Abstract

This study seeks to reconstitute Fiqh al-Bi’ah through the Islam Hadhari framework, amalgamating Muamalah and cultural aspects into a holistic ecological management model. The research employed a grounded theory methodology in Terengganu, Malaysia, utilizing data collection methods that included in-depth interviews with local community members and participatory observations of marine conservation practices. The gathered data were subjected to thematic analysis to discern patterns and correlate them with Islamic ecological principles. Data validation was accomplished via triangulation, guaranteeing consistency across many sources and methodologies. The results indicate that local traditions, including mangrove conservation, sustainable fishing methods, and spiritual ceremonies, correspond with the tenets of tawazun (balance), adl (justice), and ri’ayah al-bi’ah (environmental stewardship). This reformulation presents new dimensions, including Muwafaqah Ruhiyah Ma’a al-Tabi’ah (spiritual harmony with nature) denoting the religious aspect, Istimrariyah Bayn al-Ajyal (intergenerational sustainability) emphasizing economic sustainability across generations, and Taqdir al-Iqtisad al-Mahalli (empowerment of local economies), which illustrates the amalgamation of cultural heritage and economic resilience in ecological management. This approach's primary strength is its amalgamation of Islamic ideals with pragmatic conservation measures, promoting a balance between environmental sustainability and community welfare. Nonetheless, the study's restricted geographic emphasis on Terengganu poses a hurdle for generalizing its application to broader contexts. Subsequent studies should extend this model to more regions characterized by varied ecological and cultural contexts, affirming its universal applicability. This study significantly contributes to Islamic environmental discourse by presenting a reproducible methodology for tackling global ecological concerns through a value-oriented approach.

Abstract

This research focuses on the discussion of misyār marriage as one of the contemporary phenomena that did not exist in the time of the Prophet Muhammad SAW by using a type of literature research with a qualitative approach and analyzing existing data inductively. The results of the study show that misyār marriage was triggered by its emergence due to the massive development of the times. One of the indicators is the emergence of women who no longer live at home and work, so that they are economically independent. In addition, the varied work of men keeps them away from their wives which then causes problems. By analyzing the opinions of several scholars who have detailed the marriage of misyār, such as Yusuf Qardhawi and Abdullah Muhammad Aṭ-Ṭayyar, it can be concluded that this opinion cannot be separated from the concept of legal change of Ibn Qayyim which is also influenced by the changing times. This study proposes to deepen the understanding of the concept of nikah misyār to answer the development of the times and its relevance to Islamic teachings, namely ṣaliḥ likulli az-zamān wa al-makān. In addition, this study also offers constructive approaches in assessing the validity of misyār marriage. This research is expected to enrich the discourse around marriage in Islam and become a medium for the wider community to know this phenomenon.

Abstract

Violence against domestic workers is a complex social and legal issue, reflecting the imbalance of legal protection and human values. This study aims to examine the dynamics of violence against domestic workers through the approach of the Minister of Manpower Regulation (PERMENAKER) No. 2 of 2015 and the Law on the Elimination of Domestic Violence (PKDRT Law). Meanwhile, Jurisprudence underlines violence against domestic workers as an act of wrongdoing, which is a jarimah ta'zir. This research was conducted using the literature method, through several stages: (1) Problem Identification, which recognizes the issue of violence against domestic workers from the perspective of positive law and Fikih Jinayah; (2) Data Collection, involving legal literature, religious documents, and case studies; (3) Data Analysis, using a descriptive-analytical approach to compare the views of positive law and Fikih Jinayah on violence; and (4) Conclusion, which integrates the findings from both perspectives to provide strategic recommendations.

Abstract

Environmental preservation is a crucial issue that continues to receive attention, especially amid growing concerns about environmental degradation caused by human activities. This study aims to examine the implementation of the sasi mechanism by the people of Negeri Iha, Seram Island, and Ambon and to analyze the cultural significance of the sasi system regarding the concepts of Fiqh al-Bi'ah and Islamic criminal law. Using an empirical approach with qualitative methods, this research explores how the sasi mechanism contributes to community welfare and its relevance to Fiqh al-Bi'ah. The findings reveal that the implementation of the sasi tradition is managed by customary institutions with the authority to determine when sasi is enforced or lifted. There are two forms of traditional natural resource management in Negeri Iha: sasi laut (marine sasi) and sasi darat (land sasi). The study also shows that the sasi tradition's rules, goals, and punishments are similar to those in Fiqh al-Bi'ah. Both try to get the most suitable things done while doing the least environmental harm. Furthermore, violations of the sasi tradition are subject to customary sanctions, including physical punishment, fines, or spiritual consequences, such as the belief that violations could bring curses or illness as divine retribution. This research provides valuable insights into the harmony between the sasi tradition and the principles of Fiqh al-Bi'ah in preserving nature and maintaining the balance between humans and their environment.

Abstract

Perkembangan teknologi digital telah mendorong lembaga pengelola zakat seperti BAZNAS untuk meningkatkan tata kelola keuangan secara transparan dan akuntabel. Penelitian ini bertujuan untuk menganalisis efektivitas penerapan Sistem Informasi Manajemen BAZNAS (SIMBA) dalam meningkatkan prinsip-prinsip good corporate governance (GCG) di BAZNAS Parepare. Studi ini menggunakan pendekatan kualitatif deskriptif dengan metode observasi, wawancara mendalam, dan dokumentasi terhadap pengelola SIMBA dan laporan operasional di BAZNAS Parepare. Hasil penelitian menunjukkan bahwa penggunaan SIMBA mempercepat pendataan, meningkatkan akurasi pelaporan, dan memperkuat akuntabilitas lembaga. Transparansi informasi, partisipasi stakeholder, serta peningkatan kepercayaan publik menjadi bukti implementasi prinsip GCG yang lebih baik melalui SIMBA. Hambatan teknis seperti keterbatasan infrastruktur dan keterampilan operator tetap menjadi tantangan, namun tidak mengurangi dampak positif sistem terhadap efektivitas manajemen zakat. Dengan demikian, SIMBA terbukti mendukung tata kelola zakat yang responsif dan profesional.

Abstract

This research aims to examine the concept of forgiveness in minor crimes from the perspective of fiqh jinayah and analyze the gap between the principle of judicial forgiveness in Indonesian positive law and Islamic legal values. Judicial pardons in the Indonesian legal system are special powers given to judges to mitigate or exempt perpetrators from criminal sanctions, especially for minor crimes that do not have a significant impact on society. This concept is a form of judicial discretion in which judges can refrain from imposing sentences even if the defendant is proven guilty. This research uses a normative method with a conceptual and legislative approach, through an analysis of Law Number 1 of 2023 concerning the Criminal Code (KUHP) and jinyayah fiqh literature. The results of the study show that judicial pardon for minor crimes has similar principles to forgiveness in fiqh jinayah, such as consideration of the benefit of the community (maslahah), protection of victims' rights, and the application of proportionate punishment so as not to cause excessive deterrent effects. These findings indicate that judicial pardons can be integrated as an alternative mechanism for resolving minor criminal cases while upholding the principles of restorative justice and a balance between the rights of victims and the rehabilitation of perpetrators. The integration of the values of fiqh jinayah into the concept of judicial forgiveness has the potential to enrich Indonesia's positive legal practice in realizing a more humanistic and beneficial criminal justice system.

Abstract

This research aims to examine and reconstruct the concept of nusyūz and the phrase idribūhunna as found in Surah Al-Nisa (4:34), with particular focus on how these concepts are perceived by religious leaders in Ternate City. The purpose of the study is to offer a more humanistic and contextually relevant interpretation of nusyūz that aligns with the dynamics of modern family life. Methodologically, this study adopts a qualitative approach, combining library research with fieldwork. The library research explores classical Islamic jurisprudence (fiqh) and Qur’anic exegesis (tafsir) related to nusyūz, while the fieldwork involves interviews with community and religious leaders in Ternate City. The data were analyzed using three theoretical frameworks: fiqh al-wāqi‘ (contextual jurisprudence), the theory of ‘urf (custom), and linguistic theory (ma‘nā al-ḥaml). The findings reveal that the interpretations held by many religious leaders continue to be shaped by patriarchal norms, leading to a rigid and gender-biased understanding of nusyūz. This study contributes originality by offering a linguistic and contextual reconstruction of the term, presenting nusyūz as a concept that encompasses broader relational disharmony rather than focusing solely on female disobedience. The implications of this research support the development of a more egalitarian and compassionate Islamic legal framework, particularly in addressing family issues in contemporary Muslim societies.

Abstract

The purpose of this study is to reassess the application of the maslahah (public interest) framework in a minority Muslim setting, specifically through an analysis of the 2023 MUI South Sulawesi Fatwa (No. 003) regarding the permissibility of selling crops for pig feed in Toraja. By examining this fatwa, the study aims to contribute to the broader discourse on how Islamic legal reasoning adapts within pluralistic and socio-economically diverse contexts. The research employs a qualitative methodology that combines library research and field study. The library research encompasses Islamic legal sources, previous fatwas, and scholarly literature on maslahah (public interest) and transactions involving prohibited elements in Islam. The field study complements this with interviews involving MUI South Sulawesi scholars and Muslim community members in Toraja, providing insights into both the rationale behind the fatwa and the community’s reception. The findings demonstrate that the fatwa represents a shift from the conventional reliance on blocking the sadd al-dharī‘ah (means to harm) toward a more pragmatic application of maslahah (public interest) and istihsān (juridical preference). By allowing the sale of crops for pig feed, the fatwa acknowledges the socio-economic realities faced by minority Muslims in Toraja and highlights the adaptability of Islamic law in non-majority settings. The originality of this study lies in situating the fatwa within the lived experiences of minority Muslims, showing how maslahah (public interest) functions beyond abstract legal theorization. The implications extend to the development of a more contextual and responsive Islamic jurisprudence that remains relevant to diverse Muslim communities navigating pluralistic societies.

Abstract

This research aims to explore understanding and clarify potential misconceptions related to hand-cutting punishment in the context of Al-Sariqah crime (theft) within Islamic law. The research also encompasses an examination of legal approaches and justice in the implementation of this punishment. By analyzing various literary sources, particularly the opinions of scholars and Islamic legal literature, this study highlights the stringent standards and conditions that must be met for hand-cutting punishment to be applied. This research will utilize academic databases, digital libraries, and other reliable sources to gather scholarly articles, books, and conference papers discussing aspects of hand amputation punishment in the context of al-Sariqah. the research dispels the common belief that it can be haphazardly applied. The stringent prerequisites, including evidence, legal clarity, and understanding the perpetrator's circumstances, underline that hand amputation is not an arbitrary measure but is reserved for specific circumstances.

Abstract

The purpose of this article is to analyse the perceptions of civil servants at the Ministry of Religious Affairs towards Islamic banking products available in Pangkep Regency. The research method used in this study is qualitative. The type of research used is field research. The study's results indicate that, despite facing challenges such as strict bureaucracy, limited understanding among informants, and potential social bias in responses, civil servants at the Ministry of Religion in Pangkep Regency hold positive perceptions of Islamic banking products. However, despite these limitations, the interview results indicate an appreciation for Sharia principles, product transparency, and the commitment of Islamic banks to provide financial services that align with Islamic values. This study not only enriches the scientific knowledge on civil servants' perceptions of Islamic financial products but also serves as a positive foundation for improving financial literacy, encouraging more responsive product innovation, and strengthening the role of Islamic banks as ethically based financial inclusion instruments. With a wise and cautious approach, the author hopes that these findings can contribute meaningfully to the sustainable development of the Islamic economy in Indonesia. ABSTRAKTujuan dari artikel ini adalah untuk menganalisis persepsi Pegawai Negeri Sipil di Kementerian Agama terhadap produk bank syariah yang tersedia di Kabupaten Pangkep. Metode penelitian yang digunakan dalam penelitian ini adalah metode kualitatif. Jenis penelitian yang digunakan adalah penelitian lapangan atau Field Research. Hasil penelitian menunjukkan bahwa; persepsi Pegawai Negeri Sipil di Kementerian Agama Kabupaten Pangkep terhadap produk bank syariah, meskipun dihadapkan pada tantangan birokrasi yang ketat, keterbatasan pemahaman informan, dan potensi bias sosial dalam jawaban. Namun, di balik keterbatasan tersebut, hasil wawancara menunjukkan adanya apresiasi terhadap prinsip syariah, transparansi produk, dan komitmen bank syariah dalam menyediakan layanan keuangan yang sesuai dengan nilai-nilai Islam. Penelitian ini tidak hanya memperkaya khazanah ilmiah tentang persepsi PNS terhadap produk keuangan syariah, tetapi juga menjadi dasar positif untuk meningkatkan literasi keuangan, mendorong inovasi produk yang lebih responsif, serta memperkuat peran bank syariah sebagai instrumen inklusi keuangan berbasis etika. Dengan pendekatan yang bijak dan penuh kehati-hatian, penulis berharap temuan ini dapat memberi kontribusi nyata bagi pengembangan ekonomi syariah yang berkelanjutan di Indonesia.
