Abstract

The role of the community is important in realising the fulfilment of the right to a good and healthy environment as part of human rights. Lack of awareness of the disclosure of information in environmental documents to the public in surveilling activities or businesses that impact the environment is one of the many violations of environmental law resulting in environmental damage and pollution. This paper examines the importance of information disclosure in environmental documents in supporting the role of community oversight of activities that impact the environment. It used a normative legal research method with the statutory and conceptual approaches. This paper finds that the disclosure of information in environmental documents is important in optimising the role of public monitoring. Environmental documents are used as a guide for detailed information related to compliance with the implementation of activity on its terms and obligations. Such disclosure can be seen as the implementation of the right to access information in support of community responsibility, guaranteeing and fulfilling the right to a good and healthy environment as a human right so that environmental damage and pollution from activities that are illegal and/or violate environmental permits can be controlled and prevented.

Abstract

Kondisi meluasnya sebaran dan peningkatan kasus Covid-19 di daerah sangat tinggi. Percepatan dalam penanggulangan salah satunya berupa Pembatasan Kegiatan Masyarakat (PKM) di Tingkat Desa, Kelurahan dan Desa Adat. Pemerintah Kota Denpasar menetapkan kebijakan dalam bentuk Peraturan Walikota Nomor 32 Tahun 2020 tentang Pembatasan Kegiatan Masyarakat dalam bentuk kebijakan tatanan baru di tingkat desa, kelurahan dan desa adat dalam percepatan penanganan Covid-19. Tujuan dari kegiatan pengabdian kepada masyarakat ini adalah untuk melakukan Evaluasi Pengaturan Kebjakan Dalam Masa Pensdemi Covid-19 adalah untuk menilai kebijakan yang diambil memang tepat dan mampu memberikan dampak yang sangat baik bagi masyarakat. Kajian disusun dengan metode normative dengan aspek filosofis, sosiologis dan yuridis dengan mengakaitkan pada peraturan perundang-undangan dalam bentuk bahan hukum primer dan bahan hukum sekunder. Hasil yang diharapkan dari evaluasi kebijakan ini adalah model dan bentuk kebijakan yang tepat untuk mengatasi pandemi covid-19 maupun jenis dan bentuk bencana dan wabah yang lainnya di Kota Denpasar. Kesimpulan dalam pengabdian ini dengan pendekatan evaluasi dan metode deskriptif untuk menghasilkan informasi yang valid tentang hasil kebijakan yang kredibel dan tentang hasil kebijakan yang secara eksplisit diinginkan oleh pemangku kepentingan pada masyarakat

Abstract

Kegiatan Pengabdian untuk Masyarakat di Desa Tampaksiring, Kecamatan Tampaksiring, Kabupaten Gianyar bertujuan untuk memperkuat pemberdayaan masyarakat melalui peningkatan partisipasi Sumber Daya Manusia dalam pembangunan desa wisata berbasis inovasi dan ekonomi kreatif sesuai dengan visi dan misi Desa Tampaksiring. Selain itu, kegiatan ini bertujuan untuk memperkuat sistem pengelolaan desa, karena masih minimnya keterlibatan masyarakat dalam pengelolaan desa wisata yang terdapat di desa, lemahnya partisipasi SDM terhadap potensi wisata dan potensi budaya yang dimiliki. Metode pendekatan dengan model yang dilakukan meliputi: 1) Model Partisipatory Rural Appraisal (PRA); 2) Model Entrepreneurship Capacity Building (ECB); dan 3) Model Teknologi Transfer (TT). Untuk mengatasi berbagai permasalahan tersebut diatas, beberapa rencana kegiatan yang diusulkan dalam pelaksanaan program Pengabdian untuk Masyarakat sebagai berikut: 1) Pelatihan penyusunan peraturan desa; 2) Pelatihan teknik memandu wisata bagi calon guide dan muda-mudi lokal di Desa Tampaksiring 3) Pelatihan manajemen pengolahan pangan ; 4) Pelatihan pembuatan souvenir khas untuk meningkatkan ekonomi kreatif di Desa Tampaksiring; 5) Membuat pelatihan kesehatan hewan; dan 6) Membuat Buku Panduan informasi tentang segala potensi wisata yang ada di Desa Tampaksiring dalam Bahasa Inggris dan Bahasa Indonesia.

Abstract

The objections of this article are to describe, analyze, combine, and maintain concurrent relationships between regulations, implementation of Direct Cash Fund regulations at the regional level, and determined or measured factors on Direct Cash Fund by regional governments. This study combined normative and empirical legal research, analyzed legal instruments, and conducted interviews with various apparatus and parties involved in the Direct Cash Fund. This research results demonstrate that Direct Cash Fund was an effective government instrument, both in terms of its regulation and implementation by central and regional governments, in assisting village governments in mitigating the COVID-19 pandemic effect, particularly on the poorest people, and sustaining village development agendas through the new Village Fund scheme within Direct Cash Fund allocation.

Abstract

The research purposes is to explain the comparison of the legal division of powers in the constitution in the 1945 Constitution of the Republic of Indonesia and in the Constitution of the Republic Democratic Timor Leste. The division of powers within a country, both in Indonesia and in Timor Leste, are stipulates in a constitution, in this case a state that protects and guarantees the implementation of human rights and other civil rights and limits its powers in a balanced manner between the interests of state administrators and their citizens. The research method used in this study was normative legal research. In addition, this research also applied comparative legal research method is a research methodology carried out by comparing one legal system to another, an activity in which experts compare the positive legal system of a nation to that of other nations. In this case, legal comparison of Indonesia and Timor Leste. The novelty of this research is to examine and analyze comparative law on the distribution of power in the constitutions of Indonesia and Timor Leste, it can be explained that there is a difference in the division of power. In Indonesia there is constitutive power, executive power, legislative power, judicial power, examining/inspective power, and monetary power, while in Timor Leste it is based on the constitution of the Democratic Republic of Timor Leste division of power consisting of the power of the president, the power of the national parliament, the power of the government and the power of the court.

Abstract

Abstrak Kajian berjudul “Pertanggungjawaban Hukum Terhadap Pekerja/Buruh Yang Di PHK Akibat Force Majeure Pandemi Covid 19” dibuat dengan tujuan untuk mengetahui apakah pandemi Covid 19 ini dapat dikatakan sebagai kondisi Force Majeure dan bagaimana bentuk pertanggungjawaban hukum yang di dapat pekerja/buruh yang diputus hubungan kerja oleh pihak perusahaan akibat pandemi Covid 19. Penulisan ini menggunakan metode penulisan normatif yang berdasar kepada peraturan perundang-undangan, teori hukum, serta pendapat sarjana. Pembahasan lebih lanjut menyimpulkan pandemi Covid 19 ini merupakan keadaan Force Majeure dan dapat dijadikan alasan pemutusan kontrak kerja sesuai dengan ketentuan yang diatur dalam Undang-undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan. Pertanggungjawaban hukum wajib diberikan oleh pihak pengusaha terhadap pekerja/buruh berupa gaji/uang pesangon, uang penghargaan masa kerja, serta pengganti hak yang seharusnya diterima. Kata kunci: Pemutusan Hubungan Kerja, Force Majeure, Pandemi Covid 19 Abstract The study entitled "Legal Responsibility to Workers / Laborers Which Is Discontinued Due to The Force Majeure Covid 19 Pandemic”, aims to percieve if the Covid 19 Pandemic can be consider as Force Majeure and how the legal responsibility is received by workers / laborers who have been discontinued due to the Covid 19 pandemic. This writing uses the normative writing method which is based on statutory regulations, legal theory, and the opinions of scholars. Further discussion concludes that the Covid 19 pandemic is considered as Force Majeure condition and can be used as an excuse for termination of employment in accordance with the provisions of Law Number 13 of 2003 concerning Manpower. Abstract

The role of the Village Consultative Body (BPD) in formulating village policies. Policy in the village is the basis when the local government will implement its policy. Policies in the village are for example in the form of Village Regulations (Perdes) in Bongan Village, Tabanan District, Tabanan Regency. The methods used in the training are presentation, discussion and practice. Presentations are carried out only as an introduction to the material and to provide knowledge about certain materials. Furthermore, more activities carried out with discussion and practice. The approach used is experiential learning, so that the lecturer is more of a facilitator, and the participation of participants can be maximized. Through this experience-based training participants are actively involved in every activity. The conclusions from the results of the research above are (1) The role of the Consultative Body in Bongan Village, Tabanan District, Tabanan Regency in carrying out the oversight function of Village Regulations has not been implemented optimally (2) The biggest inhibiting factors in the implementation of BPD supervision of Village Government Bongan, Tabanan District, Tabanan Regency are: The role of the BPD is not well understood and the understanding of the duties and functions of the BPD in administering Village Government, as well as other factors, such as mental attitude, and existing customary/family factors.

Abstract

ABSTRAK Penelitian ini bertujuan untuk menganalisis lebih dalam hal yang berkaitan dengan regulasi aktivitas transaksi jual beli aset kripto di Indonesia guna mengetahui bagaimana pengaturan perwujudan perlindungan hukum investor kripto sebagai pengguna pada aplikasi investasi online di Indonesia. Pada penyusunan studi ini penulis menggunakan metode penelitian hukum normatif melalui pendekatan peraturan perundang-undangan yang berlaku di Indonesia dengan kegiatan menganalisis regulasi atau peraturan yang berkaitan dengan isu hukum yang peulis teliti yaitu terkait transaksi jual beli aset kripto melalui aplikasi online. Hasil yang didapat oleh penyusun dalam studi ini yakni ditemukannya pengaturan hukum transaki kripto di Indonesia yakni diantaranya diatur dalam UU Nomor 10 Tahun 2011, PP No 49 Tahun 2014, Peraturan Menteri Perdagangan Nomor 99 Tahun 2018, Peraturan Bappebti Nomor 5 Tahun 2019. Terdapat 2 bentuk perlindungan hukum bagi para investor yakni perlindungan hukum preventif dan represif. Perlindungan hukum tersebut tercantum dalam KUHperdata, UU Nomor 11 /2008 dan UU Nomor 8/1999. Kata kunci : Perlindungan Hukum, Investasi, Komoditi Aset Digital ABSTRACT This study aims to analyze more in terms related to the regulation of crypto asset buying and selling transaction activities in Indonesia in order to find out how to regulate the embodiment of legal protection for crypto investors as users of online investment applications in Indonesia. In compiling this study, the author uses a normative legal research method through the approach to the laws and regulations that apply in Indonesia by analyzing regulations or regulations related to legal issues that the authors examine carefully, namely those related to buying and selling crypto assets through online applications. The results obtained by the authors in this study are the discovery of legal regulations for crypto transactions in Indonesia, including those regulated in Law Number 10/2011, Government Regulation Number 49/2014, Minister of Trade Regulation Number 99/2018, and Bappebti Regulation Number 5/2019. There are 2 forms of legal protection for investors, namely preventive and repressive legal protection. This legal protection is stated in the Civil Code, Law No. 11/2008 and Law No. 8/1999. Abstract

This study aims to analyze the provisions of Indonesian legislation governing the protection of personal data relating to cybercrime or cybercrime and conduct an analysis with international instruments in the field of Cybercrime, namely the Convention on Cybercrime which has not been ratified by Indonesia and the urgency of ratifying this Convention for the harmonization of Indonesian national law. Researchers used normative legal research in this study. Researchers use laws and regulations, articles, scientific journals, and books as sources of information and library materials so that legal research is known as formative law. This study used a statutory approach and a case approach. The study findings show that Indonesia already has several types of personal data protection arrangements spread across several regulations and laws. But in fact, this does not make cases of personal data leakage in Indonesia subside. Therefore, the strategy that Indonesia must take is to first ratify or access the Convention on Cybercrime, Budapest, 2001, so that the cooperation mechanism stipulated in the convention ultimately benefits and helps Indonesia in eradicating borderless cybercrime.

Abstract

Upholding human rights in the context of education is manifested in the form of the right to education. Realizing this right requires equal distribution of education which means the widest possible educational opportunity for everyone, including fulfilling children's rights to education for refugees or asylum seekers. Based on data from the United Nations High Commissioner for Refugees (UNHCR) in 2021, there are 13,459 refugees in Indonesia, of whom it is estimated that around 27% are child refugees and 114 children of whom come alone or are separated from their families. This research article will discuss the role of the Indonesian state in providing educational rights to children of refugees from other countries or children of asylum seekers as well as international arrangements related to the education rights of children of asylum seekers in transit countries. This study uses normative juridical research methods, through international regulatory approaches and conceptual approaches, in this case studying and analyzing material and legal issues based on international regulations and concepts related to the study of human rights from the perspective of the educational rights of asylum seeker for refugee especially child refugee.
