Abstract

From the Global Intellectual Property Center (GIPC) survey, Indonesiastill considered weak in protecting intellectual property. Then the political direction of law began to look at the concept of the omnibus law to promote the ease of doing business (EoDB). Therefore, the purpose of this study is to analyze first, the legal protection issues of famous brand holders in Act No. 20/2016 through political instruments and criminal law policies. Secondly, the concept of the omnibus law as iusconstituendum of the Act Related to Indonesian Intellectual Property in the politicalperspective of criminal law. The normative method was chosen because of the objectof the study on the principles of law, theories, and doctrines of jurisprudence. The results of this study show that although Indonesia’s IPR index score increased in2019, it’s global ranking declined. This means that despite increases in scores, Indonesia’s IPR enforcement tends to be stagnant when compared to other countries.The IPR-related Act can be combined into an omnibus law. The aim is to simplify the laws of Patents, Trademarks, Copyrights, Industrial Designs, Layout Designsof Integrated Circuits, and Communal Investment Credit which greatly affect the economy and investment in Indonesia.

Abstract

Dalam realita pertambangan batubara banyak muncul permasalahan lingkungan dan ketidakadilan. Dalam penelitian ini memunculkan problem hukum dalam hal realisasi kebijakan keseimbangan dari suatu pertambangan batubara di Provinsi Kalimantan Selatan. Penelitian ini menggunakan jenis penelitian hukum normatif dengan didukung penelitian lapangan. Peneliti melakukan pengumpulan bahan hukum yang meliputi bahan hukum primer, sekunder dan tersier. Hasil dari penelitian ini menunjukan realisasi kebijakan pertambangan batubara di Provinsi Kalimantan Selatan berdampak positif dan negatif. Dampak positif berupa bantuan di bidang sosial budaya, pendidikan dan perkebunan, dari dana tanggung jawab social perusahaan tambang batubara, dan masyarakat di sekitar areal pertambangan juga mendapat keuntungan dan pekerjaan tambahan. Selain dampak positif yang disebutkan di atas, ternyata pertambangan lebih banyak mempunyai dampak negatif baik bagi masyarakat sekitar, bagi hasil pertambangan yang dirasa masih kurang adil, maupun dampak bagi lingkungan.

Abstract

Abstract

The performance and productivity of any enterprise is a contentious topic of discussion in development. This research looks at the performance of Small and Medium Enterprises (SMEs) and how they are regulated to increase company productivity. Specifically, the paper sought to establish how policies and regulations contribute to leadership tasks, loyalty, employee motivation and job performance, affecting a firm’s production capacity. Policies and Regulations are examined in this paper because to enhance the performance of Small and Medium-sized Enterprises, the government of Indonesia issued regulation No. 20/2008, Article 3 about Micro, Small and Medium Enterprises intending to support the growth and development of the economy since 99% of the country’s economy is support by SMEs which also employees 97% of the working population of the country, yet there is still limited research on policies in relation performance and Productivity of SMEs. Though policies are a fundamental component in business growth, it has been established that employee performance affects company productivity, affecting local employment rates. The sample population was taken from Indonesia’s Small and Medium Enterprises (SMEs) employees. The sample size was 250, and PLS software was applied to analyze the data. The study’s findings showed the leadership role’s significance concerning existing Policies and Regulations regarding SMEs. It was also revealed that motivational policies enable employees to go beyond expectations and show higher levels of job performance in their respective tasks, increasing productivity.

Abstract

Penelitian ini bertujuan menganalisis efektivitas penggunaan media papan himpunan dan roda berputar dalam pembelajaran matematika kelas 6 di SDN 67 Rabantala, Kota Bima. Media ini dirancang untuk membantu siswa memahami konsep himpunan dengan lebih mudah melalui pendekatan visual yang menarik. Penelitian menggunakan metode kualitatif dengan pendekatan deskriptif, di mana data dikumpulkan melalui observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukkan bahwa penggunaan media papan himpunan dan roda berputar berdampak positif terhadap motivasi dan pemahaman siswa. Media ini mampu membuat siswa lebih antusias, aktif, dan terlibat dalam proses pembelajaran. Siswa dapat memahami materi himpunan dengan lebih mudah karena media ini memberikan representasi visual yang jelas dan interaktif. Selain itu, pembelajaran menjadi lebih menyenangkan, sehingga meningkatkan motivasi belajar siswa secara keseluruhan. Penggunaan media kreatif seperti papan himpunan dan roda berputar juga mendukung terciptanya suasana kelas yang interaktif, di mana siswa lebih percaya diri untuk berpartisipasi dalam diskusi dan kegiatan kelompok. Dengan pendekatan yang menyenangkan, siswa tidak hanya memahami materi lebih baik, tetapi juga lebih termotivasi untuk belajar secara mandiri di luar kelas. Kesimpulannya, penerapan media pembelajaran yang inovatif dapat menjadi alternatif yang efektif dalam meningkatkan hasil belajar siswa, khususnya dalam materi matematika seperti himpunan. Media ini dapat diadaptasi dan diterapkan pada berbagai jenjang pendidikan untuk mendukung pembelajaran yang lebih bermakna.

Abstract This study aims to analyze the urgency of the notary's obligation to report the beneficial owner in each deed to the Financial Transaction Analysis Reporting Center (PPATK) and how to assess the beneficial owner.Beneficial Ownership) referred to by the Legislation. The method used isnormative with the Antinomy research type, namely conflicting norms in the authority and obligations of a notary in reporting beneficial owners(beneficial ownership). The research results areThe urgency of the notary's obligation to report the beneficial owner(beneficial ownership) in each Deed to the Notary Financial Transaction Reports and Analysis Center (PPATK) as a state official or general official appointed by the state in making Deeds that are vulnerable to being exploited by money laundering (TPPU) and terrorism financing (TPPT) perpetrators.Authority The Financial Transaction Reports and Analysis Center (PPATK) requests reports from professions that are vulnerable to being misused by money laundering (TPPU) and terrorism financing (TPPT) perpetrators. Abstract

The development of information technology in the healthcare sector brings significant benefits for improving services, but also poses serious challenges related to the protection of patient personal data. The prevalence of medical data leaks demonstrates weak security systems and a low level of understanding among healthcare workers regarding the legal and ethical aspects of data management. This study aims to improve the legal understanding of medical and healthcare workers in protecting patient personal data through the Compulsory Lecturer Service Program (PDWA) at a hospital in Banjarmasin City. The method used was participatory outreach, delivering materials on regulations, data governance, and professional ethics, as well as quantitative evaluation through pre- and post-tests. The results showed a gap in initial knowledge, but after the outreach, there was a significant increase in legal understanding, professional attitudes, and ethical awareness among participants. This program also encouraged the formation of a work culture that better respects patient privacy and strengthens hospital institutional governance, thereby increasing public trust in healthcare services. The implications of this activity are the importance of ongoing training, strengthening internal regulations, and developing a secure digital infrastructure to minimize the risk of data leaks. Thus, patient personal data protection can be implemented optimally and sustainably in the hospital environment.

Abstract

Besides producing CPO and KPO, oil palm also produces a lot of waste. Oil palm waste can be managed and utilized. This study aims to determine how oil palm waste is managed, the authority of local governments to regulate oil palm waste management in South Kalimantan Province. Third, what is the concept of future local government policies in utilizing oil palm waste as a new and renewable energy development in South Kalimantan? The research method used is normative juridical research, the research that is focused on examining the application of the rules or norms in positive law, analyzing in-depth and holistically, from all aspects comprehensively, sourced from library research using legal materials, namely primary legal materials, secondary legal materials, and tertiary legal materials, to answer regulatory issues in the legislation regarding the Policy on the Use of Oil palm Waste as New and Renewable Energy in South Kalimantan Province. The result shows that Indonesia has been able to create renewable energy from the oil palm industry. However, the government needs to regulate the use of oil palm shell waste through local regulations and policies. With the participation of policymakers, and focus for development. It can creates jobs, increase and develop disadvantaged areas and in the end will reduce the level of poverty.

Abstract

The responsibility of corporations engaged in mining activities within forest areas without the Minister's permit is an important issue in the context of environmental protection and management in Indonesia. Law No. 32 of 2009 on Environmental Protection and Management (UUPPLH) regulates the obligation of all parties, including corporations, to conduct business activities while considering environmental sustainability. In this case, corporations that engage in mining activities without the Minister's permit are considered to violate existing regulations, which may lead to both criminal and administrative sanctions. This study aims to examine the extent of corporate responsibility for environmental damage caused, as well as the implications for law enforcement and environmental protection. The research uses a normative legal method with a legislative, conceptual, and comparative approach, focusing on the analysis of Article 89 Paragraph (2) letter (a) of the P3H Law and its implementation in the enforcement of law related to corporate crimes in the mining sector. Furthermore, the study will discuss how existing policies and regulations can improve corporate accountability in carrying out environmentally friendly mining activities. Through this analysis, it can be concluded that Article 89 Paragraph (2) letter (a) of the P3H Law does not clearly specify who is responsible, preventing the corporate management from being held criminally accountable. This undermines the purpose of the law to provide certainty, justice, and benefits. As a result, the law fails to achieve its goals of criminal punishment and legal protection for the welfare of society and environmental preservation.
