Abstract

Community empowerment institutions are one form of village institutions in realizing community welfare. The welfare of people's lives must be realized by creating an equal distribution of rights and obligations of the surrounding community. The government in its efforts to realize it is ready with various program arrangements to support this. This research is focused on knowing the existence of Community Empowerment Institutions (LPM), as well as obstacles and efforts in realizing village development carried out by Community Empowerment Institutions (LPM) in Datah Village, Abang District, Karangasem Regency. The method used is an empirical legal approach by seeking information and data directly in the field. Research findings reveal that the existence of LPM in Datah village in village development still needs to be improved. The village government must try to find the obstacles or inhibiting factors that occur, as well as the efforts made so that the LPM program can be said to be effective in the context of village development that aims to prosper the community. Based on the results of the study, it can be concluded that the existence of LPM in Datah village has not had a significant impact and is fully felt by the community. The government needs to increase the empowerment of this institution so that it has a good influence on the progress of the local community.

Abstract

Currently, there is a rampant circulation of Balinese fermented drinks that do not have distribution permits. The Government of Indonesia has regulated regulations related to the circulation of fermented beverages that do not have a distribution permit in Presidential Regulation No. 74 of 2013 and Bali Provincial Governor Regulation No. 1 of 2020. Therefore, the purpose of this reserach is to examine the legal arrangements regarding the production of Balinese fermented drinks and to analyze law enforcement against Balinese fermented beverage business actors without a distribution permit. This reserach uses a normative legal research type, using a statutory approach and a conceptual approach. The sources of legal materials for this research are: primary, secondary and tertiary sources of legal materials. This research data collection technique is a literature reserach technique, namely by reviewing legal materials that intersect and then being categorized or classified and archived, written, quoted, summarized, investigated as needed with a qualitative approach. The researcher found that Legal arrangements regarding the production of Balinese fermented beverages are regulated in Bali Provincial Governor Regulation No. 1 of 2020. Bali Governor Regulation No. 1 of 2020 is a supporting factor for law enforcement because it is a reference for the law in addition to law enforcement factors, namely police officers in this case pamong praja police who have the task of supporting in organizing local government in the field of security and order and enforcement of local regulations in terms of controlling the circulation of alcoholic beverages.

Abstract

Tourism has several forms, one of which is community-based tourism. Community-Based Tourism, or what is often referred to as Community Based Tourism (CBT) is a form of tourism managed by local communities with an emphasis on environmental, social, and cultural sustainability principles to help tourists understand and learn the local community's way of life. CBT aims to build and strengthen organizational capabilities in local communities. CBT prioritizes improving the welfare of the community through the empowerment of tourism village development which is carried out based on the potential of the rural community itself. Likewise, Apuan Village, Susut District, Bangli Regency, which is rich in potential spiritual tourism objects such as the Tirta Payuk tourist attraction in the Banjar Bangunlemah Kangin, Yeh mangsi, and Tirta Empul attractions in the Banjar Apuan. However, the problem then is that the utilization of tourism objects in Apuan Village has not been maximized. In this study, the object of study to be studied is Apuan Village by emphasizing the model of tourism object development by analyzing the potential and characteristics of Apuan Village so that later an appropriate tourism object development model can be arranged so that it can be applied optimally.

Abstract

ABSTRAK Masayarakat Bali memiliki berbagai budaya lokal yang menjadi aset pariwisata Pulau Bali. Salah satu budaya lokal nampak pada budaya arsitektur pada bangunan tradisional Bali. Sebagai upaya mempertahankan budaya arsitektur tradisional Bali maka Pemerintah Provinsi Bali membentuk Perda No. 5 tahun 2005 tentang Persyaratan Arsitektur Bangunan Gedung. Ketentuan Pasal 15 perda tersebut mewajibkan setiap bangunan non-tradisional harus menerapkan prinsip-prinsip arsitektur tradisional Bali pada gerbang dan pagar. Ketentuan ini sangat penting diterapkan di wilayah kawasan strategis pariwisata Bali seperti Nusa Penida. Salah satu akses laut menuju Nusa Penida adalah melalui pelabuhan Sampalan di Banjar Sampalan. Efektifnya keberlakuan Pasal 15 Perda Bali No. 5 tahun 2005 di Banjar Sampelan akan mendukung program pengembangan kawasan strategis pariwisata di Nusa Penida. Beranjak dari hal tersebut maka akan dilakukan penelitian perihal penegakan hukum Pasal 15 Perda Bali No. 5 tahun 2005 di Banjar Sampalan Desa Batununggul Nusa Penida. Kata kunci: Penegakan hukum, Arsitektur tradisional Bali, Gerbang dan Pagar ABSTRACT Balinese society has various local cultures that become tourism assets of Bali Island. One of the local culture is seen in the architectural culture of traditional Balinese buildings. In an effort to preserve the traditional Balinese architecture culture, the Bali Provincial Government established the Local Regulation no. 5 of 2005 on Building Architecture Requirements. The provisions of Article 15 of the regulation require that any non-traditional buildings should apply the principles of traditional Balinese architecture to gates and fences. This provision is very important applied in the strategic areas of Bali tourism such as Nusa Penida. One of the sea access to Nusa Penida is through Sampalan port in Banjar Sampalan. The effectiveness of the implementation of Article 15 of the Bali Regulation no. 5 year 2005 in Banjar Sampelan will support the development of strategic tourism program in Nusa Penida. Moving from that matter will be conducted research concerning law enforcement Article 15 of Bali Regulation no. 5 year 2005 in Banjar Sampalan Village Batununggul Nusa Penida. Abstract

A good and healthy environment is a human right for every Indonesian citizen as mandated in Article 28H of the 1945 Constitution of Indonesia. Unwise management of the environment contributes to the deterioration in the quality of the environment because it is necessary to increase environmental protection and management. Environmental protection and sustainable management is the responsibility of the government and the community. The responsibility of the government in carrying out environmental protection and management is a function of public services, to ensure that all residents have a good and healthy environment. Then the government can be held accountable, whether administratively, civil or criminal, when the government fails to carry out its obligations that are not in accordance with the aspirations of the community. This study is qualified as a normative legal research by applying several types of approaches, namely, the legislative approach, conceptual approach, philosophical approach, historical approach, comparative approach, case approach including cultural approaches based on the wisdom of the local community.The results showed that the protection and management of the environment is an effort to assume responsibility is very difficult so that it results in a decrease in the quality of the environment is increasingly apparent. Likewise in the event of environmental pollution and damage, the perpetrators can be held responsible both in civil law and criminal law. However, participatory environmental enforcement by integrating values that develop in the community in protecting and preserving the environment is an ideal form of protecting and prudent environmental management to realize sustainable regional development.

Abstract

The island of Bali is famous for its natural beauty. Likewise with Bangli Regency which is one of the regencies on the island of Bali which is famous for having water tourism destinations that are no less beautiful than other places on the island of Bali. Tibumana Waterfall is a tourist attraction managed by the traditional village through an agreement made between the traditional village and the Apuan village government through an agreement. On the basis of the agreement, the traditional village can better manage tourist objects and attractions, beautiful in accordance with the Hindu order, so that their uniqueness and beauty can be maintained and developed. The cooperation agreement between the Bendesa Adat Bangunlemah Kawan and the Perbekel of Apuan Village is in accordance with the anatomy of the contract which requires that the contract must include the scope, rights and obligations, provisions for force majeure and provisions for dispute resolution. The policy model in the distribution of the results of the management of tourism objects in the Tibumana waterfall does not reflect the principle of justice. To be more ideal, before the contract is drawn up, the Village Government forms a Village Regulation which regulates the management of tourism objects in the Apuan village area, because the opening of tourist objects to tourists will of course have a levy to be paid. For illegal levies, the retribution must go through a Village Regulation. After the village regulations are formed, contracts are drawn up to determine more concrete matters.

Abstract

The objective of tourism development is not only to increase economic growth but also to preserve nature and surrounding environment. In the context as in the Regency of Badung, the problem arising is that there are still many tourism supporting facilities that are not in accordance with the zoning or designated area so they can have a negative impact towards the environment. This study examines the meaning of the concept of developing an environmentally-based sustainable tourism and strategies for developing the environmentally-based sustainable tourism in the area of tourism supporting facilities in Badung Regency. This study is of great importance in order to discover solutions in the form of appropriate strategies or policies for a sustainable tourism development. This study belongs to a empirical legal research that uses primary data and secondary data. The results of the study show that the concept of sustainable tourism development focuses on long-term tourism development minimizing negative impacts on the environment. The government has a strategic role in formulating relevant tourism development policies, especially in the process of planning as stated in the tourism development master plan in both the Province and Regency/City. The value of the philosophy of Tri Hita Karana is very appropriate to be applied in formulating policies for sustainable tourism development. In addition to formulating policies, a strategy for developing environmentally-based sustainable tourism in tourism supporting facilities in Badung Regency can be implemented by ensuring that all development is in accordance with its designation so as to reduce negative impacts on the environment. Empowerment of local communities in tourism development is also very important to be applied by holding the principles of religious and cultural values that live in the community as well as environmental sustainability.

Abstract

The responsibility of the State in ensuring the fulfillment of the people's right to drinking water is carried out through the implementation of the Drinking Water Supply System (SPAM), one of which can be implemented by BUM Desa. The problems to be studied are: What is the legal form of BUM Desa in drinking water management in Apuan Village? and what efforts are made by the BUMDes of Apuan Village in optimizing drinking water management? This research is empirical legal research with a sociology of law approach. The results of the study indicate that the legal form of the Apuan Village BUM must be renewed through a conversion process so that it is a legal entity and reorganizes the drinking water management business unit so that it has legality in drinking water management. In the context of optimizing drinking water management, a legal instrument is needed in the form of the Apuan Village Regulation on the Drinking Water Management System based on the SDA Law and the SPAM PP to ensure certainty of the quality, quantity, and continuity of SPAM for the Apuan Village community. Furthermore, it is necessary to prepare SPM and SOP, monitoring facilities, as well as human resource development for drinking water management through comparative studies and training or mentoring.

Abstract

Pandemi Coronavirus 2019 adalah bahaya nyata bagi Indonesia. Virus yang berawal di Wuhan, Provinsi Hubei, China, Desember 2019. Covid-19 sudah mengkontaminasi manusia sangat cepat menyebar ke seluruh dunia dan sudah berubah ke masalah medis yang menimbulkan kekhawatiran apa lagi, kekacauan. Wabah Covid-19 sangat berpengaruh dalam kesejahteraan, sosial, serta perekonomian sebagai peristiwa non-bencana. Pandemi tahun ini yang terjadi di Indonesia mempengaruhi kehidupan ekonomi, jelas membawa kemalangan yang dialami oleh banyak perkumpulan. Juga ada lebih banyak pemilik kekuasaan yang membuat apa yang terjadi untuk bergerak penganiayaan kekerasan. Seperti yang terjadi karena penurunan nilai bantuan sosial sebagai paket sembako yang diarahkan oleh Juliari Batubara, Mantan Menteri Sosial. Kemudian muncul permasalahan, penelitian ini diharapkan dapat mengetahui, Apa saja bentuk-bentuk penyalahgunaan bantuan sosial selama pandemi Coronavirus, dan bagaimana penegakan hukum terhadap kesalahan penyalahgunaan bantuan sosial selama krisis Covid-19. Metode penelitian ini menggunakan tipe penelitian Hukum Normatif, metode penelitian hukum yang dilakukan dengan meneliti bahan pustaka atau data sekunder. Jika tujuannya adalah untuk membantu kelompok atau individu tertentu serta merusak negara, maka dianggap menjadi tindakan pidana, tidak adanya supervisi dari pihak yg terkait, contohnya pada pengawasan rencana keuangan. Maka memungkin penyelewengan oleh pemegang kekuasaan atau pelopor yg akan mengakibatkan wilayah setempat sebagai alasan untuk produksi rakyat yang pluralistik dan multikultural.Terdapat berbagai bentuk-bentuk penyalahgunaan kekuasaan dan bagaimana penegakan hukum terhadap tindakan penyalahgunaan kekuasaan serta upaya yang telah dilakukan pada para penegak hukum agar memberikan efek jera kepada para penyalahgunaan kekuasaan.

Abstract

Tanah merupakan suatu objek yang berkaitan erat dengan kehidupan manusia. Lelang adalah satu dari beberapa cara untuk memperoleh hak milik, contohnya adalah tanah. Masalahnya adalah masih banyak kasus yang terjadi dalam proses lelang tersebut. Maka dari itu rumusan masalahnya adalah bagaimana perolehan hak atas tanah melalui lelang dan bagaimana perlindungan serta kepastian hukum bagi peserta atau pemenang lelang hak milik atas tanah. Dalam pelaksanaannya, lelang akan dibagi menjadi 3 tahap yaitu tahap sebelum lelang, pelaksanaan lelang dan setelah lelang. Proses pendaftaran hak atas tanah yang telah dimenangkan melalui lelang dapat diajukan atau diproses dengan membawa sejumlah dokumen sebagai persyaratan utama pendaftaran hak atas tanah ke Kantor ATR/BPN. Jenis penelitian yang dipakai dalam metode penelitian yang dibahas oleh penulis ini adalah penelitian hukum normatif. Penelitian hukum jenis ini adalah penelitian hukum yang memfokuskan pada hukum tertulis dari berbagai aspek, antara lain teori, filosofi, perbandingan, sejarah, struktur serta komposisi, lingkup dan materi, penjelasan dari pasal ke pasal, formalitas dan kekuatan mengikat suatu UU tetapi tidak mengikat aspek terapan atau implementasinya. bertujuan untuk melakukan penjualan terhadap barang yang tealah ada oleh peraturan perundang-undangan diharuskan dengan cara lelang. di dalam tahapan pelaksanaan lelang yang dilakukan adalah penetapan pembeli dan penawaran lelang. Kemudian sampai pada tahapan terakhir yaitu setelah pelaksanaan lelang dilakukan pembayaran serta penyerahan dokumen kepemilikan suatu barang yang dilelang tersebut. Perlindungan hukum bagi peserta atau pemenang lelang bisa didapat dari akta risalah lelang yang mempunyai kekuatan pembuktian yang kuat, akta ini juga merupakan akta otentik.
