Abstract

The law that regulates all lines of life is included in regulating legal aid. Indonesia as a rule of law country certainly regulates the implementation of legal aid. However, in practice, legal aid in Indonesia is considered not to have run optimally because many people find it difficult to get legal assistance when they experience problems related to law from a civil-criminal perspective as well as state administration. This of course causes misery to the community and it can be judged that the community does not experience prosperity. Therefore, the author wants to examine this problem using normative juridical research methods. And found that there are problems juridically from Law Number 16 of 2011 Concerning Legal Aid, the community, and executors providing legal aid. especially oversight of funds for the provision of legal aid. Therefore it is necessary to change from a juridical and implementation perspective to be regulated again in order to meet the needs of the Indonesian people.

Abstract

The Indonesian state, as stated in the 1945 Constitution, initially declared itself a legal state before undergoing amendments. After the amendment, the statement changed to "Indonesia is a state of law." This means that every action taken by the government or state must comply with the legal provisions in force in Indonesia. The principle of the rule of law is regulated in the 1945 Constitution, Article 1 Paragraph (3), both before and after the amendment, indicating that Indonesia is a country based on law. Indonesian law also regulates the rights and obligations of parents in the modern era. The development of modern society brings changes in interpersonal relationships, especially in the family context. The main issue that emerged was regarding the status of children born out of wedlock, reflecting shifts in social values and raising complex legal questions regarding the rights of parents and children. With the significant increase in the number of children born outside of marriage, there is a need to review the legal system that regulates the status of children outside of marriage. The primary focus is on the parents' and children's rights perspective, with attention to child recognition, custody, and financial responsibilities.

Abstract

Innovative solutions are needed to enhance the efficiency and affordability of the trial process. One such solution is e-Litigation, an electronic trial system that utilizes technology to realize the principles of swift, simple, and cost-effective trials. However, its implementation faces challenges such as limited human resources, infrastructure, and administrative processes. The formulation of the research problem is as follows: 1) How is the Implementation of Electronic Litigation (e-Litigation) in Efforts to Realize the Principles of Swift, Simple, and Cost-Effective Trials at Semarang District Court? 2) What are the obstacles and their solutions in the Implementation of Electronic Litigation (e-Litigation) in Efforts to Realize the Principles of Swift, Simple, and Cost-Effective Trials at Semarang District Court? The research approach used is qualitative legal research with an empirical juridical type. Data is obtained through interviews, documentation, and literature review. Data validity is ensured through triangulation by comparing primary data with secondary data. Data analysis is conducted in three stages: data reduction, data display, and conclusion drawing. The research findings explain the implementation of electronic trials at Semarang District Court to realize the principles of swift, simple, and cost-effective trials based on Supreme Court Regulation No. 7 of 2022 on electronic trials to ensure optimal law enforcement by law enforcement officials during the trial process. There are self-reliant individuals in the community who seek legal assistance independently, and if there are obstacles, they can consult through the e-court corner, Legal Aid Institute of Semarang District Court, or use legal representation in seeking justice. The correlation between the principles of swift, simple, and cost-effective trials and the implementation of electronic trials at Semarang District Court can be seen from the maximum trial time limit of 5 months, features allowing parties to access, download, and upload trial-related documents, integration of electronic media for summoning parties, effective archiving systems, efficiency in trial needs, especially accommodation costs, creating transparency, and eradicating brokers and illegal levies. There are several obstacles including Lack of Public Knowledge, which significantly affects the effectiveness of the law, especially if there are technologically inexperienced individuals who tend to resist change and distrust the legal system. The second factor is Lack of Infrastructure (Network Constraints).

Abstract

This study analyzes the problem of a prosecutor’s procrastination in executing a court judgment that delays the prisoners’ serving their sentences and causes some irregularities in the correctional facilities regarding the prisoners’ rights trade. The introduction of many prisons without a specific body to supervise the execution of the sentence, particularly the warded people’s freedom in Indonesia, appeared to have unfulfilled justice in the society. In this regard, this research aims to define the validity of the need to enhance the Supervision of prisoners’ rights protection in Central Java. It describes an optimal system relevant to such Supervision. The type of research that was utilized in this study is sociological juridical. Sociological juridical research serves to be the opposite of normative legal research. It is revealed that there have been ongoing infringements of prisoners’ rights, highlighting the further need to set a more comprehensive mechanism that would include the Police, the Prosecutors, the Courts, and the Correctional Institutions in the system of oversight and other management functions. Every level in the hierarchy system of the Criminal Justice System has its limit on including the human rights of prisoners containing adequate risks of intrusion, where checks and balances must be exercised. Formally and horizontally, these rights must be assured and upheld both legally and in their spirit by Justice and the Law. This study’s findings are that appropriate measures need to be applied to implement better Supervision policies aimed at safeguarding the human rights of prisoners and ensuring the justice system in Indonesia is not compromised.

Abstract

Marriage is one of the legal events and regulated in a marriage law which is part of a civil law and regulates a man and woman with the intention of living together for a long time according to the legal regulations stipulated in the law. Most of the contents or regulations regarding social intercourse, husband and wife are regulated in religious norms, decency, or modesty, but disputes often occur in the household, resulting in a divorce or breakdown of marital ties, breaking marriage contract due to the wishes of husband or wife or both because disharmony originating from the failure to exercise the rights and obligations of a husband or wife as per the applicable marriage law. When a husband and wife decide on the desire to divorce, they must be prepared to face the court. Because the legal complaints process can only be taken in court, the possibility of the problem being faced by a husband and wife who are going to divorce is complicated and has difficulties when going through the divorce path, this factor can be caused because they are legally blind. divorce which is basically complicated, complicated to drain a lot of funds. In Islamic law itself. Everything that leads to damage to the household is something that is hated by God, such as divorce. Divorce is a lawful act but is very hated by God. Basically, all religious teachings do not allow divorce. So it is recommended for Muslims to be able to maintain integrity, harmony in the household, and be able to solve existing problems in a peaceful manner, so that there is no divorce. The factors that cause divorce are biological factors, psychological factors, moral factors, economic factors, sociological factors.

Abstract

This study aims to examine the phenomenon of femicide in Indonesia, focusing on the murder case in Cirebon. Femicide, as a form of extreme violence against women, is often triggered by complex social, cultural, and economic factors. The research method used is descriptive qualitative with a sociological juridical approach, which includes news analysis and secondary data related to femicide cases. The results of the study indicate that the patriarchal structure that dominates society contributes to the high number of femicide, where many perpetrators are intimate partners of the victim. Law enforcement against perpetrators of femicide also faces significant challenges, including a lack of understanding of gender issues among law enforcement officers. This study recommends the need for more effective public policies and strict law enforcement to protect women and prevent future femicide.

Abstract

The research aims to explore the socio-political dimensions of gender justice and human rights, emphasizing women's political equality while ensuring appropriate support for family life. Using a combination of field research (non-doctrinal) and a literature review of primary sources, including those related to Boja Village, the paper analyzes legislative changes and economic initiatives that have enhanced women's status and family welfare. The study also examines global and national gender-equality indices, evaluating their progress through both quantitative indicators and qualitative policy assessments/public opinion. The discussion highlights the complex roles of governments, non-governmental organizations, and women’s activist groups in advocating for gender parity on a global scale. While many aspects of life have seen improvements, cultural and economic challenges, along with institutional remnants, continue to hinder equal opportunities for both men and women. The coordinated approach to women’s and family welfare emphasizes gender- and culture-sensitive empowerment of the individual. The chapter concludes with policy and practice recommendations aimed at fostering more gender-sensitive interventions, accelerating progress toward universal human rights, and advancing the sustainable development agenda.

Abstract

Intellectual property is used to increase economic value while providing legal protection for innovative inventions. Goyor Glove, typical of Pemalang, in fact, does not yet have legal protection on Intellectual Property, especially Industrial Design, so that the protection is low and many industrial designs of Goyor sarong are used by others without permission. The methods used to solve the problems in this service program are: (1) Training (workshop), which aims to provide knowledge and skills in quality improvement and product development (2) Product development and application management of the Goyor motif motif to be a description of IP Industrial Design; (3) Assisting and facilitating IP registration of Industrial Designs to be able to increase the economic value of the product; and (4) Monitoring and Evaluation for follow-up plans. Partners in this program, namely the Goyor Sarong Craftsmen in Pemalang District, were given the opportunity to play an active role, from the time of training to mentoring, facilitation and monitoring and evaluation especially during registration and acceleration of obtaining IP Industrial Design certificates craftsmen are given the opportunity to actively provide ideas, criticism in product development and application of management to obtain IP protection. Thus this activity is centered on partners based on the basic needs of partners to develop by increasing the economic value and welfare of the Goyor Gloves craftsman in particular.

Abstract

Small and Medium Enterprises (SMEs) in Indonesia are growing rapidly and continuing to grow. These developments had a significant impact on economic growth for various sectors in Indonesia. However, the dynamics of the development of SMEs are still overshadowed by the unclear protection of rights relating to intellectual property, including economic rights for SMEs. In fact, this right becomes an important part that is regulated both in national and international legal rules. The purpose of this study is to determine and compare the implementation of the protection of economic rights for SMEs in Central Java Province, Indonesia. This research method uses interview techniques and direct observation in several SMEs in Central Java. This study found that the protection of economic rights for SMEs had not been maximally carried out, even the number of SMEs did not yet obtain guaranteed recognition of the brand rights and copyrights of their products. This study concludes that in applying protection to economic rights for SMEs, collaboration between sectors and ministries is needed, not only the Ministry of Law and Human Rights, but also Industry, Trade and Economy.

Abstract

Penelitian ini bertujuan untuk mengkaji aspek perlindungan hukum terhadap kreditur dalam hal terjadinya pembatalan Sertifikat Hak Tanggungan (SHT) berdasarkan putusan pengadilan, sebagaimana tercermin dalam Putusan Nomor 226/Pdt.G/2022/PN.Skt. Dalam konteks sistem perbankan yang bergantung pada jaminan kebendaan seperti hak tanggungan untuk menjamin pelunasan kredit, kasus ini memperlihatkan bagaimana sertifikat hak tanggungan yang secara administratif sah dapat dibatalkan secara hukum akibat tindakan melawan hukum berupa pemalsuan dokumen dan pencurian sertifikat. Penelitian ini menggunakan pendekatan normatif yuridis dengan analisis terhadap peraturan perundang-undangan yang relevan, seperti Undang-Undang Nomor 4 Tahun 1996 tentang Hak Tanggungan dan Kitab Undang-Undang Hukum Perdata. Hasil penelitian menunjukkan bahwa pembatalan SHT tidak hanya menghapus hak eksekutorial bank sebagai kreditur separatis, tetapi juga menurunkan kedudukan hukumnya menjadi kreditur konkuren yang tidak memiliki jaminan khusus. Kondisi ini mencerminkan lemahnya perlindungan hukum terhadap kreditur dalam situasi di mana agunan yang dijadikan dasar pemberian kredit ternyata cacat hukum. Oleh karena itu, penelitian ini merekomendasikan perlunya perbaikan sistem verifikasi dokumen agunan oleh lembaga perbankan dan penguatan prinsip kehati-hatian (prudential principle) dalam proses pemberian kredit untuk menghindari kerugian hukum dan ekonomi akibat penyalahgunaan hak tanggungan oleh pihak ketiga.
