Abstract

Badan Usaha Milik Desa (BUMDes) as an instrument to drive the village-based economy has shown a significant role in achieving SDGs targets, which amounted to 74 percent before the Covid-19 pandemic hit the world. However, the situation changed during the Covid-19 pandemic, where the focus of the program was on the health and economic recovery process affected by the pandemic. This research was conducted with a descriptive-prescriptive approach that aims to get suggestions on what should be done to overcome the problems faced by BUMDes in the Covid-19 pandemic situation. From the results of this study, it is concluded that in the context of national economic recovery after the Covid-19 pandemic, the participation of all policy makers is needed to formulate the various needs needed to restore the economy at the village level which is also affected by the pandemic. The momentum of the Covid-19 pandemic can be used by the government to ensure the formation of BUMDes in villages while still paying attention to the potential and needs of the village, as well as optimizing the role and operations of BUMDes that have been formed.

Abstract

This study aims to analyze the regulation of registration requirements as a seller in the Marketplace owned by the Regional Government in terms of the concept of MSE empowerment in Government Regulation Number 29 of 2021 concerning the Implementation of the Trade Sector and the regulation of commission fees in the Marketplace owned by the Regional Government in terms of the concept of MSE empowerment in Law Number 20 of 2008 concerning Micro, Small and Medium Enterprises (UMKM Law). The research method used in this research is normative legal research using a statutory approach. Based on the results of the research, two things can be concluded. First, Marketplace Si Bakul is in line with the concept of MSE Empowerment in Government Regulation Number 29 of 2021 concerning the Implementation of the Trade Sector, especially in Article 58. Second, the commission fee at Marketplace Si Bakul is different from the concept of MSE empowerment, as stated in Article 9 Letter B of the UMKM Law.

Abstract

Micro, Small and Medium Enterprises (MSMEs) play a significant role in the economy, but often face obstacles in accessing financing. Credit performance guarantee is one of the mechanisms to mitigate risks for financial institutions. Along with the development of financial technology, innovative credit scoring emerged as an alternative method of assessing the creditworthiness of MSMEs. This research aims to analyze the legal effectiveness of the application of MSME credit performance guarantees based on innovative credit scoring. This research uses a normative juridical method with qualitative juridical analysis to try to examine and analyze the problems studied. The application of innovative credit scoring in MSME credit performance guarantees has the potential to increase the legal effectiveness of guarantees through a more comprehensive and accurate risk assessment. However, its implementation requires regulatory clarity regarding scoring standards, personal data protection, and dispute resolution mechanisms. An adaptive and responsive legal framework to technological innovation is crucial to optimize the role of innovative credit scoring in strengthening the effectiveness of MSME credit performance guarantees and promoting financial inclusion.

Abstract

The existence of marketplaces helps MSMEs expand their business reach and facilitates their transformation into digital MSMEs. However, issues have emerged concerning private marketplace platforms in Indonesia, particularly related to the increasing commission fees and direct-to-consumer sales by producers that bypass traditional distribution channels, disadvantaging smaller businesses. This raises the question of how local governments, as part of the welfare state, can establish and regulate marketplaces to empower MSMEs. The research method used is normative legal research with a statutory approach. The results of the study show that in accordance with the welfare state principle, the government bears responsibility for the economic welfare of its citizens. Local governments play a crucial role in supporting MSMEs by developing regionally owned marketplaces. These platforms implement policies such as differentiated commission rates based on the scale of the business, where smaller enterprises are subject to lower fees, and allow only MSME-scale producers and those selling perishable goods to conduct direct sales. These measures are intended to provide fairer access and greater protection for micro small and medium enterprises within the digital economy.

Abstract

The New The construction of the New Effluent Water Treatment Plant (EWTP) is a National Strategic Project aimed at managing crude oil industrial waste in accordance with prevailing regulations. However, the project failed at 98.84% completion due to a fire at the fuel tank prior to the handover phase. Legal issues subsequently arose, as the contractor neglected to renew the mandatory insurance coverage stipulated in the contract. This study aims to analyze the legal liability of the contractor for the uninsured project failure and to evaluate the legal consequences under Indonesia’s positive law, particularly Law No. 2 of 2017 on Construction Services and Law No. 1 of 2025 on State-Owned Enterprises (BUMN). The research employs a normative juridical approach, and the findings indicate that the contractor may be deemed in breach of contract (wanprestasi) under Article 1239 of the Indonesian Civil Code, leading to legal consequences including compensation for damages, delay penalties, and responsibility for project losses. The absence of insurance coverage invalidates any claim of force majeure and strengthens the contractor’s legal liability based on the pacta sunt servanda principle and risk management obligations within BUMN projects. This research underscores the critical importance of contractual compliance and risk mitigation through insurance protection as integral components in the execution of national infrastructure projects. Proyek pembangunan New Effluent Water Treatment Plant (EWTP) merupakan Proyek Strategis Nasional yang bertujuan mengelola limbah industri minyak mentah sesuai peraturan perundang-undangan. Namun, proyek mengalami kegagalan saat progres mencapai 98,84%, akibat kebakaran Tangki BBM sebelum serah terima. Permasalahan hukum pun muncul karena kontraktor lalai dalam memperpanjang jaminan asuransi yang secara kontraktual diwajibkan. Penelitian ini bertujuan untuk menganalisis bentuk tanggung jawab hukum kontraktor atas kegagalan proyek yang tidak diasuransikan serta mengevaluasi akibat hukumnya berdasarkan hukum positif Indonesia, khususnya UU No. 2 Tahun 2017 tentang Jasa Konstruksi dan UU No. 1 Tahun 2025 tentang BUMN. Metode yang digunakan adalah pendekatan yuridis-normatif dan hasil penelitian menunjukkan bahwa kontraktor dapat dikualifikasikan melakukan wanprestasi berdasarkan Pasal 1239 KUHPerdata, dengan konsekuensi hukum berupa kewajiban mengganti kerugian, membayar denda keterlambatan, serta tanggung jawab atas kerusakan proyek. Ketiadaan asuransi meniadakan pembelaan force majeure dan memperkuat tanggung jawab hukum kontraktor berdasarkan asas pacta sunt servanda serta prinsip pengelolaan risiko dalam proyek BUMN. Penelitian ini menegaskan pentingnya kepatuhan kontraktual dan manajemen risiko melalui perlindungan asuransi sebagai bagian integral dalam pelaksanaan proyek konstruksi nasional.

Abstract

This study aims to describe the penetration of international economic law in the development of the cyber notary concept in Indonesia. The development of the world today, which has entered the Industrial Revolution 4.0, has forced international law to develop the idea of a cyber notary. It needs to be conducted because Indonesia has no legal instrument to regulate cyber notaries. This study adopts legal research conducted to examine the problem in a normative juridical approach where the author examines various laws and regulations because normative juridical conceptualizes law as a written norm and is poured into legislation used as a benchmark for the community. The study results indicate that various legal instruments have been established, such as legal norms regarding Cyber Notaries in Indonesia, which are contained in the Act, in particular a. Law No. 2 of 2014 concerning amendments to Law No. 30 of 2004 concerning the Position of a Notary. Law No. 11 of 2008 concerning Information and Electronic Transactions (UU ITE), Law No. 40 of 2007 concerning Limited Liability Companies.

Abstract

Badan Usaha Milik Desa (BUMDes) merupakan badan hukum yang didirikan oleh Desa. Pendirian oleh Desa sejalan dengan adanya Perseroan Perorangan dalam UU Cipta Kerja yang pendiriannya hanya dilakukan oleh satu orang saja, berkaitan dengan hal tersebut maka BUMDes dapat diklasifikasikan sebagai Perseroan Perorangan. Akan tetapi, banyak BUMDes yang belum melakukan pendaftaran sebagai Perseroan Peroranga, sehingga dipertanyakan status badan hukumnya. Penelitian ini bertujuan untuk mengetahui apakah BUMDes yang telah ditetapkan dengan Peraturan Desa sudah sah status badan hukumnya meskipun belum melakukan pendaftaran sebagai Perseroan Perorangan. Metode penelitian yang digunakan adalah penelitian hukum normatif. Hasil penelitian menunjukan bahwa BUMDes yang telah ditetapkan dengan Peraturan Desa telah sah sebagai badan hukum sehingga tidak perlu melaksanakan pendaftaran sebagai Perseroan Perorangan.

Abstract

The emergence of the Dispute Board in Indonesia through Law Number 2 of 2017 on Construction Services raises several challenges, including the complexity of the dispute resolution process, the unclear legal status of decisions, and the lack of recognition within the existing arbitration legal framework. Using a legal normative approach, this research explores the issue in the dispute resolution mechanism under the Law Number 2 of 2017, analyses the main obstacles, and formulates recommendations for improving the effectiveness of the Dispute Board. This research in particular emphasized the enforceability of the decision of the Construction Dispute Board. The method to this problems was to analyze the provisions under the Law. In addition this article also analyzed the main provision on the settlement of disputes, including the possibility of the legal recognition of the Dispute Construction Board in view of the institutional aspects under the Law No 30 of 1999 on Arbitration and Alternative Dispute Resolution. This article found that the complexity of the dispute resolution process through the Construction Dispute Board, along with the high cost and lack of clarity regarding the enforceability of judgments, creates uncertainty for the parties. This marred the deicison of the Construction Dispute Board.

Abstract

This article analyzes the interplay between Indonesia’s collectivist cultural values and the implementation of Law No. 27 of 2022 on Personal Data Protection (Law No. 27/2022). The Law faces significant challenges in a society where awareness of data privacy remains low. This article utilizes a socio-legal research methodology to explore the cultural factors influencing Indonesian societal attitudes and behaviors towards data privacy. The article begins by outlining the core regulatory framework of Law No. 27/2022, comparing its implementation within individualistic and collectivist contexts. It highlights the inherent tension between the Law’s emphasis on individual data rights and Indonesia’s deeply ingrained collectivist values, which prioritize communal harmony and open information sharing. This cultural tendency often overshadows concerns about potential security risks, hindering the Law’s effective implementation. To bridge this gap, the article proposes a “hybrid” approach that integrates international data protection standards with culturally relevant strategies. This includes emphasizing the collective benefits of data protection, framing it as a shared responsibility to protect the community’s well-being. Furthermore, the article stresses the importance of public education campaigns tailored to resonate with Indonesian cultural values. By empowering individuals with knowledge and legal awareness, the article argues that Indonesia can foster a more balanced approach to data protection that respects both individual rights and collective harmony.

Abstract

Civil servants (ASN) entering retirement represent a strategic human resource asset for national development; however, their potential is often underutilized due to an institutional vacuum. This study identifies this fundamental problem as manifesting in two dimensions: the absence of a cohesive structure among the retired community and the lack of a structure that systematically connects them to the economic empowerment ecosystem. Consequently, the transition from active service to a productive retirement period presents a significant challenge. The purpose of this research is to design an effective institutional forum model to serve as a facilitative bridge. The analysis employs a framework integrating three pillars: Mochtar Kusumaatmadja's Development Law Theory as the philosophical foundation, Ansell and Gash's Collaborative Governance concept as the governance paradigm, and the Pentahelix model as the operational framework. This study proposes a multi-stakeholder collaborative forum designed to synergize the roles of government, industry, academia, communities, and the media. The primary recommendation is the establishment of a formal entity functioning as an incubator and accelerator. This entity is intended not only to address the economic needs of retirees but also to align with the country's constitutional mandate to achieve sustainable social welfare.
