Abstract

This study examines the problematic regulation of articles of contempt of state institutions in Law No. 1 of 2023 concerning the Criminal Code on the right to freedom of opinion in Indonesia. This type of research is normative legal research that uses a statute, analytical, and conceptual approach. The results of this study show that juridically formal insults to state institutions (President, MPR, DPR, DPD, MA, and MK) are regulated in Article 240 and Article 241 of Law No. 1 of 2023 concerning the Criminal Code as complaint offenses. The existence of articles of contempt of state institutions has negative implications for the right to freedom of opinion if reviewed using the legal system theory with the concept of three elements of the legal system. In legal substance, the article of insult to state institutions is multi-interpretive because there is no clear and concrete distinction between insult and criticism. In legal structure, the article of contempt of state institutions has the potential to be misused because there are power relations both structurally and functionally between law enforcement and state institutions; and (3) legal culture, standardization of articles of insult to state institutions has the potential to degrade the pluralism of habits in society in opinion and expression.

Abstract

The quantity of Modern Markets in Bone Regency has increased sharply, this has an impact on the existence of the people's market. Thus, this study aims to analyze the arrangement of modern markets to restore the existence of the people's market in Bone Regency. The research method used is legal research with a legislative and socio-legal approach. The results obtained are first, the number of modern markets that exceed the number of people's markets in Bone Regency is a sign that the people's markets in Bone Regency are increasingly degraded. Second, when viewed from legal aspects, both philosophical, sociological, and juridical, the people's market needs to be preserved because the people's market is a local wisdom owned by the Indonesian people which has been regulated in Permendag Number 21 of 2021 concerning Guidelines for the Development and Management of Trade Facilities. Therefore, the author suggests that local governments need to establish a regulation related to modern market structuring to restore the dignity of the people's market through regional rules.

Abstract

This study aims to understand and analyze the legal arrangements of esports in terms of the point of view of labor law. The research method used is legal research with a normative juridical approach. The research results obtained are first, in terms of legal substance, second, in terms of legal structure, and third, in terms of legal culture. The author reflects that in the substance of the law, there has not been a single piece of legislation that contains explicitly and comprehensively regarding esports. Then in the aspect of esports dispute resolution, that is, the phrase “final and binding” on the award of the settlement of violations by Executive Board of Esports Indonesia is biased. In addition, in terms of legal culture, the existence of esports in Indonesia has risen in all walks of life, players who are legal subjects in esports are dominated by underage players. This study concludes that the government needs to form a law that explicitly regulates esports activities in Indonesia, in the form of: 1) The rights of esports athletes, especially minors; 2) The legal position of the Executive Board of Esports Indonesia statute in the laws and regulations in Indonesia; 3) Rights and obligations of esports athletes.

Abstract

This paper examines the idea of adding the authority of the Constitutional Court of Republic Indonesia to examine draft laws against the constitution of the basic law with a mechanism called judicial preview. This paper aims to examine the involvement of the judiciary, in this case the Constitutional Court, in the law-making process. This paper is a measure of the involvement of the Constitutional Court in the expansion of authority by examining the constitution against the draft law. The type of research used is library research in the form of normative research using statutory, conceptual, and comparative approaches. The research results obtained found that the existence of the Constitutional Court as the sole interpreter of the constitution shows that the involvement of the Constitutional Court in the law-making process has the potential to improve the quality and constitutionality of the draft law. In terms of functions and main tasks, the Constitutional Court can participate in the law-making process. The Constitutional Court is actually present as a judiciary activism that bases its function as a counter-majoritarian. Abstract

The use of conventional voting systems in electoral processes continues to face significant vulnerabilities, including ballot manipulation, vote tampering, and human error. As a digital alternative, electronic voting (e-voting) offers a promising solution to enhance electoral integrity, efficiency, and transparency. While Indonesia has begun experimenting with e-voting—particularly in village head elections—it has yet to scale the system to national-level elections. This study aims to analyze Indonesia's readiness to implement a national e-voting system by drawing comparative insights from Brazil, a country that has successfully adopted e-voting in its federal elections. Using a normative legal approach and library-based research, the study evaluates the infrastructural, legal, and technological challenges facing Indonesia’s electoral modernization. The findings indicate that a major barrier to nationwide implementation lies in the technological dependency on devices such as laptops and touchscreen computers, which require stable electricity—an issue in Indonesia’s underdeveloped and remote regions. The study highlights the need for infrastructural equity and policy reform to support digital electoral governance. Theoretically, this research contributes to global debates on digital democracy, offering lessons on how socio-technical readiness shapes the adoption of e-voting in emerging democracies

Abstract

Penelitian ini menganalisis mengenai wewenang pemerintah Desa dibidang pertanian yang ditinjau dari perspektif Undang-Undang Nomor 19 Tahun 2013 tentang Perlindungan dan Pemberdayaan Petani. Metode yang digunakan dalam penelitian ini yaitu pendekatan kualitatif dengan subjek pemerintah Desa dan masyarakat petani. Sedangkan teknik pengumpulan data dilakukan melalui observasi, wawancara dan dokumentasi. Hasil penelitian ini menunjukan bahwa pelaksanaan kewenangan Pemerintah Desa Kulo dalam pemberdayaan Petani Desa Kulo Kecamatan Kulo Kabupaten Sidrap telah berjalan dengan baik. Terdapat beberapa pelaksanaan kewenangan yang bersifat substantif dalam pemberdayaan Petani oleh Pemerintah Desa seperti penyaluran informasi, pelatihan dan pendidikan, penyediaan fasilitas, dan penguatan kelembagaan Kelompok Tani, pengawasan dan pelaksanaan distribusi bantuan pupuk, serta pembimbingan Petani. Pemerintah Desa Kulo juga melakukan kegiatan pelatihan pembuatan pupuk kompos dan penggunaan alat pertanian modern seperti handtracktor, robot panen padi dengan melakukan sinergitas dengan Dinas Pertanian.

Abstract

This research addresses a significant issue in Indonesia, where 68% of agricultural land is controlled by just 1% of the population, leading to over 3,200 agrarian conflicts in the last decade and impacting approximately 1.8 million farming households. Only 32% of farmers have access to capital, despite being certified landowners, highlighting a stark inequality in land ownership and farmer’s sovereignty compared to modern and institutionalised agricultural system in France. This research explores how France agricultural models can inspire improvements in agrarian governance in Indonesia by analysing the paradigm of agricultural justice through the lens of economic law. This study employs comparative legal methods to examine and differentiate the regulatory frameworks and institutional mechanisms governing land distribution, market control, and peasant protection in both countries. This study finds that, France actively intervenes in its agricultural sector through SAFER, which regulates land transactions, provides CAP, and allocates 50% of SAFER to smallholder farmers, ensuring fair access and preventing corporate dominance. In contrast, 60% of Indonesian agricultural land is controlled by large corporations, with 6 million hectares in dispute. Agrarian reform is hampered by bureaucracy, overlapping regulations, and corruption. KUR programs and fertilizer subsidies often fail to reach intended target. This study recommends adopting the French model to strengthen institutions, transparency, smallholder support, and oversee monopolies.

Abstract

ABSTRAK Artikel ini mengkaji secara kritis kedudukan hukum masyarakat adat dalam sengketa tata usaha negara terkait izin lingkungan serta menilai peran dan batasan Peradilan Tata Usaha Negara (PTUN) dalam menjamin keadilan ekologis bagi komunitas adat. Dalam berbagai kasus, masyarakat adat menghadapi hambatan struktural dalam memperoleh perlindungan hukum yang memadai, antara lain akibat tidak diakuinya legal standing kolektif, minimnya pengakuan formal wilayah adat, serta pendekatan prosedural dalam pembuktian yang tidak selaras dengan karakteristik komunitas lokal. PTUN, yang secara normatif hanya memeriksa aspek administratif keputusan, belum sepenuhnya mampu menjangkau dampak substantif atas hak hidup dan kelestarian lingkungan masyarakat adat. Penelitian ini menawarkan strategi keadilan hijau sebagai pendekatan korektif terhadap keterbatasan sistem peradilan tata usaha negara, dengan merekomendasikan reformasi hukum acara PTUN, integrasi prinsip Free, Prior and Informed Consent (FPIC), penguatan peran hakim dalam interpretasi progresif, serta perluasan akses masyarakat adat terhadap bantuan hukum dan bukti partisipatif. Hasil analisis menunjukkan bahwa transformasi regulasi dan kelembagaan sangat diperlukan untuk menjadikan PTUN sebagai forum penyelesaian sengketa yang tidak hanya legalistik, tetapi juga menjamin perlindungan hak-hak kolektif masyarakat adat dalam kerangka pembangunan berkelanjutan. Kata kunci: keadilan hijau; masyarakat adat; izin lingkungan; peradilan tata usaha negara; FPIC.   Abstract This article critically examines the legal standing of Indigenous peoples in administrative court disputes related to environmental permits. It assesses the role and limitations of the Administrative Court (PTUN) in safeguarding ecological justice for Indigenous communities. In various cases, Indigenous peoples face structural barriers in obtaining adequate legal protection, including the non-recognition of their collective legal standing, lack of formal recognition of customary territories, and procedural approaches to evidence that are incompatible with the sociocultural characteristics of Indigenous groups. The PTUN, which normatively focuses on the procedural legality of administrative decisions, has not yet fully accommodated the substantive impacts of environmental decisions on Indigenous rights and livelihoods. This study proposes a green justice strategy as a corrective approach to the limitations of the administrative judicial system, recommending reform of the PTUN procedural law, integration of the Free, Prior and Informed Consent (FPIC) principle, strengthened progressive interpretation by judges, and expanded access for Indigenous communities to legal aid and participatory evidence mechanisms. The analysis indicates that regulatory and institutional transformation is essential to reposition the PTUN as a dispute resolution forum that transcends legal formalism and ensures the protection of collective Indigenous rights within the framework of sustainable development.   Keywords: green justice; indigenous peoples; environmental permits; administrative court; FPIC.

Abstract

The establishment of regional regulations on people's market management aims to create a well-functioning market environment, provide benefits to traders, consumers, and the wider community, and support the overall economic growth of the region. With good regulation, it is hoped that the people's market can become a competitive economic center, while ensuring welfare for all parties involved. The method used in this study is empirical juridical where this method applies legal knowledge theoretically and applies it in real situations or contexts, for testing, evaluation, and refinement of the legal system. The results showed that of the 21 people's markets in Pinrang Regency, there were only 3 people's markets that almost met the standardization of people's market facilities and infrastructure, namely Pinrang Main Market, Kariango Market, and Pekkabata Market. While the other 18 markets do not meet the standards of people's market management. Therefore, this study provides academic analysis in reformulating academic manuscripts  in the formation of regional regulations on the management of people's markets in Pinrang Regency as a form of legal certainty and justice in terms of theoretical, sociological, and juridical aspects.
