Abstract

Abstrak: Makalah ini memaparkan tentang penerapan syariat Islam dalam sejarah pemerintahan Islam di Mesir, yaitu dari awal masuknya Islam di Mesir hingga masa modern. Islam masuk ke Mesir pada masa khalifah Umar ibn al-Khattab. Semenjak Islam datang, penerapan syariat Islam berlaku di Mesir dengan bentuk syariat yang disesuaikan pada dinasti yang berkuasa ketika itu, di antaranya dinasti Umayyah, Abbasiyah, Fatimiyyah, Ayyubiyah, dan Usmaniyah. Perkembangan madzhab fikih di Mesir dipengaruhi oleh dinasti yang berkuasa, dan setiap dinasti memiliki sistem pemerintahan dengan ciri khas masing-masing. Setelah runtuhnya dinasti Usmaniyah Mesir dijajah Perancis, dan mempengaruhi perundang-undangan di Mesir. Saat ini Mesir adalah negara republik dengan mencantumkan syariat Islam sebagai landasan utama dalam undang-undang di Mesir. Kata Kunci: Penerapan, syariat, Islam, Mesir

Abstract

Abstract: in the article election of head of lcal governments that will be held all at once will be discussed from the perspective of maqâshid al-syarî’ah (the ultimate goals of Islamic law). The legal basis of the election is the Law NO. 8/2015 on the amendment of Law No. 1/2014 on the effectiveness of Government Regulation in Lieu of Law No. 1/2014 on the Election of Governors, District heads and Mayors. Based on the maqâshid al-syarî’ah, this all at once election relates to the preservation of community in realizing the five basic principle of Islamic law hifz al-dîn, hifz al-nafs, hifz al-aql, hifz al-‘ird, hifz al-mâl. Although this kind of election is unprecedented in Islamic history, its implementation in Indonesia complies with the ultimate goals of Islamic law to achieve the common good, justice, legal equality of rights and duties and accountability. Keywords: all at once local government election, maqâshid al-syarî’ah Abstrak: Artikel ini membahas tentang pemilihan umum kepala daerah serentak perspektif maqâshid al-syarî’ah. Pemilihan umum kepala daerah serentak dilaksanakan berdasarkan Undang-Undang Republik Indonesia Nomor 8 Tahun 2015 tentang P erubahan atas Undang-Undang Nomor 1 Tahun 2015 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2014 tentang Pemilihan Gubernur, Bupati, dan Walikota Menjadi Undang-Undang. Berdasarkan maqâshid al-syarî’ah pemilukada serentak berkaitan dengan hifz al-ummah untuk mempertanggungjawabkan lima hal: hifz al-dîn, hifz al-nafs, hifz al-aql, hifz al-‘ird, hifz al-mâl. Meskipun pemilukada secara langsung yang bersifat serentak belum ada dalam sejarah pemerintahan Islam, tetapi pelaksanaannya di Indonesia sesuai dengan tujuan syariat untuk mencapai kemaslahatan hidup bagi diri sendiri maupun orang lain, tegaknya keadilan, persamaan hak dan kewajiban dalam hukum dan saling kontrol di dalam masyarakat. Kata kunci: pemilihan umum kepala daerah, serentak, maqâshid al-syarî’ah.

Abstract

Abstract: This article discusses the verse of the Quran concerning iddah (waiting period after divorce or death of husband). The concerned verse is QS. 65:4. It stipulates iddah for menopause women, amenorrhea women, and pregnant women. Muslim jurists agree that waiting period for menopause and amenorrhea women is three lunar months, whereas pregnant women must wait until labor. Medical examination shows several advantages for waiting period. Firstly, the word “in irtabtum” (when you have doubt) in the verse for menopause women, that women before menopause tend to get their menstrual period irregularly which in medical perspective a menopause women are those who have not get their menstrual period in a full year. Secondly, the attribute to women who not yet get menstruation and not yet pregnant, because there are two types of amenorrhea; primary and secondary. Primary amenorrhea for those who never get menstruation whereas secondary amenorrhea is caused by pregnancy or other causes. Thirdly, the attribute in the verse of iddah for pregnant women with “an yadha’na hamlahunna” not with “an yalidna” means that pregnancy take place when ovum was fertilized by sperm. Thus, when there is no pregnancy, either because of miscarriage or labor, the iddah concludes. Key words: iddah, Quranic interpretation, medical knowledge

Abstract

The article discusses the role of the Indonesian police in preventing the spread of the covid-19 virus from a fiqh siyasah perspective with a statutory approach. Research data were obtained from primary legal materials, namely laws, and regulations related to the Indonesian National Police. Secondary legal materials were collected from books, articles, and news and analyzed descriptively with a deductive mindset. Data on the role of the police during the Covid-19 pandemic based on Law No. 2 of 2002 concerning the National Police of the Republic of Indonesia was analyzed with a review of fiqh siyasah.  This research concludes that the Indonesian National Police agency acts as an instrument of law enforcement and supports the success of the Indonesian government in dealing with covid-19.  Among the duties of the Indonesian National Police during the Covid-19 pandemic are enforcing the law, educating the public, detecting the spread of the covid-19 virus early, and maintaining security.  The police force adheres to the role of al-hisbah in fiqh siyasah, aiming to invite people to act appropriately and prevent people from committing crimes.

Abstract

During the Covid-19 Pandemic, many couples divorced due to various factors, including disputes and the economy. However, many families have strong resilience in the face of the Covid -19 Pandemic so that their families remain harmonious. This article discusses the role of husband and wife in improving family resilience during the Covid-19 Pandemic. This is field research was conducted in Medali, Mojokerto, East Java, Indonesia. The data is collected through interviews and documentation to answer existing problems. Qualitative methods with a deductive mindset analyze the results of interviews and documentation. This study concluded that during Covid-19 Pandemic, the husband and wife in Medali maintained their family resilience by playing a role in meeting daily needs, fulfilling economic aspects, and fulfilling education for children. In addition, they support each other and are convinced that this Pandemic is a provision from Allah, so they must pray and be grateful. The family carries out the role of husband and wife in Medali during the Covid-19 Pandemic according to the Compilation of Islamic law, articles 77 and 79.

Abstract

During the Covid-19 pandemic, the family cluster was among the clusters that caused the spread of this virus. For families exposed to this virus, their family's resilience has been tested. This article discusses the resilience of families exposed to Covid-19 to be analyzed in maqasid al-shari’ah. The method used in this research is qualitative and field research. Data were collected through observation, interviews, and documentation. The collected data were analyzed as normative-descriptive. This study concluded that families exposed to Covid-19 work together to fight this virus by adjusting their respective conditions. For the mild, they self-isolate at home, and those with severe illnesses are hospitalized. If a family dies from Covid-19, the family left behind is isolated. What the family exposed to Covid does is maintain family resilience and maintain the physical and psychic health of the family. From the perspective of maqasid al-shari'ah, the effort corresponds to the concepts of hifz al-din (guarding religion), hifz al-nasl (guarding offspring), hifz al-nafs (guarding the soul), and hifz al-'aql (guarding reason).

Abstract

This article discusses the Political Thought that Khalid Muhammad Khalid experience the duality of political thought. In the 1950s, when he wrote "Min Huna Nabda '" he believes religion is not a state, it must be a separation between religion and state. Based on his view that there should be a purification of the religion (Islam) from the clergy, upholding the concept of sosialism in public life, keep the desire to have a religious government, and provide political freedom for women. However, in the 1980s Khalid wrote the book "al-Daulah fi al-Islam". In his book, he revised the previous view on the separation of religion and state, and said that religion also set the state. Thus, Islam is religion and state. His thinking is influenced by political and sosial conditions of Egypt at that time, and its proximity to the Muslim Brotherhood. Dualism of Islamic political thought Khalid Muhammad Khalid is a natural thing in the context of thinking.

Abstract

Deradicalization is important to do in an effort to prevent the academic community from being exposed to radical ideas. Several universities carry out deradicalization policies to prevent the spread of radical understanding in Islamic universities in East Java, Indonesia, such as UIN Sunan Ampel Surabaya (UINSA) and UIN Sayyid Ali Rahmatullah Tulungagung (UIN SATU). This study aims to answer two problems: First, how is the deradicalization policy applied at UINSA and UIN SATU; second, how effective is the deradicalization policy at UINSA and UIN SATU. This research is field research with a case approach. The case approach analyzes the role model of deradicalization at UINSA and UIN SATU. The research concluded that the deradicalization policy implemented at UINSA through various forms, including Ma'had activities, regulations on Student and Lecturer Code of Ethics, studies, and seminars on anti-radicalism and terrorism, integration of teaching in Pancasila and Citizenship courses, philosophical Integrated Twin Tower, Nusantara Studies with INNUS (Institute for Nusantara Studies), and the mainstreaming of moderate Islamic understanding. The deradicalization policy applied at UIN SATU uses six models: organizing seminars, studies with the theme of deradicalization, managing ma’had diniyah, Student Code of Ethics, supporting all religious moderation activities, optimizing local wisdom, and creating a learning environment that supports deradicalization programs. The deradicalization program within the scope of UINSA and UIN SATU effectively prevents radicalism on campus.

Abstract

Abstract: In Indonesia, many cases of polygamy are carried out in series, so to register polygamy requires marriage isbat. On the other hand, polygamous marriages must obtain permission from the court. Based on this, this article aims to review the Surabaya Religious Court Decision Number 3401/Pdt.G/2022/PA. Sby about isbat nikah for husbands who practice polygamy in siri (secret).  This research is normative juridical research. Data was collected from rulings laws and regulations on marriage and polygamy. In addition, data is supported from books or journals. The collected data were analyzed with a deductive mindset that the data on isbat nikah for polygamous marriages were serially analyzed under law. The study concluded that judges had several considerations for granting isbat requests from serial polygamous marriages. From a philosophical point of view, the decision prioritizes the acquisition of rights that must be owned by the Petitioners. However, from the juridical side, the Panel of Judges is considered to have committed contra legem actions by overriding SEMA rule Number 3 of 2018. Because, indirectly, the Surabaya Religious Court Judges justify an act that has deviated and violated the law. Keywords: Contra legem, polygamy, siri marriage, Islamic law. Abstrak: Di Indonesia banyak kasus poligami yang dilakukan secara siri, sehingga untuk mencatatkan poligami tersebut dibutuhkan isbat nikah. Di sisi lain pernikahan poligami harus mendapatkan izin dari pengadilan. Berdasarkan hal tersebut, maka artikel ini bertujuan untuk mengkaji Putusan Pengadilan Agama Surabaya Nomor 3401/Pdt.G/2022/PA.Sby tentang isbat nikah bagi suami yang melakukan poligami secara siri.  Penelitian ini adalah penelitian yuridis normatif. Data dikumpulkan dari putusan dan peraturan perundang undangan tentang isbat nikah dan poligami. Selain itu data didukung dari buku atau jurnal. Data yang terkumpul dianalisis dengan pola pikir deduktif bahwa data tentang isbat nikah bagi pernikahan poligami secara siri dianalisis dengan hukum. Penelitian ini menyimpulkan bahwa hakim memiliki beberapa pertimbangan untuk mengabulkan permohonan isbat dari perkawinan poligami siri. Ditinjau dari sisi filosofis, putusan tersebut mengedepankan perolehan hak-hak yang harus dimiliki oleh Para Pemohon. Namun, dari sisi yuridis Majelis Hakim dinilai telah melakukan tindakan contra legem dengan mengesampingkan aturan SEMA Nomor 3 Tahun 2018. Sebab, secara tidak langsung Majelis Hakim Pengadilan Agama Surabaya membenarkan suatu perbuatan yang telah menyimpang dan melanggar hukum.  Kata Kunci: Contra Legem, Poligami, Kawin Siri, hukum Islam

Abstract

Abstract: Human trafficking is an illegal practice that involves the exploitation of individuals for commercial purposes. Many minors are victims of human trafficking, including in Sidoarjo. Law enforcement officials, including the police, play an important role in dealing with victims of human trafficking. This study aims to discuss the role of the Sidoarjo City Resort Police (POLRESTA) in dealing with victims of human trafficking from the perspective of Islamic law. This research is a field research conducted at the Sidoarjo Police. Data was collected from observations, interviews, and documentation. The collected data is analyzed descriptively with a deductive mindset. The results of the study show that the Sidoarjo Police have an important role in handling victims of human trafficking. The efforts made by the Sidoarjo Police for victims of human trafficking are to accompany victims and provide safe houses. In addition, to handle the crime of human trafficking in Sidoarjo, the Sidoarjo police are making prevention efforts and repressive efforts. Prevention efforts include socialization, while repressive efforts are monitored, field operations, and the application of punishments. In Islamic law, the role played by the Sidoarjo police is closely related to the benefit. The protection of victims of human trafficking is closely related to the benefits of protecting the soul in maqasid al-shari'ah. Meanwhile, preventive efforts are related to maintaining the intellect (hifz al-aql), and repressive efforts are related to preserving the soul (hifs al-nafs). Keywords: human trafficking, children, victims, maslahah, maqasid al-syari'ah. Abstrak: Human trafficking adalah praktek ilegal yang melibatkan eksploitasi individu untuk tujuan komersial. Banyak anak di bawah umur yang menjadi korban human trafficking termasuk di Sidoarjo. Aparat penegak hukum, diantaranya polisi, berperan penting dalam menangani korban human trafficking. Penelitian ini bertujuan membahas tentang peran Kepolisian Resor Kota (POLRESTA) Sidoarjo dalam menangani korban human trafficking perspektif hukum Islam. Penelitian ini adalah penelitian lapangan yang dilakukan di Polresta Sidoarjo. Data dikumpulkan dari hasil observasi, wawancara dan dokumentasi. Data yang terkumpul dianalisis secara deskriptif dengan pola pikir deduktif. Hasil penelitian menunjukkan bahwa Polresta Sidoarjo memiliki peran yang penting dalam menangani korban human trafficking. Upaya yang dilakukan Polresta Sidoarjo bagi korban human trafficking adalah dengan mendampingi korban dan memberikan rumah aman. Selain itu, untuk menangani tindak pidana human trafficking di Sidoarjo, polresta Sidoarjo melakukan upaya pencegahan dan upaya represif. Upaya pencegahan meliputi sosialisasi sedangkan upaya represif dengan melakukan pemantauan, operasi lapangan, dan penerapan hukuman. Dalam hukum Islam peran yang dilakukan polresta Sidoarjo berkaitan erat dengan kemaslahatan. Perlindungan terhadap korban human trafficking berkaitan erat dengan kemaslahatan menjaga jiwa dalam maqasid al-syari’ah. Sedangkan upaya prefentif berkaitan dengan menjaga akal (hifz al-aql) dan upaya represif berkaitan dengan menjaga jiwa (hifs al-nafs). Kata kunci: human trafficking, anak, korban, maslahah, maqasid al-syari’ah.
