Abstract

As an international organization established with the aim of improving maritime safety and security of international shipping, IMO sets up various guideline in assuring the establishment of international shipping. One of the those guidelines is the Guidelines for the Identification and designation of Particular Sensitive Areas (PSSAs). This article aims to analyse whether it is possible that the in situ of underwater cultural heritage can be included as PSSAs. This way would implied restrictions to international shipping in order to protect and preserve underwater cultural heritage. This research conducted through legal analyses of relevant legal documents. The method used in this paper is normative legal research with in-depth literature studies. This paper argued that while it is possible to include in situ location of underwater cultural heritage as PSSAs, however, conflicting interpretation between national and international law as well as disputes between States are imminent. Thus, IMO should play decisive role in properly co-ordinated and decide which marine areas requires restrictions in relation to the protection and preservation of underwater cultural heritage. The restrictions to international shipping with regard to the protection and preservation of underwater cultural heritage should not in any way prevent other legitimate uses of the sea as envisages under the 1982 Law of the Sea Convention (LOSC), especially on the freedom of navigation regimes. Thus co-operation and communication between IMO, other international organization and coastal State is crucial.

Abstract

The responsibility of parents to fulfill children's rights must still be carried out even if the parents are divorced. In Law Number 1 of 1974 concerning Marriage it is explained that the father is responsible for all rights to provide for the child, but often the father is negligent in fulfilling his obligations even though there has been a judge's decision in court. Basically in the realm of the Court, a request for execution can be made in fulfillment of child support costs if the father/ex-husband is negligent, but this execution is not an easy thing. The purpose of this study is to analyze the urgency of establishing a supervisory institution as an effort to fulfill child support costs due to divorce. This research method is normative law with statutory approaches, conceptual approaches, and comparisons originating from legal materials which are processed and analyzed with the results of the study.

Abstract

The responsibility of parents towards fulfilling children's rights must still be carried out even though both parents have divorced. In the Constitutional Marriage it is explained that a father is responsible for all the rights to life for his children, but often the father is negligent in fulfilling his obligations even though there has been a judge's decision in court. Basically in court, actually the implementation of a request in fulfilling the child's maintenance rights can be done if the father is negligent, but the implementation is not easy. This study will examine what are the juridical obstacles to fulfilling children's rights as a result of divorce and how to fulfill children's livelihood rights in the future. The purpose of this study is to describe efforts to fulfill children's livelihood rights as a result of divorce. This research is a normative legal research with a literature study approach, a case approach, and a comparison of efforts to fulfill children's rights to a just life. The results of the research in this description are that it is very necessary to have a supervisory institution that will oversee the level of compliance of fathers in fulfilling their children's right to life due to divorce.

Abstract

The debate over the concept of Indonesia's national defense and security system has been a significant topic since independence until the reform era. This article aims to discuss the dynamics of the Universal People's Defense System within the National Defense and Security System from the independence period to the reform era. A documentation study method is used to collect and analyze important documents such as laws, government policies, official reports, and relevant literature. Data analysis is conducted to identify significant changes in the concept and implementation of the National Defense System and its impact on the system's sustainability. Findings indicate that the national defense concept remains relevant and should be maintained. The Universal People's System involves all societal components, territorial integrity, natural resources, and other means, strengthening military and non-military defense integration, increasing respect, and enhancing deterrence. This concept is still valid in the reform era and remains upheld after the 1945 Constitution amendment. The debate on Indonesia's national protection and security system has been a fundamental issue from independence to the reform era, covering national security, protection, safety functions, and policies. Implications for education include integrating national defense topics in schools to foster public awareness and participation, contributing to a well-informed, participatory society.

Abstract

Berdasarkan data BPS (Badan Pusat Statistik) pada tahun 2021, hasil produksi perikanan tangkap di perairan NTT (Nusa Tenggara Timur) mencapai 190.594 ton dan berpotensi naik setiap tahunnya, sehingga diperlukan pemetaan zona potensi penangkapan ikan di Selat Ombai. Metode yang digunakan adalah metode pembobotan untuk melihat area yang berpotensi dan tidak berpotensi menjadi zona penangkapan ikan. Waktu penelitian dilakukan selama bulan September hingga Oktober 2023 di Perairan Selat Ombai. Data yang digunakan adalah data sekunder Suhu Permukaan Laut (SPL) dan klorofil-a  dari citra Aqua-MODIS Level 3 dengan pendekatan pengindraan jauh dan sistem informasi geografi.Waktu penelitian dilakukan selama bulan September hingga Oktober 2023 di Perairan Selat Ombai. Perbedaan peta zona potensi penangkapan ikan dapat dilihat dari parameter suhu permukaan laut, klorofil-a, musim dan sumber data yang diperoleh. Persebaran area potensi tangkapan ikan terjadi di area pesisir pantai di Pulau Timor dan Pulau Flores. Selama tahun 2022, pada bulan Februari hingga Oktober 2022 merupakan waktu dengan zona potensi penangkapan ikan sangat kuat, sedangkan pada bulan Januari, November dan Desember merupakan waktu dengan zona potensi penangkapan ikan yang sangat lemah.   According to BPS (Central Statistics Agency) data in 2021, catch production in NTT (East Nusa Tenggara) waters reached 190.594 tons and is potentially rising every year, so it is necessary to map potential fishing zones in the Ombai Strait. The method used is a weighting method to see areas that have and do not have the potential to become fishing zones. The data used is secondary data on Sea Surface Temperature (SST) and chlorophyll-a from Aqua-MODIS Level 3 imagery using a remote sensing approach and geographic information system. The research was conducted from September to October 2023 in the waters of the Ombai Strait. Differences in fishing potential zone maps can be seen from parameters such as sea surface temperature, chlorophyll-a, seasons, and data sources obtained. The spread of potential fishing areas occurred in the coastal areas of Timor Island and Flores Island. During 2022, February to October 2022 was a time with a very strong fishing potential zone, while January, November, and December had very weak fishing potentials.

Abstract

Pengelolaan ekowisata yang baik adalah ketika ekowisata dapat memberikan manfaat bagi seluruh masyarakat. Salah satu konsep yang menjelaskan peranan masyarakat tersebut dalam pembangunan pariwisata adalah Community-Based Tourism (CBT). Tujuan penelitian yaitu mendeskripsikan konsep pengelolaan ekowisata bahari berbasis masyarakat. Lokasi penelitian di Desa Sitiarjo, Sumbermanjing Wetan, Kabupaten Malang, Provinsi Jawa Timur pada bulan April 2021. Teknik pengumpulan data dilakukan dengan cara observasi, wawancara dan diskusi dengan responden yang ada di daerah penelitian. Informan awal penelitian ini dipilih secara purposive (purposive sampling) selanjutnya penentuan informan yang lainnya dilakukan secara snowball berdasarkan petunjuk dari informan kunci terdiri 20 responden yang memahami bidang ekowisata. Pendekatan dalam penelitian ini adalah bersifat kualitatif dengan maksud untuk memahami fenomena tentang pengelolaan ekowisata bahari berbasis masyarakat. Metode analisis dalam penelitian ini menggunakan model interaktif. Hasil penelitian menunjukkan bahwa konsep pengelolaan ekowisata bahari melibatkan dan menempatkan masyarakat lokal sebagai pengendali penuh dalam pengelolaannya. Pemerintah sebagai regulator dan fasilitator berperan strategis dalam pengelolaan ekowisata, begitu juga pihak swasta, peneliti, dan media juga sangat diperlukan sebagai katalisator.Good ecotourism management is when ecotourism can provide benefits to the whole community. One concept that explains the role of the community in tourism development is Community-Based Tourism (CBT). The research objective is to describe the idea of community-based marine ecotourism management. The research location is in Sitiarjo Village, Sumbermanjing Wetan, Malang Regency, East Java Province, April 2021. Data collection techniques are carried out using observation, interviews and discussions with respondents in the research area. The initial informants of this study were selected by purposive sampling (purposive sampling) and then the determination of other informants was carried out by snowball based on instructions from key informants consisting of 20 respondents as experts in ecotourism. The approach in this study is qualitative with the aim of intending to understand the phenomenon of community-based marine ecotourism management. The analytical method in this study uses an interactive model. The results showed that the concept of marine ecotourism management involves and places the local community as the whole controller in its management. The government, as a regulator and facilitator, plays a strategic role in ecotourism management, as well as the private sector, researchers, and the media are also needed as catalyst.

Abstract

This research aims to gain a vivid and comprehensive portrait of legal aspects in the digitalization of cultural heritage in Greater Malang in Indonesia from the perspective of ecotourism and the state’s role in terms of policies and involvement of the members of the public in cultural conservation. The involvement of e-tourism and e-government in managing and developing the tourism potential in developed areas is inevitable. Cultural heritage-based tourism promoting the utilization of advanced information and communication technology has attracted the attention of tourists. Empirically, the digitalization of cultural heritage does not stand on its own but is more integrated with other aspects and sectors. The proposed concept in this study reminds us of the urgency in the development and utilization of integrated cultural heritage digitalization from the perspectives of eco-tourism, e-tourism, as well as other sectors such as e-government and spiritual aspect. The process of the development and utilization of digitalization of cultural heritage tourism is intended to ward off any disputes over ulayat rights happening these days. The role of the government and the participation of tribal people are deemed vital in reconstructing the system of social and spiritual values in developing eco-tourism based on the application of an integrated digital information system disseminating local wisdom through the threshold of global civilization.

Abstract

The status of Indonesia as an archipelago state is stated clearly in the Indonesian Constitution. Indonesia’s territory consists of three dimensions: land, sea, and air. To maintain the order of the State, the State’s security is crucial. It is further argued that State’s security in all territorial dimensions can be established through a comprehensive inward-looking approach. With this approach, national security can be achieved while holding on to the principles of national resilience. In order to maintain a stable national resilience, sustainable policies are needed to govern the land, air, and ocean territory. This research analyses whether existing policies in a state’s territorial governance are sufficient to maintain national resilience. Using a multi-disciplinary approach that combines descriptive-qualitative and normative-juridical methods, this research recommends a policy model for governing the State’s territory towards maintaining national resilience in Indonesia. While the inward approach is preferable, contemporary threats to national resilience need to be considered by considering an outward-looking approach.

Abstract

Karimun Jawa Island is a promising maritime asset, enriched by abundant water resources in Central Java. However, the allure of this location poses a potential threat to the sustainable ecosystems of marine biota unless prompt government action is taken to safeguard its underwater cultural heritage. This research proposes a comprehensive policy design for legal protection and ecotourism development in Karimun Jawa, balancing economic considerations and environmental preservation. Employing a socio-legal methodology encompassing interviews, observation, and focus group discussions, the study identifies substantial challenges in managing underwater cultural heritage in Karimun Jawa. These challenges encompass over-exploitation, shipwreck theft, damage from trawlers, natural disasters, and plastic pollution. The research underscores the imperative for the government to formulate measures ensuring legal protection on international, national, and regional fronts. At the global level, immediate ratification of the Convention on the Protection of Underwater Cultural Heritage 2001 is recommended. Moreover, effective collaboration among stakeholders—central and regional governments, local communities, and maritime enterprises—is deemed crucial for sustainable, culturally informed policy formulation fostering responsible management, utilization, and protection of this unique marine heritage.
