Abstract

Desa atau yang disebut dengan nama lain mempunyai karakteristik yang berlaku umum untuk seluruh Indonesia, sedangkan Desa Adat atau yang disebut dengan nama lain mempunyai karakteristik yang berbeda dari Desa pada umumnya, terutama karena kuatnya pengaruh adat terhadap sistem pemerintahan lokal, pengelolaan sumber daya lokal, dan kehidupan sosial budaya masyarakat Desa. Metode Penelitian yang digunakan ialah jenis penelitian normatif, dengan pendekatan perundang-undangan. Adapun urgensi pembentukan Desa Adat ialah dalam rangka menjadikan sebagai alternatif penyelesaian sengketa, mempertahankan budaya lokal serta berperan dalam Pembangunan desa. Selain itu upaya formalisasi ini juga dibutuhkan untuk mempertahankankan eksistensi kesatuan masyarakat hukum adat serta memberikan perlindungan hukum.

Abstract

The format for regulating new and renewable energy in the draft law on new and renewable energy in Indonesia still contains many polemics and problems. This is motivated by various problems of conception and substance in it, such as misconceptions about nomenclature, problems with institutional formats, licensing problems, and the accommodation of nuclear energy. This paper aims to analyze the potential impacts and prospects of energy using a green constitution point of view. This study used normative juridical research with a statutory and conceptual approach. The results show that the environment is the dominant entity affected by energy management and utilization activities, both fossil energy and new renewable energy with different potential impacts. The prospect of a green constitution has been contained in the draft law on new and renewable energy, but it cannot be realized optimally because transition policies in Indonesia still have dual orientations and overlapping arrangements. The principles of a green constitution can be a guiding concept and norm for the format of regulation and implementation of the use and utilization of new and renewable energy so that it is in line with the values ​​of environmental protection and preservation.

Abstract

This research departs from the Regional Regulation of Balikpapan City Number 1 of 2014 concerning the Permit to open a State Land while the permit is required as proof of land ownership to register the right to land in Balikpapan city. A stamp statement of the land concerned can be used as proof of land ownership for the registration mentioned above. Based on the above issue, this research aims to investigate the problems regarding (1) the regulation of the provision of the permit used to open a state land as a requirement to register the right to land in Balikpapan city and (2) the implementation of the permit used to open a state land as a requirement to register the right to land in Balikpapan city. This research employed socio-legal and socio-juridical methods and took place in Balikpapan as the first city to put the regulation in place regarding the permit mentioned above as a requirement to register the right to land as governed in a Regional Regulation. His research reveals that the Regional Government of Balikpapan City holds the authority to enforce this regulation according to Law Number 23 of 2014 concerning the Regional Government. The implementation of this permit to open a state land as the proof of land ownership in the registration of the right to land in Balikpapan has not been efficient, while people can still refer to the stamp statement to replace this permit document. Therefore, this research suggests that adjustments regarding the regulation be made to assure legal certainty for the people of Balikpapan.

Abstract

Sidomulyo Hamlet, Sumberwaru Village, which serves as buffer zones of Baluran National Park, has 2,220 beef cattle as a potential economical source. At the same time, the beef cattle farming business's potential threatens Baluran National Park's existence due to being grazed illegally. The condition urges an efficient strategy so cattle farming can develop without disturbing the conservation zone of the national park. The study's objective was to find out the characteristics of beef cattle farmers in Sidomulyo Hamlet and to determine a strategy to improve beef cattle farming efficiency in Sidomulyo. The research was conducted in Sidomulyo Hamlet, Sumberwaru Village, from 1st June to 18th July 2022. The research method used a descriptive quantitative method with a SWOT analysis. The respondents were 72 cattle farmers. The research results showed that most of the cattle farmers in Sidomulyo are male, aged between 41-50 years old; the education level is mostly Elementary School, 11-20 years of cattle farming experience, and livestock ownership scale under 4 Animal Unit (AU). Increasing cattle farming efficiency is an SO strategy that supports aggressive growth: 1) Optimizing land use by planting forage. 2) Optimization of farmers' potencies and the availability of resources. 3) Cooperate with government and academicians to increase farmers’ knowledge and skill. 4) Application of feed processing and livestock manure technology.

Abstract

The escalating environmental crisis and pressing water resource conservation issues globally necessitate comprehensive research. This study investigates urban green space regulations and water resource conservation challenges in Indonesia and Australia. Employing a comparative analysis, it examines the legal frameworks, policies, and implementations in both countries. The research aims to identify innovative and sustainable strategies for water resource protection. Findings reveal substantial disparities in regulatory approaches, public involvement, and the integration of green technologies in green space management between the two nations. Indonesia needs help enhancing institutional capacity and integrating green space policies into urban planning, while Australia focuses on climate change adaptation and sustainable water resource management. The study advocates cross-sectoral collaboration and ecosystem principles in green space regulations for practical water conservation objectives. It contributes fresh perspectives on legal and policy frameworks for addressing water resource conservation challenges through urban green space management, offering recommendations for cohesive and sustainable policy development.

Abstract

This research aims to find out the management model of biodiesel based on used cooking oil in East Java. In this study, researchers used a research method with a qualitative approach. The result of this research is that the management of biodiesel based on used cooking oil in East Java technically, no special field handles these problems, so the relationship between related agencies could have gone better. In the research findings in the field, the current model still needs to improve. The use of interpretive qualitative methods was to provide satisfactory information related to the required aspects of the research and for researchers to closely assess the respondents' views on the challenges of recycling used cooking oil to produce biodiesel. The management of used cooking oil-based biodiesel in East Java technically does not have a special field that handles this problem, so relations between related agencies do not run well. In the policy-making process, there has also yet to be an adjustment to the existing characteristics of society, resulting in the policy for managing used cooking oil-based biodiesel not being optimal. Abstract

The constitutional interpretation of the regulation of State-Owned Enterprises (BUMN) is still looking for the right method, BUMN as the embodiment of the constitution for the state's responsibility in managing strategic resources that are used as wide as possible for the prosperity of the people. Submission of a judicial review to the Constitutional Court regarding BUMN can show the direction of constitutional interpretation given by the judges of the Constitutional Court. This article examines whether the constitutional interpretation of SOE arrangements is in accordance with Indonesia's national economic system. The method of approach in this writing is descriptive analysis which explains and analyzes the constitutional interpretation of SOE regulations. the results of the study reveal that the constitutional court has carried out its duties in accordance with the basic principles and principles of the constitution. The Constitutional Court in every decision in the field of BUMN dominates its interpretation by using an originalist interpretation.

Abstract

Paradigma pengelolaan sumber daya alam di sektor pertambangan yang dilakukan pemerintah selama ini menimbulkan berbagai permasalahan, antara lain: semakin meningkatnya konflik, kerusakan lingkungan dan tingkat kemiskinan masyarakat yang belum berubah serta mengabaikan sistem nilai, sosial, ekonomi, dan budaya masyarakat lokal. Sebagaimana yang terjadi di Lumajang, Konflik pertambangan di Lumajang berkaitan dengan isu sengketa kepemilikan lahan antara masyarakat dengan penambang maupun perusahaan tambang, interaksi pelaku tambang dengan masyarakat sekitar lokasi tambang, legalitas aktivitas pertambangan, degradasi lingkungan akibat adanya aktivitas lingkungan, dan regulasi pertambangan. Dalam kaitan itu diperlukan mekanisme penyelesaian sengketa alternatif atau alternative dispute resolution yang tidak membuat masyarakat tergantung pada dunia hukum yang terbatas kapasitasnya, namun tetap dapat menghadirkan rasa keadilan dan penyelesaian masalah. Mekanisme tersebut sebenarnya telah memiliki dasar hukum dan telah memiliki preseden serta pernah dipraktikkan di Indonesia walau jarang disadari. Mekanisme tersebut juga memiliki potensi untuk semakin dikembangkan di Indonesia.The paradigm of natural resource management in the mining sector by the government, has brought many problems, among others: the increasing conflict, environmental degradation and the poverty rate has not changed and the society that ignores the value system, social, economic, cultural and local communities. As in Lumajang, Lumajang mining conflicts relating to issues of land ownership disputes between communities and miners and mining companies, mining offender interaction with the community around the mine site, the legality of mining activities, environmental degradation due to environmental activities, and mining regulations. That regard the necessary mechanisms of alternative dispute resolution does not make people dependent on the legal capacity, but still can bring a sense of justice and problem resolution. The mechanism actually has a legal basis and already have a precedent and once practiced in Indonesia though rarely recognized. The mechanism also has the potential for further development in Indonesia.

Abstract

This research aims to analyze the impact of regulatory changes on the handling of discretionary authority within the State Administrative Court (PTUN) in Indonesia. Specifically, it examines how the legal status of discretion as an object of dispute has evolved following the enactment of Law No. 6 of 2023, which amended the Job Creation Perppu. The study focuses on how this legislative reform affects the acceptance and settlement of lawsuits related to discretionary decisions by public officials, as well as the legal boundaries that define which discretionary actions can be challenged in court. Using a normative juridical approach and in particular, this research employs statutory analysis to evaluate relevant laws and regulations, case studies to analyze precedents in PTUN decisions, and a comparative approach to assess differences in discretionary oversight before and after the enactment of Law No. 6 of 2023. The findings show that Law No. 6 of 2023 enhances judicial oversight of discretionary actions by allowing challenges based on both procedural and substantive grounds. It sets clearer limits on discretionary authority, requiring decisions to meet standards of transparency, accountability, and public interest. This reform strengthens the PTUN's role in reviewing not only the legality but also the justification of administrative decisions, offering citizens greater protection against arbitrary discretion and promoting good governance. This research contributes to academic discourse on administrative law by offering specific insights into how Law No. 6 of 2023 impacts discretionary authority and PTUN supervision. It highlights that the law now requires discretionary acts to meet stricter standards, focusing on procedural transparency and substantive justification. For instance, public officials must ensure their decisions align with good governance principles, and PTUN now plays a stronger role in assessing the substance of these actions. This provides legal practitioners with clearer guidelines for handling disputes involving discretion, particularly regarding the balance between decision-making flexibility and citizen protection.

Abstract

This paper illustrates how to develop a local development strategy in the establishment regulation of regional enterprises in the oil and gas sector in Bojonegoro District, Indonesia. This paper focuses on the locally generated domestic revenue in Bojonegoro, which have believed to be one of the most important strategies in their economic development. The oil and gas sector has contributed to almost 50% of the regional economic growth in Bojonegoro. However, the community in the region has not yet received an optimal benefit from the contribution as this sector only contributes 4.6% for its local employment in 2018 in comparison with the agrarian sector which contributes 36% for its local employees. The legal research conducted in this paper is juridical normative research by emphasising the establishment arrangement of the oil and gas regional enterprises to increase the locally generated domestic revenue from the sector. According to the Ministry Regulation of Ministry of Energy and Mineral Resources (MoEMR) Republica of Indonesia No. 1, 2008 on Guidelines for the Exploitation of Petroleum Mining in Mature Field stated that any Local (Village) Enterprise Unit ("KUD") or Regional Local Enterprises ("BUMD").
