Abstract

The rapid development of digital technology has a significant impact on people's lives, including children's lives. Due to the use of this technology, protecting children's personal data has become an important issue in the current digital era, where children are vulnerable to the misuse of their personal data. The aim of this research is to examine the role of supervisory institutions in providing protection for children's personal data in Indonesia and to analyze it in comparison with the Personal Information Protection Act (PIPA) in South Korea. This research employs a normative legal approach. The legal materials used in this study focus on primary legal sources in the form of legislation, secondary legal sources such as literature, books, and journals, tertiary legal sources including Black’s Law Dictionary and the Indonesian Language Dictionary, as well as legal comparisons between Indonesia and South Korea. The results of this study indicate that the law in Indonesia has not fully provided adequate protection for personal data, particularly regarding the establishment and role of supervisory institutions, which have not yet been formed as a means of safeguarding children's personal data. In contrast, the regulations in South Korea provide more detailed provisions regarding the protection of children's personal data, along with an effectively functioning supervisory body known as the Personal Information Protection Commission (PIPC).

Abstract

ABSTRAKBanyak tanah wakaf yang belum dapat dimanfaatkan untuk kemaslahatan umat. Pemanfaatan tanah wakaf dapat dilakukan secara produktif yang salah satunya dengan membangun rumah susun diatas tanah wakaf untuk hunian atau tempat tinggal bagi masyarakat berpenghasilan rendah. Rumah susun diatas tanah wakaf dapat dilakukan dengan cara menerbitkan Sertifikat Kepemilikan Bangunan Gedung. Metode penelitian dilakukan secara yuridis normatif, dengan data sekunder sebagai data utama, dengan didukung oleh data primer. Dalam Sertifikat Kepemilikan Bangunan Gedung, tidak terjadi peralihan kepemilikan tanah. Tanah masih dalam penguasaan nazhir, sehingga tidak melanggar syariat Islam, karena harta benda wakaf merupakan milik umat yang dikelola oleh nazhir dan harta benda wakaf tidak boleh beralih kepada siapapun. Di sisi lain nazhir tanah wakaf mendapatkan penghasilan dari sewa tanah yang dibangun untuk rumah susun. Penghasilan dari sewa tanahnya tersebut dapat digunakan untuk kemaslahatan umat. Dalam Sertifikat Kepemilikan Bangunan Gedung, kepemilikan hanya bangunan ruang tempat tinggal pembeli rumah susun saja dan tidak termasuk tanahnya. The land is still under Nazir control, so it does not violate Islamic law, because waqf property belongs to the people which is managed by the nazhir and waqf property cannot be transferred to a particular person or legal entity. On the other hand, waqf land nazhirs earn income from renting land built for flats. The income from renting the land can be used for the benefit of the people. In the Building Ownership Certificate, ownership is only of the building where the apartment buyer lives and does not include the land.Keywords: building ownership certificates, low income communities, waqf.

Abstract

Tujuan dari penelitian ini adalah untuk mengetahui pelaksanaan perjanjian bagi hasil tanah pertanian antara pemilik tanah dan penggarap tanah di Desa Cileungsi Kecamatan Ciawi Kabupaten Bogor ditinjau dari Undang-Undang Nomor 2 Tahun 1960 tentang Perjanjian Bagi Hasil serta untuk memperoleh gambaran pembagian hasil dalam perjanjian bagi hasil tanah pertanian di Desa Cileungsi Kecamatan Ciawi Kabupaten Bogor telah memberikan keadilan bagi pihak pemilik tanah dan penggarap. Pendekatan penelitian ini adalah pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Penelitian dilakukan dengan penelitian kepustakaan yang ditunjang dengan penelitian lapangan. Hasil menunjukkan bahwa pelaksanaan perjanjian bagi hasil tanah pertanian di Desa Cileungsi Kecamatan Ciawi Kabupaten Bogor masih belum sepenuhnya sesuai dengan aturan Undang-Undang Nomor 2 Tahun 1960 tentang Perjanjian Bagi Hasil. Perjanjian bagi hasil yang masyarakat Desa Cileungsi dilakukan masih secara lisan, tidak dibuat dihadapan kepala desa, berdasar pada kata sepakat kedua belah pihak, dan tidak dihadirkannya saksi dalam perjanjian.

Abstract

Tujuan dari penelitian ini untuk menganalisis kepastian hukum konversi bentuk sertipikat tanah dari fisik menjadi elektronik serta perlindungan hukumnya terhadap pemegang hak sebagai alat pembuktian. UUPA hingga PP 24/1997 dinyatakan bahwa alat bukti kepemilikan hak atas tanah yaitu sertipikat berupa surat-surat sehingga memiliki kedudukan sebagai alat bukti tertulis namun Kementerian ATR/BPN mengeluarkan kebijakan terkait sertipikat elektronik yang mengubah dan menggantikan keberadaan sertipikat fisik sehingga penelitian ini merupakan penelitian baru mengingat selama ini sertipikat berbentuk fisik dan kebijakan sertipikat elektronik baru akan dilaksanakan. Metode penelitian dalam penelitian ini yaitu metode yuridis normatif. Hasil penelitian yaitu konversi bentuk sertipikat tanah dari fisik menjadi elektronik hanya dilakukan pada bidang tanah yang sudah terdaftar melalui permohonan pemeliharaan data pendaftaran tanah yang diajukan oleh pemegang hak sehingga jaminan kepastian hukum terdapat pada ada atau tidaknya permohonan pemeliharaan data yang diajukan. Adapun kaitannya dengan pembuktian, sertipikat elektronik dapat memberikan perlindungan terhadap pemegang hak sebagai alat bukti elektronik yang dibuktikan dengan 2 cara yaitu memperlihatkan secara langsung dari sistem elektronik dan hasil cetakannya.  The purpose of this study is to analyze the legal certainty of converting the form of land certificates from physical to electronic and the legal protection for rights holders as a means of proof. In the UUPA to PP 24/1997 it is stated that proof of ownership of land rights is a certificate in the form of letters so that it has the position as written evidence but the Ministry of ATR/BPN issued a policy related to electronic certificates that change and replace the existence of physical certificates so that this research is a research study. only considering that so far the certificates are in the form of physical certificates and the new electronic certificate policy will be implemented. The research method in this study is the normative juridical method with qualitative juridical data analysis methods and descriptive analytical research specifications. With the results of the study, namely the conversion of the form of land certificates from physical to electronic is only carried out on land parcels that have been registered through a land registration data maintenance application submitted by the right holder so that the guarantee of legal certainty is in the presence or absence of the submitted data maintenance application. With regard to evidence, electronic certificates can provide protection to rights holders as electronic evidence, which is proven in 2 ways, namely by showing directly from the electronic system and the printed results.

Abstract

Mixed marriages between Indonesian citizens (WNI) and foreign nationals (WNA) often give rise to legal issues, particularly in divorce cases involving the division of marital property. A key challenge arises from the restriction on land ownership for foreign nationals under the Basic Agrarian Law. This study examines Decision Number 146/Pdt.G/2021/PA.Dps, in which an Indonesian wife was accused of extortion against her foreign husband in the context of a mixed marriage divorce. Using a normative juridical method and a descriptive-analytical approach, the study finds that the wife’s act of withholding her husband’s documents does not constitute extortion, but rather a form of self-protection due to the husband's failure to provide financial support. The findings emphasize that the division of marital assets in mixed marriages must consider the provisions of the Marriage Law, the Compilation of Islamic Law for Muslim couples, and the Basic Agrarian Law, especially regarding land ownership by foreign nationals. Therefore, resolving property disputes in mixed marriages requires a careful legal approach to ensure compliance with applicable laws.

Abstract

Child marriage remains a significant issue in Indonesia, despite existing regulations that set a minimum legal age for marriage. This study examines Court Decision Number 442/Pdt.P/2023/PA.Krw, which granted a marriage dispensation to a minor without any urgent justification. The legal issues addressed include the judge's considerations in granting the dispensation and the extent of judicial authority in applying the principle of ius curia novit in such cases. This research employs a normative juridical and descriptive-analytical approach, using secondary data such as court decisions, marriage law, child protection law, judicial authority law, and relevant literature. The results showed that the decision was contrary to the relevant positive law which expressly prohibits underage marriage without urgency as mandated in the legislation. Granting dispensation without urgent grounds risks undermining the government’s efforts to prevent child marriage. Therefore, stricter regulations and oversight are needed to ensure the protection of children's rights.

Abstract

Pengingkaran Anak merupakan tindakan hukum untuk menyangkal status seorang anak sebagai anak sah dari seorang ayah karena ada dugaan bahwa anak tersebut bukan hasil hubungan biologis antara suami dan istri dalam perkawinan. Skripsi ini membahas tentang gugatan pengingkaran anak oleh ibu dalam Putusan Nomor 1549/Pdt.G/2024/PA.Kab.Kdr dan meninjau kedudukannya dalam hukum positif di Indonesia. Fokus utama penelitian ini adalah untuk menganalisis kekuatan hukum tes DNA sebagai alat bukti dalam perkara pengingkaran anak serta menelaah kedudukan hukum ibu sebagai pihak penggugat. Penelitian ini dilatarbelakangi oleh kenyataan bahwa hukum di Indonesia, baik dalam Undang-Undang Perkawinan maupun Kompilasi Hukum Islam, pada umumnya hanya mengatur hak pengingkaran anak oleh suami. Metode penelitian dalam skripsi ini menggunakan pendekatan yuridis normatif, yaitu dengan menganalisis putusan pengadilan, peraturan perundang-undangan, serta literatur hukum lainnya untuk mengkaji putusan yang menjadi objek penelitian. Penelitian ini bersifat deskriptif-analitis, dengan tujuan untuk menjelaskan dan menguraikan permasalahan berdasarkan data yang diperoleh. Selain itu, metode wawancara juga dimanfaatkan sebagai teknik pengumpulan data pendukung. Dari hasil penelitian, ditemukan bahwa hasil tes DNA memiliki kekuatan pembuktian yang kuat dalam membuktikan hubungan biologis antara anak dan ayah kandung. Namun, gugatan yang diajukan oleh ibu berpotensi mengandung cacat hukum berupa error in persona karena tidak diakomodasi secara eksplisit dalam peraturan perundang-undangan sebagai pihak yang berwenang mengajukan pengingkaran anak. Oleh karena itu, perlu ada pembaharuan hukum yang lebih responsif terhadap perkembangan teknologi dan perlindungan hak anak

Abstract

The existence of land is an important natural resource for the Republic of Indonesia, which is regulated in Law Number 5 of 1960 concerning Basic Agrarian Regulations, in Article 1 paragraph (1). Article 6 of the UUPA states, "All land rights have a social function. The land referred to here is not only related to land on land but also land in waters, as regulated in the UUPA. Land rights are not only limited to land but also include water areas or coastal borders. This is also in accordance with Government Regulation Number 18 of 2021, the function of legal norms to be binding must be based on legal principles. Legal principles shape the content of legal norms formulated in legal regulations. Without understanding legal principles, it is impossible to understand the essence of law. Therefore, to understand a nation's law, it is necessary to explore its legal principles. The issuance of land title certificates over maritime areas has given rise to conflicts of authority between various government institutions. The Ombudsman of the Republic of Indonesia highlighted the potential for malpractice in the issuance of Building Use Rights Certificates in maritime areas that should not be considered private property. Issuing land title certificates in maritime areas has the potential to violate the law and create conflicts of interest. WALHI is investigating indications of affiliation between companies that obtain Land Title Certificates and large property development corporations, which could lead to the privatization of marine space and threaten sustainability. ecosystems and the livelihoods of coastal communities. The objectives of this study include finding answers and developing previous research regarding the granting of building use rights where the issuance of certificates does not correspond to the nature and purpose of the granting of rights in relation to the principle of the social function of land rights; In this research, the researcher used a normative juridical data analysis method, Regarding the issuance of building use rights certificates in the waters of Tangerang and Bekasi related to illegal sea fences, this problem is suspected to reflect a lack of synchronization between land and maritime regulations. This is because land regulations in Article 65 paragraph (2) of Government Regulation No. 18/2021 allow the granting of land rights in waters for certain activities, such as the construction of ports or other facilities. However, regulations in the maritime sector do not explicitly regulate this. The Ministry of Maritime Affairs and Fisheries emphasized that the installation of sea fences is unlawful and disrupts the activities of thousands of fishermen. The issuance of land rights certificates above maritime areas has given rise to conflicts of authority between various government agencies. Cross-agency collaboration is needed to address this issue and ensure that administrative procedures are carried out in accordance with applicable laws and regulations

Abstract

Agrarian reform is a strategic policy to create equitable distribution of land tenure and people's welfare. Land Redistribution Object Agrarian Reform (TORA) is the main instrument to overcome inequality in land tenure. This policy aims to provide legal certainty for land recipient communities and encourage productive and sustainable land use. However, in its implementation, there are still various obstacles, such as land disputes, uncertainty about the status of land laws, and a lack of policy synergy between the central and regional governments. Based on this description, the purpose of this study is to examine the implementation of asset structuring through TORA redistribution in providing legal certainty for Agrarian Reform subjects and to find out the legal protection of ownership for Agrarian Reform subjects whose land objects are problematic as reviewed from Presidential Regulation Number 86 of 2018 or Presidential Regulation Number 62 of 2023. The research method used is normative juridical with a legal approach and case studies located in Ngargosari village, Kendal Regency and Pagerwangi Punclut village, West Bandung Regency. The data collection technique was carried out through literature studies and interviews with the local Land Office. The data analysis method uses qualitative normative analysis. The results of the study show that legal certainty on TORA redistribution in Indonesia already exists. However, in its implementation, there are still several obstacles, especially in the lack of transparency in the redistribution process and the lack of supervision over the implementation of the TORA redistribution policy. In addition, legal protection for the subject of Agrarian Reform is still not optimal. Therefore, concrete steps are needed to ensure that the land objects distributed are free from disputes, the priority resolution of land conflicts, and the improvement of legal assistance and inter-institutional coordination to ensure legal certainty and protection for the subject of Agrarian Reform.
