Abstract

Bullying has transformed from a mere school behavior problem into a serious human rights violation with complex legal implications. This study aims to analyze the phenomenon of bullying through three normative lenses: Indonesian positive law, Islamic law, and international human rights instruments, with a particular focus on the case study of Timothy. The research method used is a normative juridical approach with a case study. The results show that Indonesian law, through the Child Protection Law, has provided criminal sanctions, but its implementation is still hampered by diversion for child perpetrators. From an Islamic legal perspective, bullying is considered an act of injustice that violates the principles of hifdz al-nafs (protection of life) and hifdz al-'ird (protection of honor). Meanwhile, a human rights perspective views bullying as a violation of the right to security and human dignity. Timothy's case underscores the need to synchronize preventive and repressive policies that are more humane yet still deter. This study recommends strengthening religion-based character education and strict supervision of children's social environments.

Abstract

This study stems from academic concerns regarding the continued violation of campaign material regulations during elections, despite the provisions stipulated in Article 71 of General Election Commission Regulation No. 15 of 2023. This situation indicates a gap between legal norms and their implementation in the field, particularly in the supervisory function of the Election Supervisory Agency (Bawaslu). This study aims to analyze the implementation of Article 71 of PKPU Number 15 of 2023 concerning campaign materials in Bandar Lampung City and examine it from the perspective of fiqh siyasah tanfidziyah as a concept of the exercise of governmental power in Islam. This study uses a qualitative method with a juridical-empirical approach through interviews, documentation, and the study of laws and regulations. The results of the study show that the implementation of campaign prop supervision has not been optimal due to limitations in supervision, low compliance among election participants, and coordination factors between institutions. From the perspective of fiqh siyasah tanfidziyah, campaign monitoring is part of the implementation of the government's mandate to maintain justice and public interest. The implications of this study emphasize the importance of strengthening election monitoring based on the values of justice and government accountability

Abstract

Penelitian ini bertujuan untuk menganalisis peran strategis Kantor Pelayanan Pajak (KPP) Pratama Bandar Lampung Dua dalam meningkatkan kesadaran dan kepatuhan wajib pajak terhadap kewajiban perpajakan serta meninjau pelaksanaannya dari perspektif Fiqh Siyasah. Pajak merupakan sumber utama penerimaan negara yang berfungsi menopang pembiayaan pembangunan nasional. Namun, rendahnya kesadaran dan kepatuhan masyarakat masih menjadi kendala dalam optimalisasi penerimaan pajak. Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif melalui observasi, wawancara, dan dokumentasi di KPP Pratama Bandar Lampung Dua. Hasil penelitian menunjukkan bahwa KPP memiliki peran dominan sebagai pelaksana kebijakan perpajakan di tingkat operasional, khususnya melalui empat fungsi utama: pelayanan, penyuluhan, pengawasan, dan penegakan hukum. KPP aktif melaksanakan kegiatan edukasi melalui sosialisasi langsung maupun media digital untuk meningkatkan pemahaman wajib pajak, memperkuat sistem pengawasan berbasis teknologi, serta menegakkan sanksi bagi pelanggaran administrasi dan pidana. Upaya tersebut terbukti meningkatkan kepatuhan wajib pajak dan memperbaiki realisasi penerimaan pajak daerah. Dalam perspektif Fiqh Siyasah, peran KPP sejalan dengan prinsip tanggung jawab Ulil Amri dalam menjaga kemaslahatan umat melalui kebijakan keuangan publik. Dengan demikian, KPP Pratama Bandar Lampung Dua telah berperan efektif sebagai instrumen negara dalam mewujudkan keadilan sosial dan kesejahteraan masyarakat melalui sistem perpajakan yang profesional dan berintegritas.

Abstract

The evolution of blockchain technology has introduced smart contracts as autonomous and immutable digital transaction instruments. However, these technical characteristics create legal ambivalence when used as a means of fraudulent acts based on crypto assets. This study aims to analyze the integration of criminal law enforcement and the civil validity of smart contracts in the context of crypto crimes in Indonesia. Using normative legal research methods and a comparative approach, this study finds a legal gap in determining the civil status of contracts born of malicious intent (mens rea). The analysis shows that although smart contracts are technically valid in blockchain systems, they can be invalidated under civil law if proven to contain elements of fraud. This study recommends the need for regulatory synchronization between the ITE Law, the National Criminal Code, and civil contract law to provide comprehensive legal protection for crypto asset investors in Indonesia
