Abstract

This thesis aims is to analyze the effect of trade agreement between Indonesia and China in ASEAN-China Free Trade Agreement (ACFTA) for smuggling of Chinese textile in Indonesia on 2015-2017. This thesis begins with the descriptions of textile trading’s conditions respectively in Indonesia and China, textile trading between the two countries, textile trading between China and ASEAN, and an explanation of information on Chinese textile smuggling that occurred in the port of Batam. This research’s methode uses qualitative method with explanative type of research and analyzed by collecting data obtained from interviews, books, journals, reports of previous researchers and mass media. The range of research on this screening is from 2015 to 2017. The explanation of the effect of ACFTA on Chinese textile smuggling in Indonesia uses neoliberalism theory and the concept of free trade and deregulation. The results of this study indicate that the concept of deregulation in ACFTA is realized by the decrease of Chinese textile import duty to 0% makes Chinese textile imports in Indonesia cheaper than the domestic. This has resulted in losses for textile businessmen and guiding them to find ways to avoid losses by smuggling Chinese textiles through the port of Batam.

Abstract

This research aims to observe what role conducted by Polda Jateng against terrorism issue.Terrorism is one of the trasnational crime which has frightening effects.Central Java is oneof the province which has a many cases of terrorism from 2009 until 2014. Polda Jateng isan institution that has a role inlaw enforcement andcombating terrorism.This research usesqualitative method with necessary type of descriptive. The data were collected from bothprimary and secondary sources to describe every single roles conducted by Polda Jateng.The result shows that Polda Jateng has a role to preserve the crime scene in everyprosecution case of terrorism.

Abstract

This research aims to determine the cause of Thai Government's role on handling theissues of Rohingya’s asylum seekers, victims of ethnic conflict in Thailand. These problemsarise as a result of the conflict between ethnic Rakhine Buddhists and Rohingya Moslemsin Myanmar 2012, until eventually the Rohingya moslems fled from Myanmar seekingasylum to neighboring countries. English school of thought, concept of compliance andResponsibility to Protect or R2P, is used to explain the basis and forms of Thailandcompliance on the international organizations of the United Nations (UN), as well asThailand's responsibility to protect the Rohingya refugees and asylum seekers. Theresearch method is explanative which used to analyze and explain the various problems ofRohingya asylum seekers such as the existence of smuggling and trafficking of Rohingyaasylum seekers. Results from this research is the Thai government act in accordance withthe provisions of the United Nations and international law on handling Rohingya’s asylumseekers, as a form of allegiance to United Nations and also has the responsibility toprovide human right protection for Rohingya refugees. From these findings, thesuggestions that emerged was the Government of Thailand should ratify the 1951Convention and 1967 Protocol about the international refugee protection, in order forasylum seekers to gain firm and fair access to the procedure for sanctuary.

Abstract

This research aims to explain the causes of illegal trade of HCFC-22 between India and China in 2013-2014 from India’s side. This research used qualitative methods, with compliance theory by Ronald B. Mitchell to analyze the causes of the case. There are some result of this research. First, this reasearch found out that the illegal trade of HCFC-22 is a low-low relations. Second, the illegal trade was caused by the incapacity, seen from the limited ability of Indian goverment to fulfill the necessary of alternative chemichal substitution to HCFC-22 and the limited ability of Indian society to afford the stuff with alternative chemichal due tue economic and environmental condition.

Abstract

Malaysia is a main destination for Indonesian labors in Southeast Asia.Indonesian Labors that worked in Malaysia wanted to fix their family’seconomy condition, but their existence is thus vulnerable to human rightsviolations in particular domestic workers sector. Cases of human rightsviolations experienced by Indonesian Labors in Malaysia include traffickingin persons for labor which is a form of transnational crime. This researchaims to know the human rights violations experienced by the labor ofIndonesia in Malaysia period 2011-2013. This research is using a qualitativemethod with descriptive research analytical techniques type through researchstudies of the literature and interviews. This research uses the concept ofhuman rights and theory of transnational crime in liberalism paradigm. Theresults obtained from this research indicate that human rights violationsexperienced by Indonesian labor domestic workers sector in Malaysiahappened during the pre-labor placement and the placement period.

Abstract

From national, regional, to international level, the issue of drug abuse becomes one of the most important issues to be resolved. This issue of drug abuse also become a big problem in Indonesia and other countries in Southeast Asia. ASEAN as a regional institution in Southeast Asia region considers this as an urgency that must be handled comprehensively that eventually countries in Southeast Asia have a shared commitment to create a drug-free area. This research contains a discussion of the Indonesian manifestazion to the commitment of ASEAN Drug Free Area in President Joko Widodo era. This study uses the concept of an international regime, which draws conclusions and from data collected in the field. The results of this study show that Indonesia in the era of President Joko Widodo government made efforts in eradicating drugs referring to the work plan of the ASEAN Drug Free Area. The ASEAN Drug Free Area focus in the form of supply and demand reduction is manifested by Indonesia through their national policy. Indonesia is also implementing its policies in accordance with the ASEAN Drug Free Area work plan which is divided into six aspects: (i) Preventive education, (ii) law enforcement, (iii) treatment and rehabilitation, (iv) research, (v) alternative development, and ( vi) law and cooperation.

Abstract

This research aims to determine the cause of increasing illegal timber trade from Indonesiato China within 2010-2015. During that time, both countries established bilateralcooperation through Memorandum of Understanding Between the Ministry of Forestry ofthe Republic of Indonesia and the State Forestry Administration of the People’s ofRepublic of China Concerning the Cooperation in the Field of Forestry which was signedon September 15th, 2010. This is a qualitative research, using explanation. This researchused neorealist theory. As the consequences this research showed that the cause ofgrowing in illegal timber trade from Indonesia to China is weak supervision in borderregions and law enforcement against criminal acts of forestry in Indonesia. Besides, Chinais not seriously implement the MoU. This situation occurs because China got relative gainsless than Indonesia.

Abstract

Al-Qaeda, with Osama Bin Laden as the leader, had been known for doing a lot ofterrorism acts global-wide. This research is carried out to study about the behavior ofOsama bin Laden’s terrorism acts and to explain the factors influencing such behavior andacts. To achieve that purpose, this research employs qualitative method using thePsychosicial Principles provided by Luis de la Corte et.all. as the analytical tool. The studyfound that Osama Bin Laden’s terrorism acts were influenced by at least 5 among 7 factorstabled by de La Corte. These factors are minority interest, interaction and socialenvironment, coorperation with other groups based on common interests, facilities forsupporting terrorism, and ideology accepted by the public.

Abstract

Illegal logging is an environmental issue that is becoming one of the majorfocus of the international agendas. Losses due to illegal logging not onlyaffects the environment sector but also in the economic, legal and social sector.As one of the largest wood exporting countries for the European Union,Indonesia holds an important role in addressing illegal logging in both theEuropean Union and in Indonesia itself. In addressing the issue, Indonesia andthe European Union establish a cooperation framework called the Forest LawEnforcement Governance and Trade - Voluntary Partnership Agreement (VPA).This study research seeks to analyze Indonesia’s background in it’sparticipation on FLEGT – VPA -that is pioneered by the European Union as- aframework in preventing cases of illegal logging in Indonesia, as one of themajor exporters of the European Union. This study reseach is usingqualitative-descriptive method. This study research also uses the theory ofinternational regimes of Snidal. The results of this study research proves thatthe collaboration regime of FLEGT-VPA had a positive impact on reducing thenumbers of illegal logging and increasing the export number from Indonesia.

Abstract

United States and France were the two countries that had high involvement in humanitarian intervention in Libya in 2011. In fact, the humanitarian intervention process was deviated from the original goal of humanitarian intervention which was for humanitarian reasons. This indicates that the United States and France have their own interests behind humanitarian intervention in Libya. This research aims to analyze the interests of the United States and France in carrying out humanitarian intervention in Libya in 2011. In this study also briefly explained how the conflict in Libya occur until the UN Security Council gave a decision to intervene. This study uses qualitative and explanatory research methods with two data sources, primary and secondary data. The theoretical framework used in this research is Neorealism theory. From the research that has been done, there are three interests of the United States and France in carrying out humanitarian intervention in Libya. The First is the interests of the United States and France to control oil in Libya, and the second is the political factor of the United States and France, and the third is the interest of the United States to overthrow the Muammar Gaddafi regime.
