Abstract

This research examines the application of the Prior in Tempore and Torrens System principles in resolving double land certificate disputes within Indonesia's land registration framework, as reflected in Supreme Court Decision No. 309 PK/PDT/2021. The study is motivated by the recurring legal uncertainty arising from conflicting certificates on a single plot of land, which creates a dilemma between upholding historical ownership justice and enforcing formal legal certainty based on registered titles. The objectives are to analyze the conflict and adaptation between these two principles in Indonesia's system and to examine the judicial reasoning (ratio decidendi) employed in the aforementioned Supreme Court ruling. Employing a normative juridical method with statutory, conceptual, case, and comparative approaches, the study finds that while Indonesia’s hybrid system attempts to integrate elements of both principles, the Supreme Court's decision prioritized the Prior in Tempore doctrine. The Court ruled in favor of the holder of the earlier-issued certificate, effectively sidelining the good faith protection stipulated in Article 32(2) of Government Regulation No. 24 of 1997, which is a key feature of the adapted Torrens System. The ruling underscores the system's failure to provide absolute legal certainty and highlights the absence of a state guarantee fund to compensate parties harmed by administrative errors in land registration.

Abstract

The Krame Desa tradition as an alternative solution to criminal acts of theft in the Sasak tribal community in Central Lombok. The background to the choice of this theme was the existence of a mechanism for resolving criminal acts of theft among the Sasak Traditional Law community in the Sade Traditional Tourism Village, called Krame Desa. Krame Desa is an activity carried out by two or more people and a group of people to determine who is wrong and right in terms of defending the property rights of one person or many people by drinking the ground water from the grave of the guardian of Nyatuk. Based on the above, this paper raises the formulation Problem: How is the implementation of the "Krame Desa" Customary Law in resolving criminal acts of theft among the Sasak tribe community in the Sade Traditional Tourism Village, Central Lombok Regency? What is the Strength of the Decision to Settle the Crime of Theft Through the Village Temple in the Sade Traditional Tourism Village, Central Lombok Regency? Then this paper was written using empirical research using a sociological juridical approach and a case approach. The research location is in the Sade Traditional Tourism Village, Pujut District, Central Lombok. The data obtained by the author consisting of primary and secondary data will be analyzed using qualitative descriptive analysis techniques. The results of this research show that the meaning of Krame Desa is a mechanism for resolving disputes in the Sasak Customary Law community, especially in criminal acts of theft, where the philosophical basis is to restore magical and spiritual balance in society, in the process using oaths.

Abstract

Before Indonesian independence, Mandar people in Mamuju Regency used kumah (shifting farming) to obtain land. Customary domains overlap with protected forest areas encompassing 60–70% of the regency, and their land rights are unrecognised. The 2025–2045 Mamuju RPJPD designates ancestral lands, including Rimuku, Tadui, and Bambu, as strategic zones for the region's Nusantara Capital support city, worsening the issue. This paper examines the legal status of customary land in these vital zones, explains how land-rights neglect marginalises the Mandar people, and proposes a collaborative governance approach grounded in Mandar local wisdom to preserve their land rights. The socio-legal approach that combines normative analysis of land regulations with empirical data from Focus Group Discussions and questionnaires with academics, the National Land Agency (BPN), and the Mandar community finds that marginalisation occurs systematically through three mechanisms: stagnant implementation of regional regulations in customary-law communities without a Regent's response. The study recommends a collaborative governance model that integrates Mandar values of sipakatau (mutual humanisation), sipakalebbi (mutual respect), sisallang (deliberation for consensus), and sipakaingge (mutual reminding) with accelerated recognition of customary land rights.

Abstract

This research endeavors to investigate the intricate process of dispute resolution pertaining to conflicts that emerge between indigenous communities inhabiting the candidate site for the State Capital (Nusantara Capital City) and the Nusantara Capital Authority, a ministry-level institution endowed with the responsibility of overseeing regional administration within the Nusantara Capital City. Spanning an expansive 256,142 hectares of land, the Nusantara Capital City landscape harbors a mosaic of 17 indigenous communities in North Penajam Paser Regency and 34 indigenous communities in Kutai Kertanegara Regency, collectively comprising over 20,000 members, as documented by the Indigenous Peoples Alliance (Aliansi Masyarakat Adat). The procurement of land for the Nusantara Capital City's expansion has engendered protracted conflicts, notably pertaining to the resettlement of indigenous communities and the determination of suitable compensation areas. These conflicts persist without the presence of regulatory safeguards that could protect the rights and interests of indigenous communities while satisfying the exigencies of Nusantara Capital City development. The Indigenous Peoples Draft Law, despite its relevance, fails to address the intricacies of resolving disputes arising from land acquisition for public purposes. Similarly, the existing frameworks for land acquisition designed for public interest do not adequately address conflicts involving indigenous communities that lack legal recognition. Consequently, this research endeavors to propose a comprehensive conflict resolution framework rooted in the fundamental human rights of indigenous peoples, while also accommodating the imperatives of developmental investment. This approach seeks to strike a harmonious balance between the preservation of indigenous rights and the fulfillment of Nusantara Capital City's development needs.
