Abstract

AbstractThis study aims to examine the legal and social status of the "Tobelo Dalam" community on Halmahera Island, Indonesia, which has been ambiguously categorized as indigenous peoples or vulnerable groups. This research departs from the need to formulate the right policy approach in the context of protecting their basic rights as citizens. Using qualitative methods based on literature studies, field observations, and analysis of national and international regulations, this study found that the Tobelo Dalam community does not meet the criteria as an indigenous people according to United Nations standards and Indonesian positive laws. They are more appropriately classified as a vulnerable local ethnic group, given their limited access to education, health, economy, and legal protection. The results of the analysis show that this vulnerability status has an impact on the inhibition of the fulfillment of basic rights, thus demanding a more inclusive and adaptive approach to empowerment. The conclusion of this study emphasizes that government policies should be focused on strengthening the civil rights of the Tobelo Dalam community through a model of empowerment based on local needs and recognition as a vulnerable group, rather than mere recognition as an indigenous people. This study recommends the need for regulations that guarantee collective rights to land and natural resources for them as part of efforts to create just and sustainable social development. Keywords: Tobelo Dalam, indigenous peoples, vulnerable groups, citizens' rights, inclusive empowerment, Halmahera.

Abstract

This research addresses the urgent national issue of land disputes in Indonesia, where legal certainty is paramount. The National Land Agency (BPN) has the authority to cancel land certificates it issues, based on the contrarius actus principle, but its application is inconsistent across different types of land cases. This leads to legal ambiguity and a lack of effectiveness, particularly when third parties are involved. The novelty of this study lies in its focused analysis of this specific inconsistency, highlighting how the BPN's reluctance to use its authority in certain disputes undermines legal certainty. The research's will be contrributed on the of proposed regulatory overhaul to strengthen the BPN's authority to cancel certificates without causing unintended legal consequences, thereby ensuring more effective and fair resolution of land cases.

Abstract

The effectiveness of applying restorative justice principles in terminating prosecution for drug abuse offenses is a key effort in creating a more humane criminal justice system. This approach offers an alternative solution through medical and social rehabilitation, particularly for eligible drug addicts, as regulated by Law No. 35 of 2009 on Narcotics and the Attorney General’s Guideline No. 18 of 2021. Using empirical legal research with a qualitative field approach, primary and secondary data were gathered to illustrate how prosecution termination is implemented at the South Minahasa District Attorney’s Office. Findings show that restorative justice aligns with legal provisions and has positive impacts, including offender recovery, reduced prison overcrowding, and improved restorative-based law enforcement. However, implementation still faces challenges. Internally, obstacles include regulatory gaps in the Criminal Procedure Code (KUHAP) and limited understanding or readiness among prosecutors. Externally, differing views among law enforcement and a punitive legal culture also hinder policy effectiveness. Strengthening the substance, structure, and legal culture is essential to optimize restorative justice in drug-related cases.

Abstract

The title of this research is “Law Enforcement Against Violation of Overstaying Perpetrated by Foreigners: A Study in Class I Immigration Office of Ternate.” The object of this study is the law enforcement carried out against violations of residence permits by foreign. The objective is to analyze the law enforcement carried out against violations of residence permits by foreigners (overstay) in the working area of the Class I Ternate Immigration Office? This paper employed the juridical-empirical approach. This was qualitative field research because the primary data was collected directly from respondents through interviews and documentation. Results show that law enforcement against violations of residence permits by foreigners in the working area of the Class I Immigration Checkpoint of the Ternate Immigration Office has basically been implemented in accordance with the provisions stipulated in Law Number 6 of 2011 concerning Immigration, especially Article 75 and Article 78. The enforcement is more dominantly administrative in nature through the implementation of immigration administrative actions, such as deportation and deterrence, which are considered as a form of fast and efficient non-litigative action. From 2021 to mid-2025, 58 administrative actions were recorded, with the highest number of deportations occurring in 2023.

Abstract

Human longing for justice is essentially a longing for happiness, so efforts to fulfill various rights as witnesses of victims of theft crimes in Makassar City as a place of research have been conducted since 2017,2018 and 2019, actually show that the handling is carried out by the Police and the Prosecutor's Office especially in the victim's items found in the Police as well as the number of victim's items returned at the Prosecutor's Office, must be an important concern, but in fact, that victims of theft crimes are not like that .. This can be reflected in decisions by judges based on in the data in the last three years above, which convicted the perpetrators with imprisonment but none of the perpetrators were convicted to pay compensation to the victims. If the judge has the courage to make legal breakthroughs by punishing the perpetrator to pay compensation in the amount of the loss suffered by the victim, then, to be able to implement the legal objectives of justice related to the fulfillment of the victim's witness rights to personal property in a theft crime case can be realized

Abstract

Fungsi Kawasan Berikat adalah sebagai tempat penyimpanan, penimbunan, pengolahan barang yang berasal dari dalam dan luar negeri. Kemudahan yang diberikan dalam kawasan berikat adalah pelayanan dan pengurusan dokumen ekspor dan impor berada dalam satu atap (satu kantor). Perusahaan penerima fasilitas kawasan berikat mendapatkan fasilitas penangguhan bea masuk, yaitu peniadaan untuk sementara kewajiban pembayaran bea masuk sampai dengan timbulnya kewajiban untuk membayar berdasarkan undang-undang. Jadi sepanjang ketentuan yang menyebabkan harus dibayarkannya bea masuk tersebut tidak terjadi maka penangguhan bea masuk tetap berlaku. Apabila perusahaan hendak mengeluarkan barang asal impor ke dalam daerah pabean (diimpor untuk dipakai), maka akan dipungut bea masuk, sepanjang pengeluarannya tersebut tidak ditujukan kepada pihak yang mendapatkan fasilitas pembebasan atau penangguhan bea masuk.

Abstract

Article 18 of Law Number 48 of 2009 concerning Judicial Power determines that judicial power is exercised by a Supreme Court and judicial bodies under it in the general court, religious courts, military courts, state administrative courts, and by an Constitutional Court. Each judicial environment has competence, both absolute and relative competence. The absolute competence of the judiciary is the jurisdiction of the judiciary in examining certain types of cases which are absolutely unable to be examined by other court bodies, either in the same judicial environment or in a different judicial environment. In connection with disputes involving sharia banking, until now it is still a matter of debate, which court has the authority to try them. Not to mention that until now there are still decisions of district courts that accept and grant claims which are disputes involving sharia banking. This means that internally the Supreme Court alone, in this case the judges in making decisions are still unable to provide legal certainty regarding absolute competence in adjudicating disputes involving sharia banking

Abstract

Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara memiliki peran penting dalam pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral. Peran tersebut terdiri dari peran preemtif dan peran preventif yang merupakan peran sebagai upaya pencegahan serta peran represif sebagai upaya penindakan dalam hal ini penegakan hukum (law enforcement) bagi pelaku yang melakukan tindak pidana pada objek vital di kawasan pertambangan PT. Nusa Halmahera Mineral. Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara menghadapai berbagai kendala dalam melaksanakan pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral. Tidak berjalan optimalnya peran Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara disebabkan karena masih kurangnya jumlah personil pada Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara serta masih terbatasanya sarana dan prasarana yang memadai dalam mendukung pelaksanaan pengamanan. Kemudian lemahnya pelaksanaan koordinasi oleh manajemen PT. Nusa Halmahera juga menjadi kendala bagi Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara dalam melaksanakan perannya secara optimal untuk  pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral.

Abstract

Dengan di undangkannya Undang – Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum memberikan peluang untuk peningkatan demokrasi dengan memperhatikan adanya pelanggaran yang dilakukan dan menjadi tugas pokok dari Badan Pengawas Pemilihan Umum Kabupaten/kota. Efektifitas penegakan pelangaran administrasi oleh BAWASLU Kabupaten Halmahera Selatan berdasarkan Pasal 240 Ayat (1) Huruf (k) dan (m) Undang – undang Nomor 7 Tahun 2017 tentang PEMILU, belum maksimal dalam memberikan keputusan kepada Calon Anggota DPRD Kabupaten Halmahera Selatan Dapil II Makian Kayoa yang telah memenuhi unsur formil maupun materil dalam pemeriksaan Persidangan Pelanggaran Administrasi. Selain itu, Faktor yang mempengaruhi penegakan Pelanggaran Administrasi pada Pemilihan Umum serentak Anggota DPRD oleh BAWASLU Halmahera Selatan tahun 2019 yaitu jumlah personil dan sarana fasilitas penunjang dalam pemeriksaan persidangan tidak memadai, antara tugas dengan dana operasional tidak sebanding dalam penganan kasus pelanggaran Administrasi.
