Abstract

The curriculum is a government  policy in the field of education determined by the government. The curriculum has continued to change according to the times and advances in science and technology. This study uses a qualitative method by producing descriptive data as an observable social reality, namely the educational curriculum. The social reality is then analyzed using public policy theory. This article concludes that the curriculum as a political policy from the Indonesian government in the field of education is a logical consequence of social change and development of science. From 1999 to 2013 there were three changes to the curriculum, namely the Competency-Based Curriculum (KBK), the Education Unit Level Curriculum (KTSP) and the 2013 Curriculum (K-13). Each curriculum has its own focus and emphasis point. The purpose of the curriculum changes carried out by the government from a theoretical point of view of public policy is oriented towards fulfilling the needs and interests of the community. So that the curriculum can still be adapted to social changes, scientific and technological developments that occur in society in Indonesia and the wider world

Abstract

Thearticle discusses the dialectics in the relationship between religion and state in its correlation with the ideals of law in Indonesia, which is focused on the variants and principles of religion in the state. There are three variants regarding the relationship between religion and state namely, integralistic, secularistic and symbiotic. Indonesia as a state based on Pancasila which upholds religious values can be included in symbiotic variants. Religious principles in symbiotic variants can be implemented because they do not conflict with Pancasila and the 1945 Constitution of Republic of Indonesia. Between Islam and the ideals of law, in this case Pancasila, is not a contradictory entity but two elements that are in line. These principles are power as trust, deliberation, justice, equality, protection of human rights and independent justice; be valid proof so that the state can be said to be a nation that upholds human dignity and benefits. As a symbiotic state, Islamic law has room in the state, namely as one source of national law. The implication of this study is that between the state and religion there is no conflict, religion is not alpha in providing interpretations about the state. Therefore, between religion and state is not a new thing because the ideals of law and religious values have the same hope that is to achieve mutual benefit.Keywords: Religion; State; Principle, Ideals of Law.

Abstract

Kajian ini membahas tentang tujuan hukum Islam adalah untuk kemaslahatan manusia khususnya penerapan kaidah fiqhiyah dalam bidang ekonomi dan hukum keluarga. Metodologi Hukum Islam atau ushul fiqh dikenal qawaid fiqhiyah sebagai alat untuk untuk mempermudah proses istinbath dan metode ijtihad dalam menentukan suatu hukum. Kajian ini merupakan studi hukum Islam secara teoritis atau normatif, dengan menggunakan teori hukum Islam. Penelitian ini menyimpulkan bahwa tujuan hukum Islam yang paling utama adalah untuk kemaslahatan manusia di dunia dan akhirat yang dikenal dengan istilah maqashid al-syariah. Kemudian kaidah fiqhiyah dalam bidang ekonomi (mudharabah dan musyarakah) digunakan misalnya; “Pada dasarnya semua muamalah boleh dilakukan, terkecuali ada dalil yang mengharamkannya.” Kaidah ini bermakna kebolehan dalam muamalah itu selama belum ada dalil yang jelas melarang dan mengharamkannya, itulah prinsip dasar dalam menentukan hukum-hukum yang berkenaan dengan muamalah. Qawaid fiqhiyah dalam hubungannya dengan hukum keluarga Islam dikenal ada kaidah al-adat al-muhakkamah (adat dapat dijadikan sebagai hukum) diimplementasikan dalam hal pembagian harta bersama. Demikian juga kaidah fiqhiyah yang digunakan dalam putusan hakim Pengadilan Agama pada kasus perceraian antara suami dan isteri yang tidak mungkin lagi mempertahankan perkawinannya. Hal ini berpegang pada kaidah fiqhiyah:  ”Apabila ada dua hal yang sama-sama mengandung mudlarat, maka harus dipilih satu diantaranya yang lebih kecil mudlaratnya.” Kaidah-kaidah ini menunjukkan keluasan dan keluwesan hukum Islam yang akan mewujudkan kemaslahatan manusia sebagai tujuan utama hukum Islam

Abstract

Islamic law and Indonesian legislation basically emphasize that marriage can only have one partner. In the Shafi'i school, Ash-Sharbini al-Khatib says, "A man, circumcision does not marry more than one wife without clear hajat. An-nash has pointed out that the principle of marriage is monogamy, not polygamy. The wife or a woman cannot marry more than one husband at the same time (polyandry) because of the impact caused. Polyandry is clearly forbidden as has been said by Allah Almighty. in QS. An-Nisa verse 24. In decision No. 383/Pdt.G/2020/MS. The bna polyandry is one of the reasons for divorce with the dropping of talaq one raj'i. The question in this thesis is how the right of talaq possessed by a husband how to analyze the Decision of the Judge of the Shar'iyah Court of Banda Aceh, and why the case of polyandry as a background for the breakup of marriage is broken with talaq raj'i. In this study, the author uses library research methods to analyze the judge's consideration and the Shafi'i school in terms of holding talaq rights on the grounds that they are caused by polyandry. There are several factors that make the existing legal provisions and procedures different, in the Shafi'i school in terms of privacy such as talaq is very guarded because it is considered bad if there are parties outside who know the domestic affairs, in contrast to the judge's consideration, the procedures of the Shar'iyah Court, the benefit of divorce is regulated to reduce illegal divorces that are not in accordance with the existing Shari'a. Therefore, it can be concluded that the difference that we can see between the judge's consideration and the Shafi'i school is the freedom of the husband to impose talaq anywhere and anytime, and the determination of the amount of talaq based on the husband's own intentions.

Abstract

Islam entered the archipelago peacefully brought by Sufi scholars and is influential to this day. Sufism is a dimension of Islamic teachings that is able to answer the problems of society from the past to the present. Sufi scholars also fought against colonialism supported by Sufi brotherhood or tariqa in which there was a concept of obedience to the teacher. The reformulation of classical Sufism which is individual, personal, is important enough to become a communal collective. This article is a qualitative study analyzed using the perspective of sociology of religion. Today, Sufism remains important in various aspects of education, social movements, and moral improvement. If using the perspective of sociology of religion, Sufism is able to provide spirit and strength to humans so that Sufism values transform for the better. The values of Sufism in question are for example, qana'ah, patience, gratitude which provide solutions to the problems of human life. Not only limited to educational, social and moral improvement aspects but more than that.Islam masuk ke Nusantara secara damai dibawa oleh para ulama sufi dan berpengaruh sampai saat ini. Tasawuf merupakan dimensi ajaran Islam yang mampu menjawab problematika masyarakat sejak pada masa lalu sampai sekarang. Ulama sufi juga melakukan perlawanan terhadap kolonialisme yang didukung oleh persaudaraan sufi atau tarekat yang di dalamnya terdapat konsep ketaatan pada guru. Reformulasi tasawuf klasik yang bersifat individual personal cukup penting menjadi kolektif komunal.Artikel ini merupakan studi kualitatif yang dianalisis dengan menggunakan perspektif sosiologi agama. Saat ini kemudian bangsa Indonesia semakin maju sufisme tetap menjadi sesuatu yang urgen dalam berbagai aspek pendidikan, gerakan sosial, dan perbaikan akhlak. Jika menggunakan perspektif sosiologi agama, bahwa tasawuf mampu memberikan spirit dan kekuatan pada manusia sehingga nilai-nilai tasawuf bertransformasi ke arah yang lebih baik. Nilai-nilai tasawuf yang dimaksud misalnya, qanaah, sabar, syukur yang memberikan solusi problematika kehidupan manusia. Tidak hanya sebatas aspek pendidikan, social dan perbaikan akhlak akan tetapi lebih dari itu.

Abstract

Indonesia recognizes several legal systems i.e., state law, customary law, Islamic law, and international law. Islamic sharia in Aceh is part of legal pluralism in Indonesia. This study aims to discuss the application of Islamic sharia from the perspective of legal pluralism. This normative legal study employed a legal pluralism theory analysis. Legal pluralism is a theory that views law not only as positive or written law made by the state but also as a recognition of the legal reality that exists in a pluralistic society. The study collected data by means of a literature review. Findings revealed that Islamic sharia in Aceh as part of the recognition of the concept of legal pluralism has been implemented well in the context of state law, custom, and Islamic law. The state has provided juridical legitimacy through laws in the context of legal substance and judicial institutions or sharia courts. Likewise, revitalization has also occurred in traditional institutions in terms of customary law and customary justice. The argument emphasized in this study is that Islamic sharia in the context of legal pluralism has succeeded in manifesting legal harmonization between the state, custom, and Islamic law

Abstract

Islam and tradition in Aceh Community likes substance and attribut that cannot be separated each other. Religion and culture has been integrated in way of life, system social, culture and Islamic values. In cultural perspective, tradition of maulod has become deeping ritual of religion that integrated by values of religion and tradition that connected each other. This study used sociological and religion anthropology approach by using data collection such as observation, interview and library research. The result of this study describe that in maulud tradition in Aceh, there are integrated between religion and culture. Islam influence culture deeply in the same manner as almost whole social life aspects of Aceh community. These are can be found in process of  uroe maulod (the day of maulod), idang meulapeh (beverage of maulod), dzikee maulod (repeatedly chant part of the confession of islamic faith) and Islamic missionary. Indeed, maulod celebration is done not only in a month but also in three months namely; Rabi’ul Awwal (mulod awai/the first maulod), Rabi’ul Akhir (maulod teungoh/ the middle maulod) dan pada bulan Jumadil Awwal (maulod ache/the last maulod). Islam dan adat dalam masyarakat Aceh bagaikan zat dan sifat yang tidak dapat dipisahkan satu sama lain. Agama dan budaya terintegrasi dalam pandangan hidup, sistem sosial, budaya, dan nilai-nilai Islam. Dari konteks budaya, tradisi maulud menjadi praktek keagamaan yang kental dengan integrasi nilai-nilai agama dan adat yang saling berkelit kelindang. Kajian ini menggunakan pendekatan sosiologi dan antropologi agama dengan teknik pengumpulan data melalui observasi, wawancara dan  studi kepustakaan.  Hasil penelitian ini menunjukkan bahwa dalam tradisi maulod di Aceh terjadi integrasi antara agama dan budaya. Islam mewarnai budaya secara begitu kental, sebagaimana juga ditemukan dalam hampir seluruh aspek kehidupan bagi masyarakat Aceh. Hal ini dapat dilihat dalam proses uroe maulod, idang meulapeh, dzikee maulod, dakwah Islamiyah. Bahkan perayaan maulod tidak hanya sebatas satu bulan saja, namun dilaksanakan dalam tiga bulan yaitu, Rabi’ul Awwal (mulod awai), Rabi’ul Akhir (mulod teungoh) dan pada bulan Jumadil Awwal (mulod akhe).

Abstract

In Acehnese communities, particularly in Bayu Village, illegal marriages conducted by unofficial qadi have been identified. These marriages are often carried out in secrecy, making it difficult to verify whether they meet the pillars and conditions of marriage according to Islamic law. The study aimed to examine the practice of illegal marriages conducted by the community of Bayu Village, Nanggroe Aceh Darussalam Province, from the perspective of Islamic family law. The research employed an empirical legal research method using a qualitative descriptive approach. The findings found out several cases of illegal marriages performed by unofficial qadi in Bayu Village. Couples intending to marry are required to fulfill specific conditions set by the qadi, including providing identity cards (KTP) of the prospective spouses, passport-sized photographs of the couple, witnesses, a dowry (mahr), and a guardian (wali) from the bride’s side. The prevalence of illegal marriages is from the community's limited understanding of the importance of marriage registration. From the perspective of Islamic family law, marriages conducted with unofficial qadi in Bayu Village constitute a deviation from religious principles, a violation of government regulations, and have negative implications for the community.

Abstract

This study aims to discuss the Mappammaq Mangaji tradition in Mandar, West Sulawesi in relation to al-Quran-based child rearing patterns from an Islamic legal anthropological perspective. Mappatammaq mangaji is a tradition carried out by the community when someone is able to read the Koran fluently. This study is an empirical legal study with an anthropological approach to Islamic law as an analytical tool. Data was collected based on in-depth interviews and literature studies. This study concludes that the mappatamaq mangaji tradition carried out by the Mandar community in West Sulawesi is an acculturation of Islamic teachings and cultural values. Mappatammaq mangaji, including sayyeang pattuqduq (dancing horse), kalindaqdaq(Mandar poetry) and mabbaranji. When viewed from a legal anthropology perspective, the mappammaq mangaji tradition in Mandar society is an integration and acculturation between Islamic law and local traditions. This local tradition has become a living law and continues to be practiced in the culture of the Mandar people. So it can be said that if Islamic law is practiced in society and has become a culture, it will continue to survive today and in the future, because Islamic law has a cultural space. If it is related to the objectives of Islamic law, especially benefit, then this provides benefits, especially in the context of child rearing patterns based on the Qur’an, so that children receive care and education from parents and families based on the values of the Qur’an.
