Abstract

The substance of the legislation is identified as one of the influential aspects that impact the settlement process of civil matters in the General Court. This particular legal entity encompasses both formal and material aspects of the law. Civil procedural law governs the procedural aspects of case settlement, adhering to formal legal requirements. On the other hand, material law pertains to the substantive legal principles that govern the legal relationship between the parties involved in a dispute. The current state of the Civil Code is incongruent with the prevailing sentiment of public justice, so deviating from the fundamental tenets of national law and dualism. The objective of this study is to gain knowledge and comprehension regarding the issue of legal substance as a contributing factor in the examination of civil cases within the General Court. Furthermore, the aim is to propose a resolution to address the problem of legal substance as a factor impacting the process of examining civil cases in the General Court. The present study constitutes a normative legal research. Based on the outcomes of the discourse, the ensuing deductions may be ascertained: The insufficiency of the existing regulations governing the examination of civil cases in the General Court can be attributed, in part, to the intricate nature of legal substance issues. Consequently, it is imperative to establish a comprehensive legal framework, specifically in the form of the Civil Procedure Code, rather than relying on provisions at a lower hierarchical level, such as Supreme Court Regulations and Supreme Court Circular Letters. Furthermore, in order to garner attention from governmental entities or authorized individuals, such as the House of Representatives of the Republic of Indonesia, the President, and the Supreme Court, it is imperative to seek resolution or settlement in alignment with the enactment of a civil procedure law, specifically a Civil Procedure Code, in accordance with the prescribed legislative procedures.

Abstract

Abstrak Perlindungan hukum terhadap nasabah dalam sistem perbankan memiliki peranan penting untuk menjaga kepercayaan publik dan stabilitas keuangan nasional, terutama ketika terjadi likuidasi bank. Penelitian ini bertujuan menganalisis kerangka hukum perlindungan nasabah, mengidentifikasi kendala dalam implementasinya, serta merumuskan strategi untuk memperkuat posisi hukum nasabah. Metode yang digunakan adalah pendekatan yuridis normatif dengan menelaah peraturan perundang-undangan, literatur hukum, serta data sekunder terkait. Hasil penelitian menunjukkan bahwa meskipun telah diatur dalam Undang-Undang No. 10 Tahun 1998 tentang Perbankan dan Undang-Undang No. 24 Tahun 2004 tentang Lembaga Penjamin Simpanan (LPS), mekanisme perlindungan hukum masih menghadapi hambatan. Kendala yang muncul antara lain rendahnya literasi hukum nasabah, keterbatasan akses terhadap informasi likuidasi, ketidaktepatan data nasabah, serta lambannya proses verifikasi oleh lembaga terkait. Selain itu, kedudukan nasabah sebagai kreditur konkuren memperlemah kepastian hukum dalam pemenuhan hak simpanannya. Oleh karena itu, diperlukan langkah strategis melalui penguatan regulasi, peningkatan transparansi proses likuidasi, advokasi hukum yang berkelanjutan, serta sinergi antarotoritas perbankan dan lembaga penjamin simpanan. Upaya tersebut diharapkan mampu mewujudkan perlindungan hukum yang efektif, adil, dan berkeadilan bagi nasabah.   Kata Kunci: Perlindungan hukum; likuidasi bank; Lembaga Penjamin Simpanan. Abstract Legal protection for customers in the banking system plays a crucial role in maintaining public trust and ensuring national financial stability, particularly in cases of bank liquidation. This study aims to analyze the legal framework governing customer protection, identify obstacles in its implementation, and formulate strategic efforts to strengthen customers’ legal standing. The research employs a normative juridical approach through the study of legislation, legal literature, and relevant secondary data. The findings indicate that although legal protection has been regulated under Law No. 10 of 1998 concerning Banking and Law No. 24 of 2004 concerning the Deposit Insurance Corporation (LPS), its implementation still encounters challenges. These include customers’ low legal literacy, limited access to liquidation information, inaccurate customer data, and delays in the verification process by related institutions. Moreover, the status of customers as concurrent creditors weakens the certainty of their rights’ fulfillment. Therefore, strategic measures are required, including regulatory strengthening, enhanced transparency in the liquidation process, continuous legal advocacy, and improved synergy among banking authorities and the deposit insurance institution. Such efforts are expected to realize more effective, fair, and equitable legal protection for customers. Keywords: Legal protection; bank liquidation; Deposit Insurance Corporation.

Abstract

Despite being regulated in Law Number 30 Year 1999, the effectiveness of arbitration in Indonesia still faces various challenges, such as lack of public understanding, high costs for small businesses, and limited arbitration infrastructure in the regions. Therefore, there is a need to evaluate and strengthen the role of arbitration to ensure that this mechanism can be a quick, fair solution and support business sustainability in Indonesia. The purpose of this study is to assess the extent to which arbitration has been able to be an effective solution in resolving commercial disputes in Indonesia, identify factors that influence its success, and provide recommendations to increase its efficiency and trustworthiness as a fair and speedy dispute resolution alternative. This research uses a descriptive method with a qualitative approach to describe phenomena systematically and accurately. Data was collected through documentation techniques, analyzing various relevant documents such as reports, archives, or articles. Data analysis was conducted in three stages: data reduction, data presentation, and conclusion drawing validated through triangulation. The results showed that arbitration is an effective commercial dispute resolution mechanism in Indonesia because it offers a fast process, affordable costs, and a final and binding award. Its advantages include flexibility, confidentiality, and international recognition through the New York Convention. However, its optimization requires strengthening regulations and education to overcome challenges such as the lack of understanding of business actors and inconsistencies in the application of the law.

Abstract

Indonesia as a state based on law has regulated public welfare, especially regarding ownership of land rights guaranteed in the Basic Agrarian Law Number 5 of 1960 (UUPA). However, in practice regarding land registration there are still various problems. Because certificates, which are the end product of land registration, can still be canceled as a result of the publication system adopted. The purpose of this study is to understand the extent of legal protection and legal certainty of ownership of land rights through a positive negative publication system. The research method is Normative, a scientific research approach to find the truth based on the logic of legal science from the normative side. Based on the results of this study it can be concluded that the ownership of land rights through land registration with a negative publication system with a positive dimension is appropriate but in its an implementation it does not guarantee legal certainty for certificate holders because certificates are strong evidence so that they can still be sued within a period of 5 years. Arrangements regarding the time period for a lawsuit to cancel a certificate need to be amended, because since the certificate is issued 5 years is enough time for the certificate holder to face the possibility of a lawsuit.

Abstract

In two decades, technological developments have made the existence of intellectual works such as open-source software with economic inlays grow quite rapidly. This phenomenon is inseparable from the debate on the obligation to regist er computer program copyright license agreements as in Law Number 28 of 2014 concerning Copyright. This research revisits the obligation to record copyright license agreements required to reconstruct existing rules to present a new perspective of viewing OSS as one of the main sources in developing computer programs. The type of research is normative law. The approach uses legislation and conceptual. The results of the study concluded that although recording the license agreement is necessary as a proof base, recording is considered to add to the length of the bureaucratic process which can reduce interest in creativity, and cause confusion because copyright is not required to be registered

Abstract

In medical procedures, doctors are required to obtain informed consent. However, in emergency situations, doctors are often faced with patients who are incompetent and the family is not present to ask for consent. This can lead to lawsuits. This study aims to analyze the implementation of informed consent in Indonesia based on Law No. 17 of 2023 and to determine the obstacles and solutions to these problems. The method used is a normative legal approach, namely a literature study as the main source of research with primary legal materials. The results of the analysis show that a doctor does not need to obtain informed consent in emergency cases as stated in Law No. 17 of 2023 concerning Health Article 293 paragraph (9) and the guarantee of legal protection for doctors from claims for compensation after providing first aid with the aim of saving lives and preventing disability as in Article 275 paragraphs (1) and (2). A doctor should not hesitate to give his best efforts in saving or preventing patient disability without prior consent for medical procedures. Because the doctor only provides an agreement of efforts (Inspaningverbintenis) and is exempt from claims for compensation if the doctor is in the process of helping the patient in an emergency case.

Abstract

Revolusi Industri 4.0 atau perubahan dunia industri yang sedang berlangsung saat ini memberikan dampak yang signifikan bagi kehidupan industri, khususnya berupa kemajuan teknologi yang pesat. “Ekonomi kreatif” yang bertumpu pada kreativitas dan kecerdikan manusia dalam penerapannya, muncul sebagai akibat dari pesatnya perkembangan teknologi. Sebagai tanda terima kasih kepada seniman dan penemu atas upaya dan dedikasi mereka dalam mengembangkan ide-ide baru dan melanggar hak kekayaan intelektual, negara harus memberikan perlindungan hukum atas kekayaan intelektual. Dalam ekonomi kreatif, hak kekayaan intelektual sangat penting. Namun, dalam praktiknya, penegakan hukum kekayaan intelektual di Indonesia menghadapi banyak kendala dan tantangan. Abstract

Criminal law enforcement against environmental violations serves as the last step (ultimum remedium) used when administrative sanctions are proven to be unable to stop violations. This study aims to analyze the application of the principle of ultimum remedium and assess the suitability of the application of Article 100 paragraphs (1) and (2) in Law Number 32 of 2009 concerning Environmental Protection and Management in cases of environmental pollution carried out by PT. Trisan Abadi. This study uses a normative juridical method with a case study approach. The results of the study show that the relevant agencies have first issued administrative sanctions through Decree Number 660.31/Kep.412-DLH/2020. However, because business actors do not comply with the sanctions and violations occur again, criminal sanctions are then imposed. The application of the articles used has met the elements of the law, including the imposition of responsibility on corporations as legal subjects. These findings show that although the principle of ultimum remedium has been implemented in accordance with the provisions, its effectiveness still needs to be improved through stricter supervision, training for law enforcement officials, and inter-agency synergy. These measures are important to have a deterrent effect and ensure sustainable environmental protection.

Abstract

This study investigates the legal status of health education, particularly modern wound care, disseminated through YouTube, as well as the legal protection against misinformation. The findings highlight two main issues. First, YouTube-based health education may be classified as health advocacy; however, under Indonesian law, health advocacy faces normative challenges. Although Law No. 17 of 2023 recognizes health advocacy, it does not clearly regulate the role of non-medical personnel in public health education, creating risks of misleading information in digital spaces. Second, legal protection against misinformation relies primarily on Law No. 1 of 2024 concerning false information, which serves as a lex generalis within health law. This regulation is not sufficiently responsive to health-related misinformation and may conflict with constitutional rights to freedom of expression under Article 28E of the 1945 Constitution. Therefore, a progressive legal paradigm is necessary, emphasizing not only repressive but also preventive measures, such as specific regulations or certification for health content creators. The study concludes that challenges in social media–based health education are not solely medical but also policy-related, requiring the state to balance freedom of expression with the right to health as a fundamental public interest.
