Abstract

The purpose of this study was to ascertain the murafa’at fiqh (Saudi Arabian Law) and the Indonesian Criminal Procedure Code's perspectives on a convict's plea for i’adah al-nadzr (reconsideration). This was a normative juridical inquiry, which entailed poring over relevant material to gather data, assess content, and draw similarities between positive law and Islamic criminal law. The findings of this study indicated that review in positive law, referred to in Saudi Arabia's murafa’at fiqh as i’adah al-nadzr/al-muhakamah, attempted to ensure legal justice and judge justice in their rulings. There were parallels between positive law and murafa’at fiqh in terms of the justifications for filing reconsideration. There were, however, distinctions regarding the giyabi case as a basis for submitting reconsideration. In Saudi Arabia's murafa’at fiqh, the reconsideration application in the giyaby case could be accepted, although positive law did not cite the giyaby ruling as a reason to seek reconsideration. Positive law, on the other hand, provides for the possibility of resistance (verzet) if the defendant was not present in court and has not protested Verstek's ruling. Another parallel between positive law and Saudi fiqh murafa’at was seen in the reconsideration application regulations, which prohibited suspending the execution of rulings. However, the researcher notes that this rule cannot be applied universally.

Abstract

Penelitian ini membahas mengenai Pelimpahan Perwalian Dalam Proses Akad Nikah: Studi Kritis Tradisi Mappabakkele Di Kantor Urusan Agama Ma’rang, Kabupaten Pangkep, dengan sub masalah:1) Bagaimana mekanisme pelimpahan perwalian. 2) Faktor apa saja yang mempengaruhi terjadinya mappabakkele pada proses akad nikah. 3) Bagaimana analisis tinjauan hukum Islam tentang praktik pelimpahan perwalian. Penelitian ini adalah penelitian lapangan (field research) dengan menggunakan pendekatan hukum empiris (sosiologis). Penelitian dilakukan di Kantor Urusan Agama Ma’rang Kabupaten Pangkep dengan pengumpulan data melalui wawancara dan studi kepustakaan dengan penelusuran terdahadap literatur, buku, dan perundang-undangan. Hasil penelitian ini menunjukkan: 1) Mekanisme pelimpahan perwalian di Kantor Urusan Agama Ma’rang Kabupaten Pangkep pada proses akad nikah yaitu calon pengantin mengajukan permohonan pelimpahan perwalian, wali nikah memberikan persetujuan, KUA melakukan verifikasi terhadap dokume yang diajukan, Dalam proses akad nikah, wakil yang ditunjuk hadir untuk mewakili wali nikah dalam memberikan persetujuan dan melaksanakan akad nikah. Setelah akad nikah, KUA mencatat pernikahan tersebut. 2) Faktor yang mempengaruhi terjadinya Mappabakkele pada proses akad nikah di Kantor Urusan Agama Ma’rang Kabupaten Pangkep yaitu: faktor keluarga, faktor agama dan hukum, faktor sosial dan budaya, faktor ketiadaan wali nasab, faktor permintaan pribadi dan faktor kepercayaan pada Kantor Urusan Agama. 3) Tinjauan Hukum Islam tentang praktik Pelimpahan Perwalian yang terjadi di Kantor Urusan Agama Ma’rang Kabupaten Pangkep bahwa praktik ini sesuai dengan hukum Islam. Hal ini karena dalam hukum Islam, wakalah atau pelimpahan perwalian diakui sebagai mekanisme yang sah, dimana seorang wali nikah dapat mewakilkan haknya untuk melakukan akad nikah kepada pihak lain yang dianggap mampu dan dipercaya untuk melaksanakannya.

Abstract

This study examines the shifting meaning of Siri’ in the practice of pre-wedding photography among the Bugis community in Parepare City. In Bugis culture, Siri’ represents honor, modesty, and respect for tradition, values strictly preserved, especially by couples preparing for marriage. However, modernity and contemporary lifestyle have increased the popularity of pre-wedding photography. From an Islamic law perspective, interactions between unmarried men and women are restricted, including in pre-wedding photo sessions, creating tension between modern practices, cultural values, and religious norms.The research uses a field-based qualitative design with an empirical approach. Data were collected through observation, interviews, and documentation. Primary sources included religious leaders, photographers, and couples involved in pre-wedding photography, while secondary sources comprised literature on Siri’ and Islamic family law.The findings highlight three main points: (1) Pre-wedding photography is now part of contemporary wedding trends despite some perceptions of inappropriateness, driven by technology, social media, and visual representation. (2) There is a significant shift in Siri’s interpretation, moving from strict pre-marital modesty toward a symbolic understanding compatible with modern lifestyles. (3) Islamic law and Siri’ values respond critically and selectively; Islamic law rejects practices that violate sharia, while Siri’ has transformed yet persists in the community’s consciousness.These findings imply that Bugis cultural identity is adapting, with traditional values like Siri’ being reinterpreted rather than abandoned to accommodate modern social realities. This shift challenges communities to balance cultural expectations, religious norms, and contemporary lifestyles, highlighting the need for clearer cultural guidance and context-sensitive Islamic legal education.

Abstract

Penelitian ini membahas kontroversi keabsahan perwalian nikah non-Muslim dalam perspektif hukum keluarga Islam. Permasalahan penelitian dirumuskan dalam tiga pertanyaan utama: (1) bagaimana keabsahan wali nikah non-Muslim menurut hukum keluarga Islam, (2) apa faktor yang melatarbelakangi munculnya kontroversi tersebut, dan (3) bagaimana solusi yang dapat diterapkan dalam konteks hukum keluarga Islam di Indonesia. Penelitian ini merupakan penelitian pustaka dengan pendekatan kualitatif. Data primer meliputi al-Qur’an, Hadis, Kompilasi Hukum Islam (KHI), serta kitab fikih klasik empat mazhab. Data sekunder berasal dari buku, artikel dan jurnal ilmiah, tesis, disertasi, putusan pengadilan agama, serta fatwa ulama. Hasil penelitian menunjukkan bahwa berdasarkan pandangan mayoritas ulama fikih dan hukum positif di Indonesia, wali nikah non-Muslim tidak sah menikahkan perempuan Muslimah. Keislaman wali merupakan syarat mutlak karena berkaitan dengan prinsip akidah dan perlindungan maslahat agama, sebagaimana ditegaskan oleh mazhab Syafi’i, Maliki, dan Hanbali, serta tercermin dalam KHI Pasal 20–23. Kontroversi muncul akibat kondisi sosial, seperti pernikahan mualaf dan relasi keluarga lintas agama. Oleh karena itu, diperlukan pendekatan humanis dan dialogis melalui peran KUA dan tokoh agama, agar pengalihan perwalian kepada wali hakim dipahami sebagai upaya menjaga kesesuaian syariat tanpa menafikan ikatan kekeluargaan.

Abstract

This study analyzes the fulfillment of marital rights and obligations of wives employed at Barru Regency Hospital from the perspective of Islamic Law and Indonesian Marriage Law. The research focuses on the implementation of spousal rights and obligations, influencing factors, and legal perspectives under Islamic and positive law. This qualitative study employs a case study approach, using primary data from employed wives at Barru Hospital and secondary data from relevant literature. Data were collected through observation, interviews, and documentation. The findings indicate a generally good level of cooperation between spouses in fulfilling their rights and obligations, despite challenges related to working hours and cultural norms. Cultural, educational, and economic factors significantly influence this fulfillment. The study emphasizes that marital rights and obligations should be carried out based on principles of justice, mutual respect, and cooperation in accordance with Islamic Law and statutory regulations.

Abstract

This research explores the integration of customary law, national law, and Islamic criminal law through a case study of ma’rambu langi in the Toraja community by firstly examining its effectiveness. Ma’rambu langi is a form of customary sanction imposed for severe moral violations, such as adultery and other breaches of local traditions. This sanction aims not merely to punish, but to restore social harmony through symbolic and public acts of moral responsibility. The offender is required to confess the wrongdoing and seek reconciliation with the community. The research adopts a qualitative method using semi-structured interviews with traditional leaders, community members, and legal practitioners, along with document analysis that includes customary case archives, court decisions, and relevant academic literature. The findings reveal that ma’rambu langi plays a significant role in maintaining social order, preventing the recurrence of offenses, and reinforcing the authority of customary law. Moreover, the study indicates that elements of this customary practice resonate with values in both national and Islamic criminal law, particularly in emphasizing restorative justice and communal integrity. The research contributes to ongoing discussions on legal pluralism in Indonesia, suggesting that harmonizing customary, national, and religious legal systems can enrich the development of a more inclusive, context-sensitive, and sustainable legal framework. It also emphasizes the importance of recognizing local wisdom in addressing moral and social issues while ensuring compatibility with broader legal principles and human rights norms.

Abstract

This study aims to analyze the role and urgency of sharia fatwas in legitimizing and operationalizing zakat as a financing instrument for renewable energy projects, viewed through Islamic political thought in the context of the global climate crisis. Employing a qualitative approach, the research utilizes document analysis of fatwas (e.g., MUI Fatwa No. 15/2017 and Malaysian zakat fatwas), interviews with representatives from zakat institutions (Baznas and State Zakat Centers), and case studies of renewable energy projects in Indonesia and Malaysia. The findings reveal that sharia fatwas provide robust legal legitimacy for channeling zakat into green projects like solar power plants (PLTS) and biomass initiatives, aligning with maqasid sharia’s hifzhul bi’ah (environmental preservation) and supporting global climate goals, such as the 2050 net-zero emissions target. Despite challenges like low sharia literacy and limited fund scales, zakat demonstrates significant potential to support Sustainable Development Goals (SDGs) 7 and 13, fostering socio-economic benefits for mustahik through clean energy access and green job creation. The study concludes that sharia fatwas and green zakat serve as innovative tools to bridge Islamic values with global environmental policies, enhancing sustainability. Academically, it contributes by developing the concept of green zakat, filling a literature gap in integrating zakat with renewable energy financing, and offering a framework for aligning sharia-based finance with sustainable development.

Abstract

This study aims to examine the effectiveness of the al-shulhu approach in resolving Islamic economic disputes, particularly in cases of breach of murabahah contracts in Indonesia. Employing a qualitative approach with a library research design, this study collects data from academic journals, books, and regulations such as DSN-MUI fatwas through qualitative content analysis. Source selection was based on criteria of relevance to the topic, recency of publication (focusing on the 2020–2025 range). The findings indicate that al-shulhu, rooted in the principle of sulh in the Qur’an (Surah An-Nisa: 128), is an effective dispute resolution mechanism as it emphasizes justice (al-‘adl), honesty (as-sidq), and mutual consent (ridhā). This approach enables solutions such as financing restructuring or penalty reductions without violating sharia principles, while maintaining social harmony between Islamic banks and clients. However, the application of al-shulhu faces challenges, including the lack of a clear legal framework, inconsistent implementation across institutions, and a shortage of competent mediators with expertise in Islamic law. This study contributes to academic discourse by bridging classical Islamic legal theory with modern dispute resolution practices and provides practical recommendations for Islamic financial institutions and regulators, such as OJK and DSN-MUI, to integrate al-shulhu into the national legal system through clear regulations and mediator training. The study recommends further empirical research to enhance understanding of al-shulhu’s application in religious courts and Islamic financial institutions.

Abstract

One form of action that gets criminal abolition is an action taken by someone in order to defend themselves from an emergency threat, but the act of self-defense sometimes exceeds the proper limit. This study aims to find out how the comparison between Islamic criminal law and positive law towards actions that exceed the limits (noodweer exces) in self-defense. This research is a qualitative research study using library research. According to the results of this study, it was found that the defense carried out beyond the limit (Noodweer exces), in positive law as stipulated in KUHP 49 paragraph 2, when self-defense that exceeds the limit carried out under conditions of "shaking of the soul", then this can be used as a justification or forgiveness that can eliminate the crime. In contrast to Islamic criminal law, a person must be held responsible for acts of defense that go beyond limits under any circumstances.Keywords: Self-Defense; Noodweer Exces; Positive Law.

Abstract

The objective of this study is to ascertain the comparative analysis of religious blasphemy legislation in Egypt and Indonesia. This study also elucidates the implementation of religious blasphemy legislation in Egypt and Indonesia. This study involves comparative legal research. Comparative research was conducted to gather additional insights on the blasphemy laws in Egypt and Indonesia. This study employs library research methodology to gather both primary and secondary data. The findings of this study indicate that the legislation governing religious blasphemy in Indonesia is law number. 1/ PNPS/1965, but in Egypt it is article 98 of the Egyptian Penal Code. Additionally, this study discovered parallels in the implementation of religious blasphemy legislation in Egypt and Indonesia. The implementation of anti-blasphemy legislation in both nations frequently subjects defendants to a succession of grave human rights infringements perpetrated by both private individuals and government agents
