Abstract

This outreach activity aims to increase knowledge about the criminal law aspects of the impact of narcotics abuse and increase the experience of communicating and interacting with the community directly through this community service activity. This training is conducted offline. Participants are 40 Youth Church of HKBP Sidorame Medan. The implementation is opening, counseling, video screening, presentation of posters on the impact of narcotics abuse, question and answer sessions, and participant feedback. Participants were enthusiastic about this activity, as seen from the participants' feedback. As many as 80 % of participants thought this extension went very well and all participants agreed that this activity was very useful Counseling delivered according to the needs of participants, invites all parties including parents, teachers, and the community to take an active role in being aware of the threat of narcotics to the younger generation. There are many things that can still be done to prevent teenagers from abusing narcotics, and to help teenagers who have fallen into drug abuse

Abstract

Criminal acts in Indonesia have increased during the COVID-19 pandemic which caused unrest in the community. One of the most common types of criminal acts during the Covid-19 pandemic is the crime of theft, all of which cause many layoffs. During 2019-2021, the number of thefts of plantation products in PTPN III during the Covid-19 pandemic increased significantly. The type of research used is empirical juridical research, while the source of legal materials used is primary legal materials and secondary source legal materials. The factors that cause the criminal act of theft of plantation products in the territory of PTPN III PERSERO are economic factors, educational factors, environmental factors, global development factors and law enforcement factors. Efforts to combat the theft of plantation products are carried out by penal and non-penal means.

Abstract

Legal protection for teachers is interpreted as efforts made by the government to protect teachers and other education personnel in carrying out their professional duties, both protection in legal, welfare, professional and social aspects. Through research conducted in a normative juridical manner, this study concludes that legal protection for teachers in the education process related to violent crimes has been fully regulated in various laws such as Law Number 14 of 2005 concerning Teachers and Lecturers and Government Regulation Number 74 of 2008 About Teachers. Where it is explained in the two laws that punishment and sanctions are given to students with the aim of teaching by the teacher not to be a violent crime. Legal protection for teachers in the educational process related to acts of violence in the education sector should be implemented using a penal policy and a non-penal policy. The use of this policy by looking at the factors and background of criminal acts in the field of education occurred, especially by considering the objectives of the teaching process carried out by teachers.

Abstract

Covid-19 is transmitted through close contact and droplets. People who are most at risk of infection are in close contact with Covid-19 patients or who care for Covid-19 patients and mortuary staff. For this reason, regulating criminal acts, mechanisms, and legal sanctions to the perpetrators of curing and burying the bodies of suspected, probable, and confirmed cases of Covid-19 that are not following the procedures will be discussed in this thesis research.

Abstract

Background: Spread corona virus disesea (Covid-19) in Indonesia has changed the implementation of the trial system, especially the trial of criminal cases using applications e-court. The maximum use of the e-court system has been implemented in line with the issuance of Supreme Court Regulation No. 1 of 2019 concerning Procedures for Electronic Trials (hereinafter referred to as Perma No. 1 of 2019). Objective: to guarantee the three basic values of legal objectives, namely justice, expediency and legal certainty. In addition, the application of the principles of simplicity, speed, and low cost in the judicial process can be interpreted broadly, including aspects of regulation, institutional and judicial processes. Methods: The approach method used in this paper is a statutory approach (statute approach) and conceptual approac. Results: The embodiment of criminal trials through e-courts during the covid-19 period has become a solution for the implementation of the principles of fast, simple and low-cost justice, while still upholding the principles of justice solus populi suprema lex esto. Conslusion: The existence of Perma No. 4 The year 2020 is an effort to reform the judicial system in Indonesia which is more modern and an effort to reform the Criminal Procedure Code in Indonesia, especially during the covid-19 period. Whereas the e-court trial has similarities to the Criminal Procedure Code, but still has differences that cannot be ignored.

Abstract

Criminal law politics is indispensable in tackling crimes under the guise of electronic investment to overcome the rampant crime in the field of information technology. The Criminal Code, Consumer Protection Law has not been able to overcome information technology crimes, then the government issued Law No. 19 of 2016 concerning Electronic Information and Transactions as an anticipatory step against the negative impact of advances in information technology. The cyber world has great crime potential and is very difficult to catch because most of the people present in cyberspace are fictitious. Countermeasures carried out by the government in tackling crimes under the guise of electronic investment are still oriented towards the criminal justice system, by applying the provisions in Law No. 19 of 2016 concerning Electronic Information and Transactions. Countermeasures faced by law enforcement in tackling crimes under the guise of electronic investment include, lack of law enforcement officers savvy with technology, limited facilities and infrastructure, and lack of public investment skills.

Abstract

Tindak pidana penyalahgunaan narkotika merupakan penggunaan tanpa hak dan melawan hukum yang dilakukan tidak untuk maksud pengobatan, tetapi karena ingin menikmati pengaruhnya dalam jumlah berlebih, kurang teratur, dan berlangsung cukup lama sehingga menyebabkan gangguan kesehatan fisik, mental dan kehidupan sosial. Tidak hanya laki-laki saja yang terlibat dalam kasus penyalahgunaan narkotika tetapi juga perempuan dalam kejahatan tersebut. Maka, dalam hal ini dilakukan pembinaan perempuan penyalahgunaan narkotika di dalam lapas. Jenis penelitian yang digunakan yaitu gabungan antara penelitian hukum normatif dan yuridis sosiologis, dengan teknik pengumpulan data melalui studi dokumen (bahan pustaka) dan wawancara. Dalam penelitian ini model pembinaan perempuan penyalahgunaan narkotika pasca Undang-Undang Republik Indonesia Nomor 22 Tahun 2022 tentang Pemasyarakatan yakni pembinaan kepribadian yang bertujuan agar warga binaan dapat menyeimbangkan dan mengendalikan dirinya dalam kegiatan jasmani dan rohani serta pembinaan kemandirian yang bertujuan membekali warga binaan dengan keterampilan dan keahlian. Hambatan yang dihadapi dalam pembinaan yakni dari warga binaan perempuan dan juga fasilitas yang kurang memadai.

Abstract

Almost fifty percent of the prison population is prisoners of narcotics, this situation is very worrying for the occurrence of drug abuse in prison. Overcrowding greatly affects the process of coaching prisoners, so it is likely that the expected goal of punishment will not be achieved. The nature of the type of research is normative juridical. The concept of coaching carried out to prisoners in prison is guided by Article 34 to Article 46 of Corrections Law No. 22 of 2022. The mentoring program for prisoners of drug abuse is carried out including personality coaching and independence coaching. Efforts to minimize the abuse of narcotics in prison are guided by Permenkumham No. 6 of 2013 relating to the Code of Conduct for Correctional Institutions and Detention Centers. Based on these regulations, efforts to minimize drug abuse in prisons are carried out with preventive and repressive actions. The obstacles faced by prisons in minimizing drug abuse in prisons include the unavailability of experts, obstacles from the community and the lack of infrastructure and facilities in carrying out the process of coaching prisoners.

Abstract

The crime of transferring the object of fiduciary security is a crime in the field of fiduciary security which iscarried out by selling the object of the fiduciary security which has not yet been paid off by the payment creditto a third party without written approval from a company as the recipient of the fiduciary. The problems in thisstudy are how the criminal liability of the perpetrator of the transfer of the object of fiduciary security withoutwritten consent from the fiduciary recipient (Study of Decision No.56/Pid.Sus/2019/PN Mnd) and how thejudge's considerations are based in imposing sanctions on the perpetrator of the transfer of the object. fiduciaryguarantee without written consent from the fiduciary recipient (Study of Decision No.56/Pid.Sus/2019/PNMnd).The Legal Research Method used in this thesis is a normative juridical method, namely the analysis carried outto collect data by means of a literature study. This study uses primary legal materials, namely Law Number 42of 1999 concerning Fiduciary Guarantees and this study also uses secondary legal materials in the form ofjournal publications on law and various related literature to answer problems in the Study of Decision No.56/Pid. Sus/2019/PN Mnd.Based on the results of research conducted in the Study of Decision Number 56/Pid.Sus /2019/PN Mnd, it canbe concluded that based on the judge's considerations in imposing a crime against the perpetrator who transferred the object of fiduciary security without written consent from the fiduciary recipient, the defendanthas fulfilled the elements and violates Article 36 of Law No. 42 of 1999 concerning Fiduciary Guarantees,he is sentenced to imprisonment for 7 (seven) months and a fine of Rp. 10,000,000 (ten million rupiah) with theprovision that if the fine is not paid, it is replaced with imprisonment for 2 (two) months.

Abstract

Law as a tool in carrying out social control in this case requires the help of criminology, which is the science that studies crime as widely as possible. In legal provisions in Indonesia, the discussion on age-related insult or defamation is regulated in Article 310 paragraph (1) of the Criminal Code (KUHP), such as the case in Decision Number: 1014/Pid.SUS/2020/PN.Mdn. In this study the method used to collect data by means of literature study. Literature study is a data collection technique by conducting a review study of books, literatures, notes, and reports that have to do with the problem being solved. In this study, the primary legal material for legislation is Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions of the Criminal Code. As for this research, secondary legal material is in the form of publications on law and official articles from print media and electronic media and then arranges them systematically to answer the problems in Decision Study Number 1014/Pid.SUS/2020/PN.Mdn. One of the crimes that often occur in society is insult and defamation through electronic documents or called cybercrime, which is regulated in Article 27 paragraph 3 in conjunction with Article 45 paragraph 3 of Law no. 11 of 2008, although the Criminal Code (KUHP) also regulates insults or defamation, it is regulated in Article 310 paragraph (1) of the Criminal Code (KUHP). It can be seen that nowadays cases of defamation occur through electronic media, according to Polri data from January to September 2021, Polri received at least 2,207 reports of criminal acts using the Electronic Information and Transaction Law.
