Abstract

This article explores how third countries can claim social media information from their citizens as a legal measure to protect and fight for the rights of women and children in armed conflict. The exploration is conducted normatively with a socio-juridical approach and a comparison of state implementation of the law. Implementing law in this approach will involve comprehensive analyses that include understanding legal texts, examining social impacts, and comparing practices across different jurisdictions to draw appropriate conclusions. This research shows that social media can serve as a platform to raise global awareness of human rights violations, provide digital evidence that can be used in international tribunals, and exert diplomatic pressure on states involved in violations. Social media also enables cross-border collaboration between governments, international organisations and NGOs to coordinate legal and advocacy efforts. However, challenges include disinformation, digital security risks, and technology access gaps that can hinder the effective use of social media as a legal tool. Nonetheless, with the right strategies, third countries can utilise social media to strengthen international law enforcement and support the fulfilment of the rights of women and children in conflict zones. In conclusion, despite significant challenges, third countries can claim the use of social media as an effective legal measure in their efforts to support and protect the rights of women and children in situations of armed conflict.

Abstract

This article investigates the distortion of maqāṣid al-sharīʿah within the practice of child marriage in Indonesia, where a normative framework intended to safeguard protection is increasingly reinterpreted as a mechanism for social legitimation. This research seeks to critically examine the selective deployment of maqāṣid al-sharīʿah in judicial decisions on marriage dispensation and to uncover internal tensions among the objectives of Islamic law concerning child welfare protection. We employ a normative legal research design using conceptual and case-based approaches drawing upon statutory regulations, court rulings, and both classical and contemporary maqāṣid literature. The findings reveal that judicial reasoning in dispensation cases tends to overemphasize the protection of honor (ḥifẓ al-‘ird) while marginalizing essential safeguards such as life (ḥifẓ al-nafs) and intellect (ḥifẓ al-‘aql). This pattern produces a pseudo-maqāṣid phenomenon and reflects underlying power relations in legal construction shaped by prevailing social pressures. This study concludes that a methodological reconstruction is required for the application of maqāṣid through a hierarchical and contextual framework that prioritizes child protection, ensuring that Islamic law operates as an instrument of substantive justice rather than mere normative legitimacy within the Indonesian judicial practice.

Abstract

This study examines the regulation of abuse of circumstances in sales agreements through a comparative study between Indonesian and Dutch civil law. Abuse of circumstances is a legal doctrine that protects the weaker party in contracts where there is an imbalance of power and pressure, resulting in a lack of free will from one party. The research aims to understand the concept and analyze the legal consequences in both legal systems. This normative study employs statutory, conceptual, and analytical approaches through literature review and case law analysis. Findings reveal that in Indonesia, abuse of circumstances is not explicitly regulated in the Civil Code and relies on case law and judicial interpretation, whereas in the Netherlands, it is clearly codified in Article 3:44 of the Nieuw Burgerlijk Wetboek (NBW) providing greater legal certainty. The legal consequence in both countries is the annulment of contracts formed under such circumstances and entitlement to compensation for the harmed party. The primary difference lies in codification and consistency of application. This study recommends that Indonesia adopt explicit regulation similar to the Dutch model to enhance legal protection and fairness in sales transactions.

Abstract

The rapid development of Artificial Intelligence (AI), particularly text-generating systems, has introduced new challenges to copyright protection, especially regarding the use of written works as training data. This study aims to analyze the legal framework governing the use of written works in AI-based text generators and to examine its legal implications for the economic and moral rights of authors within the Indonesian copyright system. This research employs a normative legal method with statutory and case approaches, focusing on Law Number 28 of 2014 on Copyright and a comparative analysis of the OpenAI lawsuit in the United States. The findings indicate that Indonesian copyright law has not specifically regulated the use of copyrighted works in AI training, resulting in a legal vacuum and uncertainty. From a legal perspective, the use of works without authorization in training processes potentially infringes the economic rights of authors, particularly reproduction and commercial use rights. Furthermore, the absence of attribution and the risk of distortion of original works raise concerns regarding violations of moral rights. The complexity is further compounded by difficulties in proving infringement, the opaque nature of AI systems, and the potential overlap of liability among developers, platforms, and users. Therefore, adaptive regulatory reform and progressive legal interpretation are necessary to ensure a balance between copyright protection and technological innovation. ABSTRAKPerkembangan kecerdasan buatan (Artificial Intelligence/AI), khususnya generator teks, telah menimbulkan tantangan baru dalam sistem perlindungan hak cipta, terutama terkait penggunaan karya tulis sebagai data pelatihan. Penelitian ini bertujuan untuk menganalisis pengaturan hukum penggunaan karya tulis dalam generator teks berbasis AI serta implikasi hukumnya terhadap hak ekonomi dan hak moral pencipta dalam perspektif hukum hak cipta Indonesia. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus, khususnya dengan mengkaji Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta serta studi komparatif terhadap kasus gugatan OpenAI di Amerika Serikat. Hasil penelitian menunjukkan bahwa pengaturan hukum di Indonesia belum secara spesifik mengakomodasi penggunaan karya tulis dalam pelatihan AI, sehingga menimbulkan kekosongan norma dan ketidakpastian hukum. Secara yuridis, penggunaan karya tanpa izin dalam proses pelatihan berpotensi melanggar hak ekonomi pencipta, terutama terkait hak penggandaan dan penggunaan secara komersial. Selain itu, penggunaan tanpa atribusi serta potensi distorsi karya juga berimplikasi pada pelanggaran hak moral pencipta. Kompleksitas semakin meningkat dengan adanya kesulitan pembuktian, sifat sistem AI yang tidak transparan, serta potensi tumpang tindih tanggung jawab antara pengembang, penyedia platform, dan pengguna. Oleh karena itu, diperlukan pembaruan regulasi yang adaptif serta penafsiran hukum yang progresif untuk menciptakan keseimbangan antara perlindungan hak cipta dan perkembangan teknologi.
