Abstract

Divorce and marital disputes are significant social issues in Deli Serdang Regency, Indonesia. This study evaluates the effectiveness of the prospective bride and groom course program and the role of the Marriage Counseling, Guidance, and Preservation Agency (BP4) in resolving marital disputes during the 2021-2023 period. This empirical legal research employs a descriptive qualitative approach, utilizing data from BP4 statistical reports and the Lubuk Pakam Religious Court. The findings indicate that BP4's involvement in marital disputes is low, ranging from 0.95% to 1.48% of total cases filed with the Religious Court, but the success rate of mediation at BP4 is significant, reaching 33.33%. The prospective bride and groom course program is effective in reducing the number of disputes that end up in court. Policy recommendations include increasing public awareness about the importance of mediation before filing court cases and strengthening the prospective bride and groom course program as a more effective divorce prevention measure.

Abstract

This article is an attempt to analyze the position and authority of the Sunnah in the Ahmadiyya istinbāṭ al-aḥkām. This departs from the epistemological claim of the Ahmadiyya who explicitly identify themselves as Aḥnāf (followers of the Ḥanafi school), who are essentially ahl ar-ra’y, on the one hand, and at the same time claim to be ahl al-ḥadīs, on the other. This position is methodologically unique and interesting, because it has the potential to create tension between rational reasoning and the authority of hadith texts. This paper is a literature review (library research) by analyzing primary sources of the Ahmadiyya. The results of the study indicate that the sunnah/hadith for the Ahmadiyya is a secondary source of law, by distinguishing between binding sunnah (mulzim li al-hukmi) and non-binding sunnah (gairu mulzim li al-hukmi). However, the authority of the Sunnah is limited to its confirmatory (ta’kid) and explanatory (mubayyin) functions regarding the Qur’an, while its formative (making new laws), takhṣīṣ, and naskh functions are explicitly rejected. This limitation has the effect of narrowing the normative space of the Sunnah. Although theoretically it does not recognize the formative function of the hadith (making new laws), in practice, the Ahmadiyya uses the hadith to create new laws, namely when legitimizing the mahdīth and mujaddiqīyah of Mirza Ghulam Ahmad, even though this is not mentioned in the Qur’an. This “narrow” authority of the Sunnah has consequences for the high authority of the caliph in the practice of istinbāṭ al-ahkām of the Ahmadiyya. Of course, this is a characteristic feature of istinbāṭ al-ahkām, where the caliph has the highest authority as the highest interpreter. This finding also emphasizes the importance of studying Islamic jurisprudence (fiqh) and Islamic jurisprudence (ushul fiqh) in understanding the dynamics of Ahmadiyya thought more comprehensively.

Abstract

This study aims to analyze the position of the Qur’an and the Sunnah as the primary sources and legal evidences of Islamic law, as well as to explain the characteristics of textual implication (dalālah al-naṣṣ) in the determination of legal rulings. This study is motivated by the continuing misunderstandings in comprehending the relationship between the Qur’an and the Sunnah and their implications for the formulation of Islamic legal rulings. The research employs a qualitative approach using a library research method, examining both classical and contemporary literature in the fields of uṣūl al-fiqh, Qur’anic exegesis, and ḥadīth studies. The analysis focuses on the definitions of the Qur’an and the Sunnah, the concepts of qaṭ‘ī al-dalālah and ẓannī al-dalālah, and the functions of the Sunnah in explaining, reinforcing, and complementing Qur’anic rulings. The findings indicate that the Qur’an constitutes the primary, normative, and universal source of Islamic law, while the Sunnah occupies the position of the second source, functioning as an interpreter, explicator, and confirmer of Qur’anic provisions. The study also reveals that legal verses in the Qur’an possess varying degrees of textual certainty, namely qaṭ‘ī, which is definitive and leaves no room for ijtihād, and ẓannī, which remains open to interpretation and ijtihād. Furthermore, the Sunnah is classified into qauliyyah, fi‘liyyah, and taqrīriyyah, each of which plays a significant role in the formation of Islamic law. This study emphasizes that a proper understanding of the sources and legal evidences of Islamic law is essential for the correct and contextual application of Sharī‘ah.

Abstract

This article analyzes the differences between the legal constructions of Egypt and Indonesia in addressing the dilemma of grandchildren whose parents predeceased the decedent, thereby potentially causing them to be excluded by closer heirs. The study focuses on a comparison between the obligatory bequest (waṣiyyah wājibah) in Egyptian law and substitute heirs in Indonesian law. This research employs a normative juridical method using statutory, conceptual, comparative-law, and maqāṣid al-sharī‘ah approaches. The findings show that Egypt, through Law of Bequest No. 71 of 1946 (Qanun al-Wasiyyah), provides protection for grandchildren through a bequest limited to a maximum of one-third of the estate. In contrast, Indonesia, through Article 185 of the Compilation of Islamic Law, positions grandchildren as substitute heirs who receive a share based on the position of the parent they replace. The findings of this article affirm that the difference between the two systems is not merely a technical matter of inheritance distribution, but reflects different paradigms in the reform of Islamic inheritance law: Egypt adopts a protective-testamentary model, while Indonesia adopts a representative-inheritance model. From the perspective of maqāṣid al-sharī‘ah, both models are oriented toward the protection of lineage and property, but they differ in balancing legal certainty, the protection of grandchildren, and justice for other heirs.

Abstract

Islamic inheritance law in Indonesia is shaped not only by faraidh norms, but also by state codification, customary practices, family legal culture, and social change. This article aims to analyze the formation of Islamic inheritance law in Indonesia through a socio-anthropological approach to the dialectic between norms, custom, and social transformation. This study employs qualitative library research with normative, statutory, sociology of law, legal anthropology, legal pluralism, and maqāṣid al-sharī‘ah approaches. The findings show that Islamic inheritance law in Indonesia is formed through layered negotiations among the certainty of faraidh, the reformative provisions of the Compilation of Islamic Law, family deliberation, kinship systems, local authority, and socio-economic needs. Custom may function as a mechanism of harmony, but it may also eliminate heirs’ rights when not accompanied by legal awareness, voluntary consent, and protection of vulnerable parties. This article proposes an integrative-critical model that positions faraidh as a normative anchor, while local practices may be accommodated insofar as they fulfill transparency of rights, clarity of property status, voluntary agreement, protection of vulnerable heirs, and maqāṣid-oriented benefit. This model affirms inheritance as both a legal norm and a dynamic, contextual social practice.

Abstract

This study aims to reconstruct the function of takhsis in ushul fiqh within contemporary Muslim society by critically examining its conceptual role and practical application in modern Islamic legal reasoning. The research employs a qualitative normative methodology through textual and analytical approaches, focusing on classical ushul fiqh literature, contemporary scholarly works, and selected fatwa and legal discourses that reflect current socio-legal realities. Data are analyzed by comparing classical formulations of takhsis with contemporary interpretations to identify patterns of continuity, shift, and methodological tension. The findings indicate that the function of takhsis in contemporary practice tends to be applied in a limited and formalistic manner, often emphasizing textual restriction while neglecting broader contextual, social, and purposive considerations. This condition results in interpretive rigidity and difficulties in responding effectively to social change, legal pluralism, and new legal problems faced by Muslim societies today. The study finds that takhsis requires functional reconstruction by repositioning it not merely as a textual limiting tool, but as a dynamic methodological instrument that operates in harmony with contextual analysis and the objectives of Islamic law. The study concludes that such reconstruction is essential to maintain the relevance and adaptability of ushul fiqh in contemporary contexts. Academically, this research contributes to the development of ushul fiqh studies by offering a systematic reinterpretation of takhsis that bridges classical legal theory and contemporary legal challenges, and by enriching ongoing discussions on Islamic legal methodology, reform, and contextual interpretation.

Abstract

Masyarakat sering membandingkan Bias gender disebabkan oleh tubuh dan biologi laki-laki dan perempuan. Bias gender sering kali berasumsi bahwa perempuan lemah dan menjadi sasaran diskriminasi, kekerasan, dan pelecehan. Akibat perkembangan sosial-tradisional, pandangan ini sering terjalin dalam masyarakat. Tujuan pembebasan adalah untuk memuji perempuan atas hak-hak mereka yang tidak diakui. Di sisi lain, struktur sosial yang memaksa perempuan untuk bekerja di rumah tidak berubah meski ada pembebasan yang memungkinkan perempuan memasuki profesi publik. Kajian ini bertujuan untuk mendefinisikan isu-isu pembebasan perempuan pekerja dari perspektif Islam. Penelitian kepustakaan berbasis analisis deskriptif adalah metode yang digunakan dalam penelitian semacam ini. Informasi primer dalam penelitian ini berasal dari tulisan profesional yang membahas tentang pembebasan dan kesetaraan gender, sedangkan informasi sekunder berasal dari buku-buku dan karya-karya objektif yang berkaitan dengan modul penelitian. Studi ini menemukan bahwa Islam menerima hukum perempuan bekerja sebagai langkah menuju pembebasan perempuan selama mereka melindungi kodratnya sebagai istri, ibu, dan perempuan serta menerima bentuk amal untuk keluarganya. Namun, jika perempuan melalaikan tanggung jawabnya dan bekerja tanpa izin suaminya, hukum ini bisa menjadi tabu

Abstract

The aim of this research is to describe the study of Philosophy as a method for understanding Islamic law, especially in the field of sharia economics. The research approach uses qualitative research with the type of documentation or text study research, namely, a series of activities using collecting information relevant to the research topic, reading, taking notes and processing research materials. Meanwhile, analysis is used to carry out deeper discussions based on the information that has been obtained. The results of the research in this paper show that Philosophy is an important option in developing sharia economic law, such as salam sale and purchase contracts, al-istisna', murabahah, online shops, and vending machines which can now be investigated using the Philosophy Science method, apart from that. The advantages of applicable law with the basic aim of Philosophy are to eliminate Mudharat and achieve Ma?la?ah.

Abstract

Environmental destruction is a frequently discussed theme in the Quran, one of which is found in Surah Ar-Rum verse 41. This verse attracted the attention of Tahir Ibn 'Ashur, a 20th-century exegete, in his commentary Tahrir wa Tanwir. This study aims to analyze Ibn 'Ashur's thoughts on this verse and its relation to environmental jurisprudence. This research is library research with an environmental jurisprudence approach. The primary source is Tafsir al-Tahrir wa al-Tanwir, while secondary sources include the commentaries of al-Qurthubi, Ibn Kathir, as well as lexicons and environmental jurisprudence books. The findings show that Ibn 'Ashur provides a more contextual interpretation of Ar-Rum 41, particularly regarding the meaning of the term fasād. He distinguishes fasād into two meanings: a general meaning (ideological, moral, and spiritual destruction) and a specific meaning (environmental pollution). Ibn 'Ashur also affirms the causality between human actions and environmental damage, explaining the impacts on land (loss of food, plagues) and sea (decline of fish, pearls, and storms). In conclusion, Ibn 'Ashur's thought is relevant to addressing the contemporary ecological crisis as it encompasses both spiritual and material dimensions

Abstract

Law No. 38 of 1999, later amended by Law No. 23 of 2011 on the Administration of Zakat, provides the legal basis for the administration of zakat in Indonesia. These laws and regulations recognise only two entities, namely the National Zakat Amil Agency (BAZNAS) and the Zakat Amil Institution (LAZ), as the legal managers of zakat in Indonesia. In Medan, there are two types of amil zakat, as well as community-formed amil-amil zakat who manage zakat at the mosque level, specifically for zakat fitrah. It is important to note that some of these mosque-level Amils have been approved by the state through a sub-unit framework known as the Zakat Collection Unit (UPZ). Meanwhile, some of these amil-amil have not yet been approved by the state and are only based on the policies of the Prosperity Board (BKM) of each mosque. In Islamic Jurisprudence, the appointment of an amil is carried out by the authority of the caliph/sultan (state). In this case, the amil's position is as a representative of the zakat mustahik. It is important to note that the appointment of an amil should be approved by the state to ensure compliance with Islamic Jurisprudence. This research aims to address three problems related to the establishment and management of zakat at the mosque level in the city of Medan, according to Law No. 23/2011. Specifically, the research will examine: 1) the procedure for establishing zakat amil at the mosque level, 2) the management of zakat by the zakat amil at the mosque level, and 3) ways to optimise the management of zakat by the zakat amil at the mosque level. The language used is clear, objective and value-free, with a formal register and precise word choice. The text follows conventional structure and format, with a consistent style of quoting and footnoting. The sentences and paragraphs create a logical flow of information with causal links between propositions. The content has not been changed. This research has identified three key findings in this area. Firstly, the procedure for establishing Amil Zakat at the mosque level in the city of Medan is based on the policy of each mosque administrator (BKM). Secondly, the BKM's policy is then confirmed (validated) through the UPZ system by the National Amil Zakat Agency (BAZNAS) of the city of Medan. Finally, it is recommended that a more standardised procedure be implemented to ensure consistency across all mosques in the city. Zakat administration at the mosque level in the city of Medan is an ancillary activity that takes place only during the month of Ramadan and mainly within the framework of Zakat fitrah. During the collection phase, Amil opens a zakat booth at the mosque or at the BKM office, and potential muzakis come to the mosque to pay their zakat. Mosque Zakat Amil uses two methods: the coupon method and the delivery method for the distribution stage to the mustahik. Under the voucher system, a Muslim must present a voucher at the mosque in order to collect his zakat. Currently, the optimisation of zakat management in mosque zakat amil is limited to the collection and distribution stages, without taking into account the utilisation of zakat. Optimising Zakat collection is achieved through Zakat education, specifically by choosing recitation or lecture topics that focus on Zakat and by starting the Zakat collection period at the beginning of the month. During the distribution stage, optimization is achieved by prioritising mustahik selection, with a focus on actual mustahik. This research has found that there is little coordination between the Zakat Amil of the mosque and the BAZNAS, as well as between the Zakat Amil of the other mosques. It is important to address this issue in order to improve the effectiveness of the Zakat distribution.
