Abstract

This Journal explores the application of hermeneutics as a methodological framework for interpreting the Qur'an and the exegesis of Hadith. Hermeneutics, the art and science of interpretation, offers a systematic approach to understanding religious texts by considering historical, cultural, and linguistic contexts. The study emphasizes the significance of hermeneutical principles in revealing deeper meanings and insights within Islamic texts, which are often layered and complex. The research highlights various hermeneutical strategies, including textual analysis, contextualization, and the role of the interpreter's perspective. By examining classical and contemporary interpretations, the paper demonstrates how hermeneutics can bridge the gap between traditional understandings and modern applications, making the teachings of the Qur'an and Hadith more accessible to diverse audiences, particularly in English-speaking contexts. Furthermore, the paper discusses the implications of hermeneutical approaches for interfaith dialogue and contemporary ethical issues, illustrating how a nuanced understanding of Islamic texts can foster mutual respect and understanding among different cultures and religions. Ultimately, this study advocates for a hermeneutical approach as a vital tool in the ongoing quest for knowledge and spiritual growth within the Islamic tradition.

Abstract

This study explores the practice of manjua julo-julo and provides an Islamic legal analysis of its implementation in Nagari Sungai Jambu, Pariangan District, Tanah Datar Regency. Employing a qualitative descriptive approach within field research, the primary data sources include four individuals directly involved in manjua julo-julo, while secondary data comes from three community leaders. The findings reveal that the manjua julo-julo practice within the community is categorized into two forms: first, julo-julo (labor exchanged for labor), and second, manjua julo-julo (labor exchanged for labor with the involvement of a third party). Prior to initiating agricultural cooperation, a mutual promise (wa'ad) is made among the farmer members involved in julo-julo and manjua julo-julo. These agreements utilize ijarah and shirkah contracts, specifically classified under syirkah abdan and ijarah. The practice of manjua julo-julo aligns with the principles of cooperation (syirkah) as it falls under shirkah abdan and meets the criteria for joint efforts, involving collaboration between rice field owners and workers. Furthermore, the implementation adheres to sharia principles, ensuring compliance with Islamic legal guidelines.

Abstract

This study aims to analyze the practice of buying and selling gold on credit from a sharia perspective, focusing on the principles of justice, transparency, and avoidance of elements of usury, gharar, and fraud. This phenomenon is becoming increasingly relevant as the public"s need for gold ownership as an investment instrument or value protection increases, even though they do not have the financial ability to buy in cash. The main problem studied in this study is when gold is still in installment status and has not fully become the property of buyers, especially in emergency conditions. The method used is descriptive qualitative research with a library research approach, which involves the analysis of classical and contemporary documents and literature related to fiqh muamalah, including the views of scholars from various schools and contemporary fatwas. The results of the study show that the practice of buying and selling gold on credit has room for ability in Islamic law, especially when gold is treated as a commodity (sil"ah) and not as a medium of exchange (tsaman). Despite differences of opinion among scholars regarding the legality of this transaction, the sharia maqashid approach provides legitimacy as long as the basic principles of sharia are maintained, such as justice, openness of contracts, and protection of weak parties. This research emphasizes the importance of a comprehensive understanding of contracts, payment mechanisms, and risks inherent in transactions so as not to deviate from sharia principles. Thus, the purchase and purchase of gold on credit can still be justified under sharia under certain conditions, as long as it meets strict conditions and signs in order to maintain benefits and avoid harmful practices

Abstract

Islamic banking in Indonesia has grown significantly, but its services remain unevenly distributed, especially in rural areas like Mandailing Natal Regency, where only 30% of residents access formal financial services (BPS, 2023). This study examines the role of Islamic banks in improving financial inclusion in Panyabungan City. Using a quantitative method and 100 respondents, data were collected via structured questionnaires and analyzed with PLS-SEM. Results show that financial literacy (β = 0.422; p = 0.000) and perception of Islamic banks (β = 0.493; p = 0.000) significantly affect financial inclusion, with R² = 0.647. Despite high account ownership, digital service use and financing remain low. Findings underscore the importance of strengthening financial literacy and expanding access to Islamic digital banking. Recommendations include targeted financial education and outreach strategies to enhance service utilization in underserved regions.

Abstract

Fazlur Rahman is a Muslim scholar who has critical thinking about changes and developments in Islamic education. His thoughts were the pros and cons of his time and became an important study in this era. For this reason, research was carried out using the library research method. According to Rahman, the aim of Islamic education is to develop humans into fully functioning beings, and to save humans from themselves, for themselves, and to respect themselves. The current generation is facing serious problems due to dichotomization, which has led to the emergence of split personalities. To overcome this problem, the Islamic generation needs to receive modern education that integrates Islamic principles. Islamic education must be an agent of reform that can adapt to current developments without losing its fundamental values.

Abstract

Marriages are required to be registered under the provisions of Law Number 1 of 1974, specifically Article 2. This registration plays a crucial role in establishing the legality of marriages and enables the utilization of different associated benefits. Meanwhile, unregistered marriages give rise to a range of legal issues, including uncertainties regarding lineage, concerns related to maintenance, and inheritance rights. In line with the Ministry of Home Affairs Regulation Number 109 of 2019 regarding Population Administration, couples involved have the option to obtain important documents such as the Population Identification Card (KTP), Birth Certificate, and Family Card (KK) by signing a Statement of Absolute Responsibility (SPTJM). This situation raises significant concerns regarding the legal implications of unregistered marriages. Therefore, this study aimed to employ an empirical legal approach with qualitative methods and obtained data through interviews, observations, and documentation. The data analysis used Miles and Huberman's method to uncover the meaning within Ministry of Home Affairs Regulation Number 109 of 2019 regarding Unregistered Marriages and unveiled the ambiguity in understanding the true meaning. Furthermore, a study conducted in Dharmasraya Regency in 2021 discovered the issuance of 69,144 Family Cards by the Directorate General of Population and Civil Registration, and 22,453 (32.47%) were unregistered marriages. Only 194 individuals applied for validation (isbat) within 3 years, where 101, 27, and 66 were accepted, rejected, and revoked, respectively. In conclusion, the community perceived their marriages to be legal due to the issuance of Ministry of Home Affairs Regulation Number 109 of 2019, even though the SPTJM did not legalize the concept or hold legal authority over the consequences.
