Abstract

Combined Process (Mediation-Arbitration) is an innovative Alternative Dispute Resolution mechanism that unifies mediation’s flexibility and party autonomy with arbitration’s finality and enforceability. This hybrid offers a potentially more effective means of resolving Industrial Relations disputes. Although successfully applied in countries like China, Singapore, and the United States, Indonesia’s legal system lacks explicit provisions for this mechanism, creating uncertainty in its regulation and enforceability. This study aims to examine the use of the Combined Process (Mediation-Arbitration) for resolving industrial relations disputes and analyze it through the principle of legal justice. Using a normative juridical approach, the research reviews relevant laws and regulations to explore how this mechanism is implemented. Indonesia’s Law No. 2 of 2004 governs mediation and arbitration separately but does not explicitly acknowledge the Combined Process, leading to procedural ambiguity and unclear jurisdictional boundaries. This regulatory gap hinders the mechanism’s effective implementation despite its advantages in promoting efficiency and party satisfaction. The study finds that the Combined Process (Mediation-Arbitration) aligns with legal justice principles by fostering balance, transparency, and participation in dispute resolution. However, it requires formal legislative recognition and clear procedural rules to ensure legal certainty and practical effectiveness within Indonesia’s industrial relations framework.

Abstract

Pada Putusan Nomor 295/Pdt.G/2018/PN.Mdn dan Putusan Nomor 159/Pdt.G/2019/PN.Bdg, yang mana pada kedua putusan tersebut Penggugat mengajukan gugatan untuk kedua kalinya. Namun, terdapat inkonsistensi hakim dalam memutuskan gugatan nebis in idem pada perkara perceraian yang pada akhirnya menimbulkan ketidakpastian hukum. Penelitian ini membahas mengenai pengaturan dan alasan perceraian dalam UU Perkawinan serta penerapan asas nebis in idem pada perkara gugatan cerai yang sudah berkekuatan hukum tetap dan diajukan kembali dihubungkan dengan kepastian hukum. Metode yang digunakan dalam penelitian ini berupa pendekatan yuridis normatif, yang mana objek dari penelitian ini akan diteliti dan dianalisis dengan mengedepankan norma serta asas yang terdapat dalam hukum positif berupa data sekunder dan dilengkapi data primer. Hasil dari penelitian ini yaitu pada putusan yang menjadi objek penelitian telah memenuhi alasan perceraian yang sesuai dengan hukum positif dan terdapat inkonsistensi dalam penerapan asas nebis in idem pada putusan tersebut, yang mana Majelis Hakim pada Putusan Nomor 295/Pdt.G/2018/PN.Mdn tidak mengabulkan gugatan yang diajukan untuk kedua kalinya karena mengandung unsur nebis in idem berdasarkan Pasal 1917 KUHPerdata dan SEMA Nomor 3 Tahun 2002, sedangkan Majelis Hakim pada Putusan Nomor 159/Pdt.G/2019/PN.Bdg mengabulkan gugatan yang diajukan untuk kedua kalinya yang berdasarkan Yurisprudensi Mahkamah Agung RI Nomor 110/K/KG/1992 tanggal 23 Juli 1993 yang dijadikan pula sebagai rujukan dalam Rapat Kerja Nasional Mahkamah Agung RI Tahun 2007.

Abstract

Artificial intelligence (AI) is a technology that refers to the simulation of human intelligence programmed into electronic devices to think like humans and mimic human actions. The rapid development of AI has sparked debates in the legal field, particularly when errors occur and cause harm to the public. Currently, Indonesian law does not explicitly regulate legal protection for a party who suffers material or immaterial damages due to errors caused by AI. This research aims to contribute to the development of civil law discourses through a normative and descriptive approach. The data used are secondary data, and a qualitative method is used to analyze and present the data descriptively. The research finds that there are no specific regulations governing liability for material or immaterial damages resulting from AI activities. The conclusion drawn is that AI cannot be considered a legal subject and lacks control over its actions and intent. Therefore, the burden of compensation for errors caused by AI falls on the creators and users of AI, as stipulated under Article 1365 of the Civil Code and Article 1367 of the Civil Code, which states that: "A person is not only liable for losses caused by their own actions but also for losses caused by the actions of those for whom they are responsible or by goods under their supervision."

Abstract

Abstract: The COVID-19 pandemic has resulted in a decline in economic activity, causing companies to suffer losses. To maintain business continuity, the company conducts unilateral wage deductions for workers, which violates workers’ rights and harms workers. Therefore, this study is intended to find legal actions against companies that cut wages unilaterally because they are affected by COVID-19 and to find legal protection for affected workers. The research method used is normative juridical, namely using data sources based on positive legal sources. Based on research, unilateral wage cuts due to COVID-19 are not based on the law and cause rights disputes. There has been no definite legal action against the company, but workers can report the company to the local manpower office if their wages are cut unilaterally. To protect workers’ wages, the Decree of the Minister of Manpower No. 104 of 2021, where wages for workers who are WFO, WFH or laid off are still paid. If it turns out that the company is unable to pay, changes in the amount of wages can be made based on an agreement with the workers. Keywords: Wage Deduction, COVID-19, Employment. Abstrak: Pandemi Covid-19 berdampak pada penurunan aktivitas ekonomi, sehingga menyebabkan perusahaan mengalami kerugian. Untuk menjaga kelangsungan usaha, perusahaan melakukan pemotongan upah pekerja sepihak, yang mana melanggar hak pekerja dan merugikan pekerja.Oleh karena itu, penelitian ini ditujukan untuk mengetahui tindakan hukum terhadap perusahaan yang memotong upah sepihak karena terdampak Covid-19 dan mengetahui perlindungan hukum bagi pekerja yang terdampak.Metode penelitian yang digunakan adalah yuridis normatif, yaitu menggunakan sumber data yang didasarkan pada sumber hukum positif.Berdasarkan penelitian, pemotongan upah sepihak karena Covid-19 tidak berdasarkan hukum dan menimbulkan perselisihan hak. Belum ada tindakan hukum yang pasti pada perusahaan, namun pekerja dapat melaporkan perusahaan pada dinas ketenagakerjaan setempat jika dipotong sepihak upahnya. Untuk melindungi upah pekerja, dikeluarkan Kepmenaker No. 104 Tahun 2021, dimana upah pekerja yang WFO, WFH ataupun yang dirumahkan tetap dibayarkan.Jika ternyata perusahaan tidak mampu membayar, dapat dilakukan perubahan besaran upah berdasarkan kesepakatan dengan pekerja.
