Abstract

Kegiatan Kuliah Kerja Nyata (KKN) merupakan bagian dari implementasi Tri Dharma Perguruan Tinggi yang bertujuan mengembangkan peran mahasiswa dalam mengabdi kepada masyarakat. Artikel ini mengangkat peran mahasiswa dalam mengedukasi masyarakat terkait digitalisasi layanan pertanahan, khususnya Sertifikat Elektronik, di Kantor Pertanahan Kabupaten Klaten. Kegiatan ini bertujuan untuk meningkatkan kesadaran hukum masyarakat serta mendukung program pemerintah dalam transformasi layanan publik. Metode yang digunakan adalah pendekatan partisipatif melalui sosialisasi, penyebaran media informasi, observasi langsung, serta wawancara dengan pihak BPN dan masyarakat. Hasil kegiatan menunjukkan adanya peningkatan pemahaman masyarakat terhadap legalitas dan manfaat sertifikat elektronik. Mahasiswa berperan aktif sebagai jembatan informasi antara instansi dan masyarakat. Program ini memberikan dampak positif dalam memperkuat peran akademisi dalam edukasi hukum berbasis praktik.

Abstract

Pengabdian bertujuan mmberikan informasi didistribusikan melalui media sosial dalam platform podcast yang diselenggarakan oleh Badan Pengawas Pemilihan Umum (Bawaslu) Kota Surakarta. Pengabdian dilaksanakan pada tanggal 25 November 2025 di Kantor Bawaslu Kota Surakarta dengan ikhtisar tema urgensi demokrasi bagi generasi muda. Kegiatan ini berangkat dari rendahnya tingkat partisipasi substantif generasi muda dalam pengawasan pemilu, yang berdampak pada lemahnya kontrol publik terhadap proses demokrasi elektoral. Selain itu, kegiatan ini turut mengangkat isu hukum mengenai perlunya penguatan sistem penegakan hukum pemilu melalui gagasan pembentukan electoral court di Indonesia dengan merujuk pada praktik di Meksiko dan Uruguay. Metode pengabdian dilakukan melalui penyuluhan hukum, diskusi partisipatif, dan pemaparan studi perbandingan sistem peradilan pemilu. Hasil kegiatan menunjukkan meningkatnya pemahaman generasi muda mengenai pentingnya pengawasan pemilu serta tumbuhnya kesadaran kritis terhadap urgensi pembaruan kelembagaan penegakan hukum pemilu. Kegiatan ini diharapkan dapat menjadi kontribusi awal dalam membangun budaya demokrasi yang partisipatif dan berkelanjutan.

Abstract

Jika ditarik kronologis dalam jangka waktu yang lebih jauh, isu kekerasan seksual juga menjadi problematika yang menyeruak di berbagai kalangan. Terutama terkait pro kontra dari Rancangan Undang-Undang Penghapusan Kekerasan Seksual (RUU PKS) dimana masih terdapat perdebatan antara berbagai pihak yang menyebabkan belum rampungnya pengesahan aturan hukum ini.Penjelasan pada pendahuluan terkait dengan pentingnya wawasan terkait tindak pidana kekerasan seksual bagi masyarakat Desa Sapen Mojolaban Sukoharjo Jawa Tengah, maka kegiatan pengabdian pada masyarakat berupa Penyuluhan Hukum dilakukan guna memberikan informasi dan pengetahuan hukum terkait pentingnya informasi mengenai pencegahan kekerasan seksual kepada masyarakat di Desa Sapen Kecamatan Mojolaban Kabupaten Sukoharjo sebagai bentuk pembelajaran atau edukasi. Dosen Fakultas Hukum juga memberikan bantuan secara sukarela kepada masyarakat Desa Sapen untuk membantu mereka ketika mereka ingin melakukan konsultasi hukum sekaligus sebagai melayani upaya pendampingan hukum. Penyuluhan hukum ini sangat membantu masyarakat Desa Sapen dalam memahami dan mengetahui apa saja yang terkait kebutuhan mereka dan diharapkan setelah penyuluhan ini, masyarakat Desa Sapen dapat memahami tindak pidana kekerasan seksual dalam kehidupan sehari hari. Kegiatan penyuluhan ini berakhir dengan sesi foto bersama Dosen-Dosen Fakultas Hukum universitas Islam batik Surakarta, Kepala Desa beserta seluruh staff pemerintah Desa serta masyarakat setempat. Secara umum hasil dari penyuluhan hukum dalam rangka kegiatan pengabdian masyarakat ini mendapatkan respon positif dari peserta yang notabene adalah warga masyarakat Desa Sapen, dalam rangkaian acara penyuluhan hukum ini peserta dapat memahami mengenai bentuk-bentuk kekerasan seksual, dampak kekerasan seksual, cara pencegahan kekerasan seksual, pengaturan hukum kekerasan seksual terhadap korban.

Abstract

The problem of livestock roaming freely in Kerato Village, Unter Iwes District, has caused damage to property and agricultural land, social conflict, and economic losses. To address this problem, the Kerato Village Government issued Kerato Village Regulation Number 7 of 2021. This regulation stipulates administrative sanctions in the form of fines and compensation. This study uses an empirical legal research approach, a method that analyzes social phenomena in society using legislative, sociological, comparative, and case studies. The results show that the legal liability of livestock owners, according to Kerato Village Regulation Number 7 of 2021 concerning Livestock Maintenance, stipulates that owners of livestock that roam freely and damage agricultural land will be subject to administrative sanctions in the form of fines for security costs and maintenance costs for the secured livestock, and are required to pay compensation for crop damage. The results of the study, related to Islamic law, emphasize the responsibility of livestock owners based on the principle of justice, requiring balanced compensation, and encouraging dispute resolution through mediation

Abstract

The principle of freedom of contract, as stipulated in Article 1338 of the Civil Code, forms the legal foundation of contracts in Indonesia. In practice, the proliferation of standard-form contracts has led to this principle often being merely formal in nature, as one party lacks adequate opportunity to negotiate the contract’s terms. This study aims to analyze the shift in the meaning of the principle of freedom of contract in standard-form contracts and to formulate a reorientation model focused on contractual justice. The study employs a normative legal methodology using legislative, conceptual, and case-based approaches. The results of the study indicate that the application of the principle of freedom of contract in standard form contracts has shifted from the concept of absolute freedom toward a freedom limited by the principles of balance, good faith, and protection of the party with weaker bargaining power. Therefore, a reorientation of the principle of freedom of contract is necessary through the application of the principle of proportionality as an instrument to create contractual relationships that are fair, balanced, and provide legal certainty.

Abstract

This study examines the legal responsibility of e-commerce platforms for consumer losses resulting from defective products in electronic transactions. The concept of consumer loss is explored through the Consumer Protection Law (UUPK), the Electronic Information and Transactions Law (UU ITE), and the Government Regulation on Electronic System Operators (PP PMSE), which reveal normative gaps related to the role of digital platforms. The research identifies an optimal liability model, including business entity verification, system oversight, and dispute resolution mechanisms, in line with the EU Digital Services Act. These findings emphasize the need for regulatory harmonization and strengthening of platform obligations for effective consumer protection

Abstract

The purpose of this paper is to analyze the legal basis for the Panel of Judges' decision and acquittal in the criminal case of Decision Number 120/Pid.B/2024/PN.Skh. The research employed in this paper is normative legal research. The approaches employed in this study are the statutory approach, the case approach, and the conceptual approach. The Panel of Judges in Case Number 120/Pid.B/2024/PN.Skh issued an acquittal because the elements of premeditated murder, particularly the elements of intent and planning, were not legally and convincingly proven based on the evidence presented by the public prosecutor. Furthermore, the failure to fulfill the evidentiary requirements as stipulated in Article 183 of the Criminal Procedure Code (KUHAP) raised doubts among the judges, who then decided in favor of the defendant in accordance with the principle of in dubio pro reo. The acquittal verdict in Case Number 120/Pid.B/2024/PN.Skh complies with the principles of criminal law, particularly the principles of legality, the presumption of innocence, negative statutory proof, and in dubio pro reo. The panel of judges rendered the acquittal because the elements of premeditated murder were not legally and convincingly proven and were not supported by sufficient evidence, as stipulated in Article 183 of the Criminal Procedure Code. Given the doubts in the evidence, the judge is obligated to rule in the defendant's favor as a manifestation of justice and legal certainty.

Abstract

This study aims to examine criminal tax law provisions in Indonesia relating to the issuance of fictitious tax invoices, as well as to analyze criminal law enforcement strategies applicable to cases of fictitious tax invoices at PT PP. A fictitious tax invoice is an invoice issued without any actual transaction to reduce tax liabilities. This research is a normative study using a case and statistical approaches. The results show that the Indonesian taxation system, such as VAT, adopts a self-assessment system that is exploited for fraud, including fictitious tax invoices, as happened to PT PP. As a result, the DGT issued a warning, deactivated access to tax invoice creation, and is potentially subject to administrative sanctions in the form of a 100% increase in unpaid VAT in accordance with Article 15 paragraph (2) of the KUP Law. In addition to administrative sanctions, the issuance and/or use of fictitious tax invoices based on Article 39A of the KUP Law is punishable by a maximum imprisonment of 6 years and a maximum fine of 6 times the amount of tax in the tax invoice.

Abstract

This written aim to know about the implementation of good its principles on the health insurance agreement and to know the legal settlement when a good faith principle is involved in the health insurance agreement. Good communication required between insurance and responsible companies to conduct insurance agreements to minimize the possibility of the breach of relationship related to the good principles in the agreement. Liability responsibility tells the state with their actual insurance company can provide policy according to responsible conditions. Sharing of risk was done by a policy on the insurance company. But in practice the claims payment process is not as easy as it seems, this is because a lot of processes to go through before a claim will be paid, not even melted because of many things and one of the things that most often the problem is due to the prospective insured to peruse the contents of the contract of insurance to be entered. It should society must understand the clauses contained in the policy and the insurance company was already supposed to explain in detail the agreements contained in the policy so as not to cause disagreement in response to the content rather than the insurance polic and insurance issues are based on bad faith can be avoided. Although the disputes in the insurance sometimes can not be avoided should the parties to remain calm in the face and prefer to resolve their disputes out of court so as to achieve the concept of win-win solution for both parties.

Abstract

This study aims to provide answers to the legal certainty provided by laws and regulations regarding the use of cryptocurrency as a payment instrument in Indonesia and efforts to achieve legal certainty for the use of cryptocurrency as a payment instrument in the future. Cryptocurrency is an impact of globalization that must be responded to with legal changes, given the large amount of its global use that has an impact in Indonesia. The Currency Law does not explicitly provide space for cryptocurrency, implicating limited regulatory space for its use in Indonesia. A study analyzing the guarantee of legal certainty for cryptocurrency use is needed in light of existing normative regulations and efforts to achieve such legal certainty. This research is normative with a legislative and conceptual approach. The results show that the form of legal certainty in laws and regulations regarding the use of cryptocurrency as a payment instrument in Indonesia is not yet regulated in Law Number 7 of 2011 concerning Currency, but cryptocurrencies are partially regulated as commodities that can be traded on futures exchanges, in accordance with Minister of Trade Regulation Number 99 of 2018 concerning General Policy for the Implementation of Crypto Asset Futures Trading. This means that cryptocurrencies cannot yet be used as payment instruments but have limited transaction value on futures exchanges. Efforts to realize legal certainty for the use of cryptocurrency as a payment instrument in the future include injecting cryptocurrency as a digital payment instrument into Law Number 7 of 2011 concerning Currency, formulating technical regulations for the Regulation of the Minister of Trade and Bank Indonesia Regulations that accommodate the technical procedures for the use of cryptocurrency, and with the recognition of cryptocurrency in the updated Currency Law, its use can be guaranteed at the Deposit Insurance Corporation.
