Abstract

The rapid evolution of digital technology has brought significant benefits to society, yet it has also triggered the emergence of increasingly complex forms of cybercrime. Incidents such as data theft, online fraud, and system intrusion occur in unpredictable patterns, as technological innovation progresses faster than regulatory frameworks can adapt. This study examines the dynamics of cybercrime through four main dimensions: regulatory vulnerabilities, the level of digital literacy among the public, the effectiveness of law enforcement, and the social as well as psychological implications experienced by victims. Using a literature-based approach, this analysis reviews studies published within the last five years to understand how policy, technology, and human behavior interact within the realm of digital security. The findings reveal that low public awareness of data protection, limited technical capacity among law enforcement agencies, and the severe psychological impacts on victims remain critical challenges. This study highlights the need for a multidisciplinary response integrating legal, technical, and social interventions to ensure a safer and more sustainable digital ecosystem.

Abstract

Medical disputes in hospitals are frequently resolved through external channels, such as litigation or third-party mediation, imposing substantial burdens related to cost, time, and reputational risk on healthcare professionals and institutions. This study examines the critical urgency of strengthening the medical committee’s role as an internal mediator in resolving such disputes, utilizing a juridical-normative approach and extensive literature analysis. The study emphasizes the medical committee’s strategic position, which possesses technical clinical competence, professional ethical insight, and internal legitimacy necessary to mediate conflicts objectively, fairly, and transparently. Findings suggest that a stronger mediative role for the medical committee inversely correlates with the potential for disputes to escalate into litigation, thereby reducing administrative burdens and risks. Strengthening this function offers significant benefits, including risk mitigation, enhanced patient trust, reinforced ethical culture, accelerated restorative resolution, and a foundation for developing robust internal hospital regulations. The study recommends mandatory capacity building in mediation, communication, and health law for committee members, coupled with systematic monitoring mechanisms. This research expands the discourse on the committee’s mediative function practically, it offers an effective internal dispute resolution model for Indonesian hospitals.

Abstract

Public hospitals carry complex legal responsibilities as both medical providers and state agents ensuring citizens’ constitutional right to health. Despite reforms under Law Number 17 of 2023, Government Regulation Number 28 of 2024, and Minister of Health Regulation Number 3 of 2025, malpractice cases persist. This study aims to analyze the effectiveness of health law regulations in preventing malpractice in public hospitals. The research employs a normative legal approach using statutory, conceptual, and case study methods, with data analyzed descriptively and analytically from primary and secondary legal sources as well as five court decisions on medical negligence. The findings reveal that Indonesia’s health law regulations provide a comprehensive normative foundation but remain limited in effectiveness due to weak implementation of good governance principles, insufficient institutional supervision, and a lack of legal culture within the medical profession. Legal accountability mechanisms tend to be reactive rather than preventive. The study concludes that the effectiveness of health law regulations will be strengthened if civil, criminal, and administrative liabilities are integrated within a unified oversight system emphasizing transparency, professional development, and proactive risk prevention in public hospitals.

Abstract

Criminal law enforcement against environmental violations serves as the last step (ultimum remedium) used when administrative sanctions are proven to be unable to stop violations. This study aims to analyze the application of the principle of ultimum remedium and assess the suitability of the application of Article 100 paragraphs (1) and (2) in Law Number 32 of 2009 concerning Environmental Protection and Management in cases of environmental pollution carried out by PT. Trisan Abadi. This study uses a normative juridical method with a case study approach. The results of the study show that the relevant agencies have first issued administrative sanctions through Decree Number 660.31/Kep.412-DLH/2020. However, because business actors do not comply with the sanctions and violations occur again, criminal sanctions are then imposed. The application of the articles used has met the elements of the law, including the imposition of responsibility on corporations as legal subjects. These findings show that although the principle of ultimum remedium has been implemented in accordance with the provisions, its effectiveness still needs to be improved through stricter supervision, training for law enforcement officials, and inter-agency synergy. These measures are important to have a deterrent effect and ensure sustainable environmental protection.
