Abstract

Abstract This study aims to analyze the urgency of the notary's obligation to report the beneficial owner in each deed to the Financial Transaction Analysis Reporting Center (PPATK) and how to assess the beneficial owner.Beneficial Ownership) referred to by the Legislation. The method used isnormative with the Antinomy research type, namely conflicting norms in the authority and obligations of a notary in reporting beneficial owners(beneficial ownership). The research results areThe urgency of the notary's obligation to report the beneficial owner(beneficial ownership) in each Deed to the Notary Financial Transaction Reports and Analysis Center (PPATK) as a state official or general official appointed by the state in making Deeds that are vulnerable to being exploited by money laundering (TPPU) and terrorism financing (TPPT) perpetrators.Authority The Financial Transaction Reports and Analysis Center (PPATK) requests reports from professions that are vulnerable to being misused by money laundering (TPPU) and terrorism financing (TPPT) perpetrators. PPATK asfinancial intelligence unit Whichhave duties and functions of receiving financial transaction reports, analyzing financial reports, and forwarding the results of the analysis to other law enforcement agencies. So the obligation to report the beneficial owner(beneficial owner) by a Notary to the Financial Transaction Reports and Analysis Center (PPATK) is very important and urgent in the prevention and eradication of money laundering (TPPU) and terrorism funding (TPPT) crimes

Abstract

Penelitian ini bertujuan menganalisa Penerapan Sanksi Pidana Terhadap Tindak Pidana Pertambangan Batubara Tanpa Izin di Kalimantan Selatan Berdasarkan Asas Keadilan diatur dalam Pasal 158 Undang-undang Nomor 3 tahun 2020 tentang Perubahan atas Undang-undang Nomo 4 Tahun 2009 tentang Penambangan Mineral dan Batubara, yang menyebutkan bahwa, Setiap orang yang melakukan usaha penambangan tanpa izin dipidana penjara paling lama 10 tahun dan denda paling banyak Rp. 10.000.000.000,00- (sepuluh miliar rupiah). Penelitian ini menggunakan metode penelitian normatif atau yang disebut dengan penelitian hukum doktrinal. Hasil penelitian ini menemukan bahwa dengan ringannya sanksi pidana yang diberikan pada pelaku tindak pidana pertambangan batubara tanpa izin di Kalimantan Selatan, tidak menimbulkan efek jera pada pelaku maupun untuk mencegah peristiwa yang sama terjadi di masa yang akan datang dengan pelaku-pelaku baru. Ringannya sanksi pidana pada kasus ini terjadi karena tidak ada batasan minimum bagi hakim sebagai patokan untuk menjatuhkan pidana pada para pelaku penambangan batubara tanpa izin. Apabila ditinjau dari sudut pandang keadilan, keadilan memang sangat sulit diciptakan karena terdapat dua pihak berbeda kepentingan yang menuntut terciptanya sebuah keadilan, kedua pihak tersebut adalah pelaku dan korban, keadilan bagi pelaku tentu pidana yang ringan dan hal itu tentu akan bertentangan dengan keadilan bagi pihak korban, begitupun sebaliknya.

Abstract

The purpose of this study was to find out the application of the reasons for the elimination of criminals in cases of corruption. The results of this study are case number: 87/Pid.Sus/2010/PN.Mrb, which was strengthened in the Supreme Court's Cassation decision number: 321 K/Pid.Sus/2011, was wrong in applying the excuse of forgiveness as the reason for eliminating the crime in its legal considerations, where the element of forgiving reason applied by the Panel of Judges was not fulfilled, but the justifying reason should be applied because one of the elements of Article 3 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning the eradication of criminal acts of corruption was not fulfilled because it relied on legal facts and expert testimony without mentioning in detail and with certainty who was benefited from the act, so the implication in this case is that the defendant should be acquitted (vrisjpraak).

Abstract

Pengabdian masyarakat ini diharapkan dapat memberikan pemahaman dan kesadaran hukum kepada generasi muda Pondok Pesantren Putra Darul Istiqamah Barabai untuk mengembangkan karakter yang sesuai dengan norma hukum dan agama. Isu perundungan dan kekerasan seksual bawah sadar menjadi permasalahan dalam penyelenggaraan pendidikan yang aman  sehingga diperlukan intervensi untuk mitigasi dan pencegahan perundungan dan kekerasan seksual bawah sadar di lingkungan pondok pesantren, keluarga, dan lingkungan sosial lainnya. Metode yang digunakan dalam pengabdian masyarakat ini adalah penyuluhan hukum dengan pendekatan yuridis sosio-legal melalui ilmu kriminologi dan viktimologi  yang termuat dalam perilaku keseharian para santri dilanjutkan dengan materi peran hukum terkait terhadap perundungan dan kekerasan seksual yang tidak disadari tersebut terjadi di masyarakat. Hasil dari kegiatan ini adalah kesadaran hukum santri Pondok Pesantren Putra Darul Istiqamah mengalami peningkatan setelah menerima penyampaian sosialisasi yang bermuatan hukum dan pencegahan perundungan dan kekerasan seksual. Pada dasarnya memiliki kesadaran hukum yang baik terhadap pencegahan perundungan dan kekerasan seksual. Hal ini terlihat dari antusiasme yang tinggi dan banyaknya pertanyaan kritis yang diajukan oleh peserta penyuluhan. Meskipun demikian, masih banyak yang belum tersampaikan dan beberapa masih kesulitan memahami mengapa kekerasan seksual adalah bagian dari kekerasan berbasis gender. Penting untuk selanjutnya diberi sosialisasi lanjutan khususnya yang berkaitan tentang perlindungan data pribadi di ruang digital agar para santri tidak impulsif  dalam berbagi informasi dalam pemanfaatan gawai dan beraktivitas di ruang digital, khususnya terkait konten-konten yang dapat melampaui batas-batas norma hukum maupun norma asusila di dunia nyata.

Abstract

AbstractThe Village Consultative Body (BPD) is an institution that embodies democracy in the administration of village governance. The BPD can be considered as the "parliament" of the village. BPD is a new institution in the village in the era of regional autonomy in Indonesia. BPD as a village institution has strategic roles and functions as well as tasks because it can carry out checks and balances in the administration of government in the village as mandated by Law no. 6 of 2014 concerning Villages to realize the welfare of rural communities. This also creates a new paradigm in village administration. Village administrators with the existing system experience obstacles such as a lack of understanding of the laws and regulations as a guide in carrying out their duties and functions. The influence of human resources is the main factor in determining the quality and capacity of BPD members. This service is also present as a form of concrete steps in helping to improve human resources as members of the BPD, Village Heads and Village Apparatuses, especially in Hulu Sungai Utara Regency. So that this service proposal is an effort to be able to maximize the human resources of the BPD, the Village Head and the Village Apparatus through training and technical guidance, namely by providing an explanation of the material in tutorials and discussions. Abstrak Badan Permusyawaratan Desa (BPD) merupakan lembaga perwujudan demokrasi dalam penyelenggaraan pemerintahan desa. BPD dapat dianggap sebagai "parlemen"-nya desa. BPD merupakan lembaga baru di desa pada era otonomi daerah di Indonesia. BPD sebagai lembaga desa mempunyai peran dan fungsi serta tugas yang strategis karena dapat melakukan check and balance pada penyelenggaran pemerintahan di Desa sebagaimana amanat Undang-Undang No. 6 Tahun 2014 tentang Desa untuk mewujudkan kesejahteraan masyarakat desa. Hal ini pun menimbulkan paradigma baru dalam penyelenggaran desa. Penyelenggara desa dengan sistem yang ada mengalami kendala seperti kurangnya pemahaman akan peraturan perundang-undangan sebagai panduan dalam menjalankan tugas dan fungsinya. Pengaruh sumber daya manusia menjadi faktor utama dalam menentukan kualitas dan kapasitas anggota BPD. Pengabdian ini pun hadir sebagai bentuk langkah nyata dalam membantu meningkatkan sumber daya manusia sebagai anggota BPD, Kepala Desa serta Aparatur Desa khususnya di Kabupaten Hulu Sungai Utara. Sehingga usulan pengabdian ini sebagai upaya untuk dapat memkasimalkan sumber daya manusia BPD, Kepala Desa serta Aparatur Desa melalui pelatihan dan bimbingan teknis, yaitu dengan memberikan penjelasan materi secara tutorial dan diskus.

Abstract

In 2021, the Indonesian Constitutional Court decided conditionally unconstitutional in the review of the Job Creation Law. It was among a few decisions made by the Constitutional Court to accept a formal review, even if some dissenting opinions followed it. While the decision has largely influenced a wide array of regulatory laws because the Job Creation Law adopts the omnibus law model, the pivotal issue in this paper rests on the legal basis for investment in Indonesia after this decision. Firstly, it enquired whether the Constitutional Court exceeded its power for a procedural judicial review against the Job Creation Law. Second, it discussed the legal basis for investment in Indonesia after the Constitutional Court's Decision No. 91/PUU-XVIII/2020. Using normative research, the results showed that with the conditional unconstitutional decision, the Indonesian investment world would experience legal uncertainty for the next two years, especially new businesses, licensing, and investments with the enactment of the Job Creation Law. In particular, if the legislative branch failed to improve this law over two years, businesses, licensing, and investments in Indonesia might have no legal basis, resulting in the uncertain situation of the government’s desire to realize the friendly investment.Keywords: Constituional Court, Job Creation Law, Judicial Review.

Abstract

The performance and productivity of any enterprise is a contentious topic of discussion in development. This research looks at the performance of Small and Medium Enterprises (SMEs) and how they are regulated to increase company productivity. Specifically, the paper sought to establish how policies and regulations contribute to leadership tasks, loyalty, employee motivation and job performance, affecting a firm’s production capacity. Policies and Regulations are examined in this paper because to enhance the performance of Small and Medium-sized Enterprises, the government of Indonesia issued regulation No. 20/2008, Article 3 about Micro, Small and Medium Enterprises intending to support the growth and development of the economy since 99% of the country’s economy is support by SMEs which also employees 97% of the working population of the country, yet there is still limited research on policies in relation performance and Productivity of SMEs. Though policies are a fundamental component in business growth, it has been established that employee performance affects company productivity, affecting local employment rates. The sample population was taken from Indonesia’s Small and Medium Enterprises (SMEs) employees. The sample size was 250, and PLS software was applied to analyze the data. The study’s findings showed the leadership role’s significance concerning existing Policies and Regulations regarding SMEs. It was also revealed that motivational policies enable employees to go beyond expectations and show higher levels of job performance in their respective tasks, increasing productivity.

Abstract

Besides producing CPO and KPO, oil palm also produces a lot of waste. Oil palm waste can be managed and utilized. This study aims to determine how oil palm waste is managed, the authority of local governments to regulate oil palm waste management in South Kalimantan Province. Third, what is the concept of future local government policies in utilizing oil palm waste as a new and renewable energy development in South Kalimantan? The research method used is normative juridical research, the research that is focused on examining the application of the rules or norms in positive law, analyzing in-depth and holistically, from all aspects comprehensively, sourced from library research using legal materials, namely primary legal materials, secondary legal materials, and tertiary legal materials, to answer regulatory issues in the legislation regarding the Policy on the Use of Oil palm Waste as New and Renewable Energy in South Kalimantan Province. The result shows that Indonesia has been able to create renewable energy from the oil palm industry. However, the government needs to regulate the use of oil palm shell waste through local regulations and policies. With the participation of policymakers, and focus for development. It can creates jobs, increase and develop disadvantaged areas and in the end will reduce the level of poverty.

Abstract

Child grooming is a form of sexual harassment that continues to develop because sexual harassment is often carried out directly by the perpetrator, and is often carried out through social media. The perpetrator manipulates Child Grooming by being kind and attentive so that the child believes that the person he has just met is a good person. In Indonesia, Child Grooming is a new type of crime, and is based on existing regulations. The method used in this study is normative legal research. The approach in the research utilizes a legislative approach. The legal materials used in this study are primary legal materials, secondary legal materials, and tertiary legal materials. In the normative law research that is being carried out, the data collection method is by conducting a bibliographic study. The act of Child Grooming is a form of sexual crime that uses minors as targets. Although the Child Protection Law has regulated the protection of children, the existing articles are still limited in regulating obscene acts in general. And in the regulations in Indonesia there are 10 rules or articles that can be imposed on Child Grooming perpetrators.
