Abstract

The problem of joint property disputes after divorce in the jurisdiction of the Bengkulu Religious high courts, in the period 2010 to 2015 all decisions are always made up of half of the property of the ex-wife and the other half of the property of the ex-husband, regardless of who is more dominant in working to produce the property. This is based on article 97 of the Islamic Law Compilation. According to the authors the decisions did not fulfill a sense of justice, with regard to wives who participated in working for a living. The judges of the first level Religion Court in Bengkulu did not consider the role of the wife working for a living; which incidentally is the husband's obligation. How does the Maqāsid asy-Syarī'ah review the Bengkulu judges' consideration of joint property in the case of a wife participating in earning a living in the jurisdiction of the Bengkulu’s Religious high courts? and What are the implications of the judge's decision in the jurisdiction of the Bengkulu’s Religious high courts regarding joint property in the case of the wife participating in earning a living in the context of Islamic family law reform in Indonesia? The conclusions of this research are: Judges' considerations on decisions regarding joint assets in the case of wives participating in earning a living in the jurisdiction of the Bengkulu Religious high courts were not in accordance with Maqāsid asy-Syarī'ah, because the judge did not consider the position of his ex-wife who continued to work for a living besides running obligation to take care of the household. The judge's decision regarding joint property in the case of his wife helped earn a living in the jurisdiction of the Bengkulu Religious high courts in the context of reforming the Islamic Family Law in Indonesia, the judge must be progressive. The ex-wife who helped make a living should get a share of the joint property that is greater than the ex-husband. The ex-wife's portion was formulated peacefully and deliberately between the parties.

Abstract

This paper specifically discusses about religious differences as one of the barriers in inheritance. A Muslim does not inherit an infidel (kâfir), and conversely they also do not inherit a Muslim. Can a Muslim child inherit his infidel parents? In order to analyze this problem the author uses maqāsid syarī'ah review, where the law is determined for the benefit. This research concludes that it is permissible for a Muslim child to inherit his infidel parents, which is included in hifz al-dīn (maintaining religion) at the darūriyat level. This is because when a Muslim child is prohibited from inheriting his infidel parents, it is feared that his faith will waver, due to property problems. In the case of hifz al-māl, the hājiyat position, if a Muslim is prohibited from inheriting non-Muslim property, it means that any property that should be used for the benefit of the ummah will be lost.

Abstract

The protection of women and children is one of problems in the Indonesian judiciary. In the decision on Case Number: 1234/Pdt.G/2018/PA.Tnk and Number: 0014/Pdt.G/2019/PTA. Bdl which has permanent legal force regarding child custody by the Plaintiff. However, the Defendant was reluctant and did not want to implement the decision. So the Plaintiff must file a new lawsuit for the execution of the previous decision with decision number: 1376/Pdt.G/2019/PA.Tnk. The problem with this article is based on the judge's consideration of decision number: 1376/Pdt.G/2019/PA.Tnk regarding the determination of child custody to his biological mother. This research is library which is descriptive analytical. The primary data is in the form of decision number: 1376/Pdt.G/2019/PA.Tnk and is complemented by secondary data. Data were collected through documentation techniques and the analysis was carried out since the data collection process and deductively. The results of this study indicate that the judge's consideration in the case decision Number: 1376/Pdt.G/2019/PA.Tnk regarding the determination of child custody to the biological mother is based on the benefit and goodness of the child. The declarative nature of the previous decision prevented the realization of benefit values for the parties. The reason usually regarding child custody are executed voluntarily and not by force. The plaintiff seeks to obtain the power of legal execution from the previous decision by filing a new lawsuit with a comdennatoir decision, so that the child can be handed over to him to be treated as well as possible.

Abstract

The research discusses the considerations of judges at the Sungguminasa Religious Court regarding fulfilling the rights of wives after divorce, decision Number: 143 /Pdt.G/2014/PA.Sgm. It is generally accepted that in contested divorce cases, there are no rights to the wife after the divorce. The judge's decision that was accepted usually only granted the divorce petition. Judges usually did not grant it if there were claims for their rights and the rights of children post-divorce in the lawsuit. This research question is: What is the progressive legal analysis of the judge's considerations in case Number: 143 /Pdt.G/2014/PA.Sgm? This research was a literature study related to the considerations of judges' decisions in case number: 143/Pdt.G/2014/PA.Sgm. The primary data of this research was the decision of case number: 143/Pdt.G/2014/PA.Sgm. The judge's considerations in the decision were analyzed using Progressive Law theory to conclude. After collecting data through interviews, the findings of this research are that the Judge's considerations in Decision Number: 143 /Pdt.G/2014/PA.Sgm in fulfilling the wife's rights after a divorce from her husband, is progressive. The panel of judges granted the wife's civil rights after the divorce based on the defendant's capabilities. This decision benefits and provides financial protection for the ex-wife in continuing her life.
