Abstract

Peminangan (khitbah) dan kafa’ah merupakan dua konsep penting dalam tahap pra-nikah yang berfungsi sebagai fondasi keutuhan rumah tangga dalam Islam. Penelitian ini bertujuan untuk menganalisis praktik peminangan dan pemaknaan kafa’ah dalam adat Melayu melalui perspektif Maqāṣid al-Syarī‘ah. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian yuridis-sosiologis. Data diperoleh melalui studi lapangan terkait praktik peminangan (merisik) dalam masyarakat adat Melayu serta studi kepustakaan terhadap literatur fikih dan maqāṣid. Hasil penelitian menunjukkan bahwa peminangan dalam adat Melayu berfungsi sebagai mekanisme preventif yang menilai kesiapan moral, sosial, dan psikologis calon pasangan. Konsep kafa’ah dipahami secara fungsional sebagai kesepadanan nilai, akhlak, dan tanggung jawab, bukan sebagai instrumen eksklusivitas sosial. Dalam perspektif Maqāṣid al-Syarī‘ah, praktik tersebut sejalan dengan tujuan menjaga agama, jiwa, kehormatan, dan keturunan. Penelitian ini menegaskan bahwa integrasi hukum Islam dan adat Melayu melalui pendekatan maqāṣid mampu memperkuat keutuhan rumah tangga serta menunjukkan relevansi kearifan lokal dalam pengembangan hukum keluarga Islam yang kontekstual dan berorientasi pada kemaslahatan.

Abstract

This article examines the legal status of children born outside of marriage as a significant issue within the Indonesian legal system, particularly after the Constitutional Court Decision Number 46/PUU-VIII/2010. Prior to this decision, a child born outside of marriage was legally recognized as having a civil relationship only with the mother and her family, as stipulated in Article 43 paragraph (1) of the Marriage Law. The Constitutional Court’s ruling introduced a fundamental shift by allowing the possibility of establishing a civil relationship with the biological father, provided that scientific evidence—such as DNA testing—can prove a biological link. This development creates new dynamics in the protection of children's rights, especially regarding legal status, maintenance, and inheritance rights. This study aims to comprehensively analyze the position of children born outside of marriage after the Constitutional Court’s decision, viewed from both national law and Islamic law perspectives.

Abstract

In practice, anglers are required to purchase one kilogram of fish before starting fishing, then the fish are released into a pond shared with other anglers. This provision creates the potential for uncertainty (gharar), especially because the catch is not always comparable to the fish that have been purchased, or even nothing at all. This practice is highlighted from the perspective of Fiqh Muamalah because it concerns the validity of the contract and the element of justice in the transaction. The aim of this study is to determine the management practices of the Ocu Kampar fishing pond and to analyze the Fiqh Muamalah perspective on these practices. This study is a descriptive qualitative study, with data collection methods in the form of observation, interviews with 10 informants (owners and visitors of the pond), and documentation. The results of the study indicate that the implemented system contains elements of gharar because there is uncertainty between the price paid and the benefit (fish obtained). According to Islamic jurisprudence (Fiqh Muamalah), a sale and purchase must be based on the clarity of the object of the contract, the willingness of both parties, and be free from uncertainty and speculation. Therefore, the practice of managing the fishing pond does not align with Islamic muamalah principles, and the system needs to be improved to comply with sharia, such as clearly separating the sale and purchase contracts from the lease and eliminating the element of uncertainty regarding the number of fish.

Abstract

The jurists set several conditions for those entitled to custody of children, one of which is being Muslim. Riddah (leaving Islam) is normatively seen as an obstacle to ḥaḍānah because it is feared that it can affect the child's faith and religious education. This article aims to determine the Maqasid Syariah review of the Judge's rejection of the right of Hadanah for apostate mothers as stated in the Religious Court Decision Number PA Jakarta Timur No.1700/Pdt.G/2010/PAJT. This type of research is Normative research with a Statutory approach. Primary data are the East Jakarta Religious Court Decision Number 1700/Pdt.G/2010/PAJT, as well as laws and Islamic legal provisions related to Hadanah and Riddah, while secondary legal materials are obtained from fiqh literature, books, scientific journals, and relevant scientific works. The data collection technique is documentation, and the analysis is qualitative. The results of this article show that case No. /Pdt. G/2010/2010 / PAJT did not grant Hadanah rights to apostate mothers. In this decision, the judge understood Riddah as an obstacle to Hadanah as a consideration in the Hadanah decision. As discussed in the book Kifayatul Akhyar, as a basis for understanding fiqh, it is a requirement that parents who have the obligation to educate and raise children be Muslim, so that the judge's decision rejects the plaintiff's or appellant's petition if the plaintiff or appellant is an apostate. The Panel of Judges has prioritized hifz al-ddin (dhoruriyat) and hifdz an-nafs (care for the soul) to consider the benefit and best interests of the child

Abstract

This study explores the relationship between Islam and modernity by tracing the dynamics of tradition and innovation emerging in various aspects of social, cultural, and intellectual life. In an era of rapid globalization, Muslims face the challenge of maintaining their traditional values ​​while responding to changes involving technology, politics, and economics. The findings indicate efforts to reinterpret religious texts, establish new institutions, and adopt modern technologies that remain in line with Islamic values. This article emphasizes the importance of an adaptive and inclusive approach to bridging tradition and innovation, so that Muslim communities can contribute to the formation of a more harmonious global order without losing their religious identity. In this context, Islamic inheritance law also serves as an important arena for re-reading and adaptation amidst modern social dynamics. From a sociological perspective, inheritance law is understood not only as a normative rule governing the distribution of inherited property but also as a reflection of the social structure, gender relations, and distribution of economic power in Muslim societies. Transformations in family patterns, the increasing participation of women in the public sphere, and changes in the economic system have given rise to demands for a reexamination of inheritance practices to ensure they remain in line with the principles of social justice without abandoning their sharia foundations.

Abstract

The concepts of nusyuz (disobedience of husband or wife) and syiqaq (escalating disputes) are fundamental frameworks in the jurisprudence of munakahat for analyzing and resolving domestic conflicts. However, existing literature tends to focus on the conventional manifestations of these two concepts. This study aims to reconceptualize nusyuz and syiqaq in the context of the digital era, which has given rise to new forms of problematic issues. Using conceptual analysis methods based on primary sources of Islamic law and contemporary social theories, this article identifies and categorizes forms of "Digital Nusyuz," such as financial nusyuz through non-transparent online transactions, emotional nusyuz through social media interactions, and digital privacy violations as triggers of conflict. Furthermore, this article analyzes how the escalation of digital nusyuz can lead to more complex syiqaq. As a solution, a resolution model is proposed that integrates the role of traditional hakam (peacemakers) with digital literacy and online conflict mediation. The results of this study offer a new framework for legal practitioners, marriage counselors, and judges in Religious Courts to understand and resolve household problems rooted in interactions in the digital world, a contribution that is expected to fill the gap in contemporary Islamic family law studies.

Abstract

This study examines the reconstruction of the marriage agreement concept within Islamic family law by integrating classical–contemporary fiqh perspectives, the framework of maqāṣid al-sharī‘ah, and Indonesian positive law. Although marriage agreements have been widely discussed, previous studies tend to be fragmented and rarely combine these three analytical dimensions. Using a normative legal research method supported by conceptual, historical, and statutory approaches, this research finds that marriage agreements possess strong legitimacy within the Islamic legal tradition, grounded in the principles of al-maslahah, contractual stipulations (al-syurūṭ fī al-‘uqūd), and the inherent flexibility of mu‘āmalah. The maqāṣid al-sharī‘ah approach reveals that marriage agreements significantly contribute to the preservation of the five essential objectives of Islamic law: ḥifẓ al-māl, ḥifẓ al-nasl, ḥifẓ al-nafs, ḥifẓ al-‘aql, and ḥifẓ al-dīn. In the context of Indonesian positive law, Constitutional Court Decision No. 69/PUU-XIII/2015 expands the legal framework by allowing marriage agreements to be made after the marriage ceremony, reflecting a more progressive and responsive legal paradigm. This study concludes that an integrative reconstruction of marriage agreements can enhance stability, justice, and protection within Muslim families in Indonesia, and offers a substantial contribution to the development of family law reforms aligned with contemporary social dynamics
