Abstract

This study aims to analyze the integration of local wisdom and the principle of substantive justice in the financing practice of Musyarakah Mutanaqisah (MMQ) in Bankaltimtara Syariah, East Kalimantan. The central problem is the empirical-normative gap between formal sharia compliance (Sharia Compliance) and the effectiveness of integrating local wisdom (deliberation, cooperation) as an instrument of social law. Using a socio-legal approach (sociological jurisprudence with a descriptive qualitative method), this study is supported by the triangulation of data from in-depth interviews, observations, and document studies. The theoretical significance confirms that Islamic banking practices operate within a legal pluralist framework, demonstrating that the integration of local wisdom serves as a social mechanism of compliance, thereby strengthening the legitimacy of Islamic law. Results show that the integration of local values has been proven to strengthen customer compliance and realize distributive justice through proportional risk sharing and contract transparency. Substantive justice is achieved through dialogue-based dispute resolution and flexible payment options. Effective MMQ governance requires an adaptive and contextual model that prioritizes the principles of raḥmah and adl, ensuring the well-being of customers (hifz al-nafs and hifz al-māl) and the sustainability of partnerships, going beyond formal compliance.

Abstract

Narkotika menjadi masalah yang selalu menghantui semua kalangan dari dewasa hingga anak-anak. Keberadaan anak yang diistimewakan perlakuannya didalam hukum seringkali dimanfaatkan para pelaku tindak pidana narkotika terutama sebagai kurir atau pengedar (pelaku tindak pidana pengedaran narkotika). Penerapan pemidanaan terhadap anak sering menimbulkan perdebatan, karena pada hal ini mempunyai konsekuensi yang luas pun menyangkut perilaku maupun stigma pada masyarakat dan pun pada diri anak itu, Disatu sisi banyak pihak yang menganggap menjatuhkan pidana bagi anak yakni tak bijak, tapi ada sebagian yang berasumsi pidana pada anak perlu guna dilakukan agar sikap negatif anak tak berlanjut disaat dewasa nanti, pada artian agar memberikan efek jera pada anak. Tujuan penelitian ini merupakan menjelaskan tentang pertanggungjawaban hukum anak sebagai pelaku tindak pidana pengedar narkotika pada sistem peradilan anak di Indonesia, guna mengetahui faktor-faktor penyebab anak melakukan tindak pidana pengedar narkotika, serta agar mengetahui serta menganalisis bagaimana pertimbangan hakim di menjatuhkan putusan terhadap anak menjadi pelaku tindak pidana pengedar narkotika di masalah Putusan nomor 24/Pid.Sus Anak/2022/PN Smr. Metode yg diterapkan pada penelitian ini yakni metode penelitian hukum normatif. Hasil penelitian ini menunjukkan bahwa Majelis hakim pada menjatuhkan putusan nomor 24/Pid.Sus Anak/2022/PN telah tepat dengan menerapkan pasal 114 ayat (1) Undang Undang Nomor 35 Tahun 2009 tentang Narkotika namun, diperlukan sanksi tertentu yang diberikan pada pelaku anak untuk memberi efek jera agar tidak mengulang perbuatan yang sama dikemudian hari. Pemberian sanksi tetap memperhatikan hak-hak dan kepentingan terbaik untuk anak.

Abstract

Pengabdian kepada masyarakat ini bertujuan untuk meningkatkan pemahaman dan kesadaran masyarakat Desa Sungai Meriam, Kecamatan Anggana, mengenai peran Corporate Social Responsibility (CSR) sebagai instrumen hukum dan sosial dalam pemberdayaan ekonomi kreatif serta pelestarian lingkungan berkelanjutan. Permasalahan utama yang dihadapi mitra adalah rendahnya literasi CSR, keterbatasan kapasitas pelaku UMKM kreatif, serta minimnya sinergi antara masyarakat, perusahaan, dan pemerintah desa. Metode pengabdian dilaksanakan melalui pendekatan edukatif-partisipatif berupa penyuluhan hukum CSR, diskusi interaktif, studi kasus Green CSR, dan simulasi perancangan aksi CSR berbasis desa. Kegiatan dilaksanakan pada November 2025 dengan melibatkan 27 peserta yang terdiri atas pelaku UMKM, petani, karang taruna, dan ibu rumah tangga. Hasil kegiatan menunjukkan adanya peningkatan pemahaman masyarakat terhadap dasar hukum CSR, prinsip triple bottom line (profit, people, planet), serta pentingnya kolaborasi multipihak dalam pelaksanaan CSR yang berkelanjutan. Partisipasi aktif masyarakat selama kegiatan mencerminkan tumbuhnya kesadaran bahwa CSR bukan sekadar bantuan filantropi, melainkan instrumen strategis untuk pembangunan desa berkelanjutan. Kegiatan ini diharapkan menjadi langkah awal dalam memperkuat praktik CSR yang inklusif dan berorientasi pada pemberdayaan ekonomi kreatif serta perlindungan lingkungan desa.

Abstract

Cryptocurrency has emerged as a global innovation since the launch of Bitcoin in 2009, underpinned by blockchain technology that offers enhanced efficiency and transparency. Despite its potential, cryptocurrency presents complex legal challenges, particularly concerning its regulatory status. In Indonesia, cryptocurrency faces a dual regulatory framework: it is prohibited as a means of payment by Bank Indonesia pursuant to Law No. 7 of 2011 on Currency, yet simultaneously recognized as a tradable investment commodity by the Commodity Futures Trading Regulatory Agency (Bappebti). This study aims to analyze the implications of this duality for Indonesia’s national regulatory system. Using normative legal research and a statutory approach, the study reveals significant legal uncertainty arising from institutional regulatory inconsistencies. Such uncertainty may impede innovation and compromise consumer protection. Therefore, regulatory harmonization is essential to ensure legal certainty and adaptability, drawing on the theories of legal certainty and progressive law.

Abstract

The inti-plasma partnership scheme in the oil palm plantation sector aims to create a mutually beneficial relationship between large companies (nucleus) and smallholders (plasma). However, in practice, there are often inequalities that cause plasma farmers to lose control over their businesses. This research analyzes the violation of the partnership agreement between PT Hardaya Inti Plantations (PT HIP) and Koperasi Tani Plasma Amanah as decided in KPPU Decision No. 02/KPPU-K/2023. The focus of the analysis includes the forms of juridical, financial, and operational control that PT HIP exercised over the cooperative, as well as the legal implications based on Jeremy Bentham's theories of civil law, competition, and justice. The results show that PT HIP has abused its dominant position by fully controlling the partnership agreement, limiting cooperatives' access to decision-making, and implementing non-transparent financial practices. KPPU has imposed administrative sanctions in the form of an agreement addendum obligation, an independent audit, and a fine of Rp1,000,000,000.00. However, an evaluation of this decision indicates that the sanction has not fully provided substantive justice for plasma farmers, given the absence of a direct compensation mechanism. Therefore, there is a need to strengthen regulations and implement more effective monitoring and law enforcement mechanisms to ensure fairer and more sustainable partnership relationships in the oil palm plantation industry in Indonesia.

Abstract

Fair business competition is guaranteed in Law Number 5 of 1999, including the obligation to notify mergers or acquisitions. However, the case of PT Tamaris Hidro vs. KPPU highlights the ambiguity in this regulation, especially regarding the application of the Single Economic Entity Doctrine. PT Tamaris Hidro argued that the notification obligation had been fulfilled by PT Patria Bakti Abadi, but the KPPU rejected the claim and imposed a fine of IDR 10 billion. This study uses a normative legal approach to analyze the legal basis in decision Number 4/Pdt.Sus-KPPU/2024/PN.Niaga Jkt Pst. The results of the study show that the KPPU regulation has not accommodated business entities with complex ownership structures. As a result, parent companies are still required to make separate notifications, even though they are in the same business group. The implications of this finding emphasize the need to revise the KPPU regulation to be more adaptive to the dynamics of modern business. This study recommends further research on the application of the Single Economic Entity Doctrine in competition law in Indonesia.

Abstract

In today's digital era, smartphones have become an integral part of everyday life, especially among students. In Samarinda City, smartphone usage among senior high school students is increasing, and this has a significant impact on their learning patterns and learning culture. In this context, it is important to understand how smartphone use, study patterns, and learning culture interact and influence students' learning motivation through self-efficacy. The purpose of this study was to determine the effect of smartphone use, study patterns, learning culture, and self-efficacy on learning motivation. This research was conducted at high schools in Samarinda City. The population in this study consisted of 1,640 grade 12 students. The sample was taken using a proportional random sampling technique, which amounted to 410 respondents. The data collection techniques used were questionnaires, interviews, and documentation. Data analysis uses CFA. Data were analyzed using descriptive and inferential statistical techniques. The model fit test uses SEM with the LISREL program. The results of this study are: (1) Learning patterns and learning culture have a positive and significant effect on learning motivation, while smartphone usage and self-efficacy have no effect on learning motivation., (2) Smartphone use, learning patterns, and learning culture affect self-efficacy., (3) The use of smartphones, learning patterns, and learning culture has no effect on learning motivation through self-efficacy. This study concluded that there is a significant influence of learning patterns and learning culture on learning motivation.
