Abstract

This article discusses an academic discourse on the origin of Islamic Law by describing third school between two schools existing in this controversial field. By descriptive and comparative method, this article tries to describe how Yasin Dutton views on the beginning of Islamic Law’s construction, and then how he digs his hypothesis against two dominant schools involved in the discussion of the date of Islamic Law birth. Dutton finds that if the Qur’an is the first written formulation of Islam in general, al-Muwatta of Malik is arguably the first written formulation of the Islam-in-practice’ that becomes Islamic law. This way is missing in the first and second school attention. He considers the methods used by Malik in the Muwatta‘ to derive the judgements of the law from the Qur’an is thus concerned on one level with the finer details of Qur’anic interpretation. However, since any discussion of the Qur’an in this context must also include considerations of the other main source of Islamic law, namely the sunna, or normative practice of the Prophet, this latter concept, especially its relationship to the terms of hadith and amal (traditions’ and living tradition’), also receives considerable attention. it is impossible, for Dutton, to find that these two main legitimate sources, textual and practical, will be different and in dispute. This third school wanted to fill the gap between these two schools using different object and argument although in someway meet in same conclusion.

Abstract

Abstract: In this contents, Hadith reflects the different teaching of Islam, including creed, worship, and muamalah. All of that requires a different treatment and understanding the proportionally. This article examines how to understand the Hadiths in the field of muamalah and what is the paradigm construct of it. By using the method of subjective-humanistic hermeneutics, this article produces findings, as follows: first, the Hadiths of muamalah reflect construct of human relationships and it can change according to the changes and development of social life. Therefore, these Hadiths can be understood by using the anthropocentric paradigm, oriented on the needs of humans and make it as a subject and object either of the understanding. Second, this anthropocentric paradigm aims to find the sunnah and host it again in the present day. This anthropocentric understanding holds on to the principles and the universal values contained in the text of the Hadith as well as humanistic social ethics that upholds human values that are fairness, equal and tolerant without discrimination in various fields.Abstrak: Dari segi kandungannya, hadis Nabi mencerminkan muatan ajaran tentang akidah, ibadah dan muamalah. Kesemuanya itu membutuhkan pen­sikapan yang berbeda dan pemahaman yang proporsional. Artikel ini meng­kaji bagai­mana memahami hadis-hadis Nabi dalam bidang muamalah serta bagai­mana konstruksi paradigma yang dimaksud. Dengan menggunakan metode hermeneutika subjektif-humanistik, artikel ini menghasilkan temuan, sebagai berikut: Pertama, hadis muamalah merefleksikan konstruk relasi manusia, dan bisa berubah sesuai dengan perubahan dan perkembangan kehidupan sosial. Oleh karena itu hadis-hadis ini bisa dipahami dengan meng­gunakan paradigma antroposentris, yang berorientasi pada kebutuhan manusia dan menjadikannya sebagai subjek sekaligus objek dalam pemahaman. Kedua, paradigma antropo­sentris ini bertujuan untuk menemukan sunnah Nabi dan meng­hadir­kannya kembali dalam konteks sekarang. Pemahaman antropo­sentris ini berpegang pada prinsip dan nilai-nilai universal yang terkandung dalam teks hadis serta etika sosial humanistik yang menjunjung tinggi nilai kemanusiaan yang berkeadilan, setara dan toleran tanpa diskriminasi dalam berbagai bidang.

Abstract

Hadith ghadir khum is the culmination of a dispute between Sunni and Shi’ite. This article tries to analysis comprehensively the hadith by elaborating understanding in two perspectives: exploring the factors that cause these differences and re-understandinging the interpretation hadith. This study found that there were differences in understanding between the Sunni and Shi’ite schools in understanding the hadith. This difference is at least caused by two things, namely: the context of the hadith and the meaning of the word maul. According to the Sunnis, this hadith contains a warning from the Prophet to his people to love and help one another (having walâ’- muwalât) and not hating and opposing each other (mu’âdat). Meanwhile, according to Shi’ah, this hadith is considered a moment in which the Prophet directly named Ali as a successor and successor to the leadership after the Prophet. Reconstruction of understanding is done through two things, namely the historical reconstruction and reinterpretation of the meaning of the womb. Overall, the ghadir khum hadith is interpreted as a form of the Prophet’s love for the people and their families. The love of his people is proven by his will in the form of thaqalain, namely al-Kitab (Alquran) and love for his family with the intention to make Ali (representation of ahl al-bait) as maulâ (friend, lover) of Muslims.

Abstract

Abstrak: Kenabian merupakan derajat tertinggi dalam Islam. Dalam menetapkan seseorang dengan posisi tinggi ini, ulama telah menetapkan syarat dan karakteristik. Masalahnya muncul ketika syarat dan karakteristik ini disematkan kepada seseorang yang berjenis kelamin perempuan, yakni Maryam. Ulama berselisih dalam menetapkan posisinya di antara jajaran kenabian. Tulisan ini akan mengurai bagaimana konsep nabi dan karakteristiknya secara umum, bagaimana relasi perempuan dan wahyu, bagaimana perbedaan pandangan ulama khususnya ahli tafsir terkait dengan status Maryam dan argument al-Qur’an bagi penetapan Maryam sebagai bagian dari mata rantai nabi dalam perspektif tafsir yang berkeadilan jender. Metode yang digunakan adalah deskriptif, dengan pendekatan filosofis dan komparatif. Tulisan ini menemukan bahwa karakteristik kenabian yang ada jika diterapkan pada sosok Maryam akan “memaksa” adanya kesimpulan bahwa Maryam dengan segala deskripsi al-Qur’an dan sejarah merupakan salah satu mata rantai kenabian dalam Islam. Abstract: Prophethood is the highest degree in Islam. In determining a person with this high position, scholars have established requirements and characteristics. The problem arises when the seterms and characteristics attributed to someone who is female, such as Mary. Clerics argue in determining its position among the ranks of prophet hood. This article will discuss how the concept of the prophet and general characteristics, the relationships of women and revelation, how divergent views of commentators, especially relating to the status of Mary and the arguments of the Qur'an for the determination of Mary as part of the chain of prophets in perspective interpretation of gender equity. The method used is descriptive, with a philosophical approach and comparative. This paper found that the characteristics of the existing prophetic when applied to the figure of Mary will be "forced" to the conclusion that Mary with any description of the Koran and the history is one of the chain of prophethood in Islam. Abstract

Memorizing the Qur’an is a form of reception for the Qur’an. This phenomenon demonstrates the performative function of the Qur’an outside the text. The purpose of this study was to determine the practice of Halaqah Tahfiz al-Qur’an activities and the form of treatment or reception of students of Al-Mizan Muhammadiyah Lamongan in the Halaqah activity. This research resulted in the knowledge that the activities of Halaqah Tahfiz al-Qur’an in Islamic boarding schools are compulsory and superior activities that become a vehicle and means of regeneration for students. The forms of treatment of students in the Halaqah Tahfiz al-Qur’an activities include: ablution before activities, praying, praying Hifz al-Qur’an, praying hajat, writing memorized verses, and muroja'ah. The meaning produced from the Halaqah Tahfiz al-Qur’an activity follows the sociological theory of knowledge by Karl Mannheim including the objective meaning, the Halaqah Tahidz Qur’an  activity is a compulsory and superior program initiated directly by KH. Drs. Sutaman and must be followed by all students who live there. As for the expressive meaning, the activities of the Halaqah tahfiz al-Qur’an bring benefits according to the way they treat the Qur’an. As for the meaning of documentary, the Halaqah Tahfiz al-Qur’an activity is an activity without coercion and purely from the wishes of the students themselves, supported also by the motivation they get from themselves, their parents, and the Islamic boarding school caretakers. This research resulted in a new understanding and contribution reception package for the Living Qur’an research.

Abstract

In preaching, da'i must need a way or method to provide attractiveness for the object of da'wah to enter into the study of da'wah, the ethics of fashion as a thing that is very noticed by the community in the da'wah of its da'i, no wonder when fashion trends today become a favorite thing of the community in a da'wah delivered by the da'i. It has been widely studied about the ethics of fashion in preaching in order to attract mad'u, but not all people have a fashion interest in one da'i. In this journal, the author took three examples of da'i using clothes that were able to attract mad'u in his da'wah studies, namely Hanan Attaki, Ali Jaber, and Miftah. The purpose of this journal is because the public knows that fashion is able to cause mad'u interest in a da'wah. With this journal, we will know that all kinds of clothing can be used as a trend of da'wah as long as it doesn’t violate ethics of da'wah fashion that is in accordance with shariat islam
