Abstract

AbstractDe Durian Park Wonosalam is a durian farming community in the Wonosalam community that does not cooperate with any party. De Durian Park Wonosalam's activities are engaged in the economy, environment, tourism, and utilization of natural resources. However, there are existing problems regarding De Durian Park, namely partners need an understanding of the topic of Utilization of Natural Resources that is oriented towards bringing maximum profit for the benefit of the surrounding community and Partners still lack understanding of plantation law and licensing as the foundation in managing De Durian Park. The method used in this community service is to provide a thorough understanding and understanding regarding awareness of plantation licensing and the use of natural resources that bring benefits and prosperity to the surrounding community. This includes providing guidance on how to apply plantation permits and involving the government to avoid conflicts. The solution to the problems faced is that the PengMas Team participates in conducting socialization so that the goals of developing De Durian Park can be understood and accepted by all parties and provide legal consultation sessions and plantation licensing when the next activity takes place until it is finished.Keywords: Natural Resources Utilization, De Durian Park, Development AbstrakDe Durian Park Wonosalam ini adalah komunitas petani durian di masyarakat Wonosalam yang tidak bekerjasama dengan pihak manapun. Kegiatan De Durian Park Wonosalam ini bergerak dalam bidang ekonomi, lingkungan hidup, wisata dan pemanfaatan sumber daya alam. Tetapi terdapat permasalahan yang ada mengenai De Durian Park yaitu mitra membutuhkan pemahaman terkait topik Pemanfaatan Sumber Daya Alam yang berorientasi membawa keuntungan yang maksimal untuk kemaslahatan masyarakat sekitar dan Masih mininmya pemahaman Mitra mengenai hukum dan perijinan perkebunan sebagai fondasi dalam pengelolaan De Durian Park. Metode yang digunakan dalam pengabdian masyarakat ini yaitu dengan memberikan pengertian dan pemahaman secara menyeluruh terkait kesadaran perizinan perkebunan dan pemanfaatan sumber daya alamnya yang membawa keuntungan dan kesejahteraan masyarakat sekitar. Termasuk memberikan pengarahan bagaimana menerapkan izin perkebunan dan melibatkan pemerintah agar tidak terjadi konflik. Solusi dari permasalahan yang dihadapi yaitu Tim PengMas turut serta dalam melakukan sosialisasi agar tujuan dari pengembangan De Durian Park ini dapat dipahami dan diterima oleh semua pihak dan menyediakan sesi konsultasi hukum dan perijinan perkebunan pada saat kegiatan selanjutnya berlangsung hingga selesai.Kata Kunci : Pemanfaatan SDA, De Durian Park, Pengembangan

Abstract

Good faith is a principle embodied under Article 1338 Paragraph (3) of the Indonesian Civil Code, which is required in every stage of a contract, including in a land sale and purchase contract. Under several decisions of the Supreme Court, good faith is considered to exist, for instance, when a buyer purchased a land through the auction of the State Receivables Affairs Committee (PUPN). Nevertheless, based on a conviction in the judicial practices, this article believes that purchases through official auctions are not necessarily the indicators for the existence of good faith principle in a land sale and purchase contract. Therefore, this study is focused on the concept of good faith buyer with a land object as well as the characteristic of auction winner as a good faith buyer protected by law. In conclusion, parties of a land sale and purchase contract through auction can be considered to have performed in good faith when they have fulfilled the criteria under Supreme Court Circular Letter and other criteria such as purchasing through state auction office in accordance with the applicable laws and regulations, purchasing in a reasonable price, and the auction winner is not the creditor himself who purchases at a price far below the collateral limit price.

Abstract

Baitul Maal wat Tamwil is a financial institution with a sharia concept that was born as a choice that changes the concept of maal and tamwil in one institution. The concept of maal was born and became part of the lives of Muslim communities in terms of collecting and distributing funds for zakat, infaq and shadaqah) productively. While the Tamwil concept was born for purely business activities to benefit from the middle to micro sectors of society. One of the financing activities carried out by BMT is financing based on profit sharing principles. Profit sharing is done by two types with mudharabah and musyarakah contracts. musyarakah is derived from the word syirkah, also called syarikah, which means a cooperation agreement between two or more parties for certain businesses, each party providing the assistance fund, and will be borne together in accordance with the aid fund, or mutual agreement. The methods used in the writing of this article are normative research using a statute approach and a conceptual approach.the result of this research indicates distribution of funds or financing must pay attention to various matters relating to caution both from within and from outside the Islamic Financial Institutions of Islamic Banks and Non-Islamic Banks. Matters issued from internships are in the form of Legal Lending Limit (LLL), financing guidelines, operational aspects. Aside from internal, things that are of caution are also excluded from the external supported by 5C analysis (Character, Condition, Capacity, Capital, Guarantee) and sharia compliance). This analysis must be considered in channeling financing to avoid elements forbidden in Islam.

Abstract

Partnership relation as one of work relation between the farmer as the representative of micro business and main company as macro business as the owner, science and technology based on a deal is known as plasma core partnership relation. In it's implementation, many problems happened and resisted which may trigger disadvantages especially for the farmer. Therefore it is very important to pay our attention about the validaty and basics contract principle in the implementation of plasma core partnership contract. The goverments support actively or passively takes also a role in enforcing norms and regulations of the contract, so that the purpose of every side can be reached and the goals of every party could be secured as well.

Abstract

Recent development to claim damages on the basis of either wanprestatie or onrechtmatige daad would not provide saticfactory grounds to the question of justice. There will be a situation in which that no one shall be unjustly enriched at the expense of another which all outside the scope of contract and tort. This has led to the existence of an independent legal doctrine known as unjust enrichment. It is among the most debated private law subjects today in asking for justice. Corrective justice brings to the remedial relation between the plaintiff and the defendant; it is solely concerned with the norm of justice that provides reasons to restitution. Corrective justice properly evaluates the structure of injustness to the both sides, the plaintiff and the defendant. It gives effect to restitutionary proprietary interests rather than compensatiton. This article elaborates the law of unjust enrichment as ground for restitution in conjunction with the corrective justice. Furthermore, this article focuses on the theoritical foundation of corrective justice to meet the unjustified enrichment criteria.

Abstract

This study aims to find out in depth the meaning of Lejong that defines “visiting”,typical local wisdom of Manggarai. Lejong is convinced as an effort to solve theconflict faced by Manggarai’s students in Malang. This research was conducted onsome of Manggarai’s student communities in Malang, including IKAMMA, IMAMA,and others. This research focused on students who carried out the only Lejongactivities, opened in depth about the meaning of Lejong as the local identity of theManggarai community, especially in conflict management.The results of this study are the existence of local values accepted in the identity ofthe Manggarai community that has been rooted for a long time ago. It is undoubtedthat the role of senior in upholding the local identity of the Manggarai community,who are overseas, is also one of the “effective ways” in resolving conflicts thatoccur between Manggarai’s students in Malang. This research is limited only tothe Manggarai’s students. The hope of this research is to contribute to the study ofliterature on conflict resolution based on local wisdom.

Abstract

Kampong Tenggher hadir sebagai salah satu objek wisata potensial dalam upaya melestarikan adat dan budaya masyarakat Madura. Berdasarkan Undang-Undang Republik Indonesia No. 10 Tahun 2009 tentang Kepariwisataan, dalam upaya untuk mengembangkan objek wisata harus menganut prinsip kemanusian, keadilan, dan melestarikan budaya serta kearifan lokal, dalam upaya mengembangkan Kampong Tenggher menjadi objek wisata terdapat tantangan yang dihadapi. Permasalahan Kampong Tenggher yaitu rendahnya tingkat pendidikan masyarakat, rendahnya kualitas akses jalan menuju Kampong Tenggher dan kurangnya penerangan menuju dan di lokasi wisata Kampong Tenggher. Oleh karena itu, solusi dan rencana dalam permasalahan untuk program kegiatan ini adalah pembangunan dan peningkatan sarana dan prasarana penunjang pariwisata, peningkatan kualitas sumber daya manusia dan penguatan lembaga kampung wisata. Peningkatan sumber daya manusia disekitar Kampong Tenggher juga perlu diupayakan melalui pelatihan dan pendidikan kepariwisataan agar masyarakat sekitar Kampong Tanggher mampu mandiri dan berdaya serta memperbaiki dan memberikan fasilitas dan pelayaan bagi wisatawan. Dengan demikian upaya strategis perlu dilakukan untuk mewujudkan Kampong Tenggher menjadi suatu objek wisata potensial di Madura.   Development of Potential Tourism Objects “Kampong Tengher”: Challenges And Strategies. In an effort to preserve the Madurese community's customs and culture, Kampong Tenggher is being promoted as a possible tourist destination. According to the regulations of the Republic of Indonesia Law No. 10 of 2009 concerning Tourism, in order to develop tourism objects, they must adhere to the principles of humanity, justice, and the preservation of culture and local wisdom. There are challenges to overcome in order to develop Kampong Tenggher into a tourist attraction. Road access to Kampong Tenggher, as well as a lack of streetlight or to and at Kampong Tenggher's tourist attractions. So the answers and strategies for this activity program's challenges are the development and enhancement of tourist supporting facilities and infrastructure, the improvement of human resource quality, and the strengthening of tourism village organizations. Improvement of human resources around Kampong Tenggher also needs to be pursued through tourism training and education so that the people around Kampong Tanggher are able to be independent and empowered as well as improve and provide facilities and services for tourists. As a result, deliberate initiatives are required to make Kampong Tengher a prospective tourist attraction in Madura.

Abstract

The Indonesian Trade Secrets Law Number 30/2000 (ITS Law) postulates exemptions for acts that are not considered infringements to protect trade secrets. One of them is the reverse engineering of other people’s trade secrets. The problem is that the ITS Law does not limit the extent to which reverse engineering can be justified. The absence of these limitations also allows attempts to disclose trade secrets under the pretext of reverse engineering. This problem ultimately results in the absence of legal certainty for the protection against trade secret disclosure, which is the sole responsibility of the trade secret owner. This article aims to re-analyze the protection provided by the ITS Law and examine the extent to which the limitations on reverse engineering can be justified in the ITS Law. This article used normative juridical research methods combined with statutory, conceptual, and case approaches. It revealed a paradox in the protection of trade secrets against the possibility of trade secret disclosure. This article concluded that changes are necessary to the ITS Law, specifically by adjusting to the basic principles of IPR protection, limiting the extent to which the reverse engineering of other people’s trade secrets can be justified, and adding a “Good Faith” clause in performing reverse engineering actions.

Abstract

State has the power to manage natural resources for the sake of social justice, the general welfare and are used as much as possible the greatest benefit for the greatest welfare of people. Contract law is the main instrument used to protect the state assets including oil and gas. Production Sharing Contract as a legal safeguard for oil and gas, is a fundamental pillar in the effort and utilization management activities of oil and gas. In the contracts involving the Government, called government contract, there is a unique characteristic which is not entirely subject to private law. In principle, the state should not be harmed, called as state immunity. This principle also applies universally in the interest of protecting the state assets. Abstract

In the futuristic era, transportation is one of the essential necessities for society. The dynamism of urban and rural life makes all groups of people need adequate and usable accommodation in general. However, land transportation infrastructure in Indonesia is not maximally available so it requires a lot of development. The construction of transportation infrastructure requires enormous costs, so the solution that can be used is to use a financing scheme. One of the simpler financing schemes is direct lending. The purpose of this research are to explain two main topics. First, is to analyze the legal relation of the parties in providing direct lending to finance transportation infrastructure. Second, is to determine the legal remedies that the government can take when the borrowers default on lending to finance transportation infrastructure. The type of research used is doctrinal legal research so as to produce a clear and detailed legal analysis regarding direct lending to finance land transportation infrastructure. When a borrower, who has been bound in an agreement with a lender, breach of contract, the borrower can be subject to two options of legal remedies.
