Abstract

Public service is essentially part of the government's role in serving and fulfilling the interests of society. However, in practice, the implementation of public services has not been able to meet public expectations or public service standards stipulated in Law No. 25 of 2009, especially the implementation of public services by the Prosecutor's Office. The method used is socio-legal using a sample, namely the Prosecutor's Office in South Sulawesi. The problems that are present in three fundamental aspects that determine the quality of public services in the Prosecutor's Office starting from the pattern of public service delivery, the quality of human resources, and institutions indicate the need for improvements to excellent public services to realize good governance in Indonesia. Therefore, the conclusion that can be drawn is the implementation of the principles of sipakatau, sipakainge, and sipakalebbi in public services in the Prosecutor's Office is a solution to excellent public services.

Abstract

Artikel ini membahas kekuatan supremasi konstitusi dalam pembentukan hukum, dan merefleksikan persimpangan antar peraturan dari para pembentuk peraturan dalam menghasilkan produk hukum di Indonesia. Adapun perumusan masalah dalam artikel ini menguraikan rumusan masalah Pertama, bagaimana persimpangan antara supremasi konstitusi dengan sistem pembentukan hukum di Indonesia? Kedua, bagaimana refleksi kritis terhadap produk hukum yang sering kali misinterpretasi?. Metode analisis yang digunakan oleh penulis naskah Metode penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis normatif. Dengan pendekatan perundang-undangan, konseptual, kasus, dan lainnya. Teknik pengumpulan bahan hukum primer, sekunder dan tersier. Analisis yang digunakan adalah secara deskriptif. Adapun pendekatan dalam penelitian ini menggunakan metode pendekatan perundang-undangan (statue approach) dan pendekatan perbandingan (comparative approach) pembentukan hukum yang dibahas dalam teori Gustav Redbruch terkait ambiguitas perundang-undangan. Kesimpulan dari artikel ini, dalam pembentukan peraturan hukum, proses penerapan nilai-nilai yang terkandung dalam filsafat hukum ke dalam norma hukum tergantung pada derajat pengakuan dan penilaian terhadap nilai-nilai tersebut oleh pembentuk peraturan hukum tersebut. Kegagalan dalam mengenali nilai-nilai tersebut dapat menimbulkan kesenjangan antara cita-cita hukum dengan norma-norma hukum yang diciptakan. Oleh karena itu, di Indonesia yang mempunyai cita hukum Pancasila dan norma dasar nasional, maka peraturan yang dikeluarkan hendaknya membentuk dan dibentuk oleh nilai-nilai yang terkandung dalam cita hukum tersebut.

Abstract

The phenomenon of Deputy Ministers holding concurrent positions as commissioners or supervisory board members in State-Owned Enterprises (SOEs) reveals a serious problem in Indonesian constitutional practice, namely the lack of synchronization between legal norms and political behavior. Various laws and regulations, such as Law No. 39 of 2008 on State Ministries, Law No. 25 of 2009 on Public Services, and Law No. 19 of 2003 on SOEs, explicitly and imperatively prohibit public officials, including Deputy Ministers, from holding positions that have the potential to cause conflicts of interest. This provision is reinforced by Constitutional Court Decisions No. 79/PUU-IX/2011 and No. 80/PUU-XVII/2019, which confirm that Deputy Ministers are part of the government cabinet and are therefore subject to the same restrictions on concurrent positions as Ministers. This study uses a normative juridical approach with legislative, conceptual, and case analysis to examine the clarity of the norm prohibiting concurrent positions and the direction of legal reform needed. The results of the study confirm that the prohibition on holding multiple positions is binding and must be enforced in accordance with the mandate of the law and the decision of the Constitutional Court. In addition, there is a tendency for a constitutional crisis to occur in the government. Therefore, regulatory reforms are needed to reinforce this prohibition at the legislative level and limit the executive's authority in determining public positions. Abstract

Background: The Free Nutritious Meal Program (MBG) in Pinrang Regency requires an analysis of its implementation and legal regulations from a Siyasah Syar'iyyah perspective. Aims: This study aims to determine the implementation of the MBG Program and its implementing legal regulations in Pinrang Regency through Siyasah Syar'iyyah analysis. Method: The type of research is qualitative field research. Data was obtained from primary and secondary sources, through observation, interviews, and documentation. Data analysis techniques include data reduction, data presentation, and drawing conclusions. Result: The implementation of the MBG Program in Pinrang proceeded through planning, implementation, and monitoring stages. Its implementation received high participation from the school and parents. The involvement of local MSMEs has also been proven to help the local economy. The legal basis for this program refers to Law No. 18/2012 (Food), Law No. 17/2023 (Health), and Presidential Regulations No. 83/2017 & 2024. Conclusion: The MBG program is a form of public welfare (maslahah 'ammah) that is valid according to sharia. This policy aligns with the maqasid sharia principle of preserving the soul (hifz al-nafs) and the mind (hifz al-'aql), with the goal of improving health, reducing stunting, and improving the quality of human resources for the younger generation

Abstract

This study is motivated by the lack of clarity in administrative regulations regarding divorce procedures for Government Employees with Work Agreements (PPPK), as existing regulations are more focused on Civil Servants (PNS), resulting in normative and practical ambiguities. This study aims to analyze the effectiveness of divorce procedures for PPPK in Parepare City by assessing the conformity between regulations and administrative practices implemented by the regional Personel and Human Resource Development Agency (BKPSDMD). This research is a qualitative study with a normative-empirical approach. Data were obtained from primary sources through interviews and observations, as well as secondary sources in the form of laws and regulations and related documents. Data collection techniques were carried out through observation, interviews, and documentation, then analyzed qualitatively. The results show that the divorce procedures for PPPK have been implemented through administrative mechanisms with the role of BKPSDMD as the institution providing recommendations for divorce permits. The process generally takes about one month, although there are still obstacles in the form of administrative completeness and mediation processes. Thus, the effectiveness of PPPK divorce procedures is not only determined by administrative aspects, but also by legal certainty and the value of public benefit from the perspective of siyasah idariyah.

Abstract

Child marriage remains prevalent in Indonesia despite the enactment of legal restrictions through Law No. 16 of 2019, with Majene Regency in West Sulawesi recording high case numbers driven by cultural, economic, and educational factors. This study aims to analyze the impact of the policy on the long-term psychological trauma of young people in Majene, focusing on mental rehabilitation and the formulation of local policy recommendations for victim recovery. A qualitative case study approach was employed, involving 25 participants aged 18–25 with a history of early marriage (70% female), selected using purposive and snowball sampling techniques. Data were collected through semi-structured interviews, community observations, and documentation, supported by the Trauma Symptom Checklist and descriptive statistical analysis using SPSS. Data were analyzed thematically following the Braun and Clarke approach. The findings reveal that although the policy reduced the number of cases from 193 in 2023 to 20 in 2025, the post-policy trauma rate increased, with 60% of participants exhibiting an average PTSD score of 2.8. Manifestations of trauma included chronic depression (72%), domestic violence (12 cases), suicidal ideation (10 cases), and a 1.98-fold higher risk of child stunting. Access to rehabilitation services remained low (40%), although support from the PKK (Family Welfare Movement) was found to reduce trauma intensity. These findings underscore the urgency of implementing culturally grounded trauma-informed care based on Mandar traditions and integrating holistic policies that combine peer counseling and economic support to break the cycle of intergenerational trauma and strengthen victim recovery at the local level.
