Abstract

Interactional and theoretical approaches in victimology complement each other to provide a holistic understanding of victimisation. The interactional approach highlights individual dynamics, while the theoretical approach explores structural and psychological factors. Through the integration of both, victimology can continue to develop as a relevant field of science to effectively combat crime and protect victims.

Abstract

Introduction: In 2024, Indonesia remains among the ten Asian countries with the lowest income. PPATK data reveals that 2.2 million low-income Indonesians are gamblers, threatening the vision of Indonesia Emas 2045. Gambling, categorized as a crime under Articles 303 of the Indonesian Criminal Code (KUHP), causes significant losses.Purposes of the Research: The objective of this research is to analyze the judge's considerations in giving light sentences in gambling cases, specifically those involving the offering of gambling games, using Decision Number 65/PID.B/2013/PN.LBJ as a case study.Methods of the Research: This research employs a normative legal research method with an analytical approach. The analysis is conducted on legal norms, court decisions, and related literature to understand the judge's considerations in the case.Results of the Research: The findings show that although the defendant fulfilled the elements of Article 303 of the KUHP, the judge considered mitigating circumstances, such as the defendant's age, pregnancy, respectful demeanor in court, admission of guilt, and remorse. The judge balanced legal certainty with justice and utility, demonstrating an educative and preventive approach in sentencing

Abstract

Korupsi menjadi permasalahan yang terus dihadapi oleh berbagai negara termasuk Indonesia. Untuk itu dibutuhkan pembelajaran anti korupsi dalam berbagai tingkat pendidikan seperti pada tingkat perguruan tinggi. Penelitian ini bertujuan untuk menganalisis implementasi pembelajaran anti korupsi di lembaga kampus. Metode penelitian yaitu penelitian kualitatif deskriptif dengan kajian secara studi literatur. Hasil temuan menunjukkan bahwa di lembaga kampus masih ditemui berbagai praktik dan kebiasaan seperti mencontek, membolos, menitip absen, gratifikasi dosen, juga penyuapan dalam penerimaan mahasiswa baru. Hal ini menjadi bibit-bibit tindak pidana korupsi. Adapun dalam implementasi pembelajaran anti korupsi untuk meminimalisir kasus korupsi dilakukan dengan mengintegrasikan nilai anti korupsi sebagai bagian kurikulum. Pendidikan anti korupsi disampaikan dalam berbagai mata kuliah yang relevan seperti Pendidikan Kewarganegaraan, Pendidikan Pancasila, ataupun Pendidikan Agama. Meskipun sudah diterapkan namun implementasi pembelajaran anti korupsi masih menemui tantangan terutama karena mahasiswa hanya memahami teori antikorupsi saja namun belum melakukan praktik perilaku anti korupsi. Hal ini disebabkan karena tantangan misalnya kesadaran dan komitmen dalam menjalankan nilai anti korupsi yang masih rendah, penerapan kurikulum yang belum optimal, juga pengawasan yang kurang memadai. Dengan demikian, diharapkan bagi seluruh pihak agar memiliki kesadaran dalam membudayakan perilaku anti korupsi dengan mencegah berbagai bentuk korupsi sekecil apapun.

Abstract

The legal profession is one of the professions that demands the fulfillment of moral values from its development. The main benchmark for being an organizer of the legal profession in enforcing the law lies in the independence of professional organizers and strong moral integrity when facing various problems that are their responsibility. To be a good organizer of the legal profession in carrying out its professional duties in enforcing the law, practitioners who have qualified attitudes, humanitarian attitudes, attitudes of justice, are able to see and place objective values in a case handled, an honest attitude, and have technical skills and ethical maturity. The code of ethics of the legal profession actually functions as an ethical controller for those who carry out the legal profession. With legal professional ethics, it is expected that legal professionals have certain critical individual abilities.The National Police as one of the legal profession that deals directly with the community so that content is needed related to the standards of behavior and actions that are observed, where the Code of Professional Ethics of the National Police of the Republic of Indonesia is basically a guide for all actors of police functions in carrying out their duties in accordance with the laws and regulations in force in their territory contained in POLRI Regulation No. 7 of 2022 concerning the Code of Professional Ethics and Commission on the Code of Ethics of the National Police of the Republic of Indonesia. However, it is undeniable that there are still many violations of the code of ethics that often occur and are committed by police officers which result in low or decreased integrity of the police in the eyes of the public.

Abstract

The writing of this paper discusses violations of legal professional ethics committed by advocate Stefanus Roy Rening in his handling of the case of the former Governor of Papua, Lukas Enembe. The research method used in analyzing the problem of this violation case was normative where it was found that Roy Rening was suspected of being involved in acts of obstructing investigations by the Corruption Eradication Commission (KPK), including giving directions to witnesses not to comply with investigators' summons and creating scenarios to influence public opinion. This action not only violates the code of ethics of an advocate but also the law that regulates the eradication of criminal acts of corruption. The impact of this violation has the potential to damage public trust in the advocate profession and the legal system in Indonesia. To prevent similar violations in the future, it is recommended that the code of ethics be enforced, improve professional ethics education, as well as the establishment of an independent oversight body. In this way, it is hoped that the integrity and professionalism of advocates can be maintained and public trust in the legal system can be justified.

Abstract

The crime of premeditated murder is a serious crime that has a major impact on the victim, family and society. This study discusses the premeditated murder case that occurred on August 18 2021 in Kahele Ghura Village, Kadu Eta Village, North Kodi District, Southwest Sumba Regency. This case involved three perpetrators, namely Robertus Rangga Mone, Petus Pati Mone (DPO), and Daniel Rangga Wonda (DPO), with the victim named Hermanus Rehi Tebe Kati. Based on legal analysis, the perpetrators' actions fulfilled the elements of the crime of premeditated murder as regulated in Article 340 of the Criminal Code, namely that they were carried out intentionally, accompanied by prior planning, and caused the death of the victim. This study also evaluates the process of inquiry, investigation and preparation of indictments by the Public Prosecutor (JPU). The legal process carried out is in accordance with the Criminal Procedure Code, where the determination of suspects is based on valid evidence, such as witness statements, evidence and post-mortem results. Judges in deciding cases consider juridical aspects, including the prosecutor's indictment and evidence, as well as non-juridical aspects, such as the motive of the perpetrator and the social impact of the case.

Abstract

The "Jhony Coffee Case" case which occurred in 2023 involved Hotman Paris as PT's attorney. Jhony Coffee in questioning the trademark with Johnny Andrean. During this legal process, Hotman Paris issued a controversial statement calling Johnny Andrean a "plagiarist" and a "thief", which sparked criticism from various groups, including advocates. This statement is considered to violate the advocate's code of ethics, in particular Article 4 letter (b) of the Indonesian Advocate's Code of Ethics, which includes statements that are insulting or defamatory of another party. Realizing the impact of his statement, Hotman Paris then apologized, admitted his mistake, and emphasized that he had no intention of insulting Johnny Andrean. This case reflects the

Abstract

This study discusses the role of the code of ethics in building a reputable profession and enhancing public trust. The research method used is qualitative with a literature study approach. The research found that the code of ethics is an important moral foundation in maintaining the integrity and professionalism of professional members. Strict enforcement of the code of ethics helps increase public trust and preserve professional dignity. However, the study also identifies challenges in implementing the code of ethics, such as low ethical awareness and weak ethical enforcement. Recommendations include increased socialization, development of an adaptive code of ethics, and strict enforcement of ethics.

Abstract

Cybercrime is a term that refers to a criminal activity that uses a computer or computer network as a means of acting and as a target or location to commit criminal acts. The Electronic Information and Transaction Law (UU ITE) No. 11 of 2008, which was then amended first by Law No. 19 of 2016 and the second amendment to Law (UU) Number 1 of 2024 which is the main legal basis in handling cybercrime in Indonesia. One of the cases of cybercrime in Indonesia is online fraud. The method in this research uses library research, which is a method with data collection by understanding and studying theories from various literature. The Electronic Information and Transaction Law (UU ITE) in Indonesia is a significant step in providing a clear legal framework to regulate interactions in cyberspace and deal with cybercrime. Although the ITE Law has undergone several revisions to adapt to technological developments and the needs of society, challenges in its implementation are still present, such as the potential criminalization of Internet users and uncertainty in the interpretation of some articles. The ITE Law regulates various types of cybercrime, including online fraud and the dissemination of harmful information, with the aim of protecting the public from the negative impact of information technology

Abstract

Bullying merupakan masalah yang serius dalam lingkungan pendidikan di Indonesia, yang berdampak negatif terhadap fisik, mental, dan sosial anak sebagai korban. Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap anak korban bullying berdasarkan UU No. 35 Tahun 2014 tentang Perlindungan Anak, serta mengeksplorasi implementasi pendekatan restorative justice sebagai alternatif penyelesaian kasus. Metode penelitian yang digunakan adalah yuridis-normatif dengan pendekatan kualitatif melalui analisis dokumen hukum dan literatur terkait. Hasil penelitian menunjukkan bahwa faktor individu, keluarga, dan lingkungan sekolah memengaruhi terjadinya bullying, sementara perlindungan hukum yang ada belum sepenuhnya optimal dalam implementasinya. Pendekatan restorative justice terbukti efektif dalam menciptakan pemulihan trauma korban, edukasi pelaku, dan pencegahan berulangnya tindakan bullying. Studi ini merekomendasikan kolaborasi antara pemerintah, sekolah, keluarga, dan masyarakat untuk menciptakan lingkungan yang aman dan ramah bagi anak.
