Abstract

Penelitian ini akan membahas status hukum UUV menurut Hukum Laut Internasional serta membahas peluang dan tantangan pengaturan terhadap UUV. Terlepas dari manfaat yang diberikan oleh UUV, negara harus merumuskan atau menyepakati status hukum UUV; serta mengatur pengoperasian UUV. Dengan demikian Kerjasama regional sangat perlu dilakukukan. Penelitian ini menggunaka metode penelitian hukum dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukan bahwa hukum internasional secara eksplisit belum mengatur tentang status hukum UUV. Konvensi ini bahkan tidak konsisten dalam penggunaan terminology ‘ships’ dan ‘vessels’ serta tidak mendefinisikan kapal secara jelas. Sehingga menimbulkan permasalahan terutama dalam menentukan status hukum UUV, apakah UUV dapat dikategorikan sebagai kapal. Karakteristik UNCLOS 1982 sebagai ‘package-deals’ memungkinkan dilakukannya evolutionary interpretation yang dapat memasukkan kapal tanpa awak sebagai kapal yang dimaksud oleh UNCLOS 1982. Meskipun demikian, berkaitan dengan UUV, masih menimbulkan pro dan kontra. Apabila UUV dianggap sebagai kapal, apakah termasuk kapal peneliti atau kapal perang? Atau termasuk dalam other underwater vehicle yang dapat diasumsikan sama dengan kapal selam? Apakah dengan demikian UUV tunduk pada hak-hak pelayaran sebagaimana diatur dalam UNCLOS 1982.

Abstract

This paper focuses on the utilization of sea mineral resources in areas within national jurisdiction and in the international seabed area (hereafter known as the Area). It discusses Indonesian laws relevant to seabed mining and the need for such laws to take into consideration the maritime zones and activities in the Area, as stipulated by UNCLOS 1982. This paper begins with the identification of potential sea minerals both within national jurisdiction and in the Area. Next, it analyzes the international legal framework on seabed mining, including a discussion on the meaning of "legitimate interests of coastal States" and on the participation of developing states in the Area, as stipulated in Article 142 and 148 of UNCLOS 1982. Then, the national legal framework relating to seabed mining is discussed. Using the juridical-normative method, this paper finds that Indonesia does not currently have comprehensive national regulations covering seabed mining within its jurisdiction and in the Area. Although there is a presidential decree on the exploitation of sea sand, it is limited to institutional arrangements and only focuses on sea sand. Thus, this paper recommends the formulation of national regulations regarding the use of the seabed, both within and beyond national jurisdiction.

Abstract

Located in a strategic position, that is between two great oceans and two land masses have made Indonesia a centre of international trade and shipping. In fact, 90% of international trades are carried out through the ocean. It is therefore crucial to assure that the activities in carrying goods across the ocean are incident free. However, if accident happens, assistance from professionals to preserve items of property is desirable. In such, salvage law emerged. This paper discusses comprehensively Indonesian salvage law within the framework of contemporary maritime law. While Indonesian maritime law is mostly based on its national law on the carriage of goods by the sea, in fact, the development of maritime law is highly affected by international practices which are largely based on international conventions and regulations. This research finds that while Indonesian salvage law can be found in Book II Chapter VII article 545-568k Wetboek Van Koophandel or known as Kitab Undang-undang Hukum Dagang (KUHD), which focused narrowly on the value of salved property as the primary measures of success, yet Indonesian salvage law has not been developed in accordance with current international salvage law, which adopted a broader and more balanced approached in both commercial and environmental aspects. Although it is believed that such approached is "culturally unrecognized" in Indonesia, this research argued that since Indonesian waters are part of international waters, all process by waters including salvage should confirm the relevant international practices and regulations. While Indonesia has taken out salvage law from KUHD and regulates it within Act Number 17/2008 on navigation, however, such act only provides one article for salvage stating that salvage will be regulates further by Ministry Regulation. Untill this paper was written no such government regulation produced yet by Indonesia. Since Indonesian waters is the centre of international navigational routes, this paper argued that it is an urgent need for Indonesia to have appropriate salvage law in place, so it can develop dinamically from shipping practice and confirm with international regulations in salvage.

Abstract

The debate over the concept of Indonesia's national defense and security system has been a significant topic since independence until the reform era. This article aims to discuss the dynamics of the Universal People's Defense System within the National Defense and Security System from the independence period to the reform era. A documentation study method is used to collect and analyze important documents such as laws, government policies, official reports, and relevant literature. Data analysis is conducted to identify significant changes in the concept and implementation of the National Defense System and its impact on the system's sustainability. Findings indicate that the national defense concept remains relevant and should be maintained. The Universal People's System involves all societal components, territorial integrity, natural resources, and other means, strengthening military and non-military defense integration, increasing respect, and enhancing deterrence. This concept is still valid in the reform era and remains upheld after the 1945 Constitution amendment. The debate on Indonesia's national protection and security system has been a fundamental issue from independence to the reform era, covering national security, protection, safety functions, and policies. Implications for education include integrating national defense topics in schools to foster public awareness and participation, contributing to a well-informed, participatory society.

Abstract

Perkembangan kelautan di Indonesia semakin berkembang dari tahun ke tahun hingga dicetuskannya konsep ‘poros maritim’ oleh Presiden Joko Widodo. Konsep ‘poros maritim’ menekankan pada terwujudnya konektifitas antar pulau melalui pengembangan industri pelayaran serta transportasi laut. Dengan demikian dibutuhkan akselerasi pembangunan pelabuhan di wilayah-wilayah kepulauan Seperti Maluku dan Riau. Sayangnya alokasi dana dari pusat untuk daerah masih didasarkan pada luas wilayah daratan. Hal ini menjadikan daerah dengan wilayah perairan yang lebih banyak tidak mendapatkan alokasi dana sebagaimana daerah yang mempunyai wilayah daratan yang luas. Padahal percepatan pembangunan di wilayah kepulauan sangat dibutuhkan dalam mewujudkan Indonesia sebagai ‘poros maritim’ dunia. Tulisan ini akan menganalisa tantangan dan peluang pembangunan wilayah kepulauan yang berlandaskan poros maritim dalam perspektif negara kepulauan. Pembangunan Wilayah Kepulauan sangat diperlukan untuk mewujudkan konsep Poros Maritim. Akan tetapi perlu diperhatikan mengenai perimbangan keuangan daerah dalam mewujudkan akselerasi pembangunan tersebut.

Abstract

The authority of the Indonesian National Armed Forces (TNI) in addressing acts of terrorism, as mandated by the TNI Law through Non-War Military Operations (OMSP), as stated in Article 7 paragraph (2) letter (b) number 3 of Law Number 34 Year 2004 regarding the Indonesian National Armed Forces, is one of the main tasks of the TNI in OMSP, hence it is the mandate of the TNI's authority in addressing acts of terrorism. To date, there are no implementing regulations that govern this TNI authority, resulting in ambiguity and a legal vacuum that causes hesitation in every military operation carried out by the TNI to counteract acts of terrorism, significantly threatening state sovereignty, thus raises questions with the problems: 1. What is the urgency of the regulation of authority in countering terrorism that threatens the sovereignty of the Indonesian State by the Indonesian National Armed Forces (TNI); 2. What is the model of involvement of the Indonesian National Armed Forces (TNI) in countering acts of terrorism that threaten the sovereignty of the Indonesian State? Therefore, the author uses normative legal research, a statutory approach method, a concept analysis, and a comparison approach. With this research, the author tries to explain that the arrangement of TNI authority in addressing acts of terrorism that have threatened state sovereignty is essential and urgent to be immediately enacted as the legality of the military operation carried out considering the current threat of terrorism which is increasingly developing following the times. So that the involvement of the TNI in addressing acts of terrorism is no longer carried out as an auxiliary task to the Indonesian National Police (POLRI). The TNI, in addressing acts of terrorism threatening state sovereignty, has clear and firm boundaries by the place, time, and level of threat such that the TNI can directly conduct military operations to address these acts of terror.

Abstract

Tujuan Penelitian ini untuk menganalisa aktifitas bioprospecting yang dilakukan di ABNJ. Baik UNCLOS 1982 maupun Convention on Biodiversity 1992 (CBD) tidak mengatur tentang aktifitas bioprospecting ini. United Nations Convention on the Law of the Sea 1982 (UNCLOS 1982) mengatur bahwa di wilayah laut diluar yurisdiksi nasional berlaku beberapa macam kebebasan, diantaranya adalah freedom of fishing dan freedom of scientific research. Penelitian ini merupakan tulisan hukum yang menggunakan metode yuridis normative, yang berangkat dari kekosongan hukum yang mengatur tentang aktifitas bioprospecting, khususnya di ABNJ. UNCLOS 1982 selanjutnya juga membedakan sumber daya alam sebagai sumber daya alam hayati (living resources) dan sumber daya alam non-hayati (non-living resources). Dalam perkembangannya, eksploitasi yang dilakukan negara terhadap sumber daya alam di laut berkembang dengan dilakukannya aktifitas bioprospecting, yang menghasilkan apa yang disebut sebagai marine genetic resources (MGRs), yang sangat bermanfaat bagi kehidupan umat manusia. Apakah bioprospecting dapat dikategorikan sebagai aktifitas fishing atau scientific research? Jika fishing, kenyataannya MGRs bukan ikan. Sedangkan jika scientific research, pada umumnya bioprospecting akan menghasilkan commercial benefit sehingga bukan riset murni sebagaimana diatur dalam UNCLOS 1982. Selanjutnya apakah MGRs dikategorikan sebagai sumber daya alam hayati atau non-hayati? jika hayati, apakah atas MGRs yang dihasilkan dari bioprospecting tersebut diberlakukan rejim freedom of high seas? jika demikian, maka akan menimbulkan adanya potensi komersial yang dikuasai oleh negara tertentu saja. Dengan demikian dibutuhkan pengaturan yang pasti akan aktifitas bioprospecting yang dilakukan di ABNJ.

Abstract

The United Nations Convention on the Law of the Sea (UNCLOS) recognizes the protection and preservation of underwater cultural heritage found at sea by emphasizing preferential rights of the State of country of origin, the State of cultural origin, or the State of historical and archaeological origin. To preserve the rights of such States, the UNCLOS implicitly allows the removal of underwater cultural heritage upon prior approval from coastal States based on the State’s cooperation. On the other hand, the Convention for the Protection of the Underwater Cultural Heritage 2001 (2001 UCH Convention) strictly prohibits any exploitation and commercialization of such cultural heritage and applies the in-situ preservation for underwater cultural heritage. This article aims to discuss the practice of Indonesia in regulating underwater cultural heritage found in Indonesian waters. This research found that Indonesia’s law allows the removal of underwater cultural heritage and made commercial salvage for underwater cultural heritage legal. In addition to this, with the enaction of the current Job Creation Law 2021, underwater cultural heritage is listed as one of the fields in which open-investment is applied. While Indonesia has national laws relating to cultural heritage, provisions on underwater cultural heritage is lacking. This article proposes a model that can be adopted by Indonesia in protecting and preserving underwater cultural heritage. It is argued that although Indonesia is not a party to UCH Convention 2001, it is a party to the UNCLOS and is binded to the provisions envisaged in it, which is to protect and preserve underwater cultural heritage.
