Abstract

Pengabdian Pada Masyarakat yang dilakukan oleh Tim Dosen dari Fakultas Hukum Universitas Lancang Kuning bertempat di ruang pertemuan kantor Desa Ujung Batu Timur dengan judul Peningkatan Pemahaman Masyarakat Mengenai Kewajiban Memiliki KTP-el Di Desa Ujung Batu Timur Kabupaten Rokan Hulu Berdasarkan Undang-Undang Nomor 24 Tahun 2013 Tentang Administrasi Kependudukan. Penyampaian materi dilakukan dengan cara ceramah atau penyuluhan yang diawali dengan pengisian kuisioner pre test dan setelah tanya jawab di akhiri dengan kuisioner post test. Pentingnya kegiatan ini dilakukan agar masyarakat memahami betul tentang pentingnya kepemilikan KTP-el berdasarkan Undang-Undang Nomor 24 Tahun 2013 Tentang Administrasi Kependudukan. Dengan adanya beberapa pertanyaan terlihat bahwa materi yang disampaikan mendapatkan perhatian yang serius dari peserta.

Abstract

Ulayat land is a land with the members of the customary law community. This study aims to explain the transfer of customary land ownership rights according to the laws and regulations in Indonesia. The method used in this research is normative legal research, using a statutory approach. The results of the study explain that the recognition of ulayat rights is stipulated in the constitution of the State of Indonesia, namely Article 18B of the 1945 Constitution of the Republic of Indonesia admitts and reverences the customary community units and their traditional rights as long as they are alive and in accordance with with the development of society and the principles of the Unitary State of the Republic of Indonesia. Furthermore, Article 28 paragraph (3) of the 1945 Constitution of the Republic of Indonesia states that traditional cultural and community identities are respected in line with the development of times and civilizations. In the concept of national land law, there are three entities related to land status, namely state land, private land, and customary land, but in the concept of national forest law, only two forest statuses are recognized, namely state forest and private forest. In the concept of land acquisition for the public interest, indigenous peoples are not given the freedom to make decisions on development programs and investments made by the government on ulayat lands, for example toll road construction projects.

Abstract

In essence, correctionalization is one of the manifestations of the formal institutionalization of the public's reaction to crime. The reaction of this society at first only focused on the element of giving suffering to lawbreakers. However, in line with the development of society, the element of giving suffering must also be balanced with humane treatment by paying attention to the human rights of lawbreakers as individual beings, as well as creatures. social. Therefore, the correctional facility must also function as a place for the rehabilitation of prisoners with a variety of coaching activities. The purpose of this study is to analyze the implementation of the equal rights of prisoners to get health services at prisons in Riau province and to analyze the obstacles and efforts in implementing the equal rights of prisoners to get health services in prisons in Riau province. The research method is sociological legal research, by identifying the legal effectiveness of the law in society which discusses the Implementation of the Equality of Prisoners to Get Health Services in Prisons in Riau Province, namely in Class II A Lapas Pekanbaru and Class II B Rokan Hulu Prison. In general, the implementation of prisoners' rights in obtaining health services in prisons in Riau Province has not been able to meet the needs of prisoners in prisons. It is hoped that the government will pay special attention to the impact arising from the overcapacity of a correctional institution. Because the excess occupants (over capacity) of a correctional institution will cause a health condition that is not good for prisoners so that it will hinder the running or ineffectiveness of the implementation of development programs in prisons. It is hoped that the Government will further improve health resources, financing, infrastructure, health service efforts and maintain environmental health in prisons and fulfill the food and drinking needs of prisoners in prisons as well as special attention to the impact arising from overpopulation. capacity) of a correctional institution so that the right to health for prisoners can be fulfilled, and human rights can be protected according to the ideals of the Indonesian people as referred to in Pancasila and the 1945 Constitution of the Republic of Indonesia (UUDNRI).

Abstract

As referred to in Article 106 paragraph (3) in conjunction with Article 48 paragraph (2) and paragraph (3) shall be sentenced to a maximum imprisonment of 1 (one) month or a maximum fine of Rp. 250,000.00 (two hundred and fifty thousand rupiah). As for the formulation of the problem in this study is HowMean Motor Vehicle Noise Threshold, HowJuridical Overview Motor Vehicle Noise Threshold, and HowLegal SettlementMotor Vehicle Noise Threshold in Indonesian Positive Law. The method used is normative legal research. Data sources consist of primary legal materials, secondary legal materials, and tertiary legal materials. In this study the data were analyzed qualitatively and in drawing conclusions the authors applied the method of deductive thinking. Based on the results of the study it is known thatMean Motor Vehicle Noise Threshold that is in the Regulation of the State Minister of the Environment Number 7 of 2009 concerning the New Type Motor Vehicle Noise Threshold. In the attachment of the Minister of Environment Regulation Noise Threshold confirms that the motorcycle noise threshold under 175cc is 80 dB and above 175cc is 83 dB.Juridical Overview Motor Vehicle Noise Threshold that in Article 285 of Law Number 22 of 2009 concerning Road Traffic and Transportation paragraph (1) that everyone who drives a Motorcycle on the Road that does not meet the technical and road-worthy requirements which includes rearview mirrors, horns , headlights, brake lights, directional lights, reflecting devices, speed measuring devices, exhaust, and tire groove depth as referred to in Article 106 paragraph (3) in conjunction with Article 48 paragraphs (2) and (3) shall be punished with imprisonment for a maximum of 1 (one) month or a maximum fine of Rp. 250,000.00 (two hundred and fifty thousand rupiah). Legal SettlementMotorized Vehicle Noise Threshold In Indonesian Positive Law that in taking action by law enforcement in this case the police and the Transportation Agency in carrying out enforcement in terms of noise testing, they never test how much noise is produced and law enforcers do not have the tools to measure the noise level generated from exhaust of motorized vehicle users on the highway.

Abstract

Consequences of the implementation of the Act Number 23 of 2014 on Regional Government spawned extraordinary complexity of the problems in some areas. One of the problems that arise is a rampant discourse of regional expansion that occurs both at the provincial and district/city. In essence, the establishment, merger, and abolition of the area aim to improve public services to be more optimal, shorten the span of control, and accelerate the welfare of society in strengthening the integrity of the Unitary Republic of Indonesia. The purpose of this study was to determine the implications of the establishment of new autonomous regions in the frame of the Republic of Indonesia based on Act Number 23 of 2014 on Regional Government; and to understand the implications of the establishment of new autonomous regions preparation for improving people's welfare by Act Number 23 of 2014 on Regional Government. This type of research is a normative legal research. Methods and techniques of data collection through library studies or studies document. Mechanical analysis of legal material is a descriptive qualitative. Conclusions from this research are that the implications of the establishment of regional preparation of new autonomous within the framework of the Unitary Republic of Indonesia before Act Number 23 of 2014 on Regional Government due to the local communities feel there is an imbalance of equity and fairness between regions with each other in the local government areas. Implications of the establishment of new autonomous regions preparation for improving people's welfare by Act Number 23 of 2014 on Regional Government that in order to establish an area or region of the expansion needed a measure as the basis for the determination. Establishment and expansion of new areas should be based on the divisions that are objective with those aspects of the financing of Human Resources and other support facilities

Abstract

Dalam perkembangannya pendistribusian minyak bersubsidi mengalami kelangkaan. Sementara mayoritas industri yang ada di masyarakat banyak mempergunakan BBM. Misalkan, kebijakan Subsidi BBM jenis solar kepada masyarakat menurut banyak kalangan merupakan hal yang dilematis. Disatu sisi masyarakat membutuhkannya namun subsidi justru menguntungkan industry besar yang masih menggunakan BBM jenis solar. Di tengah kondisi sulit yang di hadapi oleh Pemerintah, akibat semakin meningkatnya permintaan BBM Bersubsidi dan naiknya harga BBM di pasar dunia, ada pihak-pihak tertentu baik perseorangan maupun korporasi yang melakukan perbuatan tidak bertanggung jawab berupa: pengoplosan, penimbunan, penyelundupan, pengangkutan dan penjualan kepada industri BBM Bersubsidi. Penelitian ini melihat menganalisis tinjauan normative terhadap penjualan BBM Subsidi dan menganalisis system pengawasan penyelewengan penjualan BBM Subsidi kepada industri yang dilakukan SPBU berdasarkan Undang-Undang Republik Indonesia Nomor 22 Tahun 2001 tentang Minyak Dan Gas Bumi. Dengan menggunakan pendekatan penelitian kualitatif, dengan melakukan tinjauan yang bersifat normative terhadap penjualan BBM Subsidi Berdasarkan Undang-Undang Republik Indonesia Nomor 22 Tahun 2001. Sumber data berasal dari data sekunder, primer dan bahan Hukum Tertier. Pengumpulan data menggunakan teknik studi documenter/studi kepustakaan. Hasil penelitian mendapati dalam UU No. 22 tahun 2001 telah termuat konsep penyelenggaraan kegiatan usaha migas, konsep penguasaan kemigasan, konsep penyediaan dan pemanfaatan kemigasan, konsep pengusahaan kemigasan dan konsep kelembagaan kemigasan. Sedangkan untuk implementasinya di Indonesia, penyediaan dan Pemanfaataan Gas Bumi dilaksanakan melalui berbagai aturan hukum yang telah ada

Abstract

Indonesia sebagai negara berkembang yang mempunyai istitusi Kepabeanan yang diselengarakan oleh Direktorat Jenderal Bea dan Cukai sebagai daerah kegiatan ekonomi maka sektor Bea dan Cukai merupakan suatu instansi dari pemerintah yang sangat menunjang dalam kelancaran arus lalu lintas ekspor dan impor barang di daerah Kepabeanan Cukai merupakan salah satu andalan penerimaan negara yang sangat penting. Pajak tembakau adalah retribusi atas cukai yang dipungut oleh pemerintah dan tarif pajak tembakau adalah 10 persen dari cukai tembakau. Jadi, setiap produk tembakau akan mendapat pajak dua kali, yaitu 40 persen dan 10 persen Maraknya rokok ilegal di negara Indonesia khususnya di kabupaten inhil juga menjadi sorotan, karena pada saat itu rokok illegal beredar bebas, mulai dari penggunaan, Perubahan tarif cukai rokok yang sudah terjadi empat kali dalam lima tahun terakhir dan terus menerus meningkat menjadi hambatan atau kendala dalam implementasi kewajiban membayar cukai rokok di kabupaten inhil Perubahan tersebut dinilai memberatkan bagi perusahaan rokok khususnya bagi perushaan rokok kecil dan yang menjadi upayanya adalah DJBC hendaknya perlu mengkaji ulang astas kenaikan tarif cukai rokok tersebut supaya tiak ada lagi perusahaan pengusa rokok yang mengeluhkan tentang kenaikan cukai rokok.

Abstract

Abstract: Hospitals have an important meaning in providing health services and medical services. Health services in hospitals are important and must be maintained or improved in quality according to applicable service standards so that the community as recipients of services can feel the health services provided. Calling a doctor is one form of health service, so if it is proven that a doctor has made a medical mistake, the hospital is also responsible for the doctor's mistake. Because hospitals and doctors have a legal relationship that is equally responsible for the health services provided to patients. The form of accountability can be in the form of criminal legal responsibility, civil legal responsibility, administrative legal responsibility.Keywords: legal liability, doctor's medical actionAbstrak: Rumah sakit memiliki arti penting dalam memberikan pelayanan kesehatan maupun pelayanan medis. Pelayanan kesehatan pada rumah sakit merupakan hal yang penting dan harus dijaga maupun ditingkatkan kualitasnya sesuai standar pelayanan yang berlaku agar masyarakat sebagai penerima Jasa dapat merasakan pelayanan kesehatan yang diberikan. Pemanggilan dokter merupakan salah satu bentuk dari pelayanan kesehatan, sehingga jika terbukti dokter melakukan kesalahan tindakan kedokteran, maka rumah sakit ikut bertanggungjawab atas kesalahan dokter tersebut. Karena rumah sakit dengan dokter memiliki hubungan hukum yang sama-sama bertanggung jawab terhadap pelayanan kesehatan yang diberikan kepada pasien. Bentuk pertanggungjawaban tersebut dapat berupa tanggung jawab hukum pidana, tanggungjawab hukum perdata, tanggungjawab hukum administasi.Kata kunci: tanggungjawab hukum, tindakan medis dokter
