Abstract

This article examines the role and function of Nazhir (guardian of endowment) in the empowerment of waqf objects in the Legal District of Bogor Regency, West Java, Indonesia. The aim is to increase Nazir's professionalism in increasing the productivity of waqf assets to be able to provide maximum benefits to the general public (ummah) in a sustainable manner. In Bogor district, there are waqf assets in the form of land totaling 5,686 locations within land areas of 4,433,860 M2. With such a large number of waqf assets, if managed professionally, the waqf will certainly be able to bring the sustainability of the Ummah economy, especially the sustainability of education for the younger generation. However, as this study found, only a few Nazhirs in the Bogor Regency area who have begun to develop productive waqf assets. The majority of Nazirs still use the old pattern which is not conducive to the development of the productivity of waqf property. Therefore it is necessary to optimize the role and function of Nazhir through continuous coaching by the Indonesian Waqf Board (BWI). In the form of (1) meetings in the context of coaching, (2) training activities, and (3) socialization related to the latest regulations regarding the management of waqf objects.

Abstract

 This article analyzes the realization of the professionalism principle for the nâzhir (waqf organiser) as conceptualized in waqf (endowment) law. One of the nâzhir requirements in the endowment law is the amânah which is interpreted as human responsibility covering the horizontal/insâniyyah and the hereafter (transcendental/ilâhiyyah) dimensions. By using a statutory approach (statute approach) and a conceptual approach, this research finds the fact that endowment (endowments) is the tabarru' (voluntary) contract; the amânah principle as contained in the endowment pledge has a similar meaning to the concept of trust in a general sense. The concept of trust in a general sense and the concept of amânah/trust in Islamic law are both forms of trust from one party to another with the conditions set out in Article 10 of the Endowment Law and the endowment pledge deed

Abstract

Based on the latest data, the number of Muslim population in Indonesia is currently recorded at 245,973,915 people. They all need the availability of food and beverages that meet the provisions of sharia, namely halālan thayyibā food and beverages. For this reason, the Government, through Law Number 33 of 2014 concerning Halal Product Guarantee, requires every producer to produce food and beverages that are proven by having a halal certificate. One way to obtain the certificate is through the Halal Self Declare Program. This program is free and is intended only for Micro and Small Business Actors (MSEs). This study aims to discuss the halal certification program for micro and small entrepreneurs as well as the benefits of the program from the perspective of maslahah theory and legal certainty. The results of the study concluded that the Halal certification program can provide benefits to many parties, ranging from entrepreneurs, consumers, and also the Government. For business actors, the benefits obtained are greater than for business actors who do not have the certificate, especially in terms of increasing sales turnover. This is because consumers tend to choose products that are guaranteed halal rather than other products that are not or are not clear about their halalness. With the increase in turnover, the entrepreneur's income will automatically increase and will ultimately have a positive effect on the income of his employees
