing opportunities for the younger generation to participate in politics and government, and realize a more inclusive democracy. Factors influencing the setting of age requirements for presidential and vice presidential candidates are the history of national leadership, maintaining the status quo, and senior-junior practices. Therefore, Article 169 letter Q of the Election Law must be revised/deleted.

Abstract

The principle of lower-level legislation in the hierarchy of legislation must not conflict with higher-level regulations and must be enforced. This includes regional regulations whose administrative sanction content must not deviate from higher-level regulations. This study aims to determine the validity of regional regulations in regulating the content of sanctions, the regulation of sanctions for regional head regulations that do not comply with the rules above them, and how binding they are when applied. The research method used is the normative legal method, including the approach to legislation and legal concepts. The comparative method is also used to compare this issue with Japan. The results of this study indicate that there is disharmony between regional regulations and their implementing regulations due to the lack of detailed regulations on the content of regional head regulations, which has the potential to cause deviations in the content and affect the validity of the legal product. This has a negative impact and confuses at the implementation level, especially on the content of sanctions that are not in sync with the rules above them. Meanwhile, in Japan, Japanese administrative sanctions are contained in a very structured and standardized manner to minimize inconsistencies in regulations at the regional level. Therefore, the formation of material content regarding sanctions in implementing regulations must be based on legal validity, both materially and formally.

Abstract

Undang-undang Pembentukan Peraturan Perundang-undangan mendorong pembentukan peraturan perundang-undangan yang taat asas pembentukan peraturan perundang-undangan yang baik di Indonesia. Salah satu peraturan perundang-undangan Indonesia yakni Undang-undang. Suatu undang-undang harus mencantumkan penjelasan undang-undang, namun demikian, sejumlah undang-undang melanggar eksistensi dan fungsi penjelasan dalam Undang-undang Pembentukan Peraturan Perundang-undangan, dan mendorong diuji melalui Mahkamah Konstitusi. Hal tersebut tentunya kedepan tidak tepat untuk terjadi kembali dengan menegaskan fungsi Penjelasan dalam suatu Undang-undang. Adapun tulisan ini menggunakan metode penulisan yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual serta pendekatan kasus. Tulisan ini bertujuan untuk menganalisis, mengkaji serta menegaskan fungsi dan kedudukan penjelasan dalam Undang-undang maupun produk legislasi lainnya melalui tafsir Putusan Mahkamah Konstitusi. Tulisan ini menemukan bahwa beberapa Putusan Mahkamah Konstitusi dapat dijadikan landasan otentik dalam menegaskan kedudukan penjelasan dalam suatu undang-undang dan diharapkan kedepan bagi pembentuk undang-undang dengan kesadarannya untuk memperhatikan kedudukan dan fungsi penjelasan dalam sebuah undang-undang.
