Abstract

Medical disputes in Indonesia often face challenges such as lengthy litigation processes, high costs, and low satisfaction among the parties involved. In this context, Alternative Dispute Resolution (ADR), particularly mediation and arbitration, offers a more efficient solution. Mediation has been regulated under Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution as well as Supreme Court Regulation (Perma) No. 1 of 2016. However, arbitration mechanisms still lack a specific legal framework, even though Law No. 17 of 2023 on Health emphasizes the importance of swift and fair dispute resolution in healthcare services. Unlike litigation, arbitration allows for final, expedited, and binding resolutions. Countries such as the United States, the United Kingdom, and Taiwan have successfully implemented arbitration in medical disputes. Taiwan, for instance, has specific regulations that facilitate medical arbitration processes, providing legal certainty for patients and healthcare providers. Indonesia can learn from these international experiences. By clarifying arbitration regulations in the healthcare sector, the government can strengthen a dispute resolution system that is responsive to societal needs. This enhancement can be achieved through the training of professional arbitrators and promoting the use of ADR, ensuring that medical disputes are resolved more fairly, quickly, and cost-effectively.

Abstract

Badan Arbitrase Nasional Indonesia (BANI) telah menjadi alternatif utama dalam penyelesaian sengketa hutang piutang di Indonesia. Penelitian ini bertujuan untuk menganalisis eksistensi BANI sebagai lembaga alternatif yang efektif dan terpercaya dalam menangani sengketa tersebut. Dalam penelitian ini, pendekatan yuridis normatif digunakan untuk menggali dasar hukum dan prinsip-prinsip yang mendukung keberadaan BANI sebagai lembaga penyelesaian sengketa. Berdasarkan studi literatur dan wawancara dengan praktisi hukum, hasil penelitian menunjukkan bahwa BANI menawarkan solusi yang cepat, efisien, dan adil dalam penyelesaian sengketa hutang piutang. Meskipun memiliki kelebihan seperti kerahasiaan proses, fleksibilitas, dan efisiensi biaya, BANI juga dihadapkan pada tantangan seperti tingginya biaya arbitrase, rendahnya kesadaran masyarakat terhadap mekanisme arbitrase, serta eksekusi putusan yang belum sepenuhnya efektif. Kesimpulan dari penelitian ini menggarisbawahi perlunya pengembangan skema biaya yang lebih terjangkau, sosialisasi yang lebih luas, dan kolaborasi internasional guna memperkuat posisi BANI di tingkat nasional dan global.

Abstract

Di Indonesia, penyelesaian sengketa medis seringkali dilakukan melalui litigasi, yang merupakan proses yang panjang dan sulit dan dapat mengakibatkan reputasi buruk bagi tenaga medis dan rumah sakit. Dalam banyak kasus sengketa medis, pasien, tenaga medis, dan rumah sakit tidak selalu memiliki pilihan lain selain melakukan litigasi di pengadilan. Arbitrase, sebagai alternatif penyelesaian sengketa, tidak hanya bersifat rahasia tetapi juga sangat efektif. Namun, untuk menerapkan arbitrase dalam sengketa medis di Indonesia, masih ada banyak masalah dan hambatan. Ini termasuk kurangnya pemahaman publik dan tenaga medis, kurangnya regulasi, dan sedikit ahli arbitrase yang kompeten, terutama di bidang medis. Dalam konteks hukum kesehatan Indonesia, masalah dan peluang implementasi arbitrase dibahas dalam artikel ini.

Abstract

Intellectual property rights must be protected by the state and respected by everyone. Along with the development of technology and information, violations of intellectual property rights often occur in cyberspace. However, the IPR Law still needs to provide complete protection and remedy for IPR crimes in cyberspace. Meanwhile, settlement through arbitration of IPR disputes is handled based on the jurisdiction of the countries of each party. This research is normative, using statutory, conceptual, and case approaches. The sources of this research material are primary and secondary materials. Based on the study results, the settlement of intellectual property rights disputes in the country's common law is different in each country, as the United States filed an arbitration effort if there is a clause in advance. If not, then it can be submitted in writing. Meanwhile, in England, there are no strict rules regarding IPR disputes through arbitration. Australia also has the same rules as the UK. Whereas in Switzerland, the settlement of IPR disputes through arbitration is not subject to any law. The most IPR dispute cases in Indonesia were trademark cases, reaching 267 patients from 2018-2022. The arbitration settlement mechanism is very effective because the settlement is carried out based on an agreement, and the parties choose the compensation, thus prioritizing a win-win solution. IPR dispute resolution can be resolved through litigation and non-litigation. The non-litigation route usually chosen is the arbitration route. Arbitration is a very reasonable effort because the solution is confidential, fast and low cost. It can also be used for parties with different jurisdictions. Particularly for IPR violations in cyberspace, the institution authorized as a settlement other than arbitration is the PPND institution

Abstract

Kemajuan media platform Youtube banyak disalahgunakan oleh seseorang sehingga merugikan para seniman Indonesia, hal ini menyebabkan lagu yang diciptakan oleh seniman dibajak atau ditiru oleh orang lain tanpa izin dengan mengcover lagunya dan mengunggahnya di media platform Youtube yang mendapatkan keuntungan yang cukup fantastis. Metode yang digunakan adalah yuridis normatif, dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Teknik pengumpulan dengan menggunakan studi kepustakaan yang bersumber dari bahan primer dan sekunder. Dari hasil penelitian ditemukan bahwa permasalahan dalam hak cipta lagu atau musik di Indonesia adalah Indonesia belum mengatur secara tegas tentang royalti lagu yang dicover oleh seseorang yang diunggah di Youtube dan sanksi tegas terhadap pelanggar hak cipta, dan pola pikir pencipta lagu yang masih enggan mendaftarkan karyanya untuk mendapatkan hak cipta. Karena nilai ekonomis pendaftaran lagu lebih mahal dari nilai jual lagu di pasaran. Selain itu, kelemahan dari penegak hukum dan kesadaran hukum pencipta juga menjadi faktor banyak bermunculan pengcover lagu yang tidak bertanggungjawab. Namun UU Hak Cipta memberikan perlindungan yaitu perlindungan preventif dan represif. Problematika penentuan royalti hasil lagu cover yang diunggah di Youtube belum diatur dengan jelas dalam peraturan per UU-an. Salah satu faktor terjadinya pembajakan lagu adalah karena pencipta lagu enggan mendaptarkan karya, karena biaya dikeluarkan lebih mahal dari royalti lagu. Selain itu, juga masih lemahnya penegakan hukum terhadap pembajak lagu di platform Youtube.

Abstract

Despite being regulated in Law Number 30 Year 1999, the effectiveness of arbitration in Indonesia still faces various challenges, such as lack of public understanding, high costs for small businesses, and limited arbitration infrastructure in the regions. Therefore, there is a need to evaluate and strengthen the role of arbitration to ensure that this mechanism can be a quick, fair solution and support business sustainability in Indonesia. The purpose of this study is to assess the extent to which arbitration has been able to be an effective solution in resolving commercial disputes in Indonesia, identify factors that influence its success, and provide recommendations to increase its efficiency and trustworthiness as a fair and speedy dispute resolution alternative. This research uses a descriptive method with a qualitative approach to describe phenomena systematically and accurately. Data was collected through documentation techniques, analyzing various relevant documents such as reports, archives, or articles. Data analysis was conducted in three stages: data reduction, data presentation, and conclusion drawing validated through triangulation. The results showed that arbitration is an effective commercial dispute resolution mechanism in Indonesia because it offers a fast process, affordable costs, and a final and binding award. Its advantages include flexibility, confidentiality, and international recognition through the New York Convention. However, its optimization requires strengthening regulations and education to overcome challenges such as the lack of understanding of business actors and inconsistencies in the application of the law.

Abstract

This research examines legal issues arising from business disputes in contractual agreements, specifically focusing on the Availability Payment (AP) Service Level Agreement (SLA) between PT Palapa Ring Barat and the Ministry of Communication and Informatics of the Republic of Indonesia. Disputes emerged due to differing interpretations of tax clauses, where PT Palapa Ring Barat demanded additional VAT (10%) on AP payments, while Kemenkominfo argued the payments already included VAT. This study employs a normative juridical method, analyzing primary sources such as BANI Decision No. 45016/II/ARB-BANI/2022 and relevant legal frameworks, including Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution. Findings indicate that arbitration plays a critical role as an effective, binding dispute resolution mechanism, as demonstrated by BANI's decision, which affirmed the validity of the agreement and ordered Kemenkominfo to pay additional VAT. The case highlights the importance of clear contractual clauses, particularly regarding taxation, to prevent disputes. In comparison, other dispute resolutions, such as mediation, are evident in cases like the collaboration between RSUD Mataram and CV. Ijen Perkasa on hospital information system management. This research contributes to the field by emphasizing the need for clear, comprehensive contracts and effective dispute resolution mechanisms. The findings provide insights for businesses and policymakers to develop contracts that minimize potential conflicts while promoting adherence to legal frameworks

Abstract

Kehidupan nasional dan dinamika global sangat dipengaruhi oleh hubungan antara hukum nasional dan internasional. Sementara hukum internasional berfungsi untuk menjaga stabilitas dan ketertiban hubungan antarnegara, hukum nasional berfungsi sebagai alat utama untuk mengatur urusan dalam negeri suatu negara. Perjanjian internasional, standar global, dan prinsip hukum universal sering memengaruhi hukum nasional, sehingga kedua sistem hukum ini saling melengkapi. Namun, perbedaan hukum nasional dan internasional dapat menyebabkan masalah, terutama dalam hal penerapan dan penyelesaian sengketa. Hukum internasional tidak bertujuan untuk mengganggu kedaulatan negara; sebaliknya, itu bertujuan untuk mendukung penghormatan terhadap kedaulatan sambil memastikan kepatuhan terhadap standar global untuk stabilitas dan perdamaian. Oleh karena itu, kerja sama yang erat antara negara-negara diperlukan untuk menyelaraskan prinsip hukum nasional dan internasional guna memastikan sistem hukum yang konsisten serta harmonis dalam skala global.

Abstract

Socialization of the BPJS program is a strategic effort to increase understanding and participation of workers in the social security system. However, in practice, there are still employees who do not follow the socialization process, thus potentially hampering the effectiveness of the program. This study aims to analyze the role of the Social Security Organizing Agency (BPJS) in socializing the health insurance program for workers and to identify factors that cause workers' non-engagement. This research uses a qualitative approach with interview techniques, observation, and documentation analysis of employees and socialization organizers. The results showed that the role of BPJS in socializing the health insurance program has not been fully effective. The effectiveness of socialization depends on the communication strategy used, the level of involvement of company management, and the method of delivering information. Employee disengagement is caused by lack of access to effective information, lack of support from the company, and the perception that socialization does not have significant added value. Therefore, a more interactive, adaptive, and technology-based communication strategy is needed to increase employee involvement in the socialization of the BPJS program.

Abstract

The national health insurance is a strategic initiative by the Indonesian government to guarantee equitable access to affordable and quality healthcare services for all citizens. Nevertheless, the program faces multiple challenges including financial sustainability, inadequate healthcare facilities and personnel, and policy inefficiencies. To enhance the quality of national health insurance implementation, the government introduced several policy reforms, one of which is the transformation of inpatient classification into a standardized scheme known as standard inpatient class. Standard inpatient class was formulated in response to the community's evolving healthcare needs and to replace the traditional tiered room system. Law No. 40 of 2004 on the national social security system affirms that all national health insurance participants are entitled to equitable, adequate, and non-discriminatory healthcare services, including fair access to inpatient facilities. The implementation of standard inpatient class is thus regarded as part of the state’s duty in fulfilling the human right to health. This policy is expected to positively impact both hospitals and patients, fostering a just, public-oriented, and rights-based healthcare system. With comprehensive reforms, national health insurance can continue to evolve into a fair, efficient, and sustainable health insurance system for all Indonesians.
