Abstract

State has the power to manage natural resources for the sake of social justice, the general welfare and are used as much as possible the greatest benefit for the greatest welfare of people. Contract law is the main instrument used to protect the state assets including oil and gas. Production Sharing Contract as a legal safeguard for oil and gas, is a fundamental pillar in the effort and utilization management activities of oil and gas. In the contracts involving the Government, called government contract, there is a unique characteristic which is not entirely subject to private law. In principle, the state should not be harmed, called as state immunity. This principle also applies universally in the interest of protecting the state assets. Abstract

This paper aims tp discuss the legitimacy of AIW at Nazhir Airlangga University from the perspective of the waqf law and whether it has complied with the principle of maslahah mursalah, considering that various cases of waqf property do not run optimally, are productive, are not used or are transferred to third parties. There is an interesting phenomenon, namely that at Nazhir, Airlangga University is the only one and the first time an Indonesian State University has received a Nazhir certificate to manage and develop waqf. In this case, it is interesting to discuss the practice of waqf at Nazhir Airlangga University according to the Waqf Law. This normative research uses statute approach and the conceptual approach. The results show that in practice Nazhir Universitas Airlangga in carrying out his waqf pledge practice does not use AIW un-authentic. That is, Nazhir Airlangga University in carrying out his waqf practice in terms of his pledge deed is in accordance with the procedures in accordance with Law Number 41 of 2004 concerning Waqf.

Abstract

Sebagai pemegang Hak Pengelolaan seluruh tanah di Kota Batam, BP Batam memiliki kewenangan memberikan Hak Guna Bangunan atau Hak Pakai di atas tanah tersebut kepada pihak ketiga melalui perjanjian. Namun, dalam Putusan Nomor 17/G/2020/PTUN.TPI, muncul ketidakpastian hukum akibat pembatalan sepihak perjanjian oleh BP Batam melalui surat keputusan yang membatalkan pengalokasian tanah kepada PT. Tria Galang Emas, lalu mengalokasikan tanah yang sama kepada PT. Wiraraja Tangguh. Tindakan ini menimbulkan persoalan hukum terkait keabsahan perjanjian dan akibat hukum dari tindakan BP Batam yang dinyatakan sebagai onrechtmatige overheidsdaad oleh pengadilan. Tesis ini menggunakan metode penelitian hukum dengan pendekatan Statute Approach, Conceptual Approach, dan Case Study. Hasil penelitian menunjukkan bahwa BP Batam memang berwenang membuat perjanjian dengan pihak ketiga meskipun tanah belum bersertifikat HPL. Namun, sebaiknya hak pengelolaan terlebih dahulu diurus guna menghindari kendala administratif dan memperjelas legalitas perjanjian. Putusan pengadilan yang menyatakan adanya perbuatan melawan hukum oleh BP Batam menyebabkan pembatalan surat keputusan dan perjanjian dengan PT. Wiraraja Tangguh, serta tanah kembali menjadi hak PT. Tria Galang Emas. Oleh karena itu, BP Batam perlu memastikan status tanah bersih dari sengketa sebelum membuat perjanjian baru.

Abstract

Sejak tahun 2014, untuk kegiatan penerimaan calon peserta didik baru tingkat SMP/MTs, Dinas Pendidikan Kota Pekalongan mengembangkan sistem informasi PPDB secara online. Meskipun sudah diimplementasikan  selama 6 tahun, belum pernah dilakukan pengukuran kesuksesan implementasi sistem informasi PPDB online tingkat SMP. Penelitian ini bertujuan untuk mengevaluasi apakah sistem informasi PPDB online tingkat SMP, dapat dikatakan sukses atau berhasil dalam pengembangannya Model kesuksesan implementasi sistem informasi yang diadopsi dalam penelitian ini menggunakan model DeLone dan McLean yang telah dimodifikasi, yang terdiri dari 6 variabel yang mempengaruhi kesuksesan implementasi sistem, yaitu variabel kualitas sistem, kualitas informasi, kualitas layanan, tingkat penggunaan, kepuasan user, dan manfaat bersih.  Variabel yang tidak digunakan adalah variabel penggunaan dan manfaat bersih. Variabel penggunaan dan manfaat bersih dihilangkan karena objek pada penelitian ini bersifat mandatory. Penelitian dilakukan dengan menganalisis hasil kuesioner dari 92 responden. Metode analisis yang digunakan dalam penelitian ini penggunakan uji validitas, uji reliabilitas, dan uji hipotesis. Hasil analisis menunjukkan kepuasan pengguna sistem informasi PPDB online tingkat SMP, dipengaruhi oleh kualitas sistem, sedangkan kualitas informasi dan kualitas layanan tidak berpengaruh pada kepuasan pengguna.

Abstract

Sektor pariwisata merupakan salah satu sektor yang dapat bermanfaat untuk pertumbuhan ekonomi suatu daerah. Data Dinas Pariwisata Kabupaten Madiun mencatat, banyak wilayah desa di Kabupaten Madiun di lereng Gunung Wilis yang memiliki potensi wisata dan agrowisata yang dapat digarap, antara lain Sungai Catur, Taman Hutan Pinus Nongko Ijo, dan Base Camp Pendakian Wilis. Pembenahan guna meningkatkan kunjungan wisatawan ke objek wisata setempat terus dilakukan. Pengelola tempat wisata berasal dari warga desa setempat yang dikaryakan untuk sadar akan potensi wisata di desanya. Dalam pengelolaan dan pengembangan pariwisata khususnya ekowisata dibutuhkan pengetahuan dan ketrampilan mengenai kontrak kemitraan yang menjadi wadah hubungan hukum para pihak dalam pengembangan pariwisata. Metode pengabdian masyarakat ini adalah dengan penyuluhan dan pelatihan bagi Kelompok Sadar Wisata di wilayah Kecamatan Kare, Kabupaten Madiun. Ruang lingkup materi yang disampaikan dalam pengabdian masyarakat ini adalah mengenai urgensi pemahaman hukum kontrak, asas-asas, karakteristik kontrak kemitraan yang digunakan dan bermanfaat dalam pengelolaan pariwisata. Sebagai hasil kegiatan ini, Kelompok Sadar Wisata memiliki pengetahuan yang meningkat mengenai karakteristik dan prinsip hukum kontrak yang sesuai dengan bidang pengembangan wisata.

Abstract

The spirit of Article 4 of Law No. 43 of 2007 is regulated by Article 5 paragraph (3) of Law No. 3 of 2017 is concerning to increase users interest in reading by converting printed books into electronic books. However, this breakthrough also brings new legal issues, namely the potential for reduced economic rights of creators or copyright holders of printed books as well as the decentralization of authority to convert printed books into physical books by libraries even though these requirements have been regulated by Article 27 of Law No. 28 of 2014 concerning Copyright; there is still room for illegal duplication and even piracy. There are two methods used in this research. The statutory approach is used to review statutory regulations primarily and the conceptual approach is used to support the narrative text presentation with relevant scientific literature. The results of this research indicate a need for special regulations regarding the conversion of printed books into electronic books by libraries by paying attention to the Economic Rights of the Creator or Copyright Holder of printed books. In addition, conversions must be carried out under the supervision of the relevant institutions and submitted centrally to the National Library to ensure standard procedures and conversion quality, and reformulation of previous regulations is necessary.

Abstract

The legal foundation is one of the most important sources of law that has been emphasized in several legal theories. However, concepts regarding legal foundation are still heavily debated and intertwined with other legal principles, legal values, legal norms, legal theorems, and legal rules. Foundation, principles, and norms are general concepts discussed in the law field as a separate point of discussion in the study of law, especially in legal theory.This showcases that the knowledge regarding concepts and the standing of different principles, values, norms, and rules are important in studying a particular field of law. However, in practice, most legal scholars and professors in the field of law are still unaware of such concepts that often overlap with one another. Generally, foundations are meta values from principles, principles are the meta values of norms, and norms are meta values of a rule. In comparison, values are the equivalent of principles and fundamental values. A theorem is the equivalent of a norm, which is embodied in a rule, and the rule itself is the most concrete implementation of a principle, which may be in the form of a written or unwritten rule. This paper aims to explore the relationship between justice, corrective justice, restitution, and unjust enrichment. It will discuss how fundamental values, principles, and norms serve as meta-values in achieving justice. Additionally, it will examine the role of corrective justice in providing restitution for cases of unjust enrichment.

Abstract

Indonesia’s construction sector faces acute payment risk, particularly for subcontractors and suppliers positioned downstream in multi-tier contractual chains. Unlike many common law jurisdictions that mitigate this risk through statutory construction lien rights, non-possessory security interests that attach to the improved aset, Indonesia lacks an equivalent construction-specific proprietary protection, leaving payment security largely dependent on contract remedies and general security devices. This article examines (i) how construction lien regimes function as project-specific security mechanisms in selected common law jurisdictions and (ii) the normative and functional gap created by their absence in Indonesia, along with feasible accommodation pathways. Employing doctrinal (normative) legal research using statutory, conceptual, and comparative approaches, the study analyzes representative lien frameworks in North Dakota, Texas, and Ontario. The analysis finds that, despite jurisdictional variations, lien regimes share a regulatory core: lien rights arise upon performance, are made transparent through notice/registration systems, operate under calibrated priority rules, and are enforceable against the project asset through structured procedures. By contrast, Indonesia’s principal security instruments, Mortgage Rights (Hak Tanggungan) and Fiduciary Security (Jaminan Fidusia), are structurally ill-suited to secure progressively embedded construction value and to protect parties lacking privity with owners. The article concludes that strengthening Indonesia’s construction security framework requires a construction-specific proprietary mechanism, preferably statutory recognition of construction lien rights with carefully designed registration, time limits, and priority rules to balance contributor protection with owner and financier certainty.

Abstract

Government construction projects operate under a public financial oversight regime that allows legal and financial consequences to arise after project completion and contractual payment. This study examines the legal implications of ex post audits conducted by the Audit Board of the Republic of Indonesia on legal certainty for construction service providers in government projects and analyzes their effects on business certainty during project implementation. This research is using socio-legal analysis with legal and economic perspectives. The findings indicate that ex post audits consistently generate financial recommendations with values that fluctuate widely across semesters, ranging from tens of billions to tens of trillions of rupiah. These recommendations emerge after construction completion and contractual payment, placing financial and administrative consequences in a retrospective position. Dominant audit indicators include weaknesses in internal control systems, statutory non-compliance, and uneconomical, inefficient, and ineffective use of public funds. This pattern shows that contractual finality in government construction projects depends on audit outcomes and follow-up implementation rather than contractual performance alone. The study indicates that legal and business certainty for construction service providers in government projects develop in a delayed manner under post-execution public financial oversight.

Abstract

The integration of the Indonesian Standard Quick Response Code (QRIS) is a crucial strategic step for Micro, Small, and Medium Enterprises (MSMEs) to modernize their payment infrastructure, thereby catalyzing the acceleration of the digital economy amid widespread digital transformation. This standardized payment system represents a foundational technological breakthrough, establishing a universal framework for QR-based non-cash transactions. Crucially, MSMEs are empowered to consolidate various payment platforms—spanning digital wallets, electronic money applications, and mobile banking services—under one unified QRIS logo. This eliminates the necessity for enterprises to manage multiple proprietary codes. The widespread implementation of QRIS furnishes smaller enterprises with a streamlined, highly effective mechanism to successfully transition towards a cashless operational model, significantly enhancing the fluidity and overall efficiency of financial exchanges. An analysis derived from a targeted investigation conducted in the Tlogmas area of Malang City, Indonesia, indicates that the assimilation of QRIS yields varied outcomes for local MSMEs. The findings underscore the system's inherent capacity to boost operational productivity and open up new market avenues, provided it is complemented by robust technological infrastructure and greater entrepreneurial literacy regarding its full scope of advantages. These observations necessitate proactive policy intervention aimed at heightening MSME proficiency and participation in the utilization of QRIS. It is incumbent upon governing bodies and associated entities to escalate outreach efforts and conduct extensive informational campaigns detailing QRIS benefits. Furthermore, targeted capacity building programs are essential to ensure MSME proprietors possess comprehensive technical mastery, enabling them to optimally leverage this digital payment technology not just for transactional expediency, but as a robust driver for business continuity and long-term sustainable expansion.
