Abstract

The creation of authentic deeds through video conferencing has become increasingly popular amidst technological advancements and the need to adapt to social distancing restrictions due to the pandemic. This study aims to identify the challenges and risks faced by notaries in the creation of authentic deeds online and to find solutions for maintaining the validity and integrity of the deeds. The method used is a descriptive qualitative approach with a case study, where data is collected through literature review and interviews with notaries and legal practitioners. The results of the study indicate that the main challenges in the creation of authentic deeds via video conferencing include technical issues, the difficulty of verifying identities without face-to-face interaction, and the risks of fraud or coercion of the parties involved. Proposed solutions include the use of secure identity verification technologies such as electronic signatures and biometrics, as well as the implementation of clearer regulations regarding online authentic deed creation. Additionally, the importance of maintaining process integrity by involving witnesses virtually and ensuring transparency is emphasized. This study concludes that although the creation of authentic deeds through video conferencing presents various challenges, with the proper application of technology and careful oversight, the resulting deeds remain valid and legally binding

Abstract

Insurance is the choice for customers in Gorontalo Province. Why is that based on the basic assumption that by insuring the company PT. Bumi Putra Gorontalo Branch will make it easier for customers to send their children to college. However, this hope vanished when many customers of PT. Bumi Putra Gorontalo Branch had problems after maturity and when submitting claims to the insurance company PT. Bumi Putra Gorontalo Branch, the insurer denied insurance payments for tertiary education for children who were insured who were not provided in accordance with the agreement in the PT.Bumi Putra insurance policy. The method used in this research is this type of research is empirical justice research, in other words it is a type of sociological legal research, also called field research. or law in action studies, which are seen from their nature including qualitative research. This legal research is studying the behavior of the people who are influenced by the existence of a rule or the behavior of the people that influences the formation of a rule based on primary and secondary data. Other studies that use inductive logic analysis describe a qualitative approach. Based on the results of the study, the insurance company PT. Bumi Putra, Gorontalo branch, had defaulted on customers in Gorontalo province, but the insurance company, PT. Bumi Putra, the Gorontalo branch, denied that it had not acted in default, but said customers would fulfill their obligations according to what agreed in the insurance policy with the customer.

Abstract

The purpose of this research is the Cooperation Agreement between the Goods Delivery Service Company and the Courier in the Cash on Delivery System. This research uses empirical research method. The research location is Ninja Xpress Gorontalo City. The data obtained are primary and secondary data. Data collection techniques used by the author are observation, interviews and literature. The research results obtained Every agreement must be carried out in good faith, as found in Article 1338 Paragraph (3) of the Civil Code regarding the principle of good faith, which reads “Agreements must be carried out in good faith”. This article determines that agreements are made in good faith by those who make them. The most important thing in the implementation of an agreement is to determine when the agreement begins, considering that from that moment the rights and obligations of the parties to the agreement arise. In general, an agreement occurs after an agreement between the parties, since there is an agreement, then from that moment an obligation has arisen. In addition, the contents of the agreement between Ninja Xpress and couriers consist of the scope of the agreement, validity period & termination of the agreement, agreement of the parties, work compensation, dispute resolution, tiering system, COD scheme, awards or awards for the best rider/driver and sanctions for violation of procedures. The form of agreement between the courier and Ninja Express is a partnership agreement which can be in the form of a digital agreement or print out agreement.

Abstract

This study aims to analyze the legal implications of the defendant's non-compliance with child support obligations and the judge's considerations in determining the amount and increase of child support in Decision No. 214/Pdt.G/2023/PA.Gtlo. The background of this research focuses on the issue of non-compliance with child support obligations after divorce, which often leads to negative impacts on the child's well-being and may trigger prolonged legal processes. In this context, it is important to explore how the law responds to such non-compliance and how judges consider various factors in determining fair and sustainable child support. The objective of this research is to examine the legal consequences of the defendant's non-compliance with child support obligations and to understand the basis of the judge's considerations in determining the amount and increase of child support, specifically the annual increase of 20%. The research method employed is empirical legal research with a qualitative approach, combining court decision document analysis and interviews with relevant parties. Primary data is obtained from interviews with judges and lawyers, while secondary data is gathered through relevant legal literature. The research results indicate that non-compliance with child support obligations may result in legal sanctions such as execution or fines, and impact subsequent legal processes. The judge's considerations in determining child support include the defendant's financial capacity, the child's needs, and the principle of social justice. A realistic decision on child support increases is essential for the sustainability of fulfilling the child's rights.

Abstract

The purpose of this study leads to legal action that can be done by business actors related to losses caused by fictitious orders and legal protection against business actors in online buying and selling transactions Cash on Delivery (COD) payment methods. This type of research is a juridical normative research that leads to legal norms, legal principles and using the statute approach (legislation) and supported by the fact approach (the Fact Approach) and conceptual approach (concept approach). The results of the study that the form of legal protection against business actors who are harmed by consumers is in the form of compensation and/or sanctions against consumers when consumers still do not replace the losses as intended. Although Chapter 13 of the UUPK does not specify criminal sanctions against consumers in particular, this does not mean that consumers can avoid criminal sanctions. Criminal sanctions can be imposed against consumers if the consumer's actions have met the criminal elements. The legal action of business actors against consumers who make fictitious orders can then implement the principle of strict liability, business actors who feel aggrieved over the actions of consumers who are not responsible for the goods that have been ordered can demand compensation or compensation without having to dispute the presence or absence of elements of error on the part of consumers. The threat of punishment obtained against consumers who are proven to have committed fraud will be subject to imprisonment for a maximum of four years in accordance with Article 378 of the Criminal Code.. Therefore, it should pay more attention to legal certainty regarding legal protection not only to consumers but also to business actors. Because basically losses can not only be experienced by consumers but can also be experienced by business actors.

Abstract

Penerapan kebijakan kantong plastik berbayar di ritel modern seperti Alfamart bertujuan untuk mengurangi penggunaan plastik demi menjaga kelestarian lingkungan. Namun, implementasi kebijakan ini menimbulkan berbagai persoalan di lapangan, khususnya terkait perlindungan konsumen. Penelitian ini bertujuan untuk menganalisis sejauh mana hak konsumen dilindungi ketika informasi mengenai sistem kantong plastik berbayar tidak disampaikan secara jelas oleh karyawan Alfamart. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan pengumpulan data bahan hukum dilakukan melalui studi kepustakaan (library research) dengan menelusuri dan mengkaji dokumen-dokumen hukum serta literatur ilmiah yang relevan. Hasil penelitian menunjukkan bahwa kurangnya sosialisasi dan komunikasi yang efektif dari pihak karyawan mengakibatkan konsumen tidak sepenuhnya memahami kebijakan tersebut, sehingga menimbulkan rasa keberatan dan ketidakpuasan. Dalam hal ini, apabila konsumen tidak terima dengan kebijakan kantong plastik berbayar, maka ada pihak yang dirugikan akibat praktik kasir yang tidak memberikan informasi secara jelas mengenai kantong plastik berbayar. Hal ini menunjukan bahwa masih belum terlindunginya hak-hak konsumen dari pelaku usaha sebagaimana yang diatur dalam UUPK Pasal 4 dan kewajiban pelaku usaha kepada konsumen tertuang dalam UUPK Pasal 7 dan belum adanya tindakan dari pihak berwenang dalam menangani praktik kasir industri ritel. Oleh karena itu, dibutuhkan peningkatan edukasi kepada karyawan dan pengawasan dari otoritas terkait guna memastikan pelaksanaan kebijakan ini berjalan sesuai dengan prinsip perlindungan konsumen.

Abstract

Perkembangan globalisasi dan digitalisasi telah mendorong kebutuhan akan sistem otentifikasi dokumen yang efisien, aman, dan diakui lintas negara. Penelitian ini bertujuan untuk menganalisis landasan hukum, urgensi, tantangan, serta prospek implementasi Cyber Notary dalam sistem hukum nasional. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan kualitatif, berdasarkan studi literatur dan analisis peraturan perundang-undangan seperti UU Jabatan Notaris dan UU Informasi dan Transaksi Elektronik. Hasil kajian menunjukkan bahwa meskipun telah tersedia dasar hukum, implementasi Cyber Notary masih menghadapi berbagai kendala, termasuk tumpang tindih regulasi, keterbatasan infrastruktur, serta rendahnya literasi digital di kalangan notaris dan masyarakat. Namun demikian, prospek penguatannya sangat besar dalam mempercepat layanan hukum, meningkatkan kepercayaan terhadap legalitas dokumen asing, dan memperkuat posisi Indonesia dalam sistem hukum internasional. Oleh karena itu, dibutuhkan pembaruan regulasi, penguatan teknologi, dan peningkatan kapasitas sumber daya manusia sebagai langkah strategis menuju modernisasi kenotariatan digital di Indonesia.

Abstract

Fenomena trading ilegal berbasis digital yang semakin marak di Indonesia menimbulkan berbagai persoalan hukum, terutama dalam konteks perlindungan terhadap nasabah. Penelitian ini bertujuan untuk menganalisis penanganan hukum terhadap nasabah yang terlibat dalam praktik perdagangan berjangka ilegal serta menilai efektivitas pengawasan yang dilakukan oleh Badan Pengawas Perdagangan Berjangka Komoditi (BAPPEBTI). Dengan menggunakan pendekatan normatif-empiris, kajian ini mengeksplorasi ketidakseimbangan antara keberadaan regulasi dan kenyataan di lapangan, termasuk hambatan yurisdiksi, keterbatasan teknologi, dan rendahnya literasi hukum masyarakat. Hasil penelitian menunjukkan bahwa penanganan terhadap kasus trading ilegal lebih banyak dilakukan melalui jalur pidana, sementara mekanisme penyelesaian sengketa seperti mediasi dan arbitrase tidak dapat diakses karena ketiadaan legalitas platform. Di sisi lain, pengawasan oleh BAPPEBTI dinilai belum optimal karena lemahnya kapasitas institusional dan belum adanya kerja sama lintas negara yang kuat. Penelitian ini merekomendasikan penguatan regulasi, pemanfaatan teknologi kecerdasan buatan, peningkatan literasi keuangan, serta kolaborasi lintas sektor untuk menciptakan ekosistem investasi yang aman dan legal. Kajian ini menegaskan bahwa perlindungan hukum yang efektif menuntut pendekatan sistemik yang mencakup aspek preventif, represif, dan partisipatif.

Abstract

This article analyzes the responsibilities of the National Land Agency (BPN) and Land Deed Officials (PPAT) regarding title certificates for land subject to ownership disputes. The research method used is normative legal research with statutory, conceptual and case approaches. Based on the case studied, the legal owner of the land, Ansar Lause, filed a lawsuit because the land certificate was changed to be in the name of Ratna Lause illegally. After the trial process, the court decided to partially grant Ansar Lause's lawsuit and stated that the certificate in the name of Afandi Surya Ningrat had no binding legal force. The research results show that the legal impact on BPN of canceling property rights certificates by the court based on a decision is that BPN can be subject to administrative sanctions in the form of a written warning, temporary dismissal, honorable dismissal, or dishonorable dismissal; and a Notary/PPAT who is subject to the cancellation of a certificate of ownership by a court based on a decision is that the Notary/PPAT may be subject to administrative sanctions in the form of a written warning, temporary dismissal, honorable dismissal, or dishonorable dismissal; and the form of BPN accountability, this responsibility can be in the form of administrative improvements, review of the certificate issuance process, as well as protection of the rights of parties who suffer losses due to administrative errors and PPAT/Notary for property rights certificates that have been canceled by the court. PPAT/Notary can be held civilly responsible. , criminal, and administrative.
