Abstract

Penelitian ini bersumber pada putusan PTUN Semarang Nomor: 088/G/2014/PTUN.SMG, yang akan menguraikan bagaimana kewenangan pejabat pembina kepegawaian dalam menggunakan wewenang freies ermessen/diskresi dalam menentukan keputusan demosi, serta bagaimana pertimbangan hukum hakim dalam menentukan pembatalan keputusan demosi tersebut yang bertentangan dengan konsep freies ermessen/diskresi. Tergugat dalam perkara aquo adalah Bupati Magelang, dan objek gugatan perkara ini adalah Surat Keputusan Bupati Magelang Nomor: 821.2/123/KEP/13/2014 tanggal 26 September 2014. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dilakukan dengan pendekatan perundang- undangan, pendekatan kasus, dan pendekatan konseptual. Penulis menggunakan bahan hukum primer dan bahan hukum sekunder dengan inventarisasi hukum normatif dan studi pustaka ilmiah yang berkaitan dengan penelitian. Bahan hukum tersebut diolah dengan metode analisis data normatif kualitatif dan menggunakan penafsiran gramatikal, penafsiran sistematis, dan penafsiran authentik. Berdasarkan penelitian ini, konsep freies ermessen dalam keputusan demosi tidak memenuhi UU No. 30 Tahun 2014 yang mengatur penggunaan freies ermessen sebagai syarat keabsahan suatu KTUN yang menggunakan wewenang bebas, karena demosi secara rigid telah diatur dalam PP No. 53 Tahun 2010 sehingga Majelis Hakim memutuskan untuk membatalkan surat keputusan tersebut karena tergugat melanggar kewenangannya sebagai Pejabat Pembina Kepegawaian, surat keputusan bertentangan dengan aturan penggunaan freies ermessen, dan tergugat menggunakan dasar hukum yang tidak tepat dalam penerbitan keputusan.Kata Kunci : Freies Ermessen, Keputusan Demosi, Keabsahan KTUN

Abstract

Penelitian dengan judul Peralihan Status Pegawai Negeri Sipil menjadi Pegawai Perusahaan Umum (Perum) (studi di Perum BULOG Cabang Banyumas) bertujuan untuk mengetahui bagaimana pengaturan tentang peralihan status pegawai negeri sipil menjadi pegawai perusahaan umum (Perum) serta implikasi hukum terhadap peralihan tersebut. Metode penelitian yang digunakan oleh penulis dalam penelitian ini menggunakan pendekatan perundang-undangan (Statute Approach), pendekatan analisis (Analytical Approach), pendekatan historis (Historical Approach), dan pendekatan komparatif (Comparative Approach). Data bersumber dari data sekunder yaitu bahan hukum primer dan sekunder. Data tersebut dianalisis berdasarkan norma hukum yang berkaitan dengan obyek penelitian. Hasil penelitian menunjukkan bahwa saat peralihan status Pegawai Negeri Sipil menjadi Pegawai Perusahaan Umum (Perum) BULOG diatur dalam Keputusan Direksi Perum BULOG nomor : Kep-262/DIR/12/2003 tanggal 30 Desember 2003 tentang Ketentuan Penyelesaian dan Hak Kepegawaian PNS LPND BULOG Serta Pengangkatan Pegawai Perum BULOG dan Pegawai Negeri Sipil yang memilih untuk menjadi pegawai Perusahaan Umum (Perum) BULOG yang semula diatur dengan peraturan perundang-undangan di lingkungan kepegawaian saat menjadi Pegawai Negeri Sipil Lembaga Non Departemen (LPND) Bulog berubah dengan mengikuti peraturan yang diatur dalam aturan perusahaan dan perjanjian kerja bersama (PKB) sebagaimana yang di atur dalam peraturan perundang-undangan di bidang ketenagakerjaan dan penulis menyarankan agar peralihan status pegawai negeri sipil LPND Bulog menjadi Pegawai Perusahaan Umum (Perum) BULOG sebaiknya disertai dengan ketentuan peralihan (overgang bepalingen) dalam pelaksanaannya.Kata Kunci : Hukum Administrasi Negara, Kepegawaian, Ketenagakerjaan.

Abstract

This article discusses Indonesia’s involvement in addressing the plight of the Rohingya refugees, who have been deprived of citizenship, leading to the erosion of their basic human rights. This deprivation has resulted in widespread social exclusion and displacement, forcing many to seek asylum in countries like Indonesia. Therefore, this study aims to: firstly, analyze the legal framework within which international law enables the Indonesian government to responsibly manage refugee situation; and secondly, evaluate the collective efforts of the Indonesian government and the global community in seeking a comprehensive resolution to this crisis. The paper focuses on the legal dimensions of the Rohingya refugee situation in Indonesia, employing a normative approach. It offers a descriptive analysis from the perspective of governance and international law. The findings emphasize the need for the Indonesian government to adopt a proactive stance. Key measures include advocating for the Rohingya's right to citizenship, urging the Myanmar government to halt its violence, and calling for active intervention from the United Nations (UN) and the international community. Furthermore, it is recommended that Indonesia continues to offer temporary refuge on humanitarian grounds, ensuring the provision of aid and adhering to the principle of non-refoulement. Effective coordination among local and central governments, as well as international partners, is essential for the strategic management of refugee issues.

Abstract

The enforcement of political neutrality among contract-based government employees (PPPK) presents complex legal and institutional challenges within Indonesia’s decentralized administrative system. This study critically examines the legal, constitutional, and cultural dimensions of PPPK neutrality during regional elections, with a particular focus on the case of Purbalingga Regency. Using a socio legal methodology, the research combines doctrinal, normative, and empirical approaches to assess the effectiveness of existing legal instruments, primarily Law Number 20 of 2023, and their practical application in local governance settings. The analysis draws on interviews, survey data, and field observations to evaluate the institutional capacity of civil service bodies such as BKD, KASN, and Panwaslu, as well as the role of civil society in oversight. The findings reveal significant enforcement gaps caused by regulatory ambiguity, overlapping institutional mandates, and limited internalization of neutrality as a professional ethic. Although neutrality is legally required, its implementation is constrained by legal uncertainty related to PPPK’s dual identity as both public officials and holders of constitutional rights. The study argues that enforcement must move beyond formal legal provisions to include cultural legitimacy, institutional coordination, and adaptation to digital era challenges. Drawing on the legal doctrine of proportionality and the concept of law as a living institution, the study recommends regulatory reform, structured ethical training, and participatory monitoring mechanisms to promote accountability and safeguard democratic integrity within the civil service.

Abstract

In Indonesia, the role of attorneys in resolving legal issues is indispensable, yet the absence of standardized attorney fee regulations has led to significant barriers in accessing legal services. Despite attorneys' rights to receive fees for their services, the lack of clear guidelines has resulted in public perception that hiring legal representation is a luxury, with many unable to afford it. This study explores the urgent need for state regulation of attorney fees to ensure fairness and broaden access to justice for all segments of society. The findings indicate that the lack of fee standardization contributes to inequities in the legal system, creating barriers for lower-income individuals to access legal assistance. Furthermore, it reveals that establishing a clear regulatory framework would provide legal certainty, protect consumers, and promote a more equitable system for all citizens. The novelty of this research lies in its exploration of attorney fees as a critical element in improving access to justice in Indonesia, framing the issue beyond economics and highlighting its social justice implications. By addressing the urgency of regulating attorney fees, the study contributes to the ongoing legal reform discourse, providing policy recommendations for creating a fee structure that balances fairness with professional responsibility. The research emphasizes that deliberative processes, considering factors such as case complexity, impact, and operational costs, should guide the determination of fees. Ultimately, the study presents a compelling argument for rethinking how attorney fees are regulated to ensure that justice is accessible to all, not just the wealthy.

Abstract

This Article is mention to describe the existence of administrative law that inherent with the activity of public servants and it makes many consequences in the term of law enforcement. Based on the analysis of the administrative system, there are many problems in the structure, substance and culture of its legal system. The problems in those three aspects can be seen in the substance of President Regulation No.30 year 1980 that gave the opportunity for the infraction. Abstract

In the form of philosophies, histories and comparative studies, limiting the political rights of civil Servant is a political outcome of the state to create a public official relations between the countries with the civil servant based on merit system that applies in the civil service law. Abstract

Solution of Raperda in regional parliament has entangled governmental element, parliament and society. Involvement of society assessed before existence of formal solution of Raperda is at hearing public process and empirical facts analysis by SKPD. When solution of Raperda, society can follow to involve actively at level I, II and of IV in plenary meeting. Besides that, after perda have done, society still enabled to involve in public test. In this case, legal status between woman and men is same.  The women's involvement in making of regional law, especially in Banyumas, still experience of various constraint. In this case, role of woman (generally) still assumed lower or not yet maximal. Opportunity have been given by government but woman still not yet earned the rights maximally. There are role of woman in attendance  but role in input form is not yet maximal. In general, arising out constraint to women involvement in making regional law is come from society mindset concerning woman, cultural and quality of the Human Resources.  Kata Kunci : Keterlibatan Perempuan, Produk Hukum Daerah

Abstract

These days the solving of dispute by jurisdiction gets the critics from the practitioner and the jurist. The role and function of jurisdiction were assumed overloaded, wasting time, expressive, less responsive to the public interest, and also too formal and technical. There were various concepts that already offered to make the jurisdiction more simple, quick and light expenses.  One of the concept which have been offered and now applying is the mediation institute in the civil the court system through PERMA No. 2 year 2003. The background of this regulation is because of the application of article 130 HIR is not effective. It changes the voluntary to the compulsory system by using the mediation institute. Now the party must used the mediation before entering the litigation. Kata kunci: Jurisdiction, dispute and mediation.
