Abstract

The implementation of Environmental, Social, and Governance (ESG) regulations in Indonesia is still in its developmental stage and faces several challenges in enforcement and compliance. Compared to developed countries, Indonesia's ESG framework lacks strong incentives and adequate regulatory oversight, leading to inconsistencies in corporate adherence. This study aims to analyze the effectiveness of ESG regulations in Indonesia from a legal perspective and evaluate their impact on corporate compliance. A normative juridical approach was used, supplemented by case studies of companies that have implemented ESG principles. Data were collected through document analysis of regulatory frameworks, sustainability reports, and interviews with key stakeholders. The findings indicate that while the number of companies adopting ESG practices has increased significantly from 45 in 2018 to 675 in 2023, only 38% fully comply with ESG standards. Moreover, statistical analysis reveals a strong correlation (r = 0.78, p < 0.05) between regulatory strictness and corporate adherence. Weak enforcement mechanisms and the voluntary nature of ESG reporting remain major obstacles to effective implementation. The study also highlights that firms integrating ESG principles tend to attract more investment and demonstrate better financial stability. The findings contribute to the ongoing discourse on ESG regulation by emphasizing the need for policy reforms, including stricter enforcement, standardized reporting mechanisms, and economic incentives to enhance compliance. This research provides a foundation for future comparative studies on ESG regulation and suggests integrating technology-based monitoring tools such as blockchain and artificial intelligence to improve corporate accountability and sustainability practices.

Abstract

This study aims to analyze freedom of association and assembly from a human rights perspective, and explore the challenges faced in its implementation in various countries. The scope of the study includes a review of various cases of violations of the right to freedom of association and assembly, both in countries with democratic and authoritarian systems. In addition, this study will also discuss the role of international organizations and civil society in promoting and protecting these rights. This study will not only discuss the theory and basic principles of freedom of association and assembly, but will also dig deeper into how these rights are implemented in practice, the challenges faced, and steps that can be taken to strengthen the protection of these freedoms throughout the world. This study is expected to make a significant contribution to understanding the complexity of freedom of association and assembly and its impact on human rights as a whole. This study uses a qualitative approach with a case study design. The qualitative approach was chosen because it allows researchers to dig deeper into freedom of association and assembly in the context of Human Rights (HAM).

Abstract

Violence against women constitutes a violation of human rights and reflects entrenched structural gender inequality. In Indonesia, despite the existence of Law No. 23/2004 on the Elimination of Domestic Violence and the ratification of the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW), significant challenges persist in the implementation of legal protections. This study aims to evaluate the effectiveness of existing legal frameworks in addressing violence against women and to identify necessary regulatory reforms. Utilizing a normative juridical method with statutory and conceptual approaches, the study analyzes the alignment of national laws with international human rights standards. It also assesses policy implementation by examining court rulings, institutional reports, and empirical data on victim protection outcomes. The findings reveal pervasive gender bias in both regulatory provisions and law enforcement practices, which undermines victims’ access to justice. Key obstacles include the absence of a gender-sensitive legal perspective, inadequate protection mechanisms, and the limited capacity of law enforcement personnel. The study concludes that comprehensive legal reform, capacity building, and integrating a human rights-based approach are essential to establishing a more inclusive and effective legal protection system for women in Indonesia.

Abstract

This research analyses the local authority in the formation of local regulations (Perda) based on the ideology of Pancasila. As a country with a decentralised system, Indonesia gives authority to local governments to form local regulations according to the needs of each region. However, in its implementation, this authority must remain in line with the principles contained in Pancasila as the basis of the state. This research uses normative legal research method with statute approach and conceptual approach. The data source used is secondary data consisting of laws and regulations, court decisions, and relevant legal literature. The results show that in the formation of local regulations, local governments must pay attention to the principles of the formation of good laws and regulations as stipulated in Law Number 12 of 2011 concerning the Formation of Laws and Regulations. In addition, there is a supervisory mechanism from the central government and the Supreme Court to ensure that the Perda formed does not conflict with higher regulations and the values of Pancasila. This research recommends strengthening the synergy between local and central government in drafting local regulations, as well as increasing public participation to ensure that any local regulations formed truly reflect the values of Pancasila and the interests of the community at large.

Abstract

This study evaluates the application of Pancasila values and the enforcement of human rights in Indonesia's judicial system through a constitutional approach. Using normative legal research methods, the approach taken includes analysis of legislation, conceptual studies, as well as case studies of a number of relevant Constitutional Court decisions. The results show that the values of Pancasila, particularly the second and fifth precepts, play a fundamental role as the philosophical basis in the application and interpretation of human rights principles in Indonesia. The Constitutional Court has a strategic role in safeguarding the constitution while ensuring the enforcement of human rights through progressive legal interpretation. However, despite these positive steps, challenges such as inconsistencies in lower court decisions and mismatches between the rule of law and the needs of society remain. This research recommends strengthening Pancasila-based legal education, harmonizing legal policies, and increasing the capacity of judges in integrating human rights with social justice principles holistically. The findings confirm that the judicial system, with a strong constitutional approach, can be an effective tool in realizing social justice in accordance with the values of Pancasila and the constitution.

Abstract

This study aims, first, to analyze the legal reasoning of the Constitutional Court in Decision Number 115/PUU-XXII/2024, which annulled the phrase "riots" in Article 28 paragraph (3) and Article 45A paragraph (3) of Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 on Electronic Information and Transactions. Second, it seeks to examine the implications of this annulment for the scope of freedom of expression and the potential regulation of hate speech or incitement in Indonesia's digital sphere. It further explores how this Constitutional Court decision may influence the dynamics of digital democracy, particularly in the context of public criticism and online participation in Indonesia. This study employs a qualitative research method, with the primary legal material being Constitutional Court Decision Number 115/PUU-XXII/2024 on the Judicial Review of Provisions in Law Number 1 of 2024. The findings reveal that the Constitutional Court's removal of the phrase "riots" has the potential to broaden the space for digital freedom of expression, but it also presents new challenges in maintaining public order. Therefore, a deeper understanding of the boundaries of freedom of expression in the digital age is required, along with the development of effective legal and non-legal mechanisms to balance expressive freedom and social order.

Abstract

The enactment of Law Number 1 of 2023 concerning the New Indonesian Criminal Code (KUHP 2023) marks a significant shift in Indonesia’s legal landscape, particularly concerning the recognition and integration of Adat Criminal Law within the national legal framework. This study explores the future prospects of Indonesia’s criminal law reform, focusing on the coexistence of statutory and customary law, judicial application of adat norms, human rights considerations, local governance roles, public perception, and policy directions. Using a normative juridical approach, the research examines the legal, sociological, and political justifications for adat law recognition, its challenges in enforcement, and the implications for Indonesia’s legal pluralism. Key findings highlight the complexities of judicial discretion in applying adat law, the need for harmonization with constitutional protections, and public attitudes toward adat-based justice mechanisms. Additionally, this study proposes policy recommendations for ensuring legal certainty, judicial training, and technological advancements in adat law documentation. By addressing these challenges, Indonesia can establish a balanced legal system that respects customary traditions while aligning with national and international legal standards.

Abstract

Penelitian ini menganalisis implementasi Artificial Intelligence (AI) dalam transformasi manajemen keuangan perusahaan pada tahun 2025, dengan fokus pada dampak teknologi Generative AI terhadap efektivitas dan efisiensi operasional. Menggunakan metodologi kuantitatif dengan pendekatan survei dan analisis regresi terhadap 300 perusahaan di Indonesia, penelitian ini mengevaluasi tingkat adopsi AI, hambatan implementasi, serta manfaat yang diperoleh. Hasil penelitian menunjukkan bahwa 87% perusahaan telah mengimplementasikan AI dalam fungsi keuangan mereka, dengan peningkatan efisiensi operasional rata-rata 45%, reduksi waktu penyelesaian tugas hingga 50%, dan peningkatan akurasi prediksi keuangan sebesar 62%. AI terutama digunakan untuk fraud detection (78%), predictive analytics (72%), dan automated reporting (65%). Hambatan utama implementasi meliputi keterbatasan anggaran (58%), kurangnya keahlian SDM (52%), dan kekhawatiran keamanan data (48%). Penelitian ini memberikan rekomendasi strategis bagi manajemen perusahaan dalam mengoptimalkan implementasi AI untuk mencapai transformasi digital yang berkelanjutan dalam manajemen keuangan.

Abstract

Indonesia is facing a personal data protection crisis, as cases of sensitive information leaks from various public institutions continue to increase. Although Law No. 27 of 2022 on Personal Data Protection has been enacted, recurring incidents, such as the hacking of eHAC, BPJS Kesehatan, PeduliLindungi, and ransomware attacks on the National Data Center, demonstrate a weak implementation at the institutional level. This research aims to identify and analyze the forms of institutional dysfunction in personal data protection in Indonesia. This research uses a qualitative approach with a descriptive-analytical design, relying on data from literature studies, documentation, online media news, and in-depth interviews with informants from government institutions, academics, and digital rights activists. The research findings indicate that there are three primary forms of institutional dysfunction: weak formal structures, a bureaucratic culture that is unresponsive, and limited technical capacity. The absence of independent oversight institutions, overlapping inter-agency authorities, and minimal public accountability exacerbate this situation. These findings are analyzed using the new institutional theory, which emphasizes the importance of internal norms and the logic of appropriateness in institutional behavior. This research contributes to filling the gap in digital law studies in Indonesia by highlighting the role of institutional culture and legal politics in explaining the failure of data protection. In conclusion, adequate personal data protection is not sufficient with formal regulations alone, but requires institutional reforms that address structural and cultural aspects, as well as the establishment of an independent supervisory authority that is adaptive to digital threats.

Abstract

This study aims to analyze the effectiveness of applying the principle of meaningful participation in lawmaking in Indonesia, Switzerland, and Sweden The method used is normative juridical with a case study and comparative law approach. Data collection was conducted through a literature review of regulations, official documents, and related literature, which was then analyzed qualitatively using a descriptive-comparative framework. The novelty of this research lies in its functional comparative approach, which not only compares legal frameworks but also the practical implementation of the principle of participation in the legislative processes of each country. This study highlights the gap between formal regulations and substantive practices in Indonesia, and identifies best practices from Swiss referendum democracy and Swedish public consultation mechanisms. The results show that Indonesia still faces challenges in ensuring substantive public participation, which tends to be formal and limited without influencing the substance of regulations. In contrast, Switzerland implements direct democracy through referendums, and Sweden has developed transparent and structured public consultation mechanisms. However, the future prospects in Indonesia are quite positive, with increasing demands for transparency, technological advances, and the role of civil society opening up opportunities to develop more inclusive and effective public participation in law-making. In conclusion, although Indonesia is still limited in ensuring substantial public participation, the opportunities to improve participation mechanisms through transparency and technology are quite promising, leading to a more inclusive and influential system in law formation.
