Abstract

Purpose: This paper is to find out the shift in the marketing strategy of cafes and culinary delights in West Sumatra from the perspective of Islamic business ethics. Basically the naming of cafes and culinary in this area uses the names of people, names of plants, describes the comfort of a place, and uses Arabic terms. However, since 2018 the naming of cafes and culinary delights has instead used terms that are unusual and tend to be scary, such as Mie Hell, Mie Power Hell, Mie Lightning, Mie Judes Neraka and the like. It turns out that these cafes and culinary delights are in demand by young people, so they are booming. This gives the impression that hell and lightning becomes the menu of food consumed. However, the behavior of traders has been regulated in Islam which is summarized in Islamic business ethics which includes monotheism, justice, balance, responsibility and freedom.Design/Method/Approach: This study uses a qualitative method with a descriptive analysis approach. This method is used to describe the shift in the marketing strategy of cafes and culinary that has a negative nuance in West Sumatra. The data sources come from culinary producers, consumers, and the management of the MUI West Sumatra. Data processing is done by code data, tell data, identify data and generalize data. All data obtained by using triangulation with data sources. The next step is to analyze the naming of cafes and culinary that are not common in West Sumatra by using the theory of Islamic business ethics and the results of the West Sumatra MUI Coordination Meeting, so as to obtain conclusions.Findings: First, the factors that cause West Sumatran cafe and culinary owners to choose unusual names are: 1. Showing product characteristics, spicy flavors are displayed with scary and unusual names; 2. Tight business competition triggers culinary owners to be creative by giving unique and unusual names; 3. Unique and unusual names in cafes and culinary delights make consumers curious, then visit and buy their products. Second, the perception of consumers and the people of West Sumatra on the unusual naming of cafes and culinary delights can be divided into 3, namely agree, disagree, disagree and uncomfortable with the unusual naming of cafes and culinary, and the name must be exchanged with another name that is more Third, a review of Islamic business ethics on naming cafes and culinary delights that choose names that are not common in West Sumatra can be divided into 2 groups: 1) The terms used are clearly contrary to the Shari'ah, namely hell, devil, devil, dajal; 2) Naming cafes and restaurants that use names related to ethical violations such as: Mie Padeh Maut, Mie Baro, Mie Caruik, Bakso Pentol Maut, Mie Pedas Maut, Spicy Sopan'Stek, Mie Padeh Gilo, Mie Pelakor, Mie Padeh Gilo, Mie Judes, Lightning Noodles, and the like. Mie Tapakiek, and the like. Islamic business ethics that are violated are the principles of monotheism, justice, balance in the world and the hereafter and the principle of accountability.Originality/Values: The main research contribution is related to the marketing strategy of cafes and culinary arts using unusual names in West Sumatra.

Abstract

This paper focuses on the resilience of Ungku Kali's practice as a marriage guardian or transfer of lineage guardian to Ungku Kali. The Ungku Kali referred to in this study, is someone appointed by both husband-and-wife candidates to carry out the marriage and acts as a marriage guardian. The research questions from this paper are, first, what is the position and practice of Ungku Kali as a marriage guardian in Kurai Taji, Padang Pariaman Regency? Second, why does Ungku Kali’s practice as a marriage guardian persist today? The primary data of this study came from interviews with thirteen informants, consisting of six couples getting married, three Ungku Kali people, and four local people. After collecting the data, they were classified according to the existing themes and analyzed with the resilience theory. The study results found that Ungku Kali's position in Kurai Taji is as a trustee in the religious field or a respected Nagari cleric in society. As for the Ungku Kali practice using the facilities of the Surau Korong Lubuk Ipuh as a place of practice assisted by Apak Labai as the marbot at the Surau Korong Lubuk Ipuh, all the requirements are conveyed by this Apak Labai. Second, the reason for the resilience of the Ungku Kali practice until now is due to the resilience of culture, the resilience of economic factors, the resilience of the need factor, and the resilience of social factors; both Ungku Kali service users and Ungku Kali itself.

The research objective in this study is to look at community customs in maintaining the baralek tradition so that the implementation of baralek is used as a condition for marriage contracts in the Sungai Nanam community, Lembah Gumanti District, Solok Regency. Formulation of the problem of how the baralek process is carried out and looking at the necessity of baralek and looking at the impact of Islamic law on the necessity of baralek in the Sungai Nanam community, Lembah Gumanti District, Solok Regency. Type of field research (field research. Data collection techniques through observation, interviews and documentation. The results of this research are: first, the procession for implementing the baralek obligation in the Sungai Nanam community was initially carried out with manyilau, after that the procession of proposing marriage, mahanta siriah, balatak tando, new marriage contract Entering the baralek procession, the factors that require the implementation of baralek are customs, social status, economics and education. According to traditional Islamic law, the requirement to carry out baralek as a condition of the marriage contract in the Nanam River community is included in the category that is more detrimental because after the implementation of baralek there is a debt that must be incurred. paid by the family and the bride and groom can be classified as 'urf-fasid if it is done excessively.

Abstract

Setiap pernikahan adalah pernikahan campuran tidak ada manusia ini diciptakan sama persis dengan dirinya. Meskipun masih adat yang menjadi pemenang dari sebuah perkawinan. Penelitian ini bertujuan pertama, untuk mengetahui prosesi perkawinan campuran anatara adat Minang dengan Jawa. Kedua, untuk menganalisis impikasi dari perkawinan campuran. Ketiga, untuk menganalisis pandangan hukum Islam terhadap perkawinan campuran. Penelitian ini menggunakan metode penelitian kualitatif yang bersifat deskriptif karena tujuan penelitian adalah memberikan gambaran tentang suatu fenomena sosial tertentu. Hasil penelitian ditemukan bahwa prosesi dari perkawinan campuran antar etnis ini mengantar sirih atau lamaran, ijab dan qabul, merias pengantin, dahar kembul, menjemput besan, sungkeman dan upacara setelah pernikahan. Implikasi dari perkawinan campuran adalah anak yang dilahirkan dari perkawinan suku Minang dan Jawa tidak memiliki suku yang diwariskan ibunya, tidak mendapatkan warisan dari keluarga ayahnya sepeser pun, dan di anggap orang asing dalam rumah tersebut. Perkawinan campuran menurut hukum Islam tidak bertentang sama sekali dengan ajaran agama Islam sesuai dengan QS. Al-Hujurat ayat (13).

Abstract

Kumun Debai has a traditional institution as a judiciary in resolving customary disputes including syiqaq disputes. The Kumun Debai traditional institution has had many successes in resolving disputes peacefully. However, people today who are in the midst of domestic conflicts, such as syiqaq , prefer to take legal action in the hope that a divorce will be granted. The aim of this research is to examine the process of resolving syiqaq disputes through Traditional Institutions in Kumun Debai. This research is qualitative in nature, in this research the data collection technique used is an interview technique which is considered primary data. The results of the research show that the process of resolving syiqaq disputes through traditional institutions is that first, traditional institutions receive complaints from disputing parties to help resolve the dispute, secondly, traditional institutions attend invitations from disputing parties at the specified time, thirdly , traditional institutions request each parties explain the problems that occur, fourth of the problems raised by traditional institutions research, study, draw conclusions and provide direction or advice to the parties in dispute in accordance with customary law, fifth traditional institutions ask for decisions from both parties to the dispute, sixth settlement by apologizing and the parties make an agreement either verbally or in writing.

Abstract

Fenomena konflik dalam rumah tangga tentunya sangat beragam, mulai dari perbedaan pendapan dan pandangan sampai adanya kekerasan didalamnya. Keluarga yang melakukan poligami tentunya memiliki konflik yang tidak sama seperti keluarga monogami. Sama halnya praktik poligami yang terjadi di Desa Simeulue Barat. Dimana praktik poligami tersebut memiliki konflik yang menarik untuk dibahas serta dampak dari konflik yang terjadi pada saat itu. Berdasarkan rumusan permasalahan yang peniliti teliti konflik yang terjadi terhadap keluarga poligami serta bagaimana cara keluarga poligami menyelesaikan konflik tersebut. Penelitian ini bertujuan untuk mengetahi apa saja konflik keluarga poligami dan bagamana cara menyelesaikan konflik tersebut. Jenis penelitian yang menggunakan penelitian lapangan (field reaserch), sifat penelitian ini adalah deskriptif kualitatif. Penelitian ini menggunakan teknik pengumpulan data wawancara dan dokumentasi. Hasil penelitian ini adalah Terdapat 2 faktor yang menjadi akar konfIik dalam keluarga poligami, yaitu faktor internal dan faktor eksternaI. Faktor internal di sini adalah rasa cemburu dan faktor eksternal adalah faktor-faktor yang berasal dari luar dirinya, seperti ketidak adilan suami ketika berkunjung dalam pembagian pekerjaan rumah tangga, kurangnya komunikasi dan keterbukaan suami terhadap masing-masing istri. Penyelesaian yang dilakukan oleh untuk mengatasi konfIik tersebut adalah dengan mengajak bermusyawarah dan saling memeberikan pemahaman serta pengertian kepada masing-masing istri.

Abstract

This study examines the implementation of the fiqh madhhab of West Sumatran society regarding the hadhanah rights of minors whose mothers remarry. The study aimed to map the moderation of the West Sumatran madhhab of society, known as the Shafi'i madhhab. This research uses qualitative methods with a sociological approach to law. Seventeen cases were found in 3 research locations: Pariaman, Luhak Agam, and Luhak Fifty Cities. The location was chosen because it is an area with a higher level of moderation than other regions in West Sumatra. The location of this study was determined using a purposive random sample technique. In the people of West Sumatra, the right of hadhanah remains with the mother, even if the mother remarries. This opinion is in harmony with that of the Maliki Madhhab. The matrilineal kinship system in Minangkabau also supports this: the child belongs to the mother and her family. When the mother's father is divorced, the child follows his mother. However, in 3 cases, it was found that the father took away the rights of a minor whose mother remarried. Basically, the people of West Sumatra have practiced the moderation of mazhab. This is evident from their practice, where they indirectly practice the diversity of mazhab opinions in the case of hadhanah of minors whose mothers remarry.

Abstract

This research explains in more detail about family law reform in several Muslim-majority countries such as Indonesia, Malaysia, Brunei, Turkey, Egypt, Jordan, Morocco, Syria and other countries. The purpose of this article is to provide a small overview of how reforms are taking place in the field of family law in several Muslim countries. Problems that arise in family law have three important components, namely marriage, divorce and inheritance. This discussion will reveal the results of reforms or changes that arose as a result of shifts in era and power from the colonial period to the period of independence. As technology develops and new problems arise, Muslim countries also provide regulations in several ways so as to produce compatibility between law and society. This research uses a normative research type, a literature study with a descriptive analysis research type. The method is carried out by combining several descriptions of changes or reforms that occurred in the formulation of Family Law Laws in Muslim Countries so as to obtain the desired results. Laws that are in line with current developments will be very much needed, especially in the field of family law. then returning laws that deviate from the teachings that are applied is a denial.

Abstract

The practice of temporary marriage (nikah mut'ah) in Iran has a long and complex history, closely related to the interpretation of Islamic law and social dynamics within Iranian society. This is marked by the complex unfolding of the Islamic revolution in Iran. Therefore, this study aims to understand the journey of family law in Iran and its development related to the phenomenon of nikah mut'ah practice before and after the Islamic revolution. This research is a literature study. The results of this study show that before the Islamic Revolution in 1979, this practice was less common and often viewed with diverse perspectives by society. However, after the Islamic Revolution, with the new government based on Sharia, the practice of nikah mut'ah gained legal legitimacy and broader support as part of the interpretation of Shia law. Nevertheless, this practice remains controversial and sparks debate among scholars and the wider community regarding its ethical and social aspects.

Masalah keluarga yang banyak terjadi, dan kurangnya keharmonisan dalam rumah tangga yaitu sangketa Nusyuz Istri, adapaun cara penyelesaian awalnya di selesaikan oleh pihak keluarga yaitu dinamakan dengan Tengganai. Tenganai merupakan orang yang tertua dari pihak laki-laki dan pihak perempuan yang sangat berperan penting dalam menyelesaikan sangketa perkawinan. Tengganai adalah pimpinan perut berasal dari laki-laki saudara nenek, ibu dan saudara kandung atau tidak, yang kepemimpinannya diakui oleh anggota perut(anggota keluarga). Jenis penelitian ini adalah lapangan dengan menggunakan pendekatan kualitatif dengan analisis data secara induktif. penelitian ini bertujuan menganalisis bagaimana peran Tengganai dalam menyelesaikan sangketa Nusyuz di Kota Sungai Penuh Kecamatan Kumun Debai. adapun hasil penelitian ini adalah Penyelesaian sangketas nusyuz istri yang dilakukan di kecamatan Kumun Debai Kota Sungai Penuh banyak melalui upaya mediasi (perdamaian) dengan pihak keluarga saja. dan ada sebeberapa peran dari masyarakat dalam menyelesaikan masalah ini. selain diselesaikan dengan pihak tengganai ada juga beberapa kasus yang tidak dapat diselsaiakn melalui keluarga . mereka lebih memilih untuk diselesaikan melalui meja hijau yaitu pengadilan. karena menurut mereka tidak dapat lagi untuk mepertahankan rumah tangganya. jarang diketmui masyarakat menyelesaikan masalah ke pihak masyarakat atau lembaga adat. dari kasus kasus di atas peran tengganai adalah hanya sebatas mendamaikan para pihak yang berselisih dalam rumah tangga, bukan untuk menceraikan.
