Abstract

The modern positivistic paradigm, which places significant emphasis on empirical verification, has led to a shift in the position of Islamic sciences. Islamic sciences, which rely on a balance between revelation, reason, and human experience, have been affected by this shift. In the intellectual history of Islam, the mystical dimension has played an important role in shaping the conception of science. This raises critical questions about the role of Islamic epistemology in contemporary intellectual discourse. This article highlights the need for a reconstruction of Islamic epistemology that unites metaphysics, rationality, and revelation as its main pillars. The prevailing imbalance among these three elements hinders the advancement of Islamic epistemology. By anchoring Islamic epistemology in metaphysics, it aims to present an alternative to the prevailing modern paradigm and contribute to the development of knowledge that is more pertinent to contemporary challenges. The reconstruction of Islamic epistemology seeks to integrate revelation and reason in a more balanced and systematic manner, with metaphysics serving as the conceptual bridge that unites the two. This integration, the study posits, creates new opportunities for dialogue between empirical science and metaphysical understanding, as well as encourages a more holistic perspective in the study of Islam.

Abstract

Kaidah fiqh merupakan hasil atau kesimpulan dari hukum-hukum fiqh yang terperinci (juz’iy) dan terpisah-pisah sebagai hasil dari ijtihad para fuqaha, kemudian bagian yang terpisah-pisah ini diikat menjadi satu ikatan atau kaidah. kaidah-kaidah fiqh perlu dipelajari guna mengetahui prinsip-prinsip umum dalam melakukan istimbath hukum atas masalah-masalah baru yang tidak ditunjuk oleh nash syar’i (Alqur’an dan Sunnah) secara sharih (jelas) dan sangat memerlukan ketetapan hukum. Orang tidak mudah menetapkan hukum terhadap problem baru dengan baik apabila dia tidak mengetahui kaidah-kaidah fiqh. Kaidah-kaidah fiqh mempunyai kedudukan yang penting dalam menentukan hukum Islam. Karena kaidah-kaidah tersebut bertujuan untuk memelihara ruh Islam dalam membina hukum dan mewujudkan ide-ide yang tinggi, baik mengenai hak, keadilan, persamaan, maupun dalam memelihara maslahat, menolak mafsadat, serta memperhatikan keadaan dan suasana. Karena itu kaidah-kaidah fiqh tersebut harus bersifat qath’i.

Abstract

The article discusses the sale of tuak drinks in Paciran Lamongan from Islamic criminal law's perspective. This research is field research. Data comes from observations, interviews, and documentation. Data will be analyzed using a descriptive qualitative method with a deductive mindset. Based on laboratory test results on 800ml of tuak drink, it contains alcohol of 8.5%. Based on Islamic law, it considered as khamr. The Regional Regulation of Lamongan Regency, Number 03 of 2004 concerning Supervision and Control of the Distribution of Liquor, alcohol of 8.5% categorized as level B liquor and it's distribution is prohibited. Those who violate the rule, punishable with imprisonment for a maximum of 3 months or a maximum fine of Rp. 50,000,000- (fifty million rupiah). According to Islamic law’s perspective, the penalty given to the seller of liquor is ?add's penalty of 40 to 80 whips. In case of the punishment of ?add cannot be carried out, the criminal can be punished by ta'z?r referring to the applicable laws or regulations.

Abstract

The court is a place to seek justice. It is a place that must be respected. However, there are still many cases of contempt of court.  This is contrary to the Criminal Code and Islamic law.  This study examines the contempt of court perspective of Islamic law. This research is a library and qualitative research. Data collection is carried out through literature studies derived from laws, books, and journals. The collected data is described for deductive analysis using Islamic law. The results of the study mentioned that in Indonesia there is no specific law on Contempt of court.  Contempt of court is based on criminal code articles 210, 2lindung16, 217, 221, 222, 223, 224, 225, 242, 222, 231, 232, 233, 317, 417, 552.  In Islamic law, contempt of court is a prohibited act as described in the Qur'an and hadith. The sentence is in accordance with the form of the contempt of the court perpetrator's actions and the consequences they cause. If the terms of his sentence are not mentioned in the Qur'an and hadith, then the judge can decide based on his ijtihad called ta'zir.

Abstract

Kekerasan seksual masih banyak terjadi di kampus, karena itu perlu ada pencegahan kekerasan seksual di perguruan tinggi. Di UIN Sunan Ampel Surabaya, salah satu lembaga yang berperan penting dalam mencegah kekerasan seksual di kampus adalah pusat studi gender dan anak (PSGA). Artikel ini membahas tentang peran PSGA UIN Sunan Ampel Surabaya dalam mencegah kekerasan seksual di kampus dalam prespektif hukum pidana Islam. Penelitian ini adalah penelitian lapangan dan kualitatif. Penelitian dilakukan di UIN Sunan Ampel Surabaya. Pengumpulan data dilakukan melalui wawancara, observasi dan dokumentasi. Data yang terkumpul dideskripsikan untuk dianalisis secara deduktif dengan menggunakan perspektif hukum pidana Islam (fiqh al-jinayah). Hasil penelitian menyebutkan bahwa PSGA UIN Sunan Ampel Surabaya berperan penting dalam mencegah kekerasan seksual di kampus. PSGA UINSA berupaya mencegah kekerasan seksual di kampus dengan menerapkan asas kampus responsive gender, membentuk SATGAS PPKS, dan aktif mensosialisasikan anti kekerasan seksual di kampus kepada stake holder. Jika ada laporan kekerasan seksual di kampus, maka PSGA berkoordinasi dengan pihak terkait dalam menyelesaikan kasus tersebut dengan memberikan hukuman kepada pelaku dan melindungi korban sesuai dengan prosedur yang ada. Dalam perspektif hukum pidana Islam, peran PSGA tersebut telah sesuai dengan teori zawajir (pencegahan) dan jawabir (paksaan).

Abstract

ABSTRACT Purpose of the study: This paper aims to analyze the impact and implications of Constitutional Court Decision No. 91/PUU-XVIII/2020 on the formal review process of Law No. 11 of 2020. This includes an understanding of changes in the legal framework relating to the formal review process of the law and how the decision affects the formal review of the law. Methodology: This paper employed the normative legal research method through a jurisprudence approach and a statute approach. This research examined primary and secondary legal materials. Results: The Constitutional Court Decision No. 91/PUU-XVIII/2020 reflects the commitment of that highest justice institution to maintaining the enforcement of constitutional principles in the law-making process in Indonesia. It decided that the Law on Job Creation had a conditional unconstitutional status, as it did not follow the procedures of law formation stated in Law No. 12 of 2011. Even though it has a conditional unconstitutional status, the Law on Job Creation still applies until it is improved in two years by the government and the Legislative House. Applications of this study: This research is useful for providing valuable insight for policymakers, lawyers, and constitutional law practitioners regarding the practical implications of Constitutional Court decisions on the process of proposing laws. It can also help people understand how this ruling affects laws and policies in Indonesia. Novelty/Originality of this study: The novelty of this research lies in its special focus on Constitutional Court Decision No. 91/PUU-XVIII/2020 and its impact on the formal review of Law No. 11 of 2020. Apart from that, this research provides an important contribution to the concreteness of the Constitutional Court's formal legislative procedures. Keywords: Implications, Constitutional Court Decisions, Formal Tests.   ABSTRAK Purpose of thestudy (Tujuan): Penelitian ini bertujuan untuk menganalisis dampak dan implikasi dari Putusan Mahkamah Konstistitusi No. 91/PUU-XVIII/2020 terhadap proses uji formil Undang-Undang No. 11 Tahun 2020. Ini mencakup pemahaman tentang perubahan-perubahan dalam kerangka hukum yang berkaitan dengan proses uji formil undang-undang dan bagaimana putusan tersebut mempengaruhi pengujian formal undnag-undang. Methodology (Metodologi): Penelitian ini menggunakan metode penelitian hukum normatif melalui pendekatan jurisprudensi dan pendekatan perundang-undangan. Penelitian ini mengkaji bahan-bahan hukum primer dan sekunder. Results (Temuan): Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 merupakan cerminan komitmen lembaga peradilan tertinggi tersebut dalam menjaga tegaknya asas-asas konstitusi dalam proses pembentukan undang-undang di Indonesia. Putusan ini menyatakan bahwa UU Cipta Kerja berstatus inkonstitusional bersyarat, karena tidak mengikuti tata cara pembentukan undang-undang sebagaimana yang tercantum dalam UU Nomor 12 Tahun 2011. Meskipun berstatus inkonstitusional bersyarat, UU Cipta Kerja tetap berlaku sampai ada perbaikan dalam jangka waktu dua tahun oleh pemerintah dan DPR. Applications of this study (Kegunaan): Penelitian ini berguna untuk memberikan wawasan yang berharga bagi para pembuat kebijakan, pengacara, dan praktisi hukum konstitusi mengenai implikasi praktis dari putusan Mahkamah Konstitusi terhadap proses pengajuan undang-undang. Penelitian ini juga dapat membantu memahami bagaimana putusan tersebut memengaruhi hukum dan kebijakan di Indonesia. Novelty/Orginalty of this study (Kebaruan/Orisinalitas): Penelitian ini menawarkan kebaruan karena ia memberikan okus khusus pada Putusan Mahkamah Konstitusi No. 91/PUU-XVIII/2020 dan dampaknya terhadap uji formil undang-undang No. 11 Tahun 2020. Selain itu, penelitian ini dapat memberikan kontribusi penting terhadap kekonkretan putusan Mahkamah Konstitusi terhadap prosedur legislatif formal. Kata Kunci: Implikasi, Putusan MK, Uji Formil.

Abstract

Abstrak: Makalah ini memaparkan tentang penerapan syariat Islam dalam sejarah pemerintahan Islam di Mesir, yaitu dari awal masuknya Islam di Mesir hingga masa modern. Islam masuk ke Mesir pada masa khalifah Umar ibn al-Khattab. Semenjak Islam datang, penerapan syariat Islam berlaku di Mesir dengan bentuk syariat yang disesuaikan pada dinasti yang berkuasa ketika itu, di antaranya dinasti Umayyah, Abbasiyah, Fatimiyyah, Ayyubiyah, dan Usmaniyah. Perkembangan madzhab fikih di Mesir dipengaruhi oleh dinasti yang berkuasa, dan setiap dinasti memiliki sistem pemerintahan dengan ciri khas masing-masing. Setelah runtuhnya dinasti Usmaniyah Mesir dijajah Perancis, dan mempengaruhi perundang-undangan di Mesir. Saat ini Mesir adalah negara republik dengan mencantumkan syariat Islam sebagai landasan utama dalam undang-undang di Mesir. Kata Kunci: Penerapan, syariat, Islam, Mesir

Abstract

Abstract: in the article election of head of lcal governments that will be held all at once will be discussed from the perspective of maqâshid al-syarî’ah (the ultimate goals of Islamic law). The legal basis of the election is the Law NO. 8/2015 on the amendment of Law No. 1/2014 on the effectiveness of Government Regulation in Lieu of Law No. 1/2014 on the Election of Governors, District heads and Mayors. Based on the maqâshid al-syarî’ah, this all at once election relates to the preservation of community in realizing the five basic principle of Islamic law hifz al-dîn, hifz al-nafs, hifz al-aql, hifz al-‘ird, hifz al-mâl. Although this kind of election is unprecedented in Islamic history, its implementation in Indonesia complies with the ultimate goals of Islamic law to achieve the common good, justice, legal equality of rights and duties and accountability. Keywords: all at once local government election, maqâshid al-syarî’ah Abstrak: Artikel ini membahas tentang pemilihan umum kepala daerah serentak perspektif maqâshid al-syarî’ah. Pemilihan umum kepala daerah serentak dilaksanakan berdasarkan Undang-Undang Republik Indonesia Nomor 8 Tahun 2015 tentang P erubahan atas Undang-Undang Nomor 1 Tahun 2015 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2014 tentang Pemilihan Gubernur, Bupati, dan Walikota Menjadi Undang-Undang. Berdasarkan maqâshid al-syarî’ah pemilukada serentak berkaitan dengan hifz al-ummah untuk mempertanggungjawabkan lima hal: hifz al-dîn, hifz al-nafs, hifz al-aql, hifz al-‘ird, hifz al-mâl. Meskipun pemilukada secara langsung yang bersifat serentak belum ada dalam sejarah pemerintahan Islam, tetapi pelaksanaannya di Indonesia sesuai dengan tujuan syariat untuk mencapai kemaslahatan hidup bagi diri sendiri maupun orang lain, tegaknya keadilan, persamaan hak dan kewajiban dalam hukum dan saling kontrol di dalam masyarakat. Abstract

Abstract: This article discusses the verse of the Quran concerning iddah (waiting period after divorce or death of husband). The concerned verse is QS. 65:4. It stipulates iddah for menopause women, amenorrhea women, and pregnant women. Muslim jurists agree that waiting period for menopause and amenorrhea women is three lunar months, whereas pregnant women must wait until labor. Medical examination shows several advantages for waiting period. Firstly, the word “in irtabtum” (when you have doubt) in the verse for menopause women, that women before menopause tend to get their menstrual period irregularly which in medical perspective a menopause women are those who have not get their menstrual period in a full year. Secondly, the attribute to women who not yet get menstruation and not yet pregnant, because there are two types of amenorrhea; primary and secondary. Primary amenorrhea for those who never get menstruation whereas secondary amenorrhea is caused by pregnancy or other causes. Thirdly, the attribute in the verse of iddah for pregnant women with “an yadha’na hamlahunna” not with “an yalidna” means that pregnancy take place when ovum was fertilized by sperm. Thus, when there is no pregnancy, either because of miscarriage or labor, the iddah concludes. Key words: iddah, Quranic interpretation, medical knowledge

Abstract

The article discusses the role of the Indonesian police in preventing the spread of the covid-19 virus from a fiqh siyasah perspective with a statutory approach. Research data were obtained from primary legal materials, namely laws, and regulations related to the Indonesian National Police. Secondary legal materials were collected from books, articles, and news and analyzed descriptively with a deductive mindset. Data on the role of the police during the Covid-19 pandemic based on Law No. 2 of 2002 concerning the National Police of the Republic of Indonesia was analyzed with a review of fiqh siyasah.  This research concludes that the Indonesian National Police agency acts as an instrument of law enforcement and supports the success of the Indonesian government in dealing with covid-19.  Among the duties of the Indonesian National Police during the Covid-19 pandemic are enforcing the law, educating the public, detecting the spread of the covid-19 virus early, and maintaining security.  The police force adheres to the role of al-hisbah in fiqh siyasah, aiming to invite people to act appropriately and prevent people from committing crimes.
