Abstract

Microtransactions are a type of small-scale financial transaction conducted online. With the advent of the internet, trading transactions no longer require direct interaction between the seller and the buyer, as everything is done through online platforms. One form of microtransaction found in games is gacha. The issue of microtransaction gacha arises due to their inherent gambling elements. However, there is a loophole in current criminal law in Indonesia where no specific regulation governs this issue. This research aims to compare the differences in the legal regulation of microtransaction gacha between national criminal law and Islamic criminal law. The research methodology employed is a comparative method with a literature review approach. The findings of this research indicate that there is no specific regulation in national criminal law that categorizes microtransaction gacha as prohibited acts under the law, whereas, in Islamic criminal law, microtransaction gacha fulfill the elements of gambling and are therefore considered haram (forbidden). Therefore it is important to establish a framework of criminal law that regulates gacha systems to minimize the impacts caused by microtransaction gacha.

Abstract

This research aims to explore understanding and clarify potential misconceptions related to hand-cutting punishment in the context of Al-Sariqah crime (theft) within Islamic law. The research also encompasses an examination of legal approaches and justice in the implementation of this punishment. By analyzing various literary sources, particularly the opinions of scholars and Islamic legal literature, this study highlights the stringent standards and conditions that must be met for hand-cutting punishment to be applied. This research will utilize academic databases, digital libraries, and other reliable sources to gather scholarly articles, books, and conference papers discussing aspects of hand amputation punishment in the context of al-Sariqah. the research dispels the common belief that it can be haphazardly applied. The stringent prerequisites, including evidence, legal clarity, and understanding the perpetrator's circumstances, underline that hand amputation is not an arbitrary measure but is reserved for specific circumstances.

Abstract

This article delves into the comprehensive examination of the dispute resolution in adultery cases within the Tolaki Tribe, specifically through the traditional practice of "Kalosara." The research also explores the relevance of Kalosara to the al-Ishlah concept in Islamic criminal law. This research uses the literature review method to establish a robust theoretical foundation. This research indicates a significant relevance between the Kalosara custom and the concept of Ishlah in the context of Islamic criminal law. The practice of Kalosara in resolving cases of adultery within the Tolaki Tribe reflects the principles of Ishlah, emphasizing reconciliation, restoration, and conflict resolution. The stages of the resolution process, from the acknowledgment of the perpetrator to the purification ceremony, mirror a holistic approach to achieving restorative justice. The research results show that the integration of Kalosara customary law in the Ishlah process reflects the aspirations of the Tolaki community for a comprehensive resolution and effective recovery at various levels, including individual, social, and broader community contexts. In the settlement through Kalosara, adulterers are expected to admit their actions, express regret, and carry out a purification process with a holistic approach to resolving conflicts and restoring social relations.

Abstract

This research was a comparative study on the effect of young age in the crime of murder between Islamic jurisprudence and Indonesian law. The presence of children around us needs attention, especially with regard to their behavior, which is out of control. the phenomenon of their deviation is one of the negative social phenomenon which required protection, guidance and education. According to previous studies, children who deviated and were not controlled would become a criminal when he reaches adulthood. Nowadays, the children's delinquency is widely spread, they are involved in committing crimes such as drugs, theft, fighting, and increased to murder. This research will focus on the murder committed by under age children, because murder is a very dangerous crime to the indivdual life and is one of the law violation againts the five  principles of shariah (daruriyat al khamsah).

Abstract

Unraveling the intricate dynamics of marriage dispensations and divorces, this study dives deep into the Sidenreng Rappang Religious Court which is located at South Sulawesi, through the lens of Sadd al-Dzarī‘ah. This is a field research study employing a juridical, anthropological, and socio-legal approach. The data analysis utilizes theories of social conflict, law enforcement and sadd al-Dzarī‘ah. Findings indicate that the primary trigger for marriage dispensation applications is premarital pregnancy resulting from free sexual interactions, which neglects children's rights. Law enforcement in cases of divorce following underage marriage reflects justice, certainty, and legal utility without compromising the best interests of underage marriages. The application of sadd al-Dzarī‘ah aims to reduce marriage dispensations and divorces, prioritizing preventive measures and closing opportunities that could harm the future and interests of underage marriages.

Abstract

Research Objective: This study examines the Territorial Principle within Islamic Criminal Law, focusing on jurisdictional boundaries and enforcement of Islamic punishments for non-Muslims under Islamic governance. Research Methodology: The research employs literature review methodology, analyzing primary and secondary sources addressing territorial jurisdiction in Islamic legal traditions and examining contemporary implementation case studies. Results: The research identifies divergent jurisprudential positions: Imām Abū Ḥanīfah restricts enforcement to Muslim territories with discretionary authority granted elsewhere, while Imām Malik, al-Syafi'ī, and Imām Ahmad advocate universal application emphasizing individual responsibility over geographical boundaries. Findings and Implications: Implementation of territorial principles in regions like Aceh reveals jurisdictional conflicts between local Islamic law and national legal frameworks, creating inconsistencies that challenge legal coherence within pluralistic governance structures. Conclusion: Diverse interpretations of territorial jurisdiction create practical challenges in contemporary legal systems. Achieving legal harmony requires balancing local religious-legal autonomy with national legal coherence. Contribution: This research provides systematic analysis of territorial jurisdiction principles in Islamic criminal law and their contemporary applications, enhancing understanding of how classical Islamic legal principles operate within modern governance structures. Limitations: The study relies exclusively on literature review methodology without empirical data collection. The research primarily examines theoretical jurisprudential positions rather than comprehensive case studies across multiple jurisdictions. Suggestions: Future research should explore comparative legal mechanisms navigating jurisdictional tensions between religious and secular systems. The study recommends establishing clearer guidelines for territorial application in pluralistic societies, particularly regarding non-Muslim citizens

Abstract

This research analyzes family law systems in Indonesia and Saudi Arabia regarding marriage from a Maqasid al-Sharia perspective. It examines issues such as serial marriage practice, implications in both countries, and Maqashid al-Shari'ah's view on marriage registration. The study aims to analyze serial marriage practice, its implications, and Maqashid al-Shari'ah's perspective on marriage registration. It employs a library research method with a normative juridical approach. Primary sources include Islamic marriage regulations, Legal Regulations on Marriage KHI, Saudi law, and library literature. Findings reveal reasons for serial marriages in Indonesia and Saudi Arabia, influenced by social, cultural, and economic factors. Both countries face legal and social challenges for children from such marriages. Implications of serial marriages include legal uncertainty, limited access to public services, and health risks. In Indonesia, marriage status is not officially recognized, while in Saudi Arabia, women lack legal protection against health and domestic violence risks. Maqashid al-Shari'ah emphasizes maintaining religion, offspring, and property through marriage registration

Abstract

The purpose of this study is to describe the understanding of traders in the Sengkang central market Wajo Regency, towards the practice of local wisdom Mula Balu as a sales booster in sharia economic analysis. The results of this empirical qualitative study are: 1) Traders' understanding of the concept of Mula Balu as something positive and not contrary to religion because it is not obtained from shamanic practices but is obtained from the process of learning sharia, tarekat, hakikat and ma'rifatullah and is understood as a manifestation of prayer or Assennung-sennungeng ri decenge (hope for goodness). 2) The practice is very diverse, some use mantras such as Arase Kursia, folded (Rekko ota) and stored normally. 3) Sharia economic analysis of the use of Mula Balu as a sales booster in the Sengkang central market, Wajo Regency shows three results of the analysis.

Abstract

Giving zakat to mama biang is one of the problems of zakat distribution that has attracted controversy. In the people of Negeri Iha, Maluku, the giving of zakat mama biang has become a tradition that has survived into the modern era. The purpose of this study is to study the practice of distributing zakat to Mama Biang, the opinions of tafsir scholars and  the implications for  Islamic law. The study uses empirical legal studies with an anthropological approach to Islamic law. While data collection techniques are in-depth interviews and literature studies. This study concluded that the controversy over the distribution of zakat mama biang occurred due to differences in scholars' interpretations of the meaning of fīsabīlillāh which had implications for differences in people's understanding of Islamic law. People who maintain the tradition of zakat mama biang understand that the distribution of zakat mama biang is in accordance with Islamic law, relying on the opinion of scholars who expand the meaning of fīsabīlillāh to include mama biang. Meanwhile, some people understand that mama biang zakat is not in accordance with Islamic law.  The controversy over the distribution of zakat to mama biang also occurs because zakat is not distributed evenly to all existing asnaf, this  can also trigger gaps in society. Therefore, in the perspective of legal anthropology, the practice of giving to mama biang can continue as a local tradition, but this gift can be categorized as infaq or sadaqah, not zakat. So that this can give birth to harmonious legal implications between Islamic law and adat which has become living law.

Abstract

Penelitian ini bertujuan untuk menganalisis realisasi eksekusi hak nafkah iddah, mut’ah, dan madhiyah pasca perceraian di Pengadilan Agama Sidenreng Rappang pada periode 2019-2023. Dengan menggunakan pendekatan yuridis normatif dan metode penelitian lapangan, data diperoleh melalui wawancara dengan hakim serta analisis dokumen hukum. Hasil penelitian menunjukkan bahwa hanya 6,21% tuntutan nafkah istri yang dipenuhi oleh mantan suami, dengan banyak kasus yang terhambat oleh kurangnya kesadaran hukum, itikad baik, dan kemampuan finansial suami. Hakim memainkan peran penting dalam menetapkan keputusan berdasarkan asas keadilan, mempertimbangkan kemampuan ekonomi suami, kebutuhan istri, serta prinsip keadilan gender. Meski beberapa peraturan, seperti SEMA No. 3 Tahun 2018, telah memberikan landasan hukum yang kuat, pelaksanaan di lapangan masih menemui banyak kendala. Rendahnya tingkat gugatan rekonvensi oleh istri juga menjadi hambatan, yang sering disebabkan oleh kurangnya pengetahuan hukum dan ketidakmampuan perempuan untuk memanfaatkan hak-haknya secara optimal. Studi ini merekomendasikan edukasi hukum yang lebih luas, peningkatan pendampingan bagi perempuan dalam persidangan, dan mekanisme eksekusi yang lebih efektif untuk memastikan perlindungan hak perempuan pasca perceraian secara berkelanjutan.
