Abstract

This study aims to find a comparison of the Legal Corporate Veil between Malaysia and Indonesia. This research is a normative legal research as a literature review. It is found that in corporate law both in Malaysia and Indonesia there is a principle of limited liability between shareholders and company directors known as Separate Legal Entity. This principle essentially asserts that a person's responsibility in a company is limited to their responsibility within the company and does not extend to personal liability. In Malaysia, this regulation is governed by Section 20 of the Companies Act 2016. Meanwhile, in Indonesia, this principle is scattered in the provisions of the Limited Liability Company Act (UU PT) applicable to shareholders, directors, and commissioners. However, this principle may become inapplicable in certain cases, known as Piercing The Corporate Veil. In Malaysia, this is regulated under the Companies Act 2016 as well as several judicial decisions. In Indonesia, this principle becomes inapplicable if shareholders act in bad faith by using the company for personal gain and are involved in legal actions undertaken by the Company. One form of protection from personal liability for Directors and Commissioners is implemented based on the Business Judgement Rule principle. Personal liability does not apply if Directors and Commissioners can prove that the company's loss is not due to their negligence, they have acted in good faith, have no conflict of interest, and have taken action to prevent losses. In this study, there is also corporate responsibility outside the existing Limited Liability Company Law based on business and economic developments decided by The Constitutional Court.

Abstract

The Supreme Court has ruled that in contested divorce cases, women are entitled to receive nafkah iddah, mut'ah, and nafkah madhiyah, provided they do not act nusyuz. However, this provision is not being effectively implemented. This study examines the fulfilment of women's rights post-contested divorce in the Malang Regency Religious Court. The goal is to identify shortcomings in implementing these regulations and propose solutions for more effective enforcement. The research employs an empirical-juridical method, using secondary data from interviews and documentation with key personnel at the Malang District Religious Court. The qualitative analysis refers to Soekanto's theory. The Findings indicate that the fulfilment of women's rights in contested divorces at the Malang Regency Religious Court is ineffective. The law is clear and understandable, and officers, judges, and staff are accountable. Furthermore, the Malang District Religious Court provides sufficient infrastructure and support. However, the unmet factors—community awareness and cultural attitudes—pose significant barriers. Low legal awareness and compliance, coupled with cultural tendencies in Malang District to avoid legal processes and seek quick resolutions, hinder effective implementation. Addressing these issues is crucial for the regulations to achieve their intended impact on women's rights post-divorce.

Abstract

Positivism and empiricism are modern paradigms become the basic guidelines for the schools of legal philosophy, namely legal positivism and legal realism. However, the current condition in Indonesia is dominated by the paradigm of legal positivism so that everything must be by written law. The practice of inheritance division that is always based on the concept of 2:1 as in the Compilation of Islamic Law is felt to be incompatible with community justice. The purpose of this research is to enrich the study of the positivism and empiricism paradigms as a renewal of Islamic inheritance law in Indonesia. The benefit of this research is to inform that the integration of positivism and empiricism in law will produce competent law enforcement. This research is a normative research with a conceptual approach and data sources in the form of literature and data analysis techniques, namely evaluation. The results of this research are; (1) The factor that causes judges in Indonesia to use the judicial restraint approach excessively as a characteristic of legal positivism is the legal culture of the application of the civil law legal system. (2) The solution to the problem offered is to borrow Fazlur Rahman's double movement theory, namely historical contextualisation by taking universal values from the norm. Therefore, it is time for judges to be free to move to realize moral justice within the limits set by the Constitution and the Law on Judicial Power.

Abstract

AbstractThis study aims to explore the views of the two main madhhabs in Islam, namely Shafi'i and Hambali Madzhabs, regarding the law of marrying daughters out of wedlock by their biological fathers. This research is done to understand the Islamic legal perspective of such marriages, a complex and challenging issue in Muslim societies.This study used normative and comparative legal methods. The normative method of law is focused on the analysis of Islamic law from the perspective of Shafi'i and Hambali Madhhabs related to the marriage of an extramarital daughter by her biological father. Meanwhile, the comparative method compares the views of the two madhhabs related to the same case. Data sources include primary legal materials, such as the Quran and hadith, and books, as well as secondary legal materials, such as data from the book of 4 madzhab and other books. The data collection techniques used were literature studies and interviews with Islamic jurists from both madhabs.From the research conducted, it was found that, according to Madzhab Shafi'i, the law of marrying a daughter out of wedlock by her biological father is invalid. Imam Shafi'i argued that a child born out of wedlock has no sexual relationship with his biological father, so a marriage between an adulterous daughter and her biological father is considered valid in his view. Meanwhile, according to Imam Hambali, if a woman becomes pregnant out of wedlock and is married by a man who impregnates or does not impregnate her, then the marriage is invalid or void because a pregnant woman, due to adultery, has an iddah period that is until her child gives birth. The child born cannot be sacrificed to his biological father but is still sacrificed to his mother and her family.Keywords: Biological Fathers, Extramarital Children, Marital Guardians

Abstract

Developing relevant learning media and learning resources in the classroom can optimize the learning process. For teachers, media helps concretize concepts or ideas and helps motivate active learning participants. For students, media can be a bridge for critical thinking and action. This training activity provides an opportunity for teachers to understand how to create Canva-based learning media. Participants in this activity were 15 teachers at the Cendana Abadi educational foundation at the primary and secondary education unit levels. The results achieved were that all teachers were able to understand and create Canva-based learning media.

Abstract

This research is a qualitative research with a descriptive normative approach, namely explaining the Position of Debt in Online Loans in the Indonesian legal system in descriptive form and accompanied by legal arguments. The data used are secondary data that researchers obtain from credible sources, namely websites, books, scientific journals, and others that are commonly used in every study. The data are analyzed by stages of data collection, data sampling, data reduction, and drawing conclusions. The result in this article show that the borrower is still obliged to return the loan that has been borrowed without being burdened with anything outside of the debt that could burden the borrower.

Abstract

The practice of forced marriage that is cultured in society has many negative effects, one of which is that women are a group that is vulnerable to various forms of domestic violence, both physically, psychologically, sexually, and economically. Criminal law is expected to overcome the high rate of domestic violence that occurs due to forced marriage. In the case of forced marriage, criminal law is important in anticipation of domestic violence. The focus of this research is how forcing marriage as a criminal act uses the theory of dzari'ah. The factors that affect the occurrence of forced marriage are patriarchal culture and ideology that are socialized in society. In the patrilineal system, marriage is often a tool to strengthen inter-clan or family relationships. The correlation between forced marriage and the right of ijbar wali shows that the practice of forced marriage in the community is also greatly influenced by the right of ijbar wali. The criminalization of forced marriage has been by dzari'ah, in practice there is a certain motivation from the perpetrator of coercion to make the victim forced to carry out marriage on the one hand, and on the other hand, the consequences arising from the marriage on which one of the spouses is forced to carry out the marriage. The TPKS Law has translated the basic values of Grundnorm into daily legal practice. This shows how the implementing norm expresses Grundnorm's values through concrete legal sanctions that are in line with the mandate of the 1945 Constitution to protect citizens.

Abstract

Desa Teluk Bakung, yang terletak di Kabupaten Langkat, dikenal sebagai komunitas yang mayoritas penduduknya memeluk agama Islam. Meskipun demikian, mereka mempraktikkan nilai-nilai toleransi yang tinggi terhadap perbedaan agama didesa tersebut. Hal ini tercermin dalam sikap mereka yang menghormati keberagaman keyakinan spiritual yang ada di tengah mereka. Dalam hal ini penelitian dengan judul “pola pembinaan kerukunan antar umat beragama di desa teluk bakung” bertujuan untuk mengetahui bagaimana kerukunan dan toleransi antar umat beragama dipelihara dan dikembangkan di desa teluk bakung ini. Penelitian ini menggunakan metode penelitian kualitatif. Subjek penelitian ini adalah toko adat dan agama di Desa Teluk Bakung Kecamatan Tanjung Pura Kabupaten Langkat. Penelitian ini berlangsung selama satu hari yaitu pada hari minggu 4 agustus 2024. Hasil analisis data diperoleh dari hasil observasi, wawancara, dan dokumentasi. Berdasarkan hasil penelitian diperoleh hasil kesimpulan bahwa 1. Desa teluk bakung ini mayoritasnya suku melayu yang umat muslimnya sangat banyak dan umat non muslimnya hanya sekitar lima persen. 2. Desa teluk bakung sejak zaman dulu sampai sekarang tidak pernah terjadi konflik, apalagi konflik kecil maupun besar. 3. Desa teluk bakung  mengenai toleransi sudah ditetapkan sejak kecil baik oleh orang tua, sekolah, maupun lingkungan sekitar. Hasil penelitian ini menunjukan bahwa toleransi antar umat beragama memberikan dampak positif yang signifikan di desa teluk bakung.

Abstract

Abstrak Program Pengabdian Kepada Masyarakat melalui edukasi dan monitoring kepada masyarakat adat Bena bertujuan untuk memberdayakan masyarakat dengan keterampilan dan pengetahuan terkait teknologi digital. Tim pengabdi dalam hal ini akademisi berkolaborasi dengan masyarakat adat bersama-sama memanfaatkan kemajuan teknologi dengan tetap melestarikan adat yang ada. Kegiatan ini diawali dengan survei dan koordinasi dengan Perangkat Kampung Megalith Bena terkait permasalahan yang dihadapi masyarakat adat, Kemudian menyusun tim pengabdian masyarakat dan mengurus perijinan dengan perangkat desa. Selanjutnya pelaksanaan edukasi dan monitoring masyarakat adat Bena. Hasil kegiatan pengabdian yaitu literasi digital masyarakat adat Bena mengalami peningkatan secara signifikan serta berkontribusi pada pengembangan konten lokal terutama terkait kebudayaan di Kampung Bena seperti kegiatan menenun khas kampung Bena. Edukasi dan monitoring yang diberikan mewujudkan Desa adat yang adaptif terhadap era teknologi. Kata Kunci: Kolaborasi, masyarakat adat, akademisi, teknologi digital Abstract Community Service Activities through socialization and direct practice to the community by establishing a waste bank and managing waste based on the 3R principle aims to educate the community about the urgency of waste management in creating a clean and healthy environment. This activity was carried out in one of the villages in East Java, precisely in Trewung Village, Grati District, Pasuruan Regency, East Java. This activity began with a survey and coordination with the Trewung Village apparatus regarding the waste problems faced by the community. Then form a community service team and ask for permission from the Trewung Village Government, as well as implementing socialization by educating the community through socialization activities and implementing the establishment of a waste bank and waste management based on the 3R principle. The results of this community service activity are that the Trewung Village community is more educated and increasingly understands the importance of overcoming waste problems through the utilization of waste that can have economic value and proper waste management based on the 3R principle. This activity helps the community by socializing the importance of instilling a culture that creates a clean and healthy environment. Keywords: Waste bank, 3R, Independent village

Abstract

Principal leadership was a determining factor in the education process in  Special Program Kartasura. Principal leadership emphasized the formation of student character and not on student grades. The purpose of this study was to describe the leadership style applied and the role of principals as leaders in building high-quality school. This type of research was qualitative research. The research design used was phenomenology. Research used primary data in the form of interviews and observations and used secondary data in the form of documents obtained from school. The data analysis used was an interactive model analysis with source triangulation and methods. The results of this study were: First. Principal leadership had a democratic-monarchic leadership style. This was based on the system that applied in the process of determining policies and decision-making processes carried out jointly. Second, the role of the principal included several aspects that had been carried out, namely: as an educator, as a manager, as an administrator, as a supervisor, as a leader, as an innovator, as a very good motivator. The principal could be an example in carrying out their duties. Therefore, the type and character of the leader must be observed and assessed properly.
